BACKGROUND Kier & Wright, on behalf of the property owner of 13251 Paramount Drive, have requested that the City allow the property owner to purchase a 19-foot-wide portion of Saratoga-Sunnyvale Road that lies along that property’s eastern boundary, and which the City is not using for roadway purposes. Prior to City sale of that unused portion of the road, the Planning Commision must find that the area’s proposed vacation as a road conforms with the City’s General Plan, and the City Council must then approve the vacation and sale. The stretch of Saratoga-Sunnyvale Road where this unused road portion lies is fully improved, with a four-lane roadway, a median, and pedestrian walkways on both sides of the roadway. The Circulation Element of the General Plan designates this road as a Major Arterial and does not contemplate future improvements requiring any of the road portion that is proposed for vacation and sale. The Public Works Department has confirmed that there are no plans to utilize the land that exists beyond the pedestrian walkway. The portion of the land that this property owner seeks to purchase is currently restricted from use by the public by an 8-foot-high wall, which runs along the proposed new eastern property line for 13251 Paramount Drive. STAFF RECOMMENDATION Adopt Resolution No. 19-003 approving the project subject to conditions of approval included in Attachment #1. Pursuant to Section 15-44.020 of the Saratoga Municipal Code, no building permit shall be issued for the construction of a Wireless Telecommunications Facility or the modification of an existing Wireless Telecommunications Facility, within any zoning district, until such structure has received design review approval by the Planning Commission. PROJECT DESCRIPTION On July 11, 2018, the Planning Commission conducted a public hearing to consider thirteen (13) separate AT&T applications for microcells to be located on existing utility poles within the public road right-of-way on Big Basin Way, Congress Springs Road, and Pierce Road. The Planning Commission approved all but the proposed microcell located at Pierce Road near Saratoga- Sunnyvale Road. The Planning Commission continued that item and directed the applicant to seek an alternate location for the microcell installation. The applicant was unable to find a suitable location within the vicinity of the proposed site and subsequently withdrew the application. On December 11, 2018, the applicant submitted a new application requesting Design Review approval to install a microcell site on an existing 38’5” tall utility pole within the public right-of- way on the east side of Saratoga-Sunnyvale Road near the intersection of Verde Vista Lane. The proposed site is approximately 0.9 mile away from the Pierce Road/Saratoga-Sunnyvale Road area. Based on existing and proposed cellular coverage diagrams provided by the applicant, the installation of this microcell site will improve the capacity of the existing 4G LTE network and allow AT&T to provide better wireless voice and data coverage for residents in the area. The proposal includes installing a new bracket and a canister antenna at the top of the existing utility pole which will increase its overall height by 10 feet. Associated mechanical equipment will be vertically mounted onto the lower half of the pole providing a minimum of seven feet of vertical clearance from the ground. The mechanical equipment would be located on the opposite side of the pole facing the Saratoga-Sunnyvale Road. No equipment will be located on the ground. The proposed antennas and all equipment would be painted to match the existing pole. Federal Communications Commission (FCC) Requirements Under the Telecommunications Act of 1996, the FCC has exclusive jurisdiction over RF emissions from personal wireless antenna facilities. Pursuant to its authority under federal law, the FCC has established rules to regulate the safety of emissions from these facilities. The applicant has provided cumulative RF exposure reports for all the proposed microcell sites, which conclude that the RF energy is well below the Maximum Permissible Exposure limit established by the FCC. Report to the Planning Commission AT&T Microcell Site – Application # PDR18-0034 March 13, 2019 Page | 3 Because the applicant has documented compliance with federal exposure limits, under the Telecommunication Act, the City can evaluate and regulate only the aesthetic aspects of wireless installations. Any concerns regarding health or safety aspects of the wireless sites are not within the purview of the Planning Commission. FINDINGS The findings required for issuance of a Design Review Approval pursuant to City Code Section Article 15-44.025 are set forth below and the Applicant has met the burden of proof to support making all those required findings: a. That the Wireless Telecommunications Facility is or can be co-located with another Wireless Telecommunications Facility located on a structure or an existing utility pole/tower in the public