A RESOLUTION DISSOLVING
ASSESSMENT DISTRICTS KNOWN AS
ZONES 4, 5, 7, AND 24
FROM THE CITY OF SARATOGA
LANDSCAPING AND LIGHTING ASSESSMENT LLA-1 PURSUANT
TO THE LANDSCAPING AND LIGHTING ACT OF 1972
WHEREAS, the City Council has, over time, formed individual assessment districts,
denoted as "Zones," which the City Council manages under the umbrella of Landscaping and
Lighting District LLA-1;
WHEREAS, the City formed, has treated, and continues to treat each Zone as an
independent assessment district;
WHEREAS, Zone 4 consists of that assessment district known as the Quito Lighting
District;
WHEREAS, Zone 5 consists of that assessment district known as the Azule Lighting
District;
WHEREAS, Zone 7 consists of that assessment district known as the Village Lighting
District;
WHEREAS, Zone 24 consists of that assessment district known as the Village
Commercial Landscape Maintenance District;
WHEREAS, the City does not levy assessments on Zones 4, 5, 7, or 24, but instead
allocates a portion of the property tax paid in said Zones to fund certain lighting and landscaping
improvements and maintenance within said Zones;
WHEREAS, the City Council desires to dissolve of Zones 4, 5, 7, and 24, which Zones
include lighting improvements and maintenance of parking and landscaping facilities that the
City intends to support from its general fund.
NOW, THEREFORE, it is hereby found, determined and ordered, as follows:
1. The public interest and convenience require the dissolution of Zones 4, 5, 7, and
24 pursuant to the provisions of the Landscaping and Lighting Act of 1972, Part 2, Division 15
of the Streets and Highways Code of the State of California. Said Zones are independent
assessment districts which together comprise a portion of the assessment district designated as
"City of Saratoga Landscaping and Lighting District LLA-1," the exterior boundaries of which
are the composite and consolidated areas as more particularly described on a map thereof on file
in the office of the Clerk of said City and attached hereto as "Attachment 1," to which reference
is hereby made for further particulars. Said map indicates by a boundary line the extent of the
territory included in the district and of any Zone thereof and the general location of said district.
The following are descriptions of the Zones dissolved:
a. Zone 4 (Quito Lighting District) Street lighting and landscape maintenance in the El
Quito Park residential neighborhood: Tracts 669, 708, 748, 6785, 7833
and 8700.
b. Zone 5 (Azule Lighting District) Street lighting in the Azule Crossing residential
neighborhoods: Tracts 184, 485, 787, 1111, and 1800.
C. Zone 7 (Village Lighting District) Street lighting in four separate residential
neighborhoods surrounding Saratoga Village, and in Saratoga Village.
Includes all or a portion of Cunningham Acres, La Paloma Terrace, Mary
Springer # 1 and #2, McCartysville, Saratoga Park, Williams, and Tracts
270, 336, 416, 2399, 2502, 4477, 5350, 5377, 5503, 5676, 6419, 6431 and
Saratoga Village.
d. Zone 24 (Village Commercial Landscape Maintenance District) Routine maintenance of
Village Parking Districts 1-4 and Big Basin Way landscaping.
2. On April 15th, 2020 the City Council adopted Resolution Number 20-018
declaring its intent to consider dissolution of Zones 4, 5, 7, and 24 and calling a public hearing
on the matter.
3. On Wednesday, the 17th day of June, 2020, the City Council held a duly noticed
public hearing on the question of the dissolution of Zones 4, 5, 7, and 24. At said hearing the
City Council accepted testimony given by all interested persons regarding the dissolution of
Zones 4, 5, 7, and 24 and received no objections to the dissolution.
4. The assessment districts known as Zones 4, 5, 7, and 24 are hereby dissolved
pursuant to the provisions of the Landscaping and Lighting Act of 1972, Part 2, Division 15 of
the Streets and Highways Code of the State of California. The services previously provided by
those assessment districts shall henceforth be provided by the City of Saratoga. In accordance
with section 22610 of the Streets and Highways Code, any moneys in the improvement fund for
the districts shall be transferred to the general fund of the City of Saratoga.
5. The City Manager or the Manager's designee is authorized to execute any
documents and take any other actions necessary to effectuate the dissolution of the districts.
Passed and adopted by the City Council of the City of Saratoga, California, at a meeting
thereof held on the 171h day of June, 2020, by the following vote of the members thereof:
