HomeMy WebLinkAboutOrdinance 381 - Amending City Zoning Map, 18500 Marshall LaneORDINANCE NO.381 AN ORDINANCE AMENDING THE ZONING FOR 18500 MARSHALL LANE FROM AGRICULTURAL (A) TO R-1-40,000 APPLICATION NUMBER: ZOA19-0005 WHEREAS, on June 26, 2019, an application was submitted by John Bellicitti Trustee & ET AL (owner) and 18500 Marshall Ln, LLC (applicant). The applicant is requesting to amend the Zoning Map for the property located at 18500 Marshall Lane. The property is currently zoned Agricultural (A) and is no longer used for agricultural purposes. The applicant is requesting the zone district be amended to R-1-40,000 to allow for residential use on a minimum lot size of 40,000 square feet. WHEREAS, on September 8, 2021, following a public hearing at which the applicant and public had an opportunity to be heard the Planning Commission recommended that the City Council amend the City Zoning Map to remove the existing Agricultural Zone on the 9.24 acres at 18500 Marshall Lane (APN 397-02-111) and apply the R-1-40,000 Zone District to the property. NOW THEREFORE, the City Council of the City of Saratoga hereby ordains as follows: Section 1: The recitals set forth above are true and correct and incorporated herein by reference. Section 2: The project is subject to the California Environmental Quality Act (CEQA) and an Initial Study/Mitigated Negative Declaration was prepared for the project and it has been determined that the project would not have a significant adverse effect on the environment with mitigation measures. Section 3. The City Zoning Map is hereby amended to remove the existing Agricultural Zone on the 9.24 acres at 18500 Marshall Lane (APN 397-02-111) and apply the R-1-40,000 Zone District to the property as shown on Exhibit A attached hereto. Section 4. This ordinance or a comprehensive summary thereof shall be published in a newspaper of general circulation of the City of Saratoga within fifteen days after its adoption. Following a duly noticed public hearing the foregoing ordinance was introduced and read at the regular meeting of the City Council of the City of Saratoga held on the 61h day of October 2021 and was adopted by the following vote following a second reading on the 201" day of October 2021.
