Saratoga City Council November 20, 2019 Subject: water rates and water meters up 67%. What is Saratoga City rate, has the city gotten an increase? i) The citizens in my neighborhood are paying $1,000, $1,400 and $2,000 for water pay more use less. 2) I asked the city council to look into buying SJWG stock with any money city may be able to invest? Did any of you consider this idea? A) Pays a dividend B) SJWG stock cap. 1.939 Billion C) It would give us a vote 3) No help coming from the state county or CPUC. Owning the stock give us a vote. If we are a minority share owner, we would have more power if we voted as a group (6% ownership). 4) SJ Water is now asking for another 9 million dollars after the last outrageous increase. Due to their own poor accounting and poor planning & no backup system. 5) The issue is when is enough, enough. 6) Never to my limited knowledge has there been a forensic audit of the SJCW by anyone, or 7) Water is life, where else can the citizen go? 8) Are you aware the state legislators are about to limit 50 gallons per person, based on number if people in your home? 9) CPUC failed to review the total impact on the rate increase to the rate payers. A) Never considered whole impact on the public rate payers. Neighbor signed with name, address, and phone number that water service changes are too high — Outrageous! B) Paying $1000-$2000 is outrageous and a hardship for seniors, retirement person, fixed income. Never considered in decision. C) Impact of the approved proposals and rates did not take into consideration health issues of seniors or people with special needs that use more water due to health issues. D) Most people fixed income will be hurt in every way with this outrageous rates and meter service changes. E) San Jose water officer increase in compensation, adding over 23 new positions, overtime pay, medical expenses, dental expenses, legal services, due to increases in water service, healthcare cost, pension expense. We the rate payers are all paying for their high pay, benefit programs $5,300,000 increase. F) Tiered rates are unfair and excess charge per unit are too high. G) The rate setting proceeding included cost of service, sales payroll expenses and many other general expenses, so putting everything together for approval at the CPUC makes the rate for water and meter service charge not the important issue at all! 10) Impact on rate payers without a forensic audit- NO real accounta ility. Did NOT give advice letter to Public Notice with enough time for public to review or understand extra 9 million cost to rate payers to response to CPUC. Public needs a complete audit of San Jose Water showing a short fall early on, why until it is over 9 million short fall? It takes 1 year to know will need additional 9 million under -collected really? This is after all rate payers cut back are water usage. Did the Water Company cut back on there overhead? anywhere??? NO! Only the rate payers are the ones who are hurt, again & again. Less water pay more, lots of water pay more now, anyway! No audit No CPA No accounting daily, weekly monthly No financial records disclosed An auditor sees to the financial operations & work to help ensure the organization run efficiently. Auditor assure statements all free of material caused by error or fraud. For San Jose Water Co. to first state under -collection of over 9 million plus is outrageous. Who did the accounting & why wait until it is 9 million plus, did not know at 2 million or 5 million etc.??? Need a full audit yearly or need full financial statements to the public and CPUC for any rate increase. There is a total need to know. Public has a right to know- They are the rate payers!!! Major Issue: San Jose Water Co. need: Flow Chart:- -Santa Clara Water District -San Jose Water Company -San Jose Water Group Need to see a flow chart to see how all the system works for the public, NOT only the water groups all 3 of them, all work together, how does that help the public the rate payers? Any rate increase without full disclosure of how the system is working is unjustice to all. Please don't approve the request until there is a full audit, flow chart & what has San Jose water co. done to cut overhead any oversized cost or made things more effective in their business awareness & duty to the public. Water rates are way to high & we rate payers have been overcharged for years. Also when it applies to high rents in the area, water bills are passed on to the renters, it's not only affordable housing but cost of water at all levels, large apartments or small homes -WATER is an issue at all levels. San Jose water group is going to do a major stock exchange with Connecticut, Water Company. How will this help San Jose's rates for payers? A flow chart might show how things really work. Where in California can prescription drugs be tested for safety? Brand name or generic? This issue effects everyone in the State rich or poor, and it's about public health & safety. if drugs are making people sick, healthcare for all, goes up! No winners here! Questions: 1. Dear Commissions, The service changes here in Saratoga is $131.66 x6 786 per year in addition HOA $30.00 total just for the water meter per household is $816.66, no water at all! Group We need a complete forensic audit of San Jose water company. Santa Clara water district, San Jose Water The CPUC cannot do their duty to the public, if there is no real forensic audit. Here is what San Jose water