A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA
AUTHORIZING THE CITY MANAGER, ASSISTANT CITY MANAGER, OR RISK
MANAGER TO SUBMIT APPLICATIONS TO THE FEDERAL EMERGENCY
MANAGEMENT AGENCY AND THE STATE OF CALIFORNIA OFFICE OF
EMERGENCY SERVICES OR ANY OTHER FEDERAL OR STATE AGENCIES AS
NECESSARY TO APPLY FOR DISASTER ASSISTANCE OR RELATED FUNDING,
TO ACCEPT FUNDS IF AWARDED, AND TO NEGOTIATE AND EXECUTE ALL
RELATED DOCUMENTS TO SUPPORT THE CITY'S RESPONSE AND RECOVER
UNDER THE NOVEL CORONAVIRUS PANDEMIC
WHEREAS, on February 10, 2020, the County of Santa Clara declared a local health
emergency and proclaimed a local emergency due to the spread of the novel coronavirus (named
"COVID-19"); and
WHEREAS, on March 4, 2020, the Governor declared an emergency due to the spread
COVID-19; and
WHEREAS, on March 18, 2020, the City Council of the City of Saratoga adopted
Resolution 20-010 confirming and affirming the existing of a local emergency due to the spread
of COVID-19; and
WHEREAS, on March 22, 2020, the President of the United States declared the State of
California as a major disaster area for the COVID-19 pandemic; and
WHEREAS, the federal disaster declaration triggered the release of public assistance
funding under the Robert T. Stafford Disaster Relief and Emergency Assistance Act to supplement
the efforts of state and local agencies responding to COVID-19 pandemic impacts; and
WHEREAS, Federal Emergency Management Agency (FEMA) public assistance
funding, administered through the State of California Office of Emergency Services (CalOES), is
currently available to the City for potential reimbursement of various COVID-19 expenditures,
such as emergency operations; and
WHEREAS, on April 15, 2020, the City Council adopted a resolution designating by title
the City Manager, Assistant City Manager, and Risk Manager as the City of Saratoga's designated
agents to execute for and on behalf of the City of Saratoga the City's application for disaster relief,
and to file it with CalOES for the purpose of obtaining certain federal financial assistance under
Public Law 93-288 as amended by Robert T Stafford Disaster Relief and Emergency Assistance
Act of 1998, and/or state financial assistance under the California Disaster Assistance Act; and
WHEREAS, the City could also qualify for additional disaster relief funding from other
federal and state agencies that may become available in the future; and
NOW, THEREFORE BE IT RESOLVED THAT the City Council of the City of Saratoga does
hereby authorize the City Manager, Assistant City Manager, and Risk Manager to submit
applications to the State of California Office of Emergency Services, Federal Emergency
Management Agency, the U.S. Department of Treasury and including, without limitation, other
federal and state agencies as necessary to apply for disaster assistance ore related funding, to accept
funds if awarded and to negotiate and execute all related documents to support the City's response
and recovery from the COVID-19 pandemic.
The above and foregoing resolution was passed and adopted at a special meeting of the Saratoga
City Council held on the 15th day of April 2020 by the following vote:
