Teleconference/Public Participation Information to Mitigate the Spread of COVID‐19
This meeting will be entirely by teleconference. All Council members and staff will only
participate via the Zoom platform using the process described below. The meeting is being
conducted in compliance with the Governor’s Executive Order N‐29‐20 suspending certain
teleconference rules required by the Ralph M. Brown Act. The purpose of this order was to provide
the safest environment for the public, elected officials, and staff while allowing for continued
operation of the government and public participation during the COVID‐19 pandemic.
Members of the public can view and participate in the Commission Interviews by:
1. Using the Zoom website https://us02web.zoom.us/j/85005911467 or App (Webinar ID
850 0591 1467) and raising their hand when directed by the Mayor to speak on an agenda
item; OR

Recommended Action:
Approve the resolution in opposition to Senate Bill 9 and authorize submittal of a letter from
the City Council expressing its opposition.
3.3. Amendment to Public Art Policy
Recommended Action:
Approve the resolution amending the Public Art Policy to allow the Public Art Committee
to authorize placement of artwork that is valued at $25,000 or less and meets other criteria
outlined in the policy.

RECOMMENDED ACTION:
Present the proclamation Declaring March 8, 2021 as International Women’s Day to the Saratoga
Foothill Club.
BACKGROUND:
International Women’s Day has been celebrated since the early 1900’s and is a global day to
celebrate women’s achievements, raise awareness about women’s equality, and to recognize
female-focused charities.
The Saratoga Foothill Club was founded in 1907 as a women’s study group and has expanded as
a source of support for the community by organizing the annual Memorial Day observance at
Madronia Cemetery, providing over 150 holiday baskets to needy community members,
supporting the West Valley Community Services food bank, and providing scholarships to high
school and community college students.

PROCLAMATION OF THE CITY COUNCIL
OF THE CITY OF SARATOGA DECLARING MARCH 8, 2021 AS
INTERNATIONAL WOMEN’S DAY
WHEREAS, International Women’s Day has been observed since the early 1900s, was first
celebrated by the United Nations in 1975, and is now celebrated around the world on March 8th; and
WHEREAS, International Women’s Day is a global day celebrating the social, economic,
cultural, and political achievements of women; and
WHEREAS, this day is an important day to celebrate women’s achievements, raise awareness
about women’s equality, be aware of gender parity, and to recognize female-focused charities; and
WHEREAS, the Saratoga Foothill Club was founded in 1907 as a women’s study group to
broaden their education and discuss community concerns and continues today to focus on civic and
social issues and has been hosting virtual events during 2021; and
WHEREAS, the Saratoga Foothill Club members have served as a source of support for the
community by organizing the annual Memorial Day observance at Madronia Cemetery, providing
over 150 holiday baskets to those in need, supporting the West Valley Community Services food bank,
and providing scholarships to high school and community college students; and
WHEREAS, in honor of Saratoga women all residents are urged to honor women and to join
in this special observance of International Women’s Day.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Saratoga does
hereby proclaim and recognize the month of March 8, 2021 as International Women’s Day and honors
the Foothill Club for everything that they do to support women and the entire Saratoga community.

BACKGROUND:
Draft City Council minutes for each Council Meeting are taken to the City Council to be
reviewed for accuracy and approval. Following City Council approval, minutes are retained for
legislative history and posted on the City of Saratoga website. The draft minutes are attached to
this report for Council review and approval.

MINUTES
WEDNESDAY, FEBRUARY 17, 2021
SARATOGA CITY COUNCIL REGULAR MEETING
At 6:00 p.m., the City Council held a Joint Meeting with the Saratoga Area Senior Coordinating
Council via teleconferencing through Zoom.
Mayor Zhao called the virtual Regular Session to order at 7:01 p.m. via teleconferencing through
Zoom.
Prior to Roll Call, the Mayor and City Clerk explained that the City Council meeting was conducted
pursuant to provisions of the Brown Act and a recent Executive Order issued by the Governor to
facilitate teleconferencing to reduce the risk of COVID-19 transmission at public meetings. Ordinarily
the Brown Act sets strict rules for teleconferencing. The Governor’s Executive Order has suspended
those rules. The Executive Order does require that public agencies continue to notice meetings in
advance and provide members of the public an opportunity to observe the meeting and offer public
comment. The City Council met all of the applicable notice requirements and the public is welcome to
participate in this meeting. Information on how the public can observe the meeting and provide public
comment was also shared. Additionally, the Mayor explained that votes would be taken through roll call.