right-of-way unless the applicant has demonstrated that such location is not technically or operationally feasible. This finding can be made in the affirmative in that the proposed microcell site would be located on existing utility pole within the public right-of-way. b. That the Wireless Telecommunications Facility and related structures incorporate architectural treatments and screening to substantially include: 1. Appropriate and innovative stealth design solutions; 2. Techniques to blend with the surrounding environment and predominant background; 3. Colors and materials that are non-reflective; 4. Exterior textures to match the existing support structure or building; and 5. Reasonably compatible height with the existing surrounding environment. This finding can be made in the affirmative in that all the proposed antenna and associated equipment will be located on existing utility poles without accessory ground mounted equipment and fencing to detract from the predominant background. Pole mounted mechanical equipment would be located on the opposite side of the pole facing away from the public street to minimize views from the public right-of-way, all equipment would be painted a non-glossy, non-reflective color to match the color of the utility pole, all cabling would be installed in a tight manner to avoid visual clutter, and the height of the pole/antenna will be consistent with nearby trees. c. That landscaping and fencing provide visual screening of the Wireless Communication Facility's ground-mounted equipment, related structures, and that fencing material is compatible with the image and aesthetics of the surrounding area. This finding can be in the affirmative in that the proposed antenna and associated equipment would be placed on an existing utility pole with at least seven feet of vertical clearance from the ground - no ground-mounted equipment is proposed. In addition, a public hearing notice and project descriptions were published in the Saratoga News. ENVIRONMENTAL DETERMINATION The project is Categorically Exempt from the Environmental Quality Act (CEQA) pursuant Section 15303, “New Construction or Conversion of Small Structures”, Class 3 (a) of the Public Resources Code (CEQA). Project Plans RESOLUTION NO: 19-003 A RESOLUTION OF THE CITY OF SARATOGA PLANNING COMMISSION APPROVING DESIGN REVIEW PDR18-0034 FOR A MICROCELL SITE LOCATED ON AN EXISTING UTILITY POLE WITHIN THE PUBLIC ROAD RIGHT OF WAY ON SARATOGA SUNNYVALE ROAD NEAR THE INTERSECTION OF VERDE VISTA LANE WHEREAS, an application was submitted by AT&T Mobility requesting approval for the installation of a microcell site on an existing utility pole located on the east side of Saratoga Sunnyvale Road near the intersection of Verde Vista Lane. The installation includes a canister antenna on top of the pole and associated equipment to be mounted on the pole. The height of the utility pole with the antenna would increase from approximately 38 feet to 48 feet. The antenna and associated equipment would be painted to match the existing utility pole. WHEREAS, the Community Development Department completed an environmental assessment for the project in accordance with the California Environmental Quality Act (CEQA) and recommends that the Planning Commission determine this project exempt. WHEREAS, on March 13, 2018, the Planning Commission held a duly noticed public hearing on the subject application, and considered evidence presented by City Staff, the applicant, and other interested parties. NOW THEREFORE, the Planning Commission of the City of Saratoga hereby finds, determines and resolves as follows: Section 1: The recitals set forth above are true and correct and incorporated herein by reference. Section 2: The project is Categorically Exempt from the Environmental Quality Act (CEQA) pursuant to Section 15303, “New Construction or Conversion of Small Structures”, Class 3 (a) of the Public Resources Code (CEQA). This exemption applies to new construction and installation of small, new equipment and facilities in small structures. Section 3: The project is consistent with the following Saratoga General Plan Policies: Land Use Goal 13 which provides that the City shall use the Design Review process to assure that new construction and major additions thereto are compatible with the site and the adjacent surroundings; Land Use Element Policy 5.2 which states that Development proposals shall be evaluated against City standards and guidelines to assure that the related traffic, noise, light, appearance, and intensity of the proposed use have limited adverse impact on the area and can be fully mitigated; and Conservation Element Policy 6.0 which provides that the City shall protect the existing rural atmosphere of Saratoga by carefully considering the visual impact of new development. Section 4: The project is consistent with the Saratoga City Code in that the design and improvements are consistent with the design review findings in that the project is located within a public right