7. Staff Comments:
a. Draft Ordinance amendment to Heritage Preservation Commission Section 13-10.010 –
Sandy Baily discussed that amendments were proposed to the Heritage Preservation
Ordinance to assist the HPC in having a full, qualified Commission, due to the inactivity
of having applicants apply for the vacant position and concern for the upcoming
additional vacancies in December. Baily discussed the proposed changes to Chapter 13
(Heritage Preservation) of the Saratoga City Code to reduce the membership and amend
the qualifications of the Heritage Preservation Commission and to be in compliance with
CLG requirements. The HPC recommended that the professional qualifications be
expanded to retain architects and contractors. The HPC also recommended that
candidates who have a place of business in Saratoga have a physical place of business,
not an online service. These recommendations will be included in the draft ordinance
that will presented to City Council. The HPC discussed the benefits of having a liaison
with the Saratoga Historical Foundation. The HPC discussed the reduction of members
and there were mixed comments regarding the matter, the lack of applicants and the
potential of not having a quorum. The majority of the HPC preferred to have a seven
member commission due to their workload and that more members allowed a broader
discussion on issues they were considering. The HPC understood the current need for the
change. The comments regarding the membership number will be forwarded in the
report to City Council.
8. Old Business:
a. Saratoga Avenue/Heritage Lane Update–
Sandy Baily summarized the response in the memo from the City Attorney. The HPC
has the responsibility to review planning development applications (i.e.: Design Review,
Subdivisions) for work on parcels abutting the Heritage Lane portion of Saratoga
Avenue. Building permits for properties that were not on the Heritage Inventory, do not
require review by the HPC. The HPC discussed that their next work plan should include
requesting an amendment to the City Code to expand their duties to review building
permits along a Heritage Lane and to clean up the confusing language in the Code.
Commissioner Rodgers left the meeting at 10:34 A.M.

Commission and make a recommendation to the Planning Commission to approve the project.
Project Description:
Background
The subject project for a new mixed-use building on a vacant site at 20640 Third Street was
previously reviewed by the Heritage Preservation Commission (HPC) at their meeting of April
10, 2018. At that meeting the HPC did not recommend approval of the project and made the
determination that the proposed building was not compatible with the adjacent Sam Cloud Barn
building and that the proposed building would block views of the barn. The minutes of the April
10, 2018 HPC meeting are included as Attachment #2.
The project is returning to the HPC for review and further evaluation because there is additional
information that staff would like the HPC to consider.
Since the April 10, 2018 HPC meeting, the project applicant had an architectural historian
prepare an evaluation of the project. This report makes the determination that the project
location and architectural style with respect to the Sam Cloud Barn is consistent with the
Secretary of the Interior’s Standards for Rehabilitation. A copy of this report is included as
Attachment #3.
In addition, the HPC was not provided the background of a project for the site that the HPC has
previously recommended for approval on March 13, 2007. This project was a 30 foot tall, 4,920
square feet; three story commercial building. The location of the building is in approximately
the same location as the proposed building. At that meeting the HPC recommend approval of the
project and determined that the project was consistent with the Secretary of Interior Standards. A
copy of the previously approved project is included as Attachment #4, the staff memorandum is
included as Attachment #5, and the minutes of the meeting are included as Attachment #6. The
project was unanimously approved by the Planning Commission on September 26, 2007. The
project was not constructed and the project approval expired.

