The 2020/2021 Commission Work Plan Study Session will be held on March 9, 2020,
starting at 6:00 p.m. in the Senior Center.
HPC is schduled to meet with Council at 7:45 p.m, however, this time may change a
regular agenda will be sent out the week before the meeting. Each Commission will
be given 25-30 minutes with the City Council. It is not required to attend the entire
evening, although you are welcome to do so.
Dinner will be provided at the beginning of the meeting and snacks and beverages
will be available throughout the meeting.

Subject: Heritage Preservation Commission Work Plan – FY 19/20
On January 8, 2019 and February 12, 2019, the Heritage Preservation Commission (HPC)
held their regularly scheduled meetings. During the meetings, the HPC discussed their
upcoming 2019/2020 work plan.
1. Increase and update Heritage Resource Inventory- Continue their duty as HPC
commissioners to recommend and add residences, commercial structures, districts, and lanes
onto the Heritage Resource Inventory. This fiscal year, the HPC has so far added three (3)
sites to the Heritage Resource Inventory. There are currently 30 sites for consideration to be
included on the inventory.
2. Plaques/Point of Interest Markers - To properly recognize heritage resources and
properties of special interest in our City, the HPC would like to continue recommending to
Council special sites that warrant a Point of Interest Marker, providing plaques to designated
Landmark sites, and reinstate awarding plaques to sites that contain designated Heritage
Trees. This fiscal year, no Point of Interest Markers have so far been considered. There are
currently five (5) sites for consideration of a Point of Interest Marker. No plaques have been
considered for this fiscal year.
3. Public Outreach – Continue to participate in City events such as the Blossom Festival, Arbor
Day, Historic Preservation Month, the State of the City, and provide information about the
Commission at these events.
4. Continuing Education - The City of Saratoga is a Certified Local Government (CLG)
recognized by the State of California Office of Preservation (OHP). The CLG requires that
all commissioners receive annual training in Historic Preservation.
5. Heritage Lane City Code Amendment- Currently the HPC has the responsibility to review
and comment upon all applications for building, demolition, grading or tree removal permits
involving work to be performed upon or within a designated historic landmark, heritage lane
or historic district, and all applications for tentative map approval, rezoning, building site
approval, use permit, variance approval, design review or other approval pertaining to or
significantly affecting any heritage resource. City staff recently discussed the duties of the
HPC with the City Attorney for clarification. It was determined that the HPC had the
authority to only review building, demolition, grading or tree removal permits that were upon
or within the public right-of-way of the heritage lane portion of Saratoga Avenue.
The HPC is requesting that City Code Sections 13-05.020 and 13-10.040 be amended so that
building, demolition, grading and tree removal permits on private property adjacent to the
heritage lane portion of Saratoga Avenue also be required to be reviewed by the HPC
(Attachment 1).
6. Saratoga Avenue (Heritage Lane) Inventory- Review, update, video and inventory of all the
homes, fences and trees along the portion of Saratoga Avenue that is designated as Heritage
Lane, for potential to add to the City’s Heritage Resource Inventory. This project may require
a professional videographer.
7. Heritage Orchard Master Plan – As part of the City’s process in updating the Heritage
Orchard Master Plan, review the goals and polices in the 2001 Heritage Orchard Master Plan,
update accordingly and work on the long-term management of the orchard.
8. War Memorial Arch – Provide the required documentation to include Saratoga’s War
Memorial Arch located in Blaney Plaza, as part of the World War I Memorial Inventory Project
(WWIMIP) which is an online inventory of World War I memorials and monuments in the
United States and U.S. territories. The WWIMIMIP is working in partnership with the United
States World War I Centennial Commission. A Mobile Application has been established to
invite and enable public participation in locating, documenting, and providing a preliminary
condition assessment of all the World War I memorials and monuments in the United States.
9. Village Inventory-Review, update, video and inventory the buildings facing Big Basin Way
for historical significance. This project may require a professional videographer.
Notable Accomplishments in fiscal year 2018/2019
During fiscal year 2018/2019, in addition to placing three (3) properties on the Heritage Resource
inventory, the HPC reviewed five (5) projects along a Heritage Lane (Saratoga Avenue), and two (2)
planning applications. In addition, the HPC attended two (2) training webinars.