of way on an existing utility pole and the antenna and associated equipment will be painted to match the existing pole. All conditions below which are identified as permanent or for which an alternative period of time for applicability is specified shall run with the land and apply to the landowner’s successors in interest for such time period. No zoning clearance, or demolition, grading for this project shall be issued until proof is filed with the city that a certificate of approval documenting all applicable permanent or other term-specified conditions has been recorded by the applicant with the Santa Clara County Recorder’s office in form and content to the Community Development Director. If a condition is not “Permanent” or does not have a term specified, it shall remain in effect until the issuance by the City of Saratoga of a Certificate of Occupancy or its equivalent. 2. As a condition of this Approval, Owner and Applicant hereby agree to defend, indemnify and hold the City and its officers, officials, boards, commissions, employees, agents and volunteers harmless from and against: a. any and all claims, actions or proceedings to attack, set aside, void or annul any action on the subject application, or any of the proceedings, acts or determinations taken, done or made prior to said action; and b. any and all claims, demands, actions, expenses or liabilities arising from or in any manner relating to the performance of such construction, installation, alteration or grading work by the Owner and/or Applicant, their successors, or by any person acting on their behalf. 3. The development shall be located and constructed to include those features, and only those features, as shown on the Approved Plans date stamped December 11, 2018. All proposed changes to the approved plans must be submitted in writing with plans showing the changes, including a clouded set of plans highlighting the changes. Such changes shall be subject to approval in accordance with City Code. 4. PERMANANT CONDITION The pole mounted mechanical equipment shall be located on the pole in a manner to reduce the visual impacts from the road right of way to the maximum extent possible. In addition, the antennas and associated equipment shall be painted to match the color of the existing utility pole. 5. The Owner and Applicant will be mailed a statement after the time the Resolution granting this approval is duly executed, containing a statement of all amounts due to the City in connection with this application, including all consultant fees (collectively “processing fees”). This approval or permit shall expire sixty (60) days after the date said notice is mailed if all processing fees Saratoga-Sunnyvale Road Application #PDR18-0034 Resolution #19-003 Page | 4 contained in the notice have not been paid in full. No Zoning Clearance or Demolition, Grading, or Building Permit may be issued until the City certifies that all processing fees have been paid in full (and, for deposit accounts, a surplus balance of $500 is maintained). 6. A Building Permit must be issued, and construction commenced, within 36 months from the date of adoption of this Resolution or the Design Review Approval will expire unless extended in accordance with the City Code. 7. The Project shall maintain compliance with all applicable regulations of the State, County, City and/or other governmental agencies having jurisdiction including, without limitation, the requirements of the Saratoga Zoning Regulations incorporated herein by this reference. 8. Prior to issuance of any Demolition, Grading, or Building Permit to implement this Design Review Approval the Owner or Applicant shall obtain a “Zoning Clearance” from the Community Development Director by submitting final plans for the requested permit to the Community Development Department for review to ascertain compliance with the requirements of this Resolution. 9. As a condition of this Approval, Owner and Applicant hereby agree to defend, indemnify and hold the City and its officers, officials, boards, commissions, employees, agents and volunteers harmless from and against: c. any and all claims, actions or proceedings to attack, set aside, void or annul any action on the subject application, or any of the proceedings, acts or determinations taken, done or made prior to said action; and d. any and all claims, demands, actions, expenses or liabilities arising from or in any manner relating to the performance of such construction, installation, alteration or grading work by the Owner and/or Applicant, their successors, or by any person acting on their behalf. In addition, prior to any Zoning Clearance from the Community Development Director, Owner and Applicant shall execute a separate agreement containing the details of this required Agreement to Indemnify, Hold Harmless and Defend, which shall be subject to prior approval as to form and content by the City Attorney. COMMUNITY DEVELOPMENT 9. The development shall be located and constructed to include those features, and only those features, as shown on the Approved Plans and Description of Use, denominated Exhibit "A", and the Photo Simulations, denominated Exhibit “B”, both received and dated February 11, 2019. All proposed changes to the Approved Plans and Description of Use must be submitted in writing with plans showing the changes, including a clouded set of plans highlighting the changes. 