has done, little increase in water rates & large increase in service charge. However, CPUC must approve all rate changes & service charges is a major rate increase. All cities are not the same, Los Gatos, Campbell & others service charges are not fair, just or reasonable and are discriminatory. This is the way to fool the public & show the CPUC not increasing water rates too high. It's a lie and misleading!!! Just increase the service charge way too high. It is very hard to understand the system. I learned a lot. However, I disagree with many issues the San Jose Water Company has done or is doing now and not thinking of the ratepayers first. We are your customers. Questions of cost: • Cost of water appreciation day free tickets! Just lower the water bill. That's appreciation. • Free water to SJW employees pay nothing, a little tax, an accounting fix. Real cost to rate payers. • Hiring a teacher to teach your people in the field to write a report. People cannot write. Cost per hour for teacher $250 per hour. What was total cost? Ratepayers paid again... • Where do you try to cut cost? • What has water co. done ever to cut cost to rate payers? • How much do the board members make? Overhead cost? • KPMG cost of audit? CPA? • Does SJ Water Co. get 3 bids on any major or costly job before doing any repairs, maintenance on trucks or equipment, etc.? • Lots of rain, snow, did cost of water go down? How does it work to reduce cost? • Need a complete forensic audit by outside firm not CPUC or KPMG. 11,000 pages however CPUC is not protecting rate payers. Who must?? The citizens! • What is the number of 1" meter in SJW Co.? Total number and income received from rate payers? 67% increase is still not enough. What is the number? Water is life_ Only being a shareholder will we have a real voice with a vote. Shareholders will receive date on the board members pay employees benefits, stocks, bonuses, etc. Some accountability were there is none now. We the citizens and rate pavers can vote our shares for fair and reasonable water bills. Any special increase for any real needed repairs must have 3 bids for any work done now or in the future. Need a forensic audit of SJW Group. We the people will now have a voice with a vote and ownersghip of SJW Group stock. Owning the stock may offset cost of our water bill. Stock prices and dividend. More important we will have a vote and as a block of stock voting we have power and gives citizens a real voice, ownership of stock will help level the field of outrageous water rates and meter rates up over 67% or no end to major increase! Water is life! Asking the city of Saratoga to think of investing in San Jose Water Group stock to help citizens have a voice. Or encourage citizens to buy SJW Group stock for themselves to have a vote and if stock goes up or pays a dividend may offset cost of their water bill. What do you think of this idea? On September 27, 2019, the Maine Public Utilities Commission (the "MPUC") issued a formal notice setting the agenda for the MPUC's open meeting scheduled for October 4, 2019. The increase was attributable to a $6.7 million change in cumulative water rates, $6.2 million in the net recognition of certain balancing and memorandum accounts, and $1.7 million in new customers, partially offset by a $5.9 million decrease in customer usage and $2. t million in customer rate credits related to the Ol l settlement with the CPUC's CPED. Year-to-date water production expenses decreased to $68.9 million from $70.3 million in 2018. The $1.4 million decrease was attributable to a $7.3 million increase in the use of available surface water supplies and $3.0 million in decreased customer usage, partially offset by $6.4 million in higher per unit costs for purchased water, groundwater extraction and energy charges and a $2.5 million increase in cost recovery balancing and memorandum accounts. Operating expenses, excluding water production costs, increased $3.7 million to $77.4 million from $73.7 million. The increase was primarily due to $3.0 million in higher depreciation expenses, $2.2 million in higher general and administrative expenses and $600,000 in higher taxes other than income taxes, partially offset by a decrease of $2.2 million in merger expenses related to our proposed CTWS merger transaction. Other expense and income year-to-date for 2019 included $4.2 million of interest income earned on money market fund investments from the proceeds of the company's equity offering in December 2018. The effective consolidated income tax rates were approximately 24% and 20% for the six-month periods ended June 30, 2019 and 2018, respectively. CTWS Merger Update On July 3, 2019, SJW Group and CTWS ("the Companies") reached a settlement agreement with the Department of Energy and Environmental Protection ("DEEP") and the Office of Consumer Counsel ("OCC") regarding the commitments in our application to the Connecticut Public Utilities Regulatory Authority ("PURA") for approval of our proposed merger. The CPUC's mission is to protect utility customers and to make sure that the rates charged by all utilities are fair and reasonable. The CPUC also ensures that all necessary improvements are made to the water system and that the system is operated efficiently. The water rates charged by San Jose Water are based upon "cost of service," which means that the majority of every dollar our customers pay goes directly to system operations. The California Public Utilities