Teleconference/Public Participation Information
The Commission Interviews, Study Session and Regular Session will be held in-person and by
teleconference pursuant to amendments to the teleconference rules required by the Ralph M.
Brown Act allowing teleconferencing during a proclaimed state of emergency when a local official
has recommended social distancing. Members of the City Council and the public may participate
in person at the location listed below or via the Zoom platform using the information below.

Recommended Action:
Provide staff with direction on funding for Fiscal Year 2023/24 Community Event and
Street Closure Grant Program including, 1) secured funding recipients and allocations as
well as total funding amount; 2) secured funding recipient and allocation for the Street
Closure Grant Program; 3) and competitive Community Event Grant Program funding
allocation and application timeline.

2.2. Discussion Regarding Future Teleconferenced Public Meetings Pursuant to Assembly
Bill 2449
Recommended Action:
Receive report on teleconferenced public meetings pursuant to Assembly Bill 2449 and
direct staff to return to “normal” pre-pandemic Brown Act rules for teleconferencing
beginning March 1, 2023.

Draft City Council Minutes for each Council Meeting are taken to the City Council to be reviewed
for accuracy and approval. Following City Council approval, minutes are retained for legislative
history and posted on the City of Saratoga website. The draft minutes are attached to this report
for Council review and approval.

WEDNESDAY, FEBRUARY 1, 2023
SARATOGA CITY COUNCIL REGULAR MEETING
At 6:00 p.m., the City Council held a Joint Session in the Linda Callon Conference Room with
Los Gatos-Saratoga Recreation and the Montalvo Arts Center.
Mayor Fitzsimmons invited public comment.
No one requested to speak.
Mayor Fitzsimmons called the Regular Session to order at 7:03 p.m.
The City Clerk explained the City Council meeting was conducted pursuant to State law as
amended by Assembly Bill 361, which allows the meeting to be conducted by teleconference. The
CityCouncilhasmetalltheapplicablenoticerequirementsandthepublicis welcometoparticipate
in person or by Zoom. Information on how the public can observe the meeting and provide public
comment was provided.

Director provided a report of the City Council Joint Session with Los Gatos-Saratoga Recreation
and the Montalvo Arts Center.

Approve the locations recommended by the Public Art Commission for the 2023 Paint the
City program, including: 1) Saratoga Avenue at State Route 85 North; 2) Saratoga Avenue
at State Route 85 South; and, 3) Saratoga Avenue at Dagmar. Authorize staff to proceed
with next steps of the Paint the City program and to seek State approvals to paint the utility
boxes at the two Saratoga Avenue at State Route 85 locations.

Cities Association of Santa Clara County Board of Directors –stated Cupertino Mayor Hung Wei
was selected to the Executive Board as Member at Large, Sunnyvale Mayor Larry Klein was
reassigned as Second Vice President and the Chair of the Legislative Action Committee, Tina
Walia was reassigned from Member at Large to Secretary-Treasurer; an Interim General Counsel
was selected; and the Board conducted priority setting for 2023.
KSAR Community Access TV Board – stated the Board met with nothing to report.
Santa Clara County Library District Board of Directors –stated the Five-Year Financial Forecast,
10-Year Capital Maintenance Plan and Three-Year Technology Replacement Program were
presented.
Silicon Valley Clean Energy Authority Board of Directors - stated the Executive Committee
selected Tina Walia as Chair and Monte Sereno Mayor Brian Mekechuk as Vice Chair.

Santa Clara Valley Water Commission – provided a brief overview of rate setting, discussed water
allocations for RHNA numbers and ornamental grass restriction ordinance contradicting Clean
Water Authority ordinance encouraging ornamental grass.
Council Member Belal Aftab
Valley Transportation Authority (VTA) Policy Advisory Committee – stated Los Gatos Council
Member Rob Rennie was selected as Chair and Morgan Hill Council Member Yvonne Martinez
Beltran was selected as Vice Chair, stated the Board discussed the prospect of individual cities
having their own Transit Policy on file with VTA and the Committee received a report regarding
increasing bus efficiency.
Saratoga Historical Foundation Board of Directors – stated the Blacksmith exhibit will likely
open in the Spring; stated the Foundation will be holding a fundraiser in July and stated a
presentation regarding the Foundation’s endowment will be provided next month.