10. Prior to the installation of the proposed antenna and associated equipment, the antenna and equipment shall be painted a color similar to the structure it’s being attached to. These plans shall be subject to review and approval by the Community Development Department Director or designee prior to issuance of Zoning Clearance. The construction plans shall, at a minimum include the following: a. Architectural drawings and other plan sheets consistent with those identified as Exhibit “A” on file with the Community Development Department b. This signed and dated Resolution printed onto separate construction plan pages; c. All additional drawings, plans, maps, reports, and/or materials required by the Building Division REQUIREMENTS OF OTHER AGENCIES OR UTILITIES 12. The applicant for this Project shall contact the FCC and verify whether there are any required permits from said Commission. If required by the FCC, prior to issuance of Zoning Clearance for any proposed equipment installations (or if none, prior to commencement of the approved use), the Owner and/or Applicant shall submit to the Community Development Department documentation from the FCC showing proof of compliance of the proposed use and/or development with the FCC's requirements. 13. If the subject site is decommissioned in the future, all cellular antennas and related equipment shall be removed within 30 days of cessation of operation. 14. All applicable requirements of the State, County, City and other Governmental entities, including the California Public Utilities Commission, must be met. 15. The applicant shall provide a 24-hour phone number to which interference problems may be reported and will resolve all interference complaints within 24 hours from the time the interference was reported. 16. Design review approval will be required for all additional antennas that are proposed to be installed on the existing utility pole that would substantially change the physical dimensions of the existing utility pole. The site is currently developed with a single-story residence with a garage. The surrounding uses consist of single-family residences to the east, west, north, and south. The 2,221 square foot first floor consists of an entry way, three (3) bedrooms with baths, a master suite, family room, dining room, kitchen and a 517 square foot attached garage. The new 714 square foot second floor will be a game room. Architecture/Design The existing home is a contemporary architectural style. The addition is designed to match the existing home. Exterior materials and colors will consist of natural color cement plaster walls, Navajo white trim, stone veneer and an autumn blend asphalt shingle roof. The variety of exterior materials, varying roof heights and the partial second story provide architectural articulation to break up the mass of the home. The applicant has provided a color and materials board, which will be available for review at the site visit and during the public hearing. Below is a list of the proposed exterior materials. Two (2) Modesto Ash and three (3) Mulberry trees, meeting the City Code thresholds for protection, are in fair to poor condition and proposed for removal. Two additional trees that are not protected are proposed to be removed. The City Arborist has been able to make the findings and recommend approval for the removal of the requested trees. All protected trees to remain in the vicinity of the project will be protected prior to building permit issuance and throughout the duration of the project. The applicant is required to place a tree security deposit of $3,800 and install tree protection fencing on the site. Details of the arborist report findings and descriptions of the trees to be preserved are included in the Arborist Report (Attachment 2). Geotechnical Review This project is not located in a geo hazard zone therefore Geotechnical review was not required. FINDINGS The findings required for issuance of a Design Review Approval pursuant to City Code Section Article 15-45.080 are set forth below and the Applicant has met the burden of proof to support making all of those required findings: Report to the Planning Commission 13550 La Paz Way-Application #PDR18-0028/ARB18-0043 March 13, 2019 Page | 4 a. Site development follows the natural contours of the site, minimizes grading, and is appropriate given the property’s natural constraints. This finding can be made in the affirmative in that the project minimizes changes to the contours of the site. Grading is limited to the location of the new garage and driveway. b. All protected trees shall be preserved, as provided in