Current Project
The proposed project is a three unit 5,678 square foot mixed-use building located on a 4,582
square foot vacant parcel located at 20640 Third Street. The height of the building would not
exceed 35 feet. The project requires a total of 16 parking spaces. Seven spaces are provided in a
basement level garage.
The new building will be constructed adjacent to the existing Sam Cloud Barn and will be
connected by stairways – the buildings will not share a common wall. The Historic Name of the
Sam Cloud Barn is the Sam Cloud Hay and Feed Warehouse. The Barn was constructed circa
1890 and is listed on Saratoga’s Heritage Resources Inventory. A copy of the DPR form for the
Sam Cloud Barn is included as Attachment #1.
Exterior modifications to the Sam Cloud barn would be minimal and would include the removal
of the existing stairs on the southern elevation and the construction of new stairs that would
provide access to both buildings. The Sam Cloud barn is located very close to the southern
property and the existing stairs are actually located on the subject vacant parcel. The proposed
building would include an elevator which will also provide elevator access to the Sam Cloud
barn. Both parcels would eventually be merged so that both buildings would be located on one
parcel.
Permit Criteria: The Planning Department, on recommendation of the Heritage Preservation
Commission, shall authorize a permit if it is determined that:
a) The proposed work is consistent with the purposes and objectives of Chapter 13 of
Saratoga’s Municipal Code;
b) The proposed work does not adversely affect the character of the designated heritage
lane;
c) In the case of construction of a new building, structure or other improvement upon or
within a designated heritage lane, the exterior of such improvements will not adversely
affect and will be compatible with the external appearance of the existing lane.

Recently rehabilitated, this former barn has (originally) a stone foundation, side-gabled roof
and double-hung windows. The building is clad in channel-rustic siding, and there is a new
metal roof. The shallow eaves are boxed and feature boxed returns at the gable ends. Centered
on the front facade (facing the rear of the original residence associated with this barn) is a
raised gable, above the hay loft and carriage openings. The hay loft door, with its
herringbone board design, is preserved, but has been encapsulated by a fixed picture window.
City records indicate that the main barn door also featured a herringbone pattern; however,
the opening is currently glazed with modern entry door. The windows have been replaced. The
area surrounding the building is mostly paved for parking, and there is a basement entrance to
the northeast side.

Sam Cloud Hay & Feed Warehouse is listed on the Saratoga Heritage Resources Inventory,
included as a part of HP-88-01. It qualified under Criteria a, b, c, and e:
a) the property exemplifies and reflects special elements of the cultural, social, economic, aesthetic,
and architectural history of Saratoga;
b) the property is identified with persons significant in local history;
c) the property embodies distinctive characteristics of the National style, type and period; and
e) the property embodies unique physical characteristics that represent an established and familiar

Historical Background
This warehouse was built by local merchant Sam Cloud. Cloud owned the Cloud-Smith store at the
corner of Third Street and Big Basin Way, and this Hay and Feed Warehouse was originally on the
same parcel as the Cloud-Smith Store. It is known that the warehouse was a storeroom for the
farm and horse products. The loft held bales of hay, oats, etc., and the basement area served
as a stable.
Integrity
The building retains some of its original architectural design, workmanship and materials;
however, the windows and agricultural openings have been altered, and much of the setting has
been changed over time, and only some of the historic associations and feelings are preserved
in this former warehouse.

The Commission considered a request for a new residential/office building adjacent to
the Sam Cloud Barn, which is on the City’s Historic Inventory. The Commission
expressed concerns that the proposed structure was not compatible with the historic
barn (ie: architecture, roof lines, number and sizes of windows) and would block the
view of the barn. Marchetti\Rodgers moved to not recommend approval of the project
to the Planning Commission because the location of the proposed structure adversely
affects the character of the barn.
Motion passed. Ayes: Marchetti, Stransky, Nugent, Rodgers. Noes: Cappello, Shah.

6.Staff Comments:
a.Workplan format
Johnson asked the Commission to review the revised work plan format and suggest
modifications if any at the next meeting.
b. Minutes format
Johnson asked the Commission if they liked the new format which includes more
information. The consensus of the Commission was that they liked the new format.
c.Saratoga Creek Bridge (Long Bridge)
Johnson explained to the Commission per the City Manager, that since the bridge is
located in the County and not under the City’s jurisdiction, that the HPC cannot
provide comments regarding the bridge but as individuals they can send letters of
opposition to the removal of the Saratoga Creek Bridge.
d.Site Visits
Johnson asked the Commission if they were ok, if there is a site visit scheduled, to
meet at the site first and then come to City Hall to resume the meeting. The
Commission agreed this was a good idea.
7.Old Business:
a.DPR Staff updated and research status by Commission and other tasks (Workplan).
Johnson explained to the Commission that they can use the application form instead of
the DPR form for proposed Heritage Inventory properties.
b.Events/Calendar: Blossom Festival (March 24), State of the City (April 28), Arbor Day