Cities Association of Santa Clara County – the members approved a financial report, received a
presentation from Silicon Valley Clean Energy Association with information about the
Community Energy Resilience Program, received a presentation by the Chamber of Commerce
Association, and received a presentation by the Planning Collaborative agency on helping cities
with their Housing Elements.
Valley Transportation Authority (VTA) Policy Advisory Committee – the Committee approved
the SASCC RYDE program application for Measure B grant funds, which now goes to the VTA
Board for their approval.
West Valley Sanitation District – the Board approved an annexation request, but the annexation
now has to be approved by LAFCO.

Vice Mayor Tina Walia
Silicon Valley Clean Energy Authority Board of Directors – the new Board members have been
attending orientation meetings as well as the Board meeting. The Board received a report that
SVCE has adjusted rates to maintain a 1% discount relative to PG&E rates, also approved a
contract for carbon-free hydropower to start in 2025, and discussed the statewide Time-of-Use
Billing rate change in June 2021 that customers will be opted-in as part of the transition.
Information will be going out to customers in March.
Vice Mayor Walia announced that Silicon Valley Clean Energy Authority has a grant program
that the City of Saratoga can apply for.
Council Member Rishi Kumar
West Valley Clean Water Program Authority – the members approved the 2021 Strategic
Priorities, including Storm water permit compliance education, negotiate new agreement with
Santa Clara County Fire to conduct commercial inspections, actively pursue grant opportunities,
financial studies with other organizations, and technology innovations.
West Valley Solid Waste Management Joint Powers Authority – the members received a report
on liquidated damages that are allowed in the contract from missed pickups by garbage company
and there are assessed damages of $11,300. The members think the company should have a call
center to report missed pickups and the company needs to create a better process. There is an ad
hoc committee discussing the Collection agreement that expires in 10 years with lots of new
legislation that will affect the rates. Also received a report on SB1383, which is to reduce organic
waste in landfills.
Council Member Kookie Fitzsimmons
Chamber of Commerce – the Chamber of Commerce is looking for ways to refresh the Village.
Council Member Mary-Lynne Bernald
Saratoga Public Art Committee – the Committee received a report that there had been 70
qualified applicants for the Paint the City program and that the Library & Community
Engagement Commission reviewed the applications and now City residents will vote on their
favorite artwork at the 3 utility box locations in the program this year. The Committee reviewed
and proposed changes to the Public Art Policy changes that will come to the Council for
consideration. The Committee also discussed Gateway sculpture ideas, agreed to replace the
stolen Nuts About Saratoga acorn in the Village, and received updates on Rainy Day Sidewalk
Poetry and Chalk Hopscotch.
CITY COUNCIL ITEMS
Council Member Fitzsimmons, with support from Mayor Zhao, asked the City Council to
consider opportunities to refresh the appearance of the Village.
COUNCIL COMMUNICATIONS
Council Member Kumar shared about the San Jose Water Company rate increases and he
advised that protest messages should go to the California Public Utilities Commission. Council
Member Kumar also shared information about COVID vaccines.

James Lindsay announced that the monthly e-newsletter, Saratoga Source, will transition from a

Review and accept the Treasurer’s Report for the month ended January 31, 2021.
BACKGROUND:
California government code section 41004 requires that the City Treasurer submit to the City Clerk and the
legislative body a written report and accounting of all receipts, disbursements, and fund balances. The
Municipal Code of the City of Saratoga, Article 2-20, Section 2-20.035 designates the City Manager as the
City Treasurer. This report is prepared to fulfill this requirement.
The following attachments provide various financial transaction data for the City of Saratoga’s Funds
collectively as well as specifically for the City’s General (Operating) Fund, including an attachment from
the State Treasurer’s Office of Quarterly LAIF rates from the 1st Quarter of 1977 to present.
FISCAL STATEMENT:
Cash and Investments Balance by Fund
As of January 31, 2021, the City had $383,277 in cash deposit at Comerica bank, and $28,267,879 on
deposit with LAIF. The City Council’s adopted policy on the Working Capital Reserve Fund states that
effective July 1, 2016: for cash flow purposes and to avoid occurrence of dry period financing, pooled cash
from all funds should not be allowed to fall below $1,000,000. The total pooled cash balance as of January
31, 2021 is $28,651,156 and exceeds the minimum limit required.
City’s Current Financial Position
In accordance with California government code section 53646 (b) (3), the City is financially well positioned
and able to meet its expenditure requirements for the next six months. As of January 31, 2020, the City’s
financial position (Assets $29.4M, Liabilities $3.6M and Fund Equity $25.8M) remains very strong and
there are no issues in meeting financial obligations now or in the foreseeable future.

