Teleconference/Public Participation Information to Mitigate the Spread of COVID‐19
This meeting will be held entirely by teleconference. All members of the City Council and staff
will only participate via the Zoom platform using the process described below. The meeting is
being conducted pursuant to recent amendments to the teleconference rules required by the Ralph
M. Brown Act allowing teleconferencing during a proclaimed state of emergency when local
official have recommended social distancing. The purpose of the amendments is to provide the
safest environment for the public, elected officials, and staff while allowing for continued
operation of the government and public participation during the COVID-19 pandemic.

SARATOGA CITY COUNCIL REGULAR MEETING
At 6:00 p.m., the City Council held a Joint Meeting with Santa Clara County Sheriff's Office via
teleconferencing through Zoom.
Mayor Zhao invited public comment.
No one requested to speak.
Mayor Zhao called the Regular Session to order at 7:03 p.m. via teleconferencing through Zoom.
Prior to Roll Call, the City Clerk explained the City Council meeting was conducted pursuant to State law
as recently amended by Assembly Bill 361, which allows the meeting to be conducted entirely by
teleconference.The City Council has met all the applicable notice requirements and the public is welcome
to participate. All Council Members, staff, and meeting attendees participated by Zoom. Information on
how the public can observe the meeting and provide public comment was provided.

WHEREAS,on June 26, 2019, an application was submitted by John Bellicitti Trustee & ET
AL (owner) and 18500 Marshall Ln, LLC (applicant). The applicant is requesting to amend the
Zoning Map for the property located at 18500 Marshall Lane. The property is currently zoned
Agricultural(A) and is nolonger used for agriculturalpurposes.The applicant is requestingthe zone
district be amended to R-1-40,000 to allow for residential use on a minimum lot size of 40,000
square feet.
WHEREAS,on September 8, 2021, following a public hearing at which the applicant and
public had an opportunity to be heardthe PlanningCommission recommended that the City Council
amend the City Zoning Map to remove the existing Agricultural Zone on the 9.24 acres at 18500
Marshall Lane (APN 397-02-111) and apply the R-1-40,000 Zone District to the property.
NOW THEREFORE, the City Council of the City of Saratoga hereby ordains as follows:
Section 1:The recitals set forth above are true and correct and incorporated herein by
reference.
Section 2:The project is subject to the California Environmental Quality Act (CEQA) and an
Initial Study/Mitigated Negative Declaration was prepared for the project and it has been determined
that the project would not have a significant adverse effect on the environment with mitigation
measures.
Section 3. The City Zoning Map is hereby amended to remove the existing Agricultural

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SARATOGA AMENDING ARTICLE 15-45 OF THE CITY CODE
(SINGLE FAMILY DWELING DESIGN REVIEW)
The City Council of the City of Saratoga finds that:
Findings:
1. This ordinance amends Article 15-45 of the Saratoga City Code – Design Review:
Single Family Dwelling. These amendments were considered by the Planning
Commission of the City of Saratoga at a duly noticed public hearing on
September 8, 2021. Following consideration of all testimony and written
materials, the Planning Commission recommended that the City Council adopt the
amendments to Chapter 15 set forth herein.
3. The City Council of the City of Saratoga held a duly noticed public hearing on
October 6, 2021, and after considering all testimony and written materials
provided in connection with that hearing introduced this ordinance and waived the
reading thereof and adopted the ordinance on October 20, 2021.
Therefore, the City Council hereby ordains as follows:
Section 1. Adoption.
Section 15-45 (Design Review: Single Family Dwelling) of the Saratoga City Code is
amended as set forth in Exhibit A.
Section 2. Severance Clause.
The City Council declares that each section, sub-section, paragraph, sub-paragraph,
sentence, clause, and phrase of this ordinance is severable and independent of every other
section, sub-section, paragraph, sub-paragraph, sentence, clause, and phrase of this
ordinance. If any section, sub-section, paragraph, sub-paragraph, sentence, clause, or
phrase of this ordinance is held invalid, the City Council declares that it would have
adopted the remaining provisions of this ordinance irrespective of the portion held
invalid, and further declares its express intent that the remaining portions of this
ordinance should remain in effect after the invalid portion has been eliminated.
Section 3. California Environmental Quality Act
The proposed ordinance is categorically exempt from the California Environmental
Quality Act (CEQA) in that the activity in question will not have a significant effect on
the environment. Pursuant to CEQA Guideline Section 15061, it can be seen with