Heritage Preservation Commission Powers and Duties (City Code Section 13-10.040)
The Heritage Commission shall be advisory only to the City Council, the Planning Commission and
the agencies and departments of the City and shall establish liaison and work in conjunction with such
authorities to implement the purposes of this Chapter. The Heritage Commission shall have the
following powers and duties:
a) Conduct, or cause to be conducted, a comprehensive survey of properties within the boundaries
of the City for the purpose of establishing the Heritage Resource Inventory. To qualify for
inclusion in the Heritage Resource Inventory, a property must satisfy any one or more of the
criteria listed in Section 13-15.010 of this Chapter. The Inventory shall be publicized and
periodically updated, and a copy thereof shall be kept on file in the Planning Department.
b) Recommend to the City Council specific proposals for designation as a historic landmark,
heritage lane or historic district.
c) Recommend to the appropriate City agencies or departments projects and action programs for
the recognition, conservation, enhancement and use of the City's heritage resources, including
standards to be followed with respect to any applications for permits to construct, change,
alter, remodel, remove or otherwise affect such resources.
d) Review and comment upon existing or proposed ordinances, plans or policies of the City as
they relate to heritage resources.
e) Review and comment upon all applications for building, demolition, grading or tree removal
permits involving work to be performed upon or within a designated historic landmark,
heritage lane or historic district, and all applications for tentative map approval, rezoning,
building site approval, use permit, variance approval, design review or other approval
pertaining to or significantly affecting any heritage resource. The Commission’s comments
shall be forwarded to the City agency or department processing the application within thirty
days after receiving the request for such comments.
f) Investigate and report to the City Council on the availability of federal, state, county, local or
private funding sources or programs for the rehabilitation and preservation of heritage
resources.
g) Cooperate with county, state and federal governments and with private organizations in the
pursuit of the objectives of heritage conservation.
h) Upon the request of a property owner or occupant and at the discretion of the Heritage
Commission, render advice and guidance on the conservation, rehabilitation, alteration,
decoration, landscaping or maintenance of any heritage resource; such voluntary advice and
guidance shall not impose any regulation or control over any property.
i) Participate in, promote and conduct public information and educational programs pertaining
to heritage resources.
j) Perform such other functions as may be delegated to it by resolution or motion of the City
Council.

Subject: Background information – Heritage Lane proposed ordinance amendment
In 2018, Saratoga City staff and the HPC conducted research on the history and definition of a Heritage
Lane. As a result of this effort to clarify HPC’s role regarding Heritage Lanes, the HPC recommends
that commissioners work with City staff to propose amendments to the City Code under section 13-
05.020 – Definitions and section 13-10.040 – Powers and duties.
The 1981 ordinance that created the Heritage Preservation Commission included the concept of a
Heritage Lane, as a way to “preserve the width and appearance of roads associated with Saratoga’s
earlier development.” Records from City Council meetings held that year include concern regarding
the “limited scope of ordinance with respect to Heritage Lanes” and that “Heritage Lanes were not
adequately defined by the ordinance.”
A July 26, 1991 memo to the City Council from then Planning Director Steve Emslie summarized the
characteristics of the Saratoga Avenue Heritage Lane as “two traffic lanes lined by old trees and
homes,” and further stated that “Measures such as maintenance of the street width and existing
vegetation as well as preservation of historic homes may be addressed in the ordinance to preserve the
historic street character.”
The amendment to the Heritage Lane ordinance proposed by the HPC exemplifies the City’s
commitment to preserving the historic character of a Heritage Lane, and is consistent with the DPR for
the Saratoga Avenue Heritage Lane, which notes that “properties on both sides of the street” are
“Related Features.”
Heritage Preservation Commission powers and duties include “Review and comment upon all
applications for building, demolition, grading or tree removal permits involving work to be performed
upon or within a designated historic landmark, heritage lane or historic district, and all applications for
tentative map approval, rezoning, building site approval, use permit, variance approval, design review
or other approval pertaining to or significantly affecting any heritage resource.” Historically, the HPC
and the Planning Department have taken this code to mean that the commission should review and
provide recommendations regarding structures adjacent to the lane, since properties bordering the lane
are “related features” and there are no buildings located on the road itself.