monthly period. This amount differs from the above Cash Summary schedule as assets and liabilities are
components of the fund balance. As illustrated in the summary below, Total Unrestricted Cash is adjusted
by the addition of Total Assets less the amount of Total Liabilities to arrive at the Ending Fund Balance –
which represents the actual amount of funds available.
Fund Balance Designations
In accordance with Governmental Accounting Standards Board (GASB) Statement No. 54, Fund Balance
Reporting and Governmental Fund Type Definitions, the components of fund balance are categorized as
follows: “non-spendable fund balance”, resources that are inherently non-spendable from the vantage point
of the current period; “restricted fund balance”, resources that are subject to enforceable legal restrictions;
“committed fund balance”, resources whose use is constrained by limitations the government imposes upon
itself through formal action at its highest level of decision making and remains binding unless removed in
the same manner; “assigned fund balance”, resources that reflects a government’s intended use of
resources, such intent would have to be established at either the highest level of decision making, by a body,
or an official designated for that purpose; and “unassigned fund balance”, net resources in excess of what
can properly be classified in one of the other four categories. Currently, the City’s fund balance reserves
fall into one of the four spendable categories; restricted, committed, assigned, or unassigned fund balance.

Move to adopt resolution granting final map approval of tentative map application No. SUB 19-
0001 for two lots located at 13939 Quito Road (APN 397-43-017).
BACKGROUND:
Attached is a resolution, which, if adopted, will grant final map approval for two lots located at
13939 Quito Road (APN 397-43-017).
The recordation of the final map is a means to create individual lots from a larger lot for which
building permits may be issued without further subdivision.Once the final map has been filed with
the City Clerk, the City Council at its next meeting shall approve or disapprove the final map and
accept or reject any offers of dedication made to the city within the map. The final map does not
have any force or effect until approved by the City Council and no title or interest may be granted
in any property described in the final map until it is recorded by the Office of the County Clerk -
Recorder.
The City Engineer has examined the final map and related documents submitted to the City in
accordance with the provisions of Section 14.40.020 of the Municipal Code and it was determined
that:
1.The final map substantially complies with the approved tentative map.
2.All conditions of the approved tentative map, as contained in Planning Commission
Resolution No. 19-020, have been completed or will be completed concurrent with
development of the two lots.
3.The Subdivision Map Act, the City's Subdivision Ordinance and all other applicable
provisions of law have been complied with.
4.The final map is technically correct.

Consequently, the City Engineer’s certificate has been executed on the final map and the final map
has been filed with the City Clerk pursuant to Section 14.40.040 of the Municipal Code for action
by the City Council. The subdivider has paid $32,343 in Park Development Fees.

BACKGROUND
At the City Council Study Session on January 25, 2021, the Council received a report on the
Housing Element Update Kickoff. Every 8 years, California Cities are required to update their
Housing Element to plan for projected housing needs at all income levels. Based on the Bay
Area’s current methodology, Saratoga may need to plan for over 1,700 new housing units to be
built in Saratoga between 2023 and 2031.
At the January 25, 2021 Study Session, the City Council directed staff to schedule consideration
of the engagement strategy for a meeting in March so that engagement can begin as soon as
possible. While the updated Housing Element is not due until January 2023, addressing this
challenge will require a significant amount of engagement and feedback from the Saratoga
community to confirm values and priorities, and to identify solutions and any necessary policy
changes. Starting engagement early provides the opportunity for the community to fully
participate in the Housing Element update process.
To begin, staff plans to work through the first phase of outreach and engagement, evaluate the
effectiveness of these efforts, check in with the Council and community, then plan for the next
phase accordingly. This approach will allow the City to be responsive and adaptive to the
community’s ongoing reactions and needs throughout this dynamic process. Staff expects to
provide the City Council with regular updates on the engagement effort. The exact timing will
vary based on the phases of engagement.
The Housing Element engagement strategy will be multipronged, utilizing all of the various
communications tools at the City’s disposal, including the City’s website, social media, median
banners, print materials, and community partners’ outreach channels. The City will use
compelling language and visuals as part of repeated and regular communications to draw the
attention of residents. The strategy also incorporates the City’s experiences from previous large-
scale communication efforts, constantly assessing whether the City is reaching residents and