certainty that there is no possibility that the activity in question may have a significant
effect on the environment, and pursuant to CEQA Guideline Section 15304(b) and
15304(i), the Code changes will result in minor alterations to landscaping and
management of fuel. CEQA applies only to projects which have the potential of causing
a significant effect on the environment.
Section 4. Publication.
A summary of this ordinance shall be published in a newspaper of general circulation of the
City of Saratoga within fifteen days after its adoption.
Following a duly noticed public hearing the foregoing ordinance was introduced at the
regular meeting of the City Council of the City of Saratoga held on the 6th day of October

The provisions of the Saratoga Municipal Code set forth below are amended or adopted
as follows:

15-45.080 - Design review findings.
The Planning Commission shall not grant design review approval unless it is able to
make the following findings. These findings are in addition to and not a substitute for
compliance with all other Zoning Regulations (which constitute the minimum
requirements, as provided in City Code Section 15-05.050).
(a) Site development follows the natural contours of the site, minimizes grading,
and is appropriate given the property's natural constraints.
(b) All protected trees shall be preserved, as provided in Article 15-50 (Tree
Regulations). If constraints exist on the property, the number of protected trees,
heritage trees, and native trees approved for removal shall be reduced to an
absolute minimum. Removal of any smaller oak trees deemed to be in good
health by the City Arborist shall be minimized using the criteria set forth
in Section 15-50.080.
(c) The height of the structure, its location on the site, and its architectural elements
are designed to avoid unreasonable impacts to the privacy of adjoining
properties and to community viewsheds.
(d) The overall mass and the height of the structure, and its architectural elements
are in scale with the structure itself and with the neighborhood.
(e) The landscape design minimizes hardscape in the front setback area, and
contains elements that are complementary to the neighborhood streetscape, and,
for sites located within the Wildland Urban Interface Area, includes a five-
foot-wide nonflammable buffer around the perimeter of all structures.
(f) Development of the site does not unreasonably impair the ability of adjoining
properties to utilize solar energy.
(g) The design of the structure and the site development plan is consistent with the
Residential Design Handbook, pursuant to Section 15-45.055.

(h) On hillside lots, the location and the design of the structure avoid unreasonable
impacts to ridgelines, significant hillside features, community viewsheds, and is
in compliance with Section 15-13.100.