A June 12, 2018 memo from Sandy Baily, Special Projects Manager for the City of Saratoga, noted
“confusion and interpretation inconsistencies by City staff and the HPC regarding HPC’s role in
reviewing work along the heritage lane portion of Saratoga Avenue,” and that “staff has determined
that the City Code regulates HPC review for work done only within the public right-of-way of a heritage
lane, not beyond the limits of the right-of-way.”
An August 18, 2018 memo from the City Attorney’s office notes that since 2005, the HPC has reviewed
both Building Applications, as well as Planning Applications for development along the Saratoga
Avenue Heritage Lane, although it has primarily approved Planning Applications. It is unknown if
there were Building Applications along Saratoga Avenue that the HPC did not review. According to
the City Attorney, “the HPC has authority to review and comment on Building Applications as long as
such applications concern work “upon or within” a heritage lane. With regard to Planning Applications,
the HPC has the authority to review and comment on such work to the extent such work is “pertaining
to or significantly affecting” any heritage lane.
Attachment 1
An amended Heritage Lane ordinance will clarify the definition of a Heritage Lane and be consistent
with past HPC review practices. Residents whose houses border Saratoga Avenue will not face the
confusion of a perceived change in how Building and Planning Applications are reviewed and they can
continue to view their properties as being part of a Heritage Lane vs. being located adjacent to a
Heritage Lane.

Item 7a-18/19 Certified Local Government report
The 1980 amendments to the National Historic Preservation Act of 1966, as
amended, provided for the establishment of a Certified Local Government Program
(CLG) to encourage the direct participation of local governments in the identification,
evaluation, registration, and preservation of historic properties within their
jurisdictions and promote the integration of local preservation interests and
concerns into local planning and decision-making processes. The CLG program is a
partnership among local governments, the State of California (OHP), and the National
Park Service (NPS) which is responsible for administering the National Historic
Preservation Program.
As part of CLG reporting requirements, each year CLG's submit an annual report to
help the OHP track the local preservation program's ongoing activities. Annual
reports for October 1, 2018 - September 30, 2019 are due no later than April 17, 2020.

MEMORANDUM
MEETING DATE: February 11, 2020
TO: Heritage Preservation Commission (HPC)

SUBJECT: Item 6b-“A deep Dive into the Secretary of Interior’s Standards”
On February 20, 202 the Californa Presrevation Foundation is holding a workstop
titled “A Deep Dive into the Secretary of Interior’s Standards” in Mountain View from
9 a.m to 4 p.m.
This workshop will discuss the application of the Secretary of the Interior Standards
(SOIS) by leading preservation professionals, planners, architects and others. Case
studies will also be analyzed and discussed by workshop participants to practice
applying the standards to a variety of buildings, structures, objects and cultural
landscapes. The workshop will conclude with a walking tour of nearby historic
resources to discuss the SOIS as well.
Currently the proposed four POI markers will consume the entire HPC budget. If HPC
members wish to attend, in order to pay for the tranining, at least one proposed POI
marker will need to be removed and added to the next fiscal year budget.
Existing Conditions, Issues and Assumptions
1. Preservation of the Orchard
Existing Conditions: The Heritage Orchard is the only park in the City of Saratoga that
preserves and celebrates Saratoga’s rich agricultural history. The property is zoned R-1-
20,000 and the Land Use designation is Open Space-Managed Resource Protection
(OS-MR).
Issues: The site does not have adequate city or state recognition for preservation. The
public has limited knowledge and is not engaged in its preservation.
Assumptions: The orchard will be secured for future generations. There will be outreach
programs and events, such as the Blossom Festival, to engage the public and gain their
continued appreciation of the land usage and history.
2. Size and Use of the Orchard
Existing Conditions: The orchard is composed of approximately 13.9 acres and consists
of fruit trees that produce fruit crops that are grown for sale by the orchardist.
Issues: Any use, such as educational opportunities, community events, marketing
efforts and campaigns could impact the health of the trees and the harvesting and
distribution/sale of the fruit. The property survey is outdated.