Article 15-50 (Tree Regulations). If constraints exist on the property, the number of protected trees, heritage trees, and native trees approved for removal shall be reduced to an absolute minimum. Removal of any smaller oak trees deemed to be in good health by the City Arborist shall be minimized using the criteria set forth in Section 15-50.080. This finding can be made in the affirmative in that the City Arborist has reviewed and recommends approval for the proposed removal of five (5) protected trees. The number of trees to be removed is limited to trees that are either in poor condition or in conflict with the location of the project. c. The height of the structure, its location on the site, and its architectural elements are designed to avoid unreasonable impacts to the privacy of adjoining properties and to community viewsheds. This finding can be made in the affirmative in that and the second story addition has a proposed height of 25’6” feet and setbacks that are greater than the minimum required by the zoning district. No community viewsheds are located in the vicinity of the project. d. The overall mass and height of the structure, and its architectural elements are in scale with the structure itself and with the neighborhood. This finding can be made in the affirmative in that the project will create a partial two-story residence in a neighborhood with both one and two-story structures fitting with the context of other residences within its vicinity. The project includes architectural elements consistent with the contemporary architectural style which are in scale with the structure and the neighborhood. e. The landscape design minimizes hardscape in the front setback area and contains elements that are complementary to the neighborhood streetscape. This finding can be made in the affirmative in there is minimal existing hardscape within the front yard setback and there are no proposed changes to this area. f. Development of the site does not unreasonably impair the ability of adjoining properties to utilize solar energy. This finding can be made in the affirmative in that the development will not unreasonably impair the ability of adjoining properties to utilize solar energy as the project meets or exceeds required setbacks. The design of the structure and the site development plan is consistent with the Residential Design Handbook, pursuant to Section 15-45.055. This finding can be made in the affirmative because the proposed project incorporates applicable design policies and techniques from the Residential Design Handbook. The overall mass and height of the structure are in scale with the neighborhood. In addition, the proposed materials, colors, and details enhance the architecture in a well-composed manner which is complementary to the architectural style of the home. h. On hillside lots, the location and the design of the structure avoid unreasonable impacts to ridgelines, significant hillside features, community viewsheds, and is in compliance with Section 15-13.100. This finding is not applicable as the project is not on a hillside lot. The project is not located on a ridgeline, and will not affect any significant hillside features or community viewsheds. Neighbor Notification and Correspondence A public notice was sent to property owners within 500 feet of the site. In addition, the public hearing notice and description of the project was published in the Saratoga News. The applicant submitted seven (7) completed neighborhood notification forms with no negative project related comments. (Attachment 3) On March 1, 2019, a letter was submitted by Michelle McIntyre (18641 Casa Blanca Lane) stating that the addition blocks a significant portion of her mountain view from the kitchen window and has a negative impact on their property value (Attachment 4). ENVIRONMENTAL DETERMINATION The project is Categorically Exempt from the Environmental Quality Act (CEQA) pursuant Section 15303, “New Construction or Conversion of Small Structures”, Class 3 (a) of the Public Resources Code (CEQA). This exemption allows for the construction of three single-family residences in a residential area, including small structures. The owner/applicant shall comply with all City requirements regarding drainage, including but not limited to complying with the city approved Stormwater management plan. The project shall retain and/or detain any increase in design flow from the site, that is created by the proposed construction and grading project, such that adjacent down slope properties will not be negatively impacted by any increase in flow. Design must follow the current Santa Clara County Drainage Manual method criteria, as required by the building department. Retention/detention element design must follow the Drainage Manual guidelines, as required by the building department. 