RECOMMENDED ACTION:
Adopt the Resolution authorizing teleconferenced public meetings for the City of Saratoga City
Council and all City of Saratoga legislative bodies pursuant to Assembly Bill 361.
BACKGROUND:
On September 16, 2021, Governor Newsom signed AB 361 which took effect October 1 and allows
cities to continue to meet remotely during proclaimed states of emergency when the city
determines that either (1)state or local public health officials have required or recommended social
distancing or (2)meeting in person would pose an imminent risk to the health or safety of
attendees. AB 361 extends the flexibilities provided in the Governor’s prior Brown Act executive
order to local and state bodies to hold public meetings virtually during proclaimed states of
emergency beyond the executive order’s September 30, 2021 expiration date.
Though adopted in the context of the pandemic, AB 361 will allow for virtual meetings during
other state proclaimed emergencies, such as earthquakes or wildfires, where physical attendance
may present a risk.
Based on direction received from the City Council and in light of the existing state of emergency
and the County Health Officer's recommendation,the attached Resolution has been prepared
to enable the City Council and all legislative bodies of the City to meet remotely in accordance
with AB 361.
Pursuant to AB 361, staff will bring this item back every 30 days for the City Council’s
reconsideration of the findings related to the declared stated of emergency and the recommended
social distancing measures.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA
AUTHORIZING TELECONFERENCED PUBLIC MEETINGS FOR THE CITY OF
SARATOGA CITY COUNCIL AND ALL CITY OF SARATOGA LEGISLATIVE
BODIES PURSUANT TO ASSEMBLY BILL 361
WHEREAS, the Governor of the State of California issued a Proclamation of a State of
Emergency on March 4, 2020 in response to COVID-19; and
WHEREAS, the state of emergency proclaimed by the Governor on March 4, 2020 has
not been rescinded and remains in effect; and
WHEREAS, Assembly Bill 361 was signed by the Governor and became effective
October 1, 2021, enacting certain changes to the Brown Act as set forth in Government Code section
54953; and
WHEREAS,AB 361 authorizes local legislative bodies to continue having purely virtual
meetings using teleconferencing and virtual meeting technology as long as there is a gubernatorial
"proclaimed state of emergency," and either (1) state or local officials impose or recommend measures
that promote social distancing or (2) the legislative body finds that meeting in person would present
an imminent safety risk to attendees; and
WHEREAS, the Santa Clara Health Officer has recommended social distancing.
NOW, THEREFORE,the City Council of the City of Saratoga in compliance with AB 361 and
in order to continue to meet via teleconference without the usual requirements of the Brown Act
hereby:
1.Finds that City Council has considered the circumstances of the COVID-19 state of emergency
and that the following circumstances exist:
The state of emergency as a result of COVID-19 continues to directly impact the ability of the
members of City Council and the members of the City’s Boards and Commissions to meet safely
in person; and
The State of California and the County of Santa Clara continue to impose or recommend
measures to promote social distancing.
2.Declares that as a result of the findings in provision 1 above, the City Manager is authorized to
implement teleconferenced public meetings for the City Council and all the City of Saratoga’s
legislative bodies, as defined by the Ralph M. Brown Act pursuant to Assembly Bill 361.
3.This Resolution shall become effective immediately and staff is directed to agendize this item
every 30 days for the City Council to reconsider the circumstances of the state of emergency and
findings of provision 1.

Joint Powers Association’s Board of Directors.
BACKGROUND:
The City of Saratoga is one of 28 member cities that comprise the Pooled Liability Assurance
Network Joint Powers Authority (PLAN JPA). PLAN JPA provides small to medium-sized cities
an opportunity to share risk management and oversight of liability programs in a cost-effective
manner. The JPA Board consists of Primary and Alternate staff representatives from each member
agency. The Board appoints officers of PLAN JPA, elects committee members, and approves
contracts, governing documents, and budgets.
The City Council designates the appointees to represent the City through the adoption of a
resolution. The Finance and Administrative Services Director is currently designated as the City’s
Primary Representative with the Human Resources Manager as the Alternate Representatives.
With the retirement of Mary Furey, risk management duties have been temporarily shifted and the
City Manager would be the appropriate person to represent the City on the PLAN JPA Board. The
Human Resource Manager will continue to serve as the Alternate Board Members.

SUBJECT: Automated License Plate Reader Update
RECOMMENDED ACTION:

BACKGROUND:
Mayor Zhao requested a City Council agenda item to provide the City Council with an updated on
Automated License Plate Readers (ALPR) and the opportunity to provide direction to staff. ALPR
systems capture images of vehicle license plates and then compare license plate numbers against
law enforcement databases to provide alerts to law enforcement when a plate matches a listing on
a database.
ALPR systems come in several configurations, including fixed location ALPRs, car mounted
ALPRs, and trailer mounted ALPRs. Fixed location ALPRs are commonly placed on traffic
signals, light poles, or overpasses in high crime or high traffic areas. Car mounted ALPRs typically
get installed in patrol vehicles and notify the driver when vehicles of interest are identified. Trailer
mounted ALPRs are usually deployed for short periods of time and relocated as needed. Both fixed
location and trailer-mounted ALPRs require a power source and network infrastructure.
Additionally, fixed location and trailer-mounted ALPRs typically provide alert notifications to a
central communications center rather than directly to an officer. Dispatchers receive notifications
and then pass on details captured by the ALPR system to officers near the camera. Dispatch
personnel may need additional equipment and training to monitor ALPR system hits.
At the November 20, 2019 Council Meeting, the City Council received a report on ALPRs. At that
time, fixed location ALPR cameras were a significant cost. For example, the Town of Atherton
considered an ALPR system to provide coverage at 10 intersections in October 2019 at an
estimated cost of $350,000. Additionally, County policies did not allow a City owned ALPR
system to provide real time alerts to County Communications for dispatch of Santa Clara County
Sheriff’s Office deputies.
Recently, several cities have deployed or initiated deployment of ALPR systems in partnership
with Flock Safety, which offers ALPR systems for law enforcement purposes as well as private

property owners. Flock systems leased for law enforcement purpose by jurisdictions compare
license plate data against the California Stolen Vehicle System and National Center for Missing &
Exploited Children Amber Alert databases.
Flock clients include Los Altos Hills, Los Gatos, Morgan Hill, and Milpitas. Like Saratoga, Los
Altos Hills contracts with the Santa Clara County Sheriff’s Office for law enforcement services.
After soliciting bids from qualified ALPR vendors, the Los Altos City Council authorized a pilot
program with Flock for a 40-camera deployment in the amount of $110,000 in March 2021 and
initiated discussions with the County of Santa Clara to enable real time notifications to County
Communications. In September 2021, the County Board of Supervisor approved the necessary
actions to enable these real time notifications. The site selection process has started, and cameras
are expected to be installed later this year. The Town of Los Gatos and City of Morgan Hill
launched smaller pilot programs in partnership with Flock this year. In June 2021, Los Gatos Town
Council authorized a two-year pilot with Flock for 15 cameras at the cost of $78,750 over the life
of the pilot. The first camera installations started in September 2021. This September, the City of
Morgan Hill launched a 25-camera pilot for a period of 30 to 60 days.
These communities have been able to conduct these pilots in partnership with Flock due to the
lease model that Flock uses for its cameras. Flock charges an annual flat rate of $2,500 per camera
that includes setup, data, training, and software plus a $250 fee per camera for installation. A
minimum of 5 cameras is required. Under this model, clients can terminate Flock ALPR services
at any time. The system uses cellular data, can run on solar power, and operates using a cloud-
based software, making initial costs much lower than traditional ALPR installations. Additionally,
if enabled, data from ALPR Flock cameras on private property can be shared with the systems
leased by jurisdictions.
Due to the unique nature of this all-inclusive service model and capabilities of the Flock
technology, some communities have foregone the competitive bidding process when partnering
with Flock. This includes the Town of Los Gatos. Saratoga City Code Section 2-45.120(b) allows
the City to proceed without going through the competitive bidding process when a service is
provided by a single source, such as the service offered by Flock. Staff is unaware of any other
vendors that provide a service similar to Flock.
All jurisdictions with an ALPR system are required to adopt a usage and privacy policy under State
law. This policy is intended to limit access and abuse of ALPR data by identifying who will have
access to data, how the ALPR system will be monitored, parameters for sharing ALPR data,
measures that will be taken to protect accuracy of ALPR data, and retention of ALPR data. Raw
data generated by an ALPR system is exempt from disclosure under the California Public Records
Act. Data must be anonymized before it can be shared with the public. Additionally, authorization
from the County Board of Supervisors would be required for data from a City ALPR system to
provide real time alerts to County dispatchers.
If the City Council wishes to consider a pilot ALPR project, the City Council could direct staff to
return at a future meeting with a proposed 1-year Flock Security pilot funded through the City
Council discretionary fund that provides the City Council with the opportunity to review pilot
results and consider funding of an ALPR system as part of the Fiscal Year 2023/2024 budget.
Unless otherwise directed, the pilot proposal could include a suggested number of cameras, project
cost, tentative camera locations, estimated project timeline, outreach program, usage and privacy
policy, and any contract authorizations or funding allocations that may be needed. Like Los Altos

Hills, County Board of Supervisors approvals would be required after authorization of a pilot
program for the system to integrate with County dispatch.

apprehending criminals in the City of Saratoga. Criminals are not going to enter our City if this ALPR use is

Dear Saratoga city council members,
My name is Karthick Iyer and I live in Brookview, Saratoga. I would like to voice my support to
install ALPR cameras in various neighborhoods in Saratoga to reduce/curb the current crime
spree. AI is playing a key role in our lives and it's high time that City of Saratoga took
advantage of this being in Silicon Valley. As AI technology is constantly improving with
software updates, I would expect the capabilities and functionality to keep improving over
time. The counter argument to this could be many of perps use stolen vehicles or stolen
plates, but again ALPR will enable you to flag stolen cameras/stolen plates with an appropriate
alert mechanism to the Sheriff's office, will enable law enforcement to intercept the criminals
as soon as possible. Lets imagine a scenario where an Amber alert issued for a particular
car/driver and the driver drives through one of our ALPR cameras. This system will ensure that
kid inside the vehicle is reunited with their family as soon as possible.

RECOMMENDED ACTION:
Approve the resolution in support of the proposed statewide initiative regarding local land use
referred to as the Californians for Community Planning Initiative by proponents.
BACKGROUND:
On August 26, 2021, a proposed statewide initiative was filed with the Attorney General. The
proponents’ website calls the measure the Californians for Community Planning Initiative. The
measure would amend the California Constitution to provide that local planning and zoning laws
prevail over any conflicting state laws. The goal of the measure is to exempt local governments
from a range of State laws such as the recently approved Senate Bill (SB) 9, which allows
development of multiple units on lots zoned for single family uses and SB 10 which allows City
Councils to override local voter initiatives such as Measure G to approve specified types of housing
development projects. Other state laws would also be affected by the measure.
The proposed initiative has been submitted to the Office of the Attorney General and is awaiting
circulating title and summary. Once completed, the proponents will have 180 days to collect
signatures for the initiative to qualify for placement on the November 2022 ballot.
On October 6, 2021, the City Council directed staff to return with a resolution of support for the
proposed statewide initiative.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA
IN SUPPORT OF PROPOSED STATEWIDE INITIATIVE REGARDING LOCAL LAND USE
(CALIFORNIANS FOR COMMUNITY PLANNING INITIATIVE)
WHEREAS, in recent years, California has experienced a growing need for affordable housing and the
State has enacted many laws that seek to address that need by stripping cities and counties of their control of local
land use decisions to increase the supply of market rate housing; and
WHEREAS, many of these State laws are based on the misconception that local planning and zoning
regulations are a significant barrier to affordable housing development and eliminating local control will spur
developers and property owners to build additional affordable housing; and
WHEREAS, the oversimplification of the affordable housing crisis has led to the adoption of Senate Bill
35, Senate Bill 9, and other similar laws that penalize communities that lack significant housing development
markets; and
WHEREAS, Attachment A to this resolution is a proposed statewide initiative referred to by its
proponents as the Californians for Community Planning Imitative that has been submitted to the State of California
Office of the Attorney General with the goal of being placed on the November 2022 ballot; and
WHEREAS, if the initiative qualifies and is approved by voters, it would amend the California
Constitution to provide that local planning and zoning laws prevail over any conflicting State laws with the goal
to exempt local governments from laws such as the recently approved Senate Bill 9; and
WHEREAS, the Californians for Community Planning Imitative seeks to eliminate centralized land-use
directives issued by the State and allow communities to manage their own land-use to ensure future growth is
done in a responsible manner in line with the community’s vision for the future.
NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Saratoga does hereby support
the proposed statewide initiative regarding local land use referred to as the Californians for Community Planning
Initiative and reaffirms its prior requests that the California State Legislature and the Governor of California to
seek a collaborative approach to the housing crisis that allows local communities to be part of the solution to the
affordable housing crisis.
The above and foregoing resolution was passed and adopted at a regular meeting of the Saratoga City Council
held on the 20th day of October 2021 by the following vote:
