Council Members,
Thank you for the opportunity to address my concerns regarding flavored tobacco.
Let me start by saying that youth experimentation, trial and decision making, both good and bad, have
been part of growing up for years. Guidance has and continues to come from family, friends and
parenting. It is the responsibility of family and friends to guide children to make good choices and
tobacco usage is still one of the strongest influences within this group. I do not want any young people
to become tobacco or nicotine users, and as we were raising our children, we made it our responsibility
to guide and educate our kids and now grandkids against tobacco and nicotine usage. Family has the
most influence with children and teens, and it should remain that way.
On the flip side, I believe that adults DO have the right to make their own independent decisions in life
and that brings me to discuss banning flavored tobacco. A total ban of flavors is too broad in scope and
needs to be more specific to the products that are popular with youth. Trends and available products
have shifted over the years. Flavors are also preferred by adults and the ability to purchase locally will
be removed if this ordinance passes without revision.
Tobacco Product carried by local retailers:
Pipe tobacco is often flavored and blended with Cherry, Bourbon, Apple, Amaretto, Coconut, Vanilla.
Pipe tobacco is certainly not a product that is driving underage usage. It is a type of tobacco consumed
by older adults.
Moist Snuff, a non-combustible tobacco, was introduced to the United Sates in the 1800's and
consumed by adults especially in the southern states. Again, not the product that is driving youth
purchases here in CA. Adult consumers choose traditional flavors typically flavored with mint,
spearmint, and wintergreen. We ask that you consider removing these 3 flavors from the flavor ban like
you have done with no restriction to menthol cigarettes.
Flavored Cigars are consumed by most adult consumers and will get caught up in a total flavor ban. You
can see many similarities in both flavored cigars and flavored alcohol. Many consumers buy cigars,
discard the tobacco fill, and use the cigar leaf wrapper for cannabis smoking. If you visit any tobacco
retailer, they will confirm this information and flavors represent approximately 80% of retailer cigar
sales.
Nicotine Products have been used by adult consumers to help them quit combustible cigarette smoking
and like the products mentioned in this letter, adults prefer flavors. 95% of all nicotine products sold are
flavored and again this choice would be eliminated; the very product that has helped them reduce
and/or quit combustible smoking. While there are certain flavors that seem to be preferred by
underage interest, these flavors are not what the adult community choses and most often these items
are purchased via the internet and delivered right to their home address. It's very easy to confirm with
parent's birthdate.
I myself, was a smoker for many years like my parents before me. It was nicotine that helped me finally
break the habit and I used both flavored Nicorette gum and a flavored Swedish nicotine pouch product
once it became available in CA. The Swedish product is not an FDA approved smoking cessation product
but available at local retailers and was recognized by the FDA "to be appropriate to the protection of the
public health." They were the first to present a modified risk product to the FDA here in the United
States. These products need to remain in the market place so that we can see a continued decline in
cigarette usage like we have for the last 15 years.
The FDA ran retailer compliance checks in Saratoga in both 2013 and 2015 with a 100% "No Violations
Observed" reported. Your retailers should not be penalized when they have been in compliance with no
issues reported involving a sale to minors. They cannot afford to lose their licenses and cannot afford to
lose the revenue generated from tobacco sales.
The American Lung Association gave the City of Saratoga an "A Grade" for tobacco compliance in their
2018 State of Tobacco Control. Congratulations, only 4 of 15 cities in Santa Clara County earned this
status. Compliance is working here.
Additionally, both Saratoga High School and Prospect High School with over 1913 students have strict
regulations regarding possession of tobacco, electronic cigarettes, and drug paraphernalia guidelines
clearly outlined in their 2018 student/parent handbooks with violation and disciplinary actions including
supervised detention, parent notification, parent conferences, suspension and possible expulsion.