adapting engagement efforts as needed.
The table below outlines major milestones and engagement efforts that will occur through the
end of 2021. In addition to the regular updates to the City Council that will be scheduled for
regular City Council Meetings as the engagement efforts progress, staff expects to return to City
Council in fall or winter of 2021 to get direction on future phases of the Housing Element
engagement strategy. The third column highlights any distinctive communication tools that will
be used, above and beyond the City’s standard methods listed above.

RECOMMENDED ACTION:
Approve the resolution in opposition to Senate Bill 9 and authorize submittal of a letter from the
City Council expressing its opposition.
BACKGROUND:
At the July 1, 2020 City Council Meeting, the City Council adopted Resolution 20-050 in
opposition of Senate Bill (SB) 1120. While this SB 1120 was approved by the Assembly, it did
not return to the Senate in time for a concurrence vote before the end of the 2019-20 legislative
session. The proposed legislation was reintroduced by State Senators Atkins, Caballero, Rubio,
and Wiener in the current legislative session as SB 9.
If adopted, SB 9 would require ministerial consideration of proposed housing developments in
urbanized areas containing 2 residential units, either as attached units or through the subdivision
of a parcel into two equal parcels. This would exempt qualified housing development applications
from discretionary review, hearing, or environmental review. Furthermore, it would prohibit cities
from imposing dedications of rights-of-way, it would limit parking requirements to no more than
one space per unit, and prohibit any parking requirements for developments within ½ mile of a
major transit stop or stop on a high frequency bus line or within one block of a car share vehicle.
Proposed developments would not be eligible for ministerial consideration if they are located in
very high fire severity zones unless the development complies with State mitigation requirements,
earthquake fault zones, within the 100-year floodplain, on a site that has a historic property or
landmark designation, within a historic or landmark district, on prime farmland or in farmland of
statewide importance, wetlands, land that serves as habitat for a protected species, or land
identified for conservation through an easement or conservation plan.
The League of California Cities has opposed the bill unless amended.

WHEREAS, in recent years, California has experienced a growing need for affordable housing
and the State has enacted many laws that seek to address that needby stripping jurisdictions of local control;
and
WHEREAS, Senate Bill (SB) 9 would require ministerial consideration without any discretionary
review, hearing, or environmental review for proposed housing developments with 2 residential units in
zones in single-family residential zones; and
WHEREAS, the bill would require cities to permit the development of a duplex or subdivision of
a parcel into two equal parcels, prohibit cities from imposing dedications of rights-of-way, limit parking
requirements to no more than one space per unit, and prohibit any parking requirements for developments
within ½ mile of a major transit stop or stop on a high frequency bus line or within one block of a car share
vehicle; and
WHEREAS, SB 9 would not spur much needed housing construction in a manner that supports
local flexibility, decision-making, and community input and State driven ministerial or by-right housing
approval processes fail to recognize the extensive public engagement associated with developing and
adopting zoning ordinances and Housing Elements; and
WHEREAS, SB 9 imposes no requirement to build affordable units and continues a one-size-fits
all approach to the housing crisis by eroding local control and the ability of residents to shape the future of
their community.
NOW, THEREFORE BE IT RESOLVED,that the City Council of the City of Saratoga does hereby
oppose SB 9, authorizes the Mayor to execute a letter reflecting the City Council’s position, and urges the
California State Legislature and the Governor of California to reject this bill and seek a collaborative
approach to the housing crisis that allows local communities to part of the solution to the housing shortfall
across all income levels without sacrificing their ability to plan future growth.