Commission approved new water rates for San Jose Water customers in 2016. Water rates are increasing because San Jose Water's (SJW) costs are increasing. Much of our local water system infrastructure was constructed more than 50 years ago and has reached the end of its useful life. In order to protect public health and safety and to deliver safe and reliable water service, SJW must continue to replace and upgrade water system components such as new water mains, tanks, wells, and treatment plants. SJW has multiple projects in the works to better and more sustainably serve its customers. In January 2018, SJW filed its next General Rate Case application for the year's 2019-2021. New rates were approved by the CPUC and became effective January 1, 2019. Rate Cases General rate cases are litigated proceedings before the CPUC that establish San Jose Water's base rates for a three-year period. Pursuant to state law, San Jose Water is required to file a general rate case filing with the CPUC every three years. In the general rate case process, the CPUC sets rates to cover the costs of providing water service and to allow the company to earn a reasonable return on its investment in water system infrastructure. Major costs to operate a water system include purchased water, groundwater extraction tax, electric power, water treatment costs, and labor. The processing of San Jose Water's filing generally takes the following 12-month path: • San Jose Water reviews its historical costs, projected costs, and planned water system improvements and prepares a General Rate Case application for consideration by the CPUC. • The CPUC's Office of Ratepayer Advocates (ORA) audits San Jose Water, analyzes its application, and makes a recommendation. • The CPUC hosts a public hearing to receive input from customers on the application. Customers may also write to the CPUC. • The CPUC holds a formal hearing, which is much like a court proceeding. • A CPUC Administrative Law Judge assigned to the application issues a proposed decision. • The CPUC Commissioners vote on the proposed decision. What are the rates authorized by the California Public Utilities Commission? • State law requires Class A water utilities like San Jose Water Company (SJW) to file a general rate case (GRC) every three years. Accordingly, SJW filed an application with the Commission for new rates effective in January of 2019, 2020, and 2021. • After a thorough and comprehensive review spanning 12 months, the Commission issued its final decision on November 29, 2018, on the three-year proposal. • Based on the Commission's Decision 18-11-025 effective January 1, 2019, SJWC's 2019 revenue requirement, which is its cost to deliver safe, high quality, and reliable water service, is increased by $16,378,000 or 4.55%. • The Commission also approved the recovery of about $27 million from SJW's Balancing and Memorandum accounts covering prior periods through September 2017. The $27 million will be recovered via two surcharges ("2019 Balancing Account Surcharge and 2019 Memorandum Account Surcharge") over a 12-month period. • The decision also authorized projected increases of $3.20% for 2020 and 3.01% for 2021. However, the rate increases for 2020 and 2021 are derived using an escalation procedure determined by the Commission. • Among the factors used to calculate rates in these years were inflation forecasts. If inflation is greater or lower than that assumed in the decision, rates for 2020 and 2021 may be higher or lower than shown in the decision. • Each of these rate changes are placed into effect thru the filing of Advice Letters for the Commission's approval. • In addition, the authorized recovery of the 2019 Balancing Account Surcharge and 2019 Memorandum Account Surcharge will add about $6.48 to the monthly bill for the typical customer for a 12-month period. • The Commission made changes to both the monthly service charge and the volume charge (per CCF). The decision allows SJW to recover approximately 67 percent of its fixed costs through the monthly service charge. This supports rate stabilization and reduces rate uncertainty for customers if usage declines below Commission projections. Your bill may also include other surcharges, taxes, and Commission fees that will affect the total bill amount. You will also continue to see a surcharge for the Water Rate Assistance Program (WRAP), which assists qualifying low-income residential households Water service will remain at about a penny a gallon — a great value considering the resources and expertise it takes to treat and deliver safe and reliable water to your tap 24 hours a day, 365 days a year. Why is SJW filing advice letters so soon after the Commission's decision in the general rate case? In accordance with the Commission procedures, all changes to rates, service levels, and terms governing the delivery of water service must be approved via advice letters. For example, once the Commission has issued a decision for a general rate case, it requires water utilities to submit informal requests known as advice letters to implement the rate changes. Other decisions by the Commission that affect service levels and terms must also follow the advice letter process. How can SJW help customers manage their water bills? SJW offers a comprehensive water conservation program to help customers use water more efficiently. We have informational brochures and offer free water check-ups to all customers. You can contact us