Johnson asked if a member of the Commission can and attend a May City Council
meeting to accept the Preservation Month proclamation. Johnson requested the

Evaluation of Proposed Addition to Sam Cloud Barn 6 August 2018
INTRODUCTION
Sam Cloud Barn, LLC, has proposed the construction of a large addition to the rear of the
four-story Sam Cloud Barn Building, located at 20640 3rd Street, Saratoga, California. The
original Sam Cloud Barn was constructed about 1890 and served as a stable and stagecoach
accommodation, as well as a hay and feed warehouse. It was dismantled by the previous
owners, who rebuilt it over the years 2006 to 2008. It is currently listed on the Saratoga
Heritage Resource Inventory and considered a Historic Resource under Section 5024.1(g) of
the Public Resource Code. The proposed construction has the potential to affect a Historic
Resource. The City of Saratoga has asked that the proposed project be evaluated for
consistency with the Secretary of the Interior’s Standards for Rehabilitation, in accordance
with the California Environmental Quality Act (CEQA) and Chapter 13 of the City of
Saratoga’s Code for Heritage Preservation, Articles 13-05, General Provisions.
Professional Qualifications
Anthony Kirk holds a Ph.D. in American History from the University of California, Santa
Barbara. He meets the Secretary of the Interior’s Professional Qualification Standards in
history and in architectural history. and serves as a consultant in environmental, cultural, and
architectural history. In 1994 he was appointed to the City of Santa Cruz Historic
Preservation Commission and fulfilled his duties until 1998, chairing the commission for the
final two years of his term. Over the course of twenty years, he has evaluated countless
buildings, for individuals, corporations, and government agencies. He has worked for the
California Department of Parks and Recreation, the City of Sunnyvale, the City of Marina,
the City of Watsonville, and the California Historical Society. For more the last decade he
has served as a consultant to Stanford University, surveying, researching, and evaluating the
significance of campus cultural resources.
Methodology
On 16 July 2018 I conducted a field survey of the property at 20640 3rd Street, Saratoga,
California (APN 503-024-071/072). This work consisted of a careful recordation of the plan
and physical features of the Sam Cloud Barn Building, including its design, manner of
construction, materials, and workmanship. I subsequently researched a series of
newspaper articles that were published when the Sam Cloud Barn was dismantled and
rebuilt. In addition, I interviewed Craig Aubrey, a former owner, who disassembled the old
barn that once stood on the site and constructed the Sam Cloud Barn Building.

Proposed Project
The project will combine two separate parcels, to create a single parcel. An annex will be
constructed at the rear of the Sam Cloud Barn, which faces west, and the building will be
used for both offices and housing. Because the Sam Cloud Barn Building is listed in the City
of Saratoga Heritage Resources Inventory, the City requires an evaluation of the proposed
project to establish if it is consistent with the Secretary of the Interior’s Standards for
Rehabilitation. A project that is consistent with the Standards is generally considered a
project that will not cause a significant impact (14 CCR § 15126.4(b)(1)).
Resource Status
The property is not listed in the National Register of Historic Places nor the California
Register of Historical Resources but is included in the City of Saratoga Heritage
Resources Inventory.
HISTORICAL BACKGROUND
The Sam Cloud Barn Building was constructed as an office complex by Craig Awbrey and
Robert Hausmann over the years 2006 to 2008. It replaced the Sam Cloud Barn, which had
been built about 1890 to house horses and serve as a hay and feed warehouse. Although the
building was said in the local press to have been “reconstructed, using about 85 percent of
the original wood,” the exterior of the building was, in fact, entirely clad with new cove-
rustic siding and windows of a different size and in some cases a different type were
introduced in a new pattern. The roof was not finished with wood shingles, but with
corrugated aluminum panels. The building was sold in 2015 to the current owner, Shawn
Taheri, who plans to construct an addition at the rear of the building.
DESCRIPTION OF HISTORIC RESOURCE
The Sam Cloud Barn Building is a four-story office building that was constructed over the
years 2006 to 2008 on a steep slope in downtown Saratoga (figures 1–3). It faces northeast
by north, or north as it is designated in this report for simplicity and clarity, toward 3rd
Street. Because of the character of the site on which it was constructed, the building is two
stories in height on the east side, three on the north side, and four on the south side. The
building was raised on the footprint of the Sam Cloud Barn and is the same height as the
original and has the same dimensions, except for a half-pace exterior staircase on the south
side. It is front gabled, with minimal overhang at the eaves. The walls are clad with cove-
rustic siding; the roof is finished with corrugated aluminum panels. The primary entrance is
on the ground floor of the north side and consists of a battened and glazed door, flanked by
two narrow sidelight. Fenestration consists of columns of double-hung two-over-two wood-

sash windows and two single-light fixed sash windows. On the east side, two-over-two
windows flank a generously sized picture window on the ground floor (and, behind it, the
original sliding-wood entry door) and two-over-two windows flank a large fixed-sash
windows (and, behind it, the original sliding hay-loft door). Tall columns of double-hung
two-over-two windows on the south and west sides admit light to the building. The size,
number, and placement of windows is entirely different from the fenestration of the Sam
Cloud Barn, except on the east side. Here the windows are placed as they were originally,
but they are significantly taller (figures 4 and 5).
IMPACTS OF THE PROPOSED PROJECT
The California Environmental Quality Act (CEQA), Sections 21000 et seq. of the Public
Resources Code (PRC), requires assessment of proposed projects to ascertain the potential
for a substantial adverse effect on the environment, including adverse effects on historical
resources, which are considered part of the environment. The implementation of CEQA is
regulated by CEQA Guidelines, which are set forth in the California Code of Regulations
(CCR), Title 14, Chapter 3, Sections 15000 et seq.
Under Section 15064.5(a)(2) of CEQA Guidelines, “A resource included in a local register of
historical resources, as defined in section 5020.1(k) of the Public Resources Code or
identified as significant in an historical resource survey meeting the requirements section
5024.1(g) of the Public Resources Code, shall be presumed to be historically or culturally

significant.” As such, the Sam Cloud Barn Building is presumed to be a historical resource.
CEQA Guidelines, in Section 15064.5(b)(1), specifically define a “substantial adverse
change in the significance of an historical resource” as “physical demolition, destruction,
relocation, or alteration of the resource or its immediate surroundings such that the
significance of an historical resource would be materially impaired.” In assessing the
potential effects of a proposed project, it is necessary to establish if the project is consistent
with the Secretary of the Interior’s Standards for the Treatment of Historic Properties. The
Secretary of the Interior’s Standards, originally developed in 1978 and most recently revised
in 1995, identify four treatments: Preservation, Rehabilitation, Restoration, and
Reconstruction. Under CEQA, projects that are consistent with the Standards are presumed
to have an impact on the historical resource that is less than significant and, as such, are not
subject to CEQA.
Project Description
The proposed project will combine two separate parcels to create a single parcel. An annex
will be constructed on the south side of the Sam Cloud Barn Building that will contain two
residential condominiums and a single commercial-office condominium, as well as a parking
garage on the ground level. The project will result in a mixed-use building, with both
commercial and residential uses. The new construction will require the removal of the
exterior half-pace staircase. The condominium annex will be set slightly more than five feet
from the south side of the Sam Cloud Barn Building. The addition will contain slightly more
than 5,678 square feet and will increase the total size of the building by 79 percent. The
walls of the annex will be covered with cove-rustic siding, the same as the Sam Cloud Barn
Building, but the fenestration will be completely different, with large fixed-sash windows
and sliding-glass doors opening to balconies. The roof will be flat rather than gabled, with an
expansive deck.
Secretary of the Interior’s Standards for Rehabilitation
Of the four treatments of historic properties, Preservation, Rehabilitation, Restoration, and
Reconstruction, only one, Rehabilitation, provides the opportunity for a property to evolve in
response to new requirements, such as those addressed by the proposed addition to the Sam
Cloud Barn Building. As defined by the Secretary of the Interior’s Standards for the
Treatment of Historic Properties, Rehabilitation is “the act or process of making possible a
compatible use for a property through repair, alterations, and additions while preserving
those portions or features which convey its historical, cultural, or architectural values.” The
ten Standards for Rehabilitation, which together with the associated Guidelines provide goals
and guidance for development projects, are:
1.A property will be used as it was historically or be given a new use that requires minimal
change to its distinctive materials, features, spaces, and spatial relationships.