Assumptions: Decisions to place structures in the orchard, or community uses of the
orchard must consider the impact these changes might have on the current health or
the future number of trees in the orchard.
3. Inventory of Trees
Existing Conditions: Approximately 1,400 fruit trees grow in the orchard, consisting of
apricot, prunes and cherry trees. There are some mature coast live oak trees growing
among the fruit trees. (The City is responsible for the care of the oak trees.)
Issues: The non-orchard, oak trees and other tree types may provide habitat for wildlife
living in this area. These non-orchard trees may be threatening the health of the fruit-
bearing orchard trees.
Assumptions: If and when a non-orchard tree dies or needs to be removed, it will be
replaced with an orchard tree. The City would continue annual thinning and caring for all
non-orchard trees.
4. Orchard Maintenance
Existing Conditions: There is a monthly maintenance chart that includes the tasks
performed each month.
Issues: No herbicides are allowed, but fungicide use is okay until an organic substitute
is developed.
Assumptions: It is assumed that all orchard maintenance will adhere to the
requirements in the SCOPE OF WORK section of the current maintenance contract with
the current orchardist. Orchard management will work toward natural farming over time.
5. Tree Irrigation
Existing Conditions: The City of Saratoga currently has a well in the orchard which is
used to irrigate the trees. An above-ground sprinkler system is currently installed.
Issues: The current system is inadequate.
Assumptions: An updated irrigation system, such as a system that allows cross-discing
will be installed.
6. Climate and Air Quality
Existing Conditions: Given climate change, the area will continue to see warmer days and drier
conditions.
Issues: Air quality is an issue, for both trees and visitors.
Assumptions: Climate and air quality will be considered when planning for the continued health
of the trees and when timing educational activities and events in the orchard.
7. Soil Conditions
Existing Conditions: The soil in the orchard is a dry, clay type of soil. Weeds are
managed with mowing and manual weed whacking.
Issues: The quality of the soil in the orchard is impacted by climate, human and animal
interactions, fertilizers, water and conservation efforts.
Assumptions: An evaluated and annually updated maintenance plan will be
implemented and followed. Soil nutrients and fertilization will be introduced when testing
shows that it is necessary to properly care for the trees. A more adequate system such
as cross-discing will be installed.
8. Pedestrian Pathways
Existing Conditions: There is currently one path of travel into the orchard, from the
southern corner of the orchard at Fruitvale Avenue, to the library.
Issues: The current path, along with any additional paths constructed to link visitors with
a future structure, may impact the health of the orchard.
Assumptions: Pedestrian paths in the orchard shall have minimal impact on the natural
appearance of the orchard and not interfere with maintenance. Pedestrian access
through the orchard should be limited to hard-packed, dirt paths created by dragging or
rolling a disced area to create an even smoother surface. Paths will need to be
recreated each year.
9. Wildlife and Domesticated Animals
Existing Conditions: The existing orchard provides a habitat for a variety of local wildlife,
including coyotes, deer, bobcats, raccoons, skunks, opossums, birds, squirrels and
gophers.
Issues: Wildlife causes serious problems to the trees and their fruit. The orchard
currently has a serious ground squirrel problem (and has for the past five years) that
needs to be addressed. New trees cannot be planted until the issue with the ground
squirrels is under control.
Assumptions: Proper precautions must be used to deter unwanted wildlife at all times
with an ongoing abatement plan. Signs will be placed to support the city’s policy with
regard to pets being on a leash.
10. Security
Existing Conditions: The orchard is not fenced. There are signs asking people not to
pick the fruit.
Issues: When fruit is removed from the orchard it decreases the amount of fruit
available and could cause damage to the trees. People walking off the paths and taking
the fruit could damage the trees and the soil.
Assumptions: Programs will be introduced to educate the public. Permanent signs will
be installed to deter the public from picking the fruit.
11. Adjacent Properties
Existing Conditions: The site is bounded by Saratoga Avenue to the North, Fruitvale
Avenue to the East, Wildcat Creek to the South and Sacred Heart Catholic Church and
School to the West.
Issues: Any increased community involvement in the orchard could impact the
surrounding properties.
Assumptions: A communication network with the adjacent properties be adopted to
assure that there are not event date conflicts with orchard events.
12. Structures
Existing Conditions: Currently there are no buildings in the orchard.
Issues: The addition of a structure will impact the number of trees possible in the
orchard.
Assumptions: With the addition of an appropriate agricultural structure, programs would
be incorporated to promote education and the engagement of the community.
13. Utilities
Existing Conditions: There are no public utilities in the orchard.
Issues: There are no public restrooms, other than those found in the library. People
attending educational events will need restroom facilities. There is currently no drinkable
water in the orchard for visitors participating in educational activities or events held in the
orchard.
Assumptions: If an agricultural structure is added there will eventually be public
restrooms and utilities brought to the structure to support this addition. The library
restrooms are not an adequate option. For any utilities (water, sewer and electrical lines,
etc.) brought into the orchard area, the HPC expects those managing the placement of
such lines will be mindful of the location, so they will not impact the success and
operations of the orchard.
14. Entrance Signage
Existing Conditions: There is not adequate signage at the orchard entrance.
Issues: The entrance signage that was approved by the council in 2007 was never
installed. (See Exhibit 8)
ANNETTE’S COMMENT: This signage should be reviewed again-- I am not sure it was approved.
Personally I think there are two entrances to the Heritage Orchard-- one at the beginning and one at the
ending of the path through the orchard. Additionally the Heritage Orchard could be advertised on the corner
as proposed. The two signs on either end of the path would be smaller than the one proposed for the corner.
Get rid of the redwood sign saying Central Park!
Assumptions: That the signage that was approved in 2007 for the corner of Saratoga
and Fruitvale Avenues be installed after updating and including lighting. National
Register of Historic Places
15. Parking, Traffic and Transit
Existing Conditions: The Saratoga Library includes a parking lot at the edge of the
orchard.
Issues: The library is often crowded and the parking lot can fill. During the Blossom
Festival, cars also park along Saratoga and Fruitvale avenues creating parking issues.
Assumptions: Parking to accommodate visitors to the orchard needs to be assessed.
That letters will continue to be sent prior to the Blossom Festival and other events to
alert West Valley College, St. Andrews, Sacred Heart, Redwood Middle School etc. of
the event. That a communication system be adopted to communicate with these
properties to be sure there are no conflicting events. *NOTE: At West Valley College
the process is very simple; fill out the form and get an entire lot for $20.
A communication plan should be in place to ensure that there would not be major events
scheduled on the same date with adjacent properties.
RECOMMENDATIONS (PRIORITY AND NUMBER THIS LIST)
Manage ground squirrels and pests that may threaten new trees.
Update the irrigation system.
Implement a tree numbering system to keep better records on each tree and to assist when an
“Adopt-A-Tree Program” is initiated.
Create a timeline to replace the current dead/diseased trees.
Create educational programs that engage the community in the preservation of its heritage
orchard.
Add an agriculture structure (such as but not limited to a barn) to educate and engage the
community.
Install the stone signage (Exhibit 8) at front of Orchard, on the corner of Saratoga and Fruitvale
Avenues, which was approved by the City Council in 2007.
Provide signage within the orchard for history, pet requirements, etc. (Exhibit 9).
Maintain existing paths and mindfully add paths if a new structure is installed to ensure that the
health of the trees is not threatened.
Request the orchardist to report annually to the HPC on the health of the trees, based on annual
orchard maintenance tasks and numbered tree records.
Implement the Adopt-A-Tree program recommended in the 2001 plan.
Have an Annual “Harvest Day” to engage the community. Saratoga Residents would be allowed
to pick the fruit on “Harvest Day.”
In the future, replace all dead/diseased trees, at the proper time, in the year that they die. Thus,
not a large number of dead trees would be in the orchard at any given time. (This would greatly
improve the overall appearance of the orchard.)
Introduce education programs that will create a better relationship between the orchardist and
the community to ensure the security of the orchard.
Agree on the name either Central Park or Heritage Orchard-- and post on the website and all
maps accordingly. The name Central Park is very confusing.
Paths will need to be recreated each year.