to set up your complimentary home inspection to check for leaks, evaluate indoor and outdoor usage, and make recommendations on ways to use water more efficiently. Additionally, SJW offers a Water Rate Assistance Program (WRAP) for qualified low-income customers. The WRAP provides a 15 percent discount on the total water bill to customers who qualify. Will SJW seek additional rate increases? SJW is required by law to file an application once every three years for the following three-year period. As SJW's more than 2,400 miles of water mains and other infrastructure reaches the end of its life and must be continually replaced, the costs to replace that material go up. Generally, it is the cost of replacing outdated infrastructure that puts pressure on rates. Why were these increases necessary? SJW has been providing water service since 1866. Much of the water system was constructed more than 50 years ago and has reached the end of its useful life. In order to protect public health and safety and to deliver safe and reliable water service, the company must continue to replace water system components rather than waiting until failure occurs. The new rates reflect escalating operating costs and significant water system replacement costs for mains, tanks, and wells that allow the company to continue to provide safe and reliable water service. Key projects under -taken in 2018 included: • Replacing approximately 24 miles of water mains to maintain reliable service • Completely reconstructing our water treatment plant facility to maximize the use and availability of our local, low-cost, and high -quality surface water supply • Replacing and upgrading storage tanks throughout our service area to increase reliability, maintain earthquake resiliency, and improve fire protection. Safe and reliable water service is essential for maintaining public health, firefighting capability, and economic prosperity, all things that contribute to the quality of life we enjoy. Can't SJW reduce costs instead of raisin,- rates? SJW works hard to provide the highest quality water service at the lowest possible costs. There are many actions we are taking to maintain our utility: • Investing in water main replacements • Upgrading aging storage facilities like tanks and wells • Complying with more stringent water quality standards • Paying for higher water supply costs We take our commitment to our one million customers seriously and work hard to make sure we monitor costs to keep them as low as possible while still meeting the challenges of a growing population, increasingly more expensive water supplies, and an aging water system. How have costs increased compared to past years? Water system replacement costs have more than doubled in the past five years. Staffing costs to deal with new financial reporting and water quality regulations also have risen by almost 50 percent in the past five years. Wholesale water rates have increased by more than 10 percent per year over the past ten years. What has SJW done to keep rates low? SJW has an excellent track record of operating an efficient utility. Over the last five years, SJW's operating costs (including operations, maintenance, purchased power, and administrative expenses), as a percentage of overall costs, have decreased. The number of customers served per employee has remained relatively stable over the last 20 years. The company's non -revenue water loss (volume not billed as a result of leaks, theft, firefighting, and water quality activities) of less than 7 percent remains one of the industry's lowest. Where does my dollar go? About half of every dollar received from customers goes to cover costs that are beyond the control of SJW in the form of taxes and water supply costs. Other major cost drivers are shown below. Water Supply Costs (40 cents) - This portion includes costs from the Santa Clara Valley Water District for both the purchase of treated water and the charge to extract groundwater from the underground aquifer. Operating Costs (22 cents) - Your 22 cents go toward "keeping the lights on" — literally and figuratively — by funding operations, maintenance, purchased power and administrative expenses. System Improvements (22 cents) - Water infrastructure health is a major issue across the country, with our national drinking water infrastructure recently receiving a D grade from the American Society of Civil Engineers. One of the reasons for that is many municipalities allow pipes and systems to continue service past their recommended end of life. SJW works to avoid such issues by continually looking for ways to refresh its systems and improve your water service. The water utility industry is the most capital -intensive utility industry. It is very expensive to install new or replace old water mains, build new tanks, and drill new wells. SJW, as well as other water utilities, have a high level of fixed costs. During times when water sales are declining due to conservation efforts, fixed costs will still have to be recovered to maintain safe and reliable water service. How are water rates determined? The California Public Utilities Commission (CPUC), a constitutional agency headquartered in San Francisco, reviews water companies' applications for new rates. SJW submitted its rates application with CPUC in January 2018 for new rates for 2019, 2020, and 2021, based on SJW's anticipated costs. SJW's water rates remain at about a penny per gallon, making SJW one of the lowest -cost utility bills you can expect to see. Are water rates fixed? Water rates follow a formula that includes both fixed and variable components defined by the CPUC's ratemaking process. In order to make sure SJW can serve you well now and into the future, it occasionally has to adjust bills to recoup the costs of your water service when the formula produces a water bill that costs you less than it cost SJW to deliver the service — an unsustainable outcome. Rates are based on estimated water sales. If sales are lower than anticipated, adjustments may be necessary to make sure that expenses are covered. Who pays water rates when renting? That depends upon your lease agreement with your landlord. Be sure to establish in your lease who is responsible for water bills. Confusion can lead to unpaid bills, which can lead to unexpected shutoffs and back payments. How much do water rates cost per month? Water is the most capital -intensive utility industry and many factors go into calculating your water rates. The CPUC's mission is to protect utility customers and to make sure that the rates charged by all utilities are fair and reasonable. The CPUC also ensures that all necessary improvements are made to the water system and that the system is operated efficiently. The water rates charged by San Jose Water are based upon "cost of service," which means that the majority of every dollar our customers pay goes directly to system operations. The California Public Utilities Commission approved new water rates for San Jose Water customers in 2016. Water rates are increasing because San Jose Water's (SJW) costs are increasing. Much of our local water system infrastructure was constructed more than 50 years ago and has reached the end of its useful life. In order to protect public health and safety and to deliver safe and reliable water service, SJW must continue to replace and upgrade water system components such as new water mains, tanks, wells, and treatment plants. SJW has multiple projects in the works to better and more sustainably serve its customers. In January 2018, SJW filed its next General Rate Case application for the year's 2019-2021. New rates were approved by the CPUC and became effective January 1, 2019. Rate Cases General rate cases are litigated proceedings before the CPUC that establish San Jose Water's base rates for a three-year period. Pursuant to state law, San Jose Water is required to file a general rate case filing with the CPUC every three years. In the general rate case process, the CPUC sets rates to cover the costs of providing water service and to allow the company to earn a reasonable return on its investment in water system infrastructure. Major costs to operate a water system include purchased water, groundwater extraction tax, electric power, water treatment costs, and labor. The processing of San Jose Water's filing generally takes the following 12-month path: • San Jose Water reviews its historical costs, projected costs, and planned water system improvements and prepares a General Rate Case application for consideration by the CPUC. • The CPUC's Office of Ratepayer Advocates (ORA) audits San Jose Water, analyzes its application, and makes a recommendation. • The CPUC hosts a public hearing to receive input from customers on the application. Customers may also write to the CPUC. • The CPUC holds a formal hearing, which is much like a court proceeding. - • A CPUC Administrative Law Judge assigned to the application issues a proposed decision. • The CPUC Commissioners vote on the proposed decision. What are the rates authorized by the California Public Utilities Commission? • State law requires Class A water utilities like San Jose Water Company (SJW) to file a general rate case (GRC) every three years. Accordingly, SJW filed an application with the Commission for new rates effective in January of 2019, 2020, and 2021. • After a thorough and comprehensive review spanning 12 months, the Commission issued its final decision on November 29, 2018, on the three-year proposal. • Based on the Commission's Decision 18-11-025 effective January 1, 2019, SJWC's 2019 revenue requirement, which is its cost to deliver safe, high quality, and reliable water service, is increased by $16,378,000 or 4.55%. • The Commission also approved the recovery of about $27 million from SJW's Balancing and Memorandum accounts covering prior periods through September 2017. The $27 million will be recovered via two surcharges ("2019 Balancing Account Surcharge and 2019 Memorandum Account Surcharge") over a 12-month period. • The decision also authorized projected increases of $3.20% for 2020 and 3.01% for 2021. However, the rate increases for 2020 and 2021 are derived using an escalation procedure determined by the Commission. • Among the factors used to calculate rates in these years were inflation forecasts. If inflation is greater or lower than that assumed in the decision, rates for 2020 and 2021 may be higher or lower than shown in the decision. • Each of these rate changes are placed into effect thru the filing of Advice Letters for the Commission's approval. • In addition, the authorized recovery of the 2019 Balancing Account Surcharge and 2019 Memorandum Account Surcharge will add about $6.48 to the monthly bill for the typical customer for a 12-month period. • The Commission made changes to both the monthly service charge and the volume charge (per CCF). The decision allows SJW to recover approximately 67 percent of its fixed costs through the monthly service charge. This supports rate stabilization and reduces rate uncertainty for customers if usage declines below Commission projections. Your bill may also include other surcharges, taxes, and Commission fees that will affect the total bill amount. You will also continue to see a surcharge for the Water Rate Assistance Program (WRAP), which assists qualifying low-income residential households Water service will remain at about a penny a gallon — a great value considering the resources and expertise it takes to treat and deliver safe and reliable water to your tap 24 hours a day, 365 days a year. Why is SJW filing advice letters so soon after the Commission's decision in the general rate case? In accordance with the Commission procedures, all changes to rates, service levels, and terms governing the delivery of water service must be approved via advice letters. For example, once the Commission has issued a decision for a general rate case, it requires water utilities to submit informal requests known as advice letters to implement the rate changes. Other decisions by the Commission that affect service levels and terms must also follow the advice letter process. How can SJW help customers manage their water bills? SJW offers a comprehensive water conservation program to help customers use water more efficiently. We have informational brochures and offer free water check-ups to all customers. You can contact us to set up your complimentary home inspection to check for leaks, evaluate indoor and outdoor usage, and make recommendations on ways to use water more efficiently. Additionally, SJW offers a Water Rate Assistance Program (WRAP) for qualified low-income customers. The WRAP provides a 15 percent discount on the total water bill to customers who qualify. Will SJW seek additional rate increases? SJW is required by law to file an application once every three years for the following three-year period. As SJW's more than 2,400 miles of water mains and other infrastructure reaches the end of its life and must be continually replaced, the costs to replace that material go up. Generally, it is the cost of replacing outdated infrastructure that puts pressure on rates. Why were these increases necessary? SJW has been providing water service since 1866. Much of the water system was constructed more than 50 years ago and has reached the end of its useful life. In order to protect public health and safety and to deliver safe and reliable water service, the company must continue to replace water system components rather than waiting until failure occurs. The new rates reflect escalating operating costs and significant water system replacement costs for mains, tanks, and wells that allow the company to continue to provide safe and reliable water service. Key projects under -taken in 2018 included: • Replacing approximately 24 miles of water mains to maintain reliable service • Completely reconstructing our water treatment plant facility to maximize the use and availability of our local, low-cost, and high -quality surface water supply • Replacing and upgrading storage tanks throughout our service area to increase reliability, maintain earthquake resiliency, and improve fire protection. Safe and reliable water service is essential for maintaining public health, firefighting capability, and economic prosperity, all things that contribute to the quality of life we enjoy. There are many actions we are taking to maintain our utility: • Investing in water main replacements • Upgrading aging storage facilities like tanks and wells • Complying with more stringent water quality standards • Paying for higher water supply costs We take our commitment to our one million customers seriously and work hard to make sure we monitor costs to keep them as low as possible while still meeting the challenges of a growing population, increasingly more expensive water supplies, and an aging water system. Now have costs increased compared to past years? Water system replacement costs have more than doubled in the past five years. Staffing costs to deal with new financial reporting and water quality regulations also have risen by almost 50 percent in the past five years. Wholesale water rates have increased by more than 10 percent per year over the past ten years. What has SJW done to keep rates low? SJW has an excellent track record of operating an efficient utility. Over the last five years, SJW's operating costs (including operations, maintenance, purchased power, and administrative expenses), as a percentage of overall costs, have decreased. The number of customers served per employee has remained relatively stable over the last 20 years. The company's non -revenue water loss (volume not billed as a result of leaks, theft, firefighting, and water quality activities) of less than 7 percent remains one of the industry's lowest. Where does my dollar go? About half of every dollar received from customers goes to cover costs that are beyond the control of SJW in the form of taxes and water supply costs. Other major cost drivers are shown below. Water Supply Costs (40 cents) - This portion includes costs from the Santa Clara Valley Water District for both the purchase of treated water and the charge to extract groundwater from the underground aquifer. Operating Costs (22 cents) - Your 22 cents go toward "keeping the lights on" — literally and figuratively — by funding