RECOMMENDED ACTION:
Provide staff with direction on funding for Fiscal Year 2023/24 Community Event and Street
Closure Grant Program including, 1) secured funding recipients and allocations as well as total
funding amount; 2)secured funding recipient and allocation for the Street Closure Grant Program;
3) and competitive Community Event Grant Program funding allocation and application timeline.
BACKGROUND:
In Fiscal Year 2013/14, City Council approved the implementation of the Community Event and
Street Closure Grant Program to assist local, volunteer-led events that help build a sense of
community in Saratoga. The program includes a competitive application process, as well as
secured funding for several traditional events/organizations, exempting these events/organizations
from the competitive application process.In addition, the program incudes funding for street
closure costs for an event taking place on Big Basin Way. To qualify, events must be: volunteer-
led; located in Saratoga; free and open to the public; focused on Saratoga’s character, diversity, or
history; and, celebrate the community as a whole.
Each year, the City Council confirms the events/organizations that receive secured funding as well
as individual allocation amounts to these events/organizations for the upcoming Fiscal Year. The
Council also establishes total funding for the Community Event Grant Program competitive
process. For the current fiscal year (2022/23), the Council allocated a total of $31,500 for secured
community event grants, $22,000 for a secured street closure grant, and $10,000 for competitive
community event grants.

This grant covers costs associated with closing Big Basin Way, such as permits, signage, and law
enforcement. Staff is requesting direction from the City Council on any changes to the secured
funding recipient and allocation amount forthe Fiscal Year 2023/24 Street Closure Grant Program.

PROGRAM POLICY TITLE: Community Event Grant Program Policy
CITY COUNCIL APPROVAL: July 1, 2020 via Resolution No. 20-047
I. PURPOSE
This policy outlines the criteria Council applies to determine secured and unsecured funding
allocations for the Community Event Grant Program. The objective is to provide guidelines
to administer a program that is in-line with Council direction and is helpful to event
organizers wishing to request community grant funding. This policy is effective with the
Community Event Grant process beginning in December 2019.
II. ELIGIBILITY CRITERIA
The criteria for receiving Community Event Grant funding is listed below:
a. Event is a volunteer-led event held in Saratoga.
b. Event is free and open to everyone.
c. The event concentrates on Saratoga’s character, diversity or history.
d. The event celebrates the community as a whole and is not limited to a small group such
as reunions.
III. PROGRAM REQUIREMENTS
The Community Event Program requirements are listed below:
a. Community Event funding applications are to include an itemized list of expenses
identifying specific expenses desired for grant funding. The application must be
completed, signed, and submitted during the annual application process. Off-cycle
requests are not allowed.
b. Event organizers are to obtain a minimum of $1 million liability insurance coverage for
the event. Events organized by individuals or an informal group of individuals, that are
not a part of or related to any non-profit corporation or other legal business entity, may
request City Council approval for event insurance to be provided by the City’s insurance
program. Events approved to receive event insurance through the City’s insurance
program include: Saratoga’s Independence Day Celebration, Saratoga Village
Development Council events, and Bollywood in the Park.
c. Unsecured event funding requests are limited to a maximum of $2,000.
d. Events run by organizations receiving Secured Community Event Grant Funding are not
eligible to apply for discretionary funding.
IV. ANNUAL APPLICATION PROCESS
The application process begins in December for the following Fiscal Year. The timeline is
outlined below:
a. December - Council reviews and determines both secured and unsecured funding
amounts for the next fiscal year’s Community Grant allocations.
b. January - Applications for unsecured funding grants are available and event organizers
are invited to apply.
c. February - Completed applications are due. Applications are reviewed and compiled for
Council review.

or if the $22,000 is a new grant to replace the past $10,000.
There is no information regarding events by the Chamber of Congress. And I note the 50%
increase in the current budget.
Regarding funding in general, Saratoga is already facing budget challenges which are projected
to get worse every year going forward.
The cost cutting needs to start now and this item is a perfect annual expense to begin this
process.
President Carter believed that each department and program needed to justify funding each
year; funding in the current budget would be no guarantee for funding in the next budget. Zero
base budgeting should apply to all grants; not just the competitive grants.
How will council members make an informed decision if a past event is worth repeating? For
example,
1) Does an event receive any funding from other sources?
2) Is there attendance data?
3) What is the cost per attendee?
4) Is there any accounting of past expenses?
5) Were the expenses reasonable?
You may have additional or other questions.
I suggest you not approve any spending this evening but instead ask staff to obtain from the
grant recipients whatever data you would like in order to make an informed decision at the next
council meeting.
When you do vote either this evening or at the next meeting, my request to the council is the
following:
1) Each grant be be discussed and voted on individually
2) For each grant consider the following options:
a) eliminate all funding
b) partial funding as a matching grant at some percent 100%, 50% etc.

c) fund as in the past
d) increased funding
Obviously I think some of these grants should not be continued especially given the current and
looming budget challenges.
If asked I will be specific this evening or at the next council meeting.
Lastly for whatever reason many of those I talk to are not aware of these events.