2.The historic character of a property will be retained and preserved. The removal of
distinctive materials or alteration of features, spaces, and spatial relationships that
characterize a property will be avoided.
3.Each property will be recognized as a physical record of its time, place, and use.
Changes that create a false sense of historical development, such as adding conjectural
features or elements from other historic properties, will not be undertaken.
4.Changes to a property that have acquired historic significance in their own right will be
retained and preserved.
5.Distinctive materials, features, finishes, and construction techniques or examples of
craftsmanship that characterize a property will be preserved.
6.Deteriorated historic features will be repaired rather than replaced. Where the severity of
deterioration requires replacement of a distinctive feature, the new feature will match the
old in design, color, texture, and, where possible, materials. Replacement of missing
features will be substantiated by documentary and physical evidence.
7.Chemical or physical treatments, if appropriate, will be undertaken using the gentlest
means possible. Treatments that cause damage to historic materials will not be used.
8.Archaeological resources will be protected and preserved in place. If such resources
must be disturbed, mitigation measures will be undertaken.
9.New additions, exterior alterations, or related new construction will not destroy historic
materials, features, and spatial relationships that characterize the property. The new work
shall be differentiated from the old and will be compatible with the historic materials,
features, size, scale and proportion, and massing to protect the integrity of the property
and its environment.
10. New additions and adjacent or related new construction will be undertaken in such a
manner that, if removed in the futures, the essential form and integrity of the historic
property and its environment would be unimpaired.
Evaluation of the Proposed Project
The proposed addition to the Sam Cloud Barn Building appears to be consistent with the
Secretary of the Interior Standards for Rehabilitation, in particular Standard 9 and Standard
10, which relate to new construction. As recommended by the Guidelines for Rehabilitating
Historic Buildings and National Park Service Preservation Brief No. 14, New Exterior
Additions to Historic Buildings, the addition will be on a secondary elevation rather than a
primary, or “public,” elevation and will, for the most part, not be visible to motorists or
pedestrians. The south side faces a parking lot. The primary elevations are the east and north
sides. The addition will alter the appearance of the south side, but it will only be clearly seen

from the end of the parking lot that is entered from 4th Street. The design of the annex, with
its wall of large glass windows and its balconies on the south side, will clearly differentiate it
from the Sam Cloud Barn Building. Currently the exterior staircase covers perhaps 60
percent of the south side. The exterior of the annex will be clad with cove-rustic siding, like
the barn building, and will be clearly seen from the alley that runs along the east side of the
barn building. The annex will be painted a different color than the Sam Cloud Barn
Building, however, and the small windows and flat roof will clearly differentiate it.
The project will not result in the loss of what are considered historic materials and features.
The addition will be set slightly more than five feet from the Sam Cloud Barn Building. The
character of the Barn Building will be preserved, and the complex will provide additional
work and living space. A new elevator and staircase will provide access to disabled persons,
making the complex more functional. The project will, additionally, transform the character
of the adjacent alley, creating a handsomely landscaped public area. If the annex were to be
removed in the future, the essential form and integrity of the Sam Cloud Barn Building
would be unimpaired
MITIGATION
The proposed project is consistent with the Secretary of the Interior’s Standards for
Rehabilitation, and, as such, no mitigation measures are required.

Project Description
The applicant proposes to add a three story commercial structure plus basement to the rear of
the Sam Cloud Barn building which is currently under renovation. The applicant has requested
that the Planning staff present the plans to the HPC, however staff has not yet provided design
review comments on this plan set dated March 6, 2007.
Background, Analysis and Designation Criteria
The property is listed on the City’s current Historic Resources Inventory list as resource # 77,
the “Sam Cloud Hay and Feed Warehouse”. Warren B. Heid AIA-E has prepared a report on
the compliance with the U.S. Department of the Interior Standards and a Historical Report on
the Sam Cloud Hay and Feed Warehouse. These are attached for reference. Warren B. Heid is
also the project architect.
The architect has designed an office and retail addition that matches the original architectural
style and uses similar materials. A glass feature has been added between the old and the new
structure to differentiate the structure in accordance to the Secretary of the Interior standards.
Staff is requesting a determination of the Historical Preservation Commission regarding
the appropriateness of the addition. The following are two options available to the
Commission in reviewing this proposal:
1.Determine that the addition is compatible and designed in accordance with
the Secretary of the Interior Standards: If the HPC determines that the addition
is compatible with the existing structure and complies with the Secretary of the
Interior Standards, staff would include the recommendation in the report to the
Planning Commission.
2.Request changes to the design of the structure: Require the applicant to
revise the plans for compatibility, with the existing structure or Secretary of the
Interior Standards and ask the applicant to return to the Heritage Preservation
Commission for additional review.

Commissioner Koepernik commented that the City Council accepted the
$2,000 donation from the Saratoga Lions Club for the plaques at its February
07, 2007 meeting and added that the Council would like to formally grant the

plaques for the City owned properties. Commissioner Louden passed around
bids for the plaques. The Commission passed a motion to accept bids as
proposed by a 6-0 vote.
B. Discuss Trees/Landscaping Plan at Historic Park – Item discussed.
Commissioner Koepernik commented that the Council decided to approve
removal of redwood trees instead of oak trees at their February 07, 2007
meeting.
C. Heritage Orchard Signage – This item will be continued to next meeting.
3. New Business
A. 8:30 am Site Visit – 20230 La Paloma Avenue – Decide if property is of
historic significance – Site visit completed (property owner present during site
visit and during deliberation). The property owner (Mr. Chris Kline) made a
short presentation. The Commissioners commented that the addition
appeared worthwhile and compatible to the existing home and that the
property should be added to the Historic Resources Inventory. The motion to:
(1) add the property to the inventory based on the information provided by the
owner and with criteria “c” and “e” and (2) approve the proposal (as it pertains
to historic significance) was passed by a 6-0 vote.
B. 8:45 am Site Visit – 20640 Third Street – Review and discuss proposed
addition to Sam Cloud Barn and provide either feedback or a decision on the
project – Site visit completed with Mr. Warren Heid, Mr. Bob Hausmann, and
Mr. Craig Aubrey present. Planner Bradley commented that staff has not
provided design review comments to the applicant yet. Typically a project is
not scheduled for HPC until it is complete before but the applicant has
requested to proceed. Mr. Warren Heid made a short presentation and
passed around an alternative to the proposed project that he prepared before
the meeting. The alternative design proposed a break in the rooflines. He
stated that in his opinion, both options met the Secretary of Interior standards.
Commissioner Marra asked if the applicant had considered color for the
original structure and the addition. Mr. Hausmann responded that the
proposed colors for both parts of the building are the same: a yellowish color.
Councilmember Waltonsmith commented that she wants to ensure the older
part of the building is not prevented from being on a national or state list. Mr.
Warren Heid said there is a six inch separation between the two foundations
and a glass separation between the original and proposed structures.
Commissioner Koepernik commented that the applicant should not sandblast
original wood material. Commissioner Gomersall asked why two separate
buildings cannot be constructed. Mr. Warren Heid responded that the
Building Code requires two exits, one at the rear of the structure. The motion
to approve the “alternative design” (with a modification such that the entry
door between the old structure and proposed building would be flush with the
two facades) and determine that the proposal meets the Secretary of Interior
standards was passed by a 5-1 vote (Gomersall).
