Participation Information: This hearing will be entirely by teleconference. All Heritage Preservation Commissioners
and staff will participate via teleconference in compliance with the Governor’s Executive Order N‐29‐20 suspending certain teleconference rules required by the Ralph M. Brown
Act. The purpose of this order was to provide the safest environment for the public, elected officials, and staff while allowing for continued operation of the government and
public participation during the COVID‐19 pandemic.
Members of the public can view and participate in Meeting by: 1. Using the Zoom website https://us02web.zoom.us/j/85635304143 or App
(Webinar ID 856 3530 4143) and using the tool to raise their hand in the Zoom platform when directed by the Mayor to speak on an agenda item; OR
2. Calling 1.408.638.0968 or 1.669.900.6833, entering the Webinar ID 856 3530 4143 and pressing *9 to raise their hand to speak on an agenda item when directed by
the Chair.
The public will not be able to participate in the meeting in person.

Property Location: 20280 Saratoga Los Gatos Road (Seven Oaks)
Property APN: 517-11-005 Property Owner/Applicant: Bijoy Bose
Background:
The property owner is requesting that the Heritage Preservation Commission (HPC) recommend that the City Council designate the property as a Historic Landmark. If the
HPC recommends that the property should be designated as a Historic Landmark, the property owner intends to then file a Mills Act application. The Landmark designation
request and the Mills Act application will both be forwarded to the City Council for final action. The Council will first need to determine whether or not to designate the property
as a Historic Landmark. If the landmark status is approved, the Council will then make a determination regarding the Mills Act application (as the property is required to have
landmark status in order to be considered under the Mills Act program).
The property was placed on the Heritage Resource Inventory in 1991. This house is not clearly visible from the public right-of-way. The home is a one-story stucco Mediterranean
villa that is formed of two large gabled bays flanking the central entry wing. The arched front door features multi-paned glass with an arched top; this arch is echoed in a wooden
pediment directly above the door, and by an eyebrow gable set into the hipped roof above the pediment. The door is approached by a concrete stoop with a low railing of
cement piers connected by an iron railing. The left bay of the house contains a tripartite arched French door similar to the front door. The right bay features three paired units of
small-paned casements. The house sits in attractive landscaping sloping up from the road and divided diagonally by a wide drive.

The original owners and builders of the house on this property are not known. The property was purchased in 1929 by the Peterson family who lived there until 1946. It is
believed that this was George P. and Ethna Peterson. The property was later occupied by Dr. George W. Phillips, a minister and early "fire and brimstone" radio preacher in Oakland
for KTAB (Tenth Avenue Baptist Church), which later became station KSFO. Dr. Phillips occasionally filled in at the pulpit at the Saratoga Federated Church during the 1940's.
The house was then owned by the Collins and Harkness families.
Staff Recommendation:
Staff recommends that:
• The HPC finds that the structure retains a substantial degree of architectural and
structural integrity with respect to the original design, and
• Recommends that the City Council designate the subject property as a historic
landmark.

Seven Oaks is listed on the Saratoga Heritage Resources Inventory, included as a part of
HP-91-01. It qualified under Criteria c and e:
c) the property embodies distinctive characteristics of the Mediterranean with Craftsman style, type
and period; and
e) the property embodies unique physical characteristics that represent an established and familiar
visual feature of a neighborhood.
Seven Oaks may also be eligible for the California Register of Historical Resources under
Criterion (3), as the house may embodies the distinctive characteristics of the Mediterranean
Villa house-type within Saratoga's City of Homes period.