6. The development shall be located and constructed to include those features, and only those features, as shown on the Approved Plans date stamped February 4, 2019. All proposed changes to the approved plans must be submitted in writing with plans showing the changes, including a clouded set of plans highlighting the changes. Such changes shall be subject to approval in accordance with City Code. 7. Prior to issuance of Building Permits, the applicant shall submit for staff approval, a Lighting Plan for the home’s exterior and landscaped areas. Proposed exterior lighting shall be limited to full-cut off & shielded fixtures with downward directed illumination so as not to shine on adjacent properties or public right-of-way. All proposed exterior lighting shall be designed to limit illumination to the site and avoid creating glare impacts to surrounding properties. 8. In order to comply with standards that minimize impacts to the neighborhood during site preparation and construction, the applicant shall comply with City Code Sections 7-30.060 and 16-75.050, with respect to noise, construction hours, maintenance of the construction site and other requirements stated in these sections. 9. Prior to issuance of Building Permits, the applicant shall prepare for review and approval by City staff a Construction Management Plan for the project which includes but is not limited to the following: a. Proposed construction worker parking area. b. Proposed construction hours that are consistent with City Code. c. Proposed construction/delivery vehicle staging or parking areas. d. Proposed traffic control plan with traffic control measures, any street closure, hours for delivery/earth moving or hauling, etc. To the extent possible, any deliveries, earth moving or hauling activities will be scheduled to avoid peak commute hours. e. Proposed construction material staging/storage areas. f. Location of project construction sign outlining permitted construction work hours, name of project contractor and the contact information for both homeowner and contractor. 10. All fences, walls and hedges shall conform to height requirements provided in City Code Section 15-29. 11. To the extent feasible, landscaping shall be designed and operated to treat storm water runoff by incorporating elements that collect, detain and infiltrate runoff. To the extent feasible, pest resistant landscaping plants shall be used throughout the landscaped area, especially along any hardscape area. c. Plant materials selected shall be appropriate to site specific characteristics such as soil type, topography, climate, amount and timing of sunlight, prevailing winds, rainfall, air movement, patterns of land use, ecological consistency and plant interactions to ensure successful establishment. d. Pest resistant landscaping plants shall be considered for use throughout the landscaped area, especially along any hardscape area. e. Any proposed or required under grounding of utilities shall take into account potential damage to roots of protected trees 12. This information is from Article 15-50.080 of the City Code and is applied to any tree requested for removal as part of the project. If findings are made that meet the criteria listed below, the tree(s) may be approved for removal and replacement during construction. (1)The condition of the tree with respect to disease, imminent danger of falling, proximity to existing or proposed structures and interference with utility services, and whether the tree is a Dead tree or a Fallen tree. (2)The necessity to remove the tree because of physical damage or threatened damage to improvements or impervious surfaces on the property. (3)The topography of the land and the effect of the tree removal upon erosion, soil retention and the diversion or increased flow of surface waters, particularly on steep slopes. (4)The number, species, size and location of existing trees in the area and the effect the removal would have upon shade, privacy impact, scenic beauty, property values, erosion control, and the general welfare of residents in the area. (5)The age and number of healthy trees the property is able to support according to good forestry practices. (6)Whether or not there are any alternatives that would allow for retaining or not encroaching on the protected tree. (7)Whether the approval of the request would be contrary to or in conflict with the general purpose and intent of this Article. (8)Any other information relevant to the public health, safety, or general welfare and the purposes of this ordinance as set forth in Section 15-50.010 (9)The necessity to remove the tree for economic or other enjoyment of the property when there is no other feasible alternative to the removal. (10)The necessity to remove the tree for installation and efficient operation of solar panels, subject to the requirements that the tree(s) to be removed, shall not be removed until solar panels have been installed and replacement trees planted in conformance with the City Arborist's recommendation. This is required prior to obtaining building division permits. h.Tree protection fencing shall remain undisturbed throughout the construction until final inspection. These activities include, but are not necessarily limited to, the following: demolition, grading, trenching for utility installation, equipment cleaning, stockpiling and dumping materials (including soil fill), and equipment/vehicle operation and parking. 