Dear Senate President Pro Tempore Atkins,
I am writing on behalf of the City Council of the City of Saratoga to express opposition to
Senate Bill (SB) 9, which would require ministerial consideration without any discretionary
review, hearing, or environmental review for proposed housing developments with 2
residential units in zones in single-family residential zones.
Housing affordability and homelessness are among the most critical issues facing California
cities. Affordably priced homes are out of reach for many people and housing is not being built
fast enough to meet the current or projected needs of people living in the state.
There has been a movement at the State level to address the affordable housing crisis by
stripping communities of local control. This effort has been based on the underlying belief that
the housing crisis can be solved by eliminating imagined barriers to development. For at least
the past 15 years, Saratoga has not denied a single application for housing.
SB 9 continues this effort to chip away at the ability of our communities to plan for their own
futures and growth and will fail to spur housing construction in a manner that supports local
flexibility, decision-making, and community input.
We urge the State Legislature and the Governor to reject this bill and seek a collaborative
solution to the housing crisis that allows local jurisdictions to be part of the solution without
sacrificing our ability to shape the future of our communities.

RECOMMENDED ACTION:
Approve the resolution amending the Public Art Policy to allow the Public Art Committee to
authorize placement of artwork that is valued at $25,000 or less and meets other criteria outlined
in the policy.
BACKGROUND:
Following the formation of the Public Art Committee, the City Council adopted the Public Art
Policy via Resolution 18-004 to delegate some of the responsibility for placement of public art on
City property to the Public Art Committee. If adopted, the attached resolution would amend the
current policy to allow the Public Art Committee to authorize placement of public art valued at
$25,000 or less if the artwork also meets the other criteria that allows the Public Art Committee to
authorize placement. This change ensures that the City Council authorizes artwork placement
before the City assumes responsibility for higher value artwork. The Public Art Committee
reviewed the proposed change at its February 16, 2021 meeting and recommended City Council
adoption of the Public Art Policy amendment.

AMENDING THE PUBLIC ART POLICY
WHEREAS, the City Council of the City of Saratoga adopted Resolution 16-
028establishing the current Saratoga Public Art Policy; and
WHEREAS, since adoption of Resolution 16-028, the City Council formed the Public Art
Committee to provide the City Council with recommendations on programs that foster arts and
culture in Saratoga for the enrichment and appreciation of the City and its citizens; and
WHEREAS, with the formation of the Public Art Committee and an increasing interest in
public art, some of the responsibility regarding placement of public art was delegated to the Public
Art Committee with the adoption of Resolution 18-004; and
WHEREAS, the City Council wishes to add a new criteria that would allow the Public Art
Committee to authorize placement of artwork or exhibits on City property that will be displayed
for a period of 3 years or less and is valued at $25,000 or less; and
WHEREAS, the Public Art Committee hereby is authorized to approve installation of
artwork and exhibits on City property that meet the following criteria:
Artwork/exhibits do not impede typical uses of the site where they are proposed to be
installed
Artwork/exhibits are appropriate in scale, media, and context with the intended display
location
Artwork/exhibits do not contain political statements or symbols, religious reference or
symbols, profane or offensive content, graffiti-like style artwork, copyrighted or
trademarked material, or corporate or organizational references, branding, or symbols
Artwork/exhibits are suitable for display to a diverse audience, including children, and
should help create a sense of place and community
There is evidence of community support for the artwork/exhibit
Artwork/exhibits installed outdoors are be able to withstand an outdoor environment
through the public display period
Artwork/exhibits do not pose a threat to public safety
Any costs associated with artwork/exhibits, such as a lease or installation expenses, can
be accounted for within the Public Art Budget approved by the City Council
Artwork/exhibits will be displayed for a period of 3 years or less and is valued at
$25,000 or less
WHEREAS, placement of public art or exhibits on City property by the City of Saratoga
that do not fall within the discretion of the Public Art Committee shall be reviewed by the Public
Art Committee and, at the recommendation of the Public Art Committee, be considered for
approval by the City Council by majority vote on a case-by-case basis; and

WHEREAS, this resolution shall replace and supersede all prior resolutions, policies, and
understandings relating to the Public Art Policy.
NOW, THEREFORE BE IT RESOLVED,that the City Council of the City of Saratoga hereby
grants the Public Art Committeewith the discretion to approve placement of public art and exhibits
based on the above criteria and any pieces of public art or exhibits that fall outside the discretion
of the Public Art Committee will be reviewed by the Public Art Committee and if recommended
for approval by the Public Art Committee, considered by the City Council by majority vote on a
case-by-case basis.