Historical Background
The original owners and builders of the house on this property are not known. The property was
purchased in 1929 by the Peterson family who lived there until 1946. It is believed that this
was George P. and Ethna Peterson, who lived in San Jose in the Naglee Park neighborhood in
1930, but who likely relocated to Saratoga-Los Gatos Road shortly after. George was a truck
salesman, born about 1882 in Sweden. His California-born wife Ethna was born in 1893, and the
Petersons were married in 1919. By 1930, they had one child, Marcia.
The property was later occupied by Dr. George W. Phillips, a minister and early "fire and
brimstone" radio preacher in Oakland for KTAB (Tenth Avenue Baptist Church), which later became
station KSFO. Dr. Phillips occasionally filled in at the pulpit at the Saratoga Federated
Church during the 1940's. The house was then owned by the Collins and Harkness families.

SUBJECT: Item 6b-2019/2020 Certified Local Government (CLG) Report
The 1980 amendments to the National Historic Preservation Act of 1966, as amended, provided for the establishment of a Certified Local Government Program (CLG) to
encourage the direct participation of local governments in the identification, evaluation, registration, and preservation of historic properties within their jurisdictions and promote
the integration of local preservation interests and concerns into local planning and decision-making processes. The CLG program is a partnership among local governments,
the State of California (OHP), and the National Park Service (NPS) which is responsible for administering the National Historic Preservation Program.
The 2019/2020 annual CLG report from Saratoga is due by March 31st. Please review and
provide any comments on the attached report.

PROGRAMS
A. What are your most critical preservation planning issues? Educating the residents and public about historic
preservation to gain their support to add properties and trees to the local heritage inventory.
B. What is the single accomplishment of your local government this year that has done the most to further preservation in
your community? The adoption of the Heritage Orchard Master Plan will help ensure that the City’s Heritage
Orchard is protected for years to come.
C. What recognition are you providing for successful preservation projects or programs? Saratoga honors homeowners
who protect trees that have a historic value related to the heritage of the City. Saratoga offers a Mills Act tax
incentive program and provides plaques to landmark properties

SUBJECT: Item 8a-2021/2022 Workplan
The 2021/2022 Commission Work Plan Study Session will be held on March 30, 2021, starting at 6:00 p.m.
HPC is schduled to meet with Council at 6:15 p.m, however, this time may change a regular
agenda will be sent out the week before the meeting. Each Commission will be given 30 minutes with the City Council. It is not required to attend the entire evening, although you
are welcome to do so.
Attachment 1 includes the 2020/2021 work plan for refrence.
2021/2022 Fiscal Year Workplan
Heritage Resource Inventory. Continue their duty as commissioners to recommend and work with property owners to add eligible properties to the Heritage Resource Inventory.
This fiscal year, the HPC has so far added two (2) sites to the Heritage Resource Inventory. There are currently 16 sites for consideration to be included on the Inventory.
Public Outreach. Continue to participate in City events such as the Blossom Festival,
Arbor Day, Historic Preservation Month, the State of the City, and provide information about the Commission at these events. Collaborate with the City’s Public Information
Officer in utilizing social media platforms and add helpful links and documents to the HPC webpage. Such items would include, but not limited to, advantages of putting
structures and trees on the Inventory, the Mills Act program, and pride in our historic community.
Plaques/Point of Interest Markers. To properly recognize heritage resources and
properties of special interest in our City, the HPC would like to continue recommending

to Council special sites that warrant Point of Interest Markers (POI). The HPC has reviewing language for four (5) POI markers and are preparing to present to Council. The
HPC is requesting funding for XX markers for the 21/22 FY.
Continuing Education – The City of Saratoga is a Certified Local Government (CLG) recognized by the State of California Office of Preservation (OHP). The CLG requires that
all commissioners receive annual training in Historic Preservation.
Saratoga Avenue (Heritage Lane) Inventory –- Review, update, video and inventory of all the homes, fences and trees along the portion of Saratoga Avenue that is designated
as Heritage Lane, for the potential addition to the City’s Heritage Resource Inventory. This project may require a professional videographer.
Notable Accomplishments in fiscal year 2020/2021
During fiscal year 2020/2021, in addition to placing two properties on the Heritage Resource inventory and two landmark properties, the HPC reviewed five development
applications for work to be performed upon a heritage resource. In addition, HPC members attended several online webinars focusing on historic preservation. The HPC
also finalized the Heritage Orchard Master Plan that was approved by City Council in December 2020.