7.Work inside fenced areas: a.Requires field meeting with City Arborist before performing work. b.Requires City Arborist approval prior to performing work. c.Requires Project Arborist on site to monitor work. 8.Project Arborist: a.Shall be David Beckham unless otherwise approved by the City Arborist. b.Shall supervise any permitted pruning or root pruning of trees on site. Roots of protected trees measuring two inches in diameter or more shall not be cut without prior approval of the Project Arborist. Roots measuring less than two inches in diameter may be cut using a sharp pruning tool. 9.Tree removal: a.Trees 1, 2, 3, 5 and 6 meet the criteria for removal and may be removed once building division permits have been obtained. b.No protected tree authorized for removal or encroachment pursuant to this project may be removed or encroached upon until the issuance of the applicable permit from the building division for the approved project. 10.New trees: a.New trees equal to $3,250 shall be planted as part of the project before final inspection and occupancy of the new home. b.Trees permitted for removal shall be replaced on or off site according to good forestry practices, and shall provide equivalent value in terms of aesthetic and environmental quality, size, height, location, appearance and other significant beneficial characteristics of the removed trees. c.Replacement values for new trees are listed below. 15 gallon = $350 24 inch box = $500 36 inch box = $1,500 48 inch box = $5,000 60 inch box = 7,000 72 inch box = $15,000 d.At least four new trees shall be planted in the front yard. e.Two of the front yard trees shall reach a height when mature of 30 feet or more. f.The rest of the replacement trees may be planted anywhere on the property as long as they do not encroach on retained trees. 11.Damage to protected trees that will be retained: Should any protected tree be damaged beyond repair, new trees shall be required to replace the tree. 12.Final inspection: At the end of the project, when the contractor wants to remove tree protection fencing and have the tree protection security deposit released by the City, call City Arborist for a final inspection. Solid and Demolition Waste Management: Provide designated waste collection areas and containers on site away from streets, gutters, storm drains, and waterways, and arrange for regular disposal. Waste containers must be watertight and covered at all times except when waste is deposited. Refer to Erosion & Sediment Control Field Manual, 4th Edition (page C3) or latest. 2. Hazardous Waste Management: Provide proper handling and disposal of hazardous wastes by a licensed hazardous waste material hauler. Hazardous wastes shall be stored and properly labeled in sealed containers constructed of suitable materials. Refer to Erosion & Sediment Control Field Manual, 4th Edition (pages C-5 to C-6) or latest. 3. Spill Prevention and Control: Provide proper storage areas for liquid and solid materials, including chemicals and hazardous substances, away from streets, gutters, storm drains, and waterways. Spill control materials must be kept on site where readily accessible. Spills must be cleaned up immediately and contaminated soil disposed properly. Refer to Erosion & Sediment Control Field Manual, 4th Edition (pages C-7 to C-8, C-13 to C-14) or latest. 4. Vehicle and Construction Equipment Service and Storage: An area shall be designated for the maintenance, where on-site maintenance is required, and storage of equipment that is protected from stormwater run-on and runoff. Measures shall be provided to capture any waste oils, lubricants, or other potential pollutants and these wastes shall be properly disposed of off site. Fueling and major maintenance/repair, and washing shall be conducted off-site whenever feasible. Refer to Erosion & Sediment Control Field Manual, 4th Edition (page C9) or latest. 5. Material Delivery, Handling and Storage: In general, materials should not be stockpiled on site. Where temporary stockpiles are necessary and approved by the County, they shall be covered with secured plastic sheeting or tarp and located in designated areas near construction entrances and away from drainage paths and waterways. Barriers shall be provided around storage areas where materials are potentially in contact with runoff. Refer to Erosion & Sediment Control Field Manual, 4th Edition (pages C-11 to C-12) or latest. 6. Handling and Disposal of Concrete and Cement: When concrete trucks and equipment are washed on-site, concrete wastewater shall be contained in designated containers or in a temporary lined and watertight pit where wasted concrete can harden for later removal. If possible have concrete contractor remove concrete wash water from site. In no case shall fresh concrete be washed into the road right-of-way. Refer to Erosion & Sediment Control Field Manual, 4th Edition (pages C-15 to C-16) or latest. 7. Pavement Construction Management: Prevent or reduce the discharge of pollutants from paving operations, using measures to prevent run-on and runoff pollution and properly disposing of wastes. Avoid paving in the wet season and reschedule paving when rain is in the forecast. Residue from saw-cutting shall be vacuumed for proper disposal. Refer to Erosion & Sediment Control Field Manual, 4th Edition (pages C-17 to C-18) or latest. 8. Contaminated Soil and Water Management: Inspections to identify contaminated soils should occur prior to construction and at regular intervals during construction. Remediating contaminated soil should occur promptly after identification and be specific to the contaminant identified, which may include hazardous waste removal. Refer to Erosion & Sediment Control Field Manual, 4th Edition (pages C-19 to C-20) or latest. 9. Sanitary/Septic Water Management: Temporary sanitary facilities should be located away from drainage paths, waterways, and traffic areas. Only licensed sanitary and septic waste haulers should be used. Secondary containment should be provided for all sanitary facilities. Refer to Erosion & Sediment Control Field Manual, 4th Edition (page C-21) or latest. 10. Inspection & Maintenance: Areas of material and equipment storage sites and temporary sanitary facilities must be inspected weekly. Problem areas shall be identified and appropriate additional and/or alternative control measures implemented immediately, within 24 hours of the problem being identified. STANDARD EROSION CONTROL NOTES 1. Sediment Control Management: Tracking Prevention & Clean Up: Activities shall be organized and measures taken as needed to prevent or minimize tracking of soil onto the public street system. A gravel or proprietary device construction entrance/exit is required for all sites. Clean up of tracked material shall be provided by means of a street sweeper prior to an approaching rain event, or at least once at the end of each workday that material is tracked, or, more frequently as determined by the County Inspector. Refer to Erosion & Sediment Control Field Manual, 4th Edition (pages B-31 to B-33) or latest. Storm Drain Inlet and Catch Basin Inlet Protection: All inlets within the vicinity of the project and within the project limits shall be protected with gravel bags placed around inlets or other inlet protection. At locations where exposed soils are present, staked fiber roles or staked silt fences can be used. Inlet filters are not allowed due to clogging and subsequent flooding. Refer to Erosion & Sediment Control Field Manual, 4th Edition (pages B-49 to B-51) or latest. Storm Water Runoff: No storm water runoff shall be allowed to drain in to the existing and/or proposed underground storm drain system or other above ground watercourses until appropriate erosion control measures are fully installed. Dust Control: The contractor shall provide dust control in graded areas as required by providing wet suppression or chemical stabilization of exposed soils, providing for rapid clean up of sediments deposited on paved roads, furnishing construction road entrances and vehicle wash down areas, and limiting the amount of areas disturbed by clearing and earth moving operations by scheduling these activities in phases. Stockpiling: Excavated soils shall not be placed in streets or on paved areas. Borrow and temporary stockpiles shall be protected with appropriate erosion control measures(tarps, straw bales, silt fences, ect.) to ensure silt does not leave the site or enter the storm drain system or neighboring watercourse. 2. Erosion Control: During the rainy season, all disturbed areas must include an effective combination of erosion and sediment control. It is required that temporary erosion control measures are applied to all disturbed soil areas prior to a rain event. During the non-rainy season, erosion control measures must be applied sufficient to control wind erosion at the site. 3. Inspection & Maintenance: Disturbed areas of the Project’s site, locations where vehicles enter or exit the site, and all erosion and sediment controls that are identified as part of the Erosion Control Plans must be inspected by the Contractor before, during, and after storm events, and at least weekly during seasonal wet periods. Problem areas shall be identified and appropriate additional and/ or alternative control measures implemented immediately, within 24 hours of the problem being identified. 4. Project Completion: Prior to project completion and signoff by the County Inspector, all disturbed areas shall be reseeded, planted, or landscaped to minimize the potential for erosion on the subject site. 5. It shall be the Owner’s/Contractor’s responsibility to maintain control of the entire construction operation and to keep the entire site in compliance with the erosion control plan. 6.