operations, maintenance, purchased power and administrative expenses. System improvements (22 cents) - Water infrastructure health is a major issue across the country, with our national drinking water infrastructure recently receiving a D grade from the American Society of Civil Engineers. One of the reasons for that is many municipalities allow pipes and systems to continue service past their recommended end of life. SJW works to avoid such issues by continually looking for ways to refresh its systems and improve your water service. The water utility industry is the most capital -intensive utility industry. It is very expensive to install new or replace old water mains, build new tanks, and drill new wells. SJW, as well as other water utilities, have a high level of fixed costs. During times when water sales are declining due to conservation efforts, fixed costs will still have to be recovered to maintain safe and reliable water service. How are water rates determined? The California Public Utilities Commission (CPUC), a constitutional agency headquartered in San Francisco, reviews water companies', applications for new.rates. SJW submitted its rates application with CPUC in January 2018 for new rates for 2019, 2020, and 2021, based on SJW's anticipated costs. SJW's water rates remain at about a penny per gallon, making SJW one of the lowest -cost utility bills you can expect to see. Are water rates fixed? Water rates follow a formula that includes both fixed and variable components defined by the CPUC's ratemaking process. In order to make sure SJW can serve you well now and into the future, it occasionally has to adjust bills to recoup the costs of your water service when the formula produces a water bill that costs you less than it cost SJW to deliver the service — an unsustainable outcome. Rates are based on estimated water sales. If sales are lower than anticipated, adjustments may be necessary to make sure that expenses are covered. Who pays water rates when renting? That depends upon your lease agreement with your landlord. Be sure to establish in your lease who is responsible for water bills. Confusion can lead to unpaid bills, which can lead to unexpected shutoffs and back payments. How much do water rates cost per month? Our rates continue to go up even though citizens make conscious efforts to use less water. In April 2019, the Monte Sereno City Council sent a unanimous protest letter to the CPUC specifically to protest a $9 million request from San Jose Water Company for cost recovery. A Proposed Resolution W-5210 denying this increase is scheduled to appear on the December 19th CPUC Agenda (ID 17946). The Commission will determine whethqr they will adopt this request. Re: Proposed Resolution W-5210 Dear CPUC Water Division members, I am writing to protest the $9 million request from the San Jose Water Company for cost recovery. As a citizen committed to fiscal fairness and water conservation, I am concerned about major rate increases over the past few years. Although my water usage has decreased because of my household conservation efforts, I have seen my rates increase dramatically. For example, my service charge has more than doubled from $35.40 in December 2013 to $79.00 today. We are using less water but paying more. My charges for 20 CCF per 3-month period in 2013 was $99 while for a 3-month period this summer and fall when my usage was only 13 CCF, the bill was $144.17. Many of my neighbors in Los Gatos, Saratoga, and Monte Sereno report exorbitant water bills that make no logical sense. At the same time, I have heard of San Jose Water giving major raises to their corporate executives. As a California citizen, I am concerned about potential fraud by San Jose Water. I strongly recommend a forensic audit by an objective outside agency so we can understand what lies behind these rate increases and ensure that California citizens are treated more fairly by their public utility. Never considered in decision. 3) Impact of the approved proposals and rates did not take into consideration health issues of seniors or people with special needs that use more water due to health issues. 4) Most people on fixed income will be hurt in every way with these outrageous rates and meter service changes. 5) San Jose Water officer increase in compensation, adding over 23 new positions, overtime pay, medical expenses, dental expenses, legal services, due to increases in water service, healthcare cost, pension expense. We the rates payers are all paying for their high pay, benefit programs $5,300,000 increase. 6) Tiered rates are unfair and excess charge per unit are too high. 7) The rate setting proceeding included cost of service, sales payroll expenses and many other general expenses, so putting everything together for approval at the CPUC makes the rate for water and meter service charge not the important issue at all! Asking for approval for all their benefits needs to run a profitable business first at the expense of rate -payers. Knowing water is life the rate payers have no choice. The duty of the CPUC is to protect the rate -payers and ask for fair and reasonable charges at all levels. The answer is to have a forensic audit of San Jose Water Co, San Jose Water Group, and Santa Clara Water District. To my knowledge a real forensic audit has never been done and that is outrageous. We the public need a real audit -forensic. That would change the disposition of my complaint for sure — Real facts exposed.