On February 11, 2020, the Heritage Preservation Commission (HPC) held their regularly scheduled
meeting and discussed their upcoming 2020/2021 work plan.
Heritage Orchard Master Plan. Continue to review and revise the 2001 Heritage Orchard Master
Plan to update accordingly and work on the long-term management of the orchard.
Heritage Resource Inventory . Continue their duty as commissioners to recommend and work with
property owners to add eligible properties to the Heritage Resource Inventory. This fiscal year, the
HPC has so far added seven (7) sites to the Heritage Resource Inventory. There are currently 21 sites
for consideration to be included on the Inventory.
Public Outreach. Continue to participate in City events such as the Blossom Festival, Arbor Day,
Historic Preservation Month, the State of the City, and provide information about the Commission
at these events. Collaborate with the City’s Public Information Officer in utilizing social media

During fiscal year 2019/2020, in addition to placing seven properties on the Heritage Resource

performed upon a heritage resource. The HPC also submitted a request to include Saratoga’s
Memorial Arch, located at the east corner of Saratoga-Los Gatos Road and Big Basin Way, to be
included to the World War I Memorial Inventory Project. In addition, several HPC members attended
an Eichler Homes Tour in San Jose. In honor of Preservation Month ( May of 2019), the HPC hosted
editor to CA Modern Magazine, Dave Weinstein’s presentation on “Eichler Homes: Birth, Death,
Rebirth”.

Heritage Preservation Commission Powers and Duties:
(CITY CODE SECTION 13-10.040)
The Heritage Commission shall be advisory only to the City Council, the Planning Commission and the
agencies and departments of the City and shall establish liaison and work in conjunction with such
authorities to implement the purposes of this Chapter. The Heritage Commission shall have the
following powers and duties:

a) Conduct, or cause to be conducted, a comprehensive survey of properties within the
boundaries of the City for the purpose of establishing the Heritage Resource Inventory. To
qualify for inclusion in the Heritage Resource Inventory, a property must satisfy any one or
more of the criteria listed in Section 13-15.010 of this Chapter. The Inventory shall be
publicized and periodically updated, and a copy thereof shall be kept on file in the Planning
Department.
b) Recommend to the City Council specific proposals for designation as a historic landmark,
heritage lane or historic district.
c) Recommend to the appropriate City agencies or departments projects and action programs
for the recognition, conservation, enhancement and use of the City's heritage resources,
including standards to be followed with respect to any applications for permits to construct,
change, alter, remodel, remove or otherwise affect such resources.
d) Review and comment upon existing or proposed ordinances, plans or policies of the City as
they relate to heritage resources.
e) Review and comment upon all applications for building, demolition, grading or tree removal
permits involving work to be performed upon or within a designated historic landmark,
heritage lane or historic district, and all applications for tentative map approval, rezoning,
building site approval, use permit, variance approval, design review or other approval
pertaining to or significantly affecting any heritage resource. The Commission’s comments
shall be forwarded to the City agency or department processing the application within thirty
days after receiving the request for such comments.
f) Investigate and report to the City Council on the availability of federal, state, county, local or
private funding sources or programs for the rehabilitation and preservation of heritage
resources.
g) Cooperate with county, state and federal governments and with private organizations in the
pursuit of the objectives of heritage conservation.
h) Upon the request of a property owner or occupant and at the discretion of the Heritage
Commission, render advice and guidance on the conservation, rehabilitation, alteration,
decoration, landscaping or maintenance of any heritage resource; such voluntary advice and
guidance shall not impose any regulation or control over any property.
i) Participate in, promote and conduct public information and educational programs pertaining
to heritage resources.
j) Perform such other functions as may be delegated to it by resolution or motion of the City
Council.
