•No changes are proposed to the existing building or the site

Recommendation
Adopt a Resolution approving a Conditional Use Permit,and Lot Merger/Lot Line
Adjustment subject to conditions of approval.
Introduce and waive the first reading of the attached ordinance to remove the Planned-
Combined (P-C)District designation from the merged parcel created from a parcel
located at 14434 Oak Street and a portion of a parcel located at 14488 Oak Street that is
subject to the Conditional Use Permit.
Direct staff to place the ordinance on the Consent Calendar for adoption on July 1,2020.

Background
•November 5,2014 -A Zoning Ordinance Amendment was approved by City
Council to add a Planned Combined (P-C)District zoning overlay to three
adjoining parcels with an underlying residential zoning designation of R-1-
10,000 in order to modify the development standards for the sites located
at 14434 Oak St.,14488 Oak St.,and 20400 Saratoga -Los Gatos Rd.
•At that time the three parcels were owned by Our Lady Fatima Villa,Inc.The
two adjacent parcels located at 14434 &14488 Oak St.are now under
separate ownership by Our Lady Fatima Villa Foundation,while 20400
Saratoga -Los Gatos Road is under new ownership by CTR Partnership,L.P.
Proposal
•Zoning Ordinance Amendment -Removal of the Planned Combined (P-C)
District from two adjacent parcels located at 14434 &14488 Oak St.The
zoning of the two parcels would revert back to R-1-10,000.
•Conditional Use Permit -As a result of removing the P-C District from 14434
&14488 Oak St,approval of a Conditional Use Permit is required in order to
maintain the existing Community Facility Use located at 14434 Oak St.
•Lot Merger/Lot Line Adjustment -Merge 14434 &14488 Oak St.to
consolidate the 2 parcels under ownership by OLFV Foundation.Adjust lot
line to allow parking stalls,which are used by The Villas at Saratoga,to be
under the ownership of CTR Partnership,L.P.
P-C District Findings

1.The proposed location of the planned combined district is in accord with the objectives
of the General Plan and the purposes of the zoning district in which the site is located.
2.The standards for the development will result in an aesthetic asset to the community
and produce an environment of stable and desirable character consistent with the
overall objectives of the General Plan and Zoning Ordinance.
3.The uses in the development will complement each other and will not adversely affect
existing and proposed land uses in the vicinity or the public health,safety and welfare.
4.The application of the combined district furthers two or more of the purposes
contained within Section 15-16.010.
Conditional Use Permit Findings

a. That the proposed location of the conditional use is in accord with the objectives of the
Zoning Ordinance and the purposes of the district in which the site is located.
b. That the proposed location of the conditional use and the conditions under which it
would be operated or maintained will not be detrimental to the public health, safety or
welfare, or materially injurious to properties or improvements in the vicinity.
c. That the proposed conditional use will comply with each of the applicable provisions of
this Chapter.
d. That the proposed conditional use will not adversely affect existing or anticipated uses
in the immediate neighborhood, and will not adversely affect surrounding properties
or the occupants thereof.
Lot Line Adjustment Findings

1.The proposed lot line adjustment is consistent with the General Plan and any
applicable specific plan.
2.The proposed lot line adjustment is consistent with the regulations contained in the
Zoning Ordinance, the Building Ordinance and this Chapter.
3.The proposed lot line adjustment will not conflict with easements, acquired by the
public at large for access through or use of the subject properties.
4.The lot line adjustment is between four or fewer existing, adjoining lots.
Requirements for Parcel Merger
14-65.010
A parcel or unit of land may be merged with a contiguous parcel or unit of land held by the same
owner if any one of such parcels or units does not conform to the applicable standard for minimum
site area as prescribed in the Zoning Ordinance, and all of the following requirements are satisfied:
(a) At least one of the affected parcels is undeveloped by any structure for which a building
permit was issued or for which a building permit was not required at the time of construction,
or is developed only with an accessory structure or accessory structures, or is developed with
a single structure other than an accessory structure that is also partially sited on a contiguous
parcel or unit.
(b) With respect to any affected parcel, one or more of the following conditions exist:
(7) The parcel is inconsistent with the General Plan and any applicable specific plan, other
than minimum lot size or density standards.
(c) For purposes of determining whether contiguous parcels are held by the same owner,
ownership shall be determined as of the date that notice of intention to determine status is
recorded pursuant to Section 14-65.020 of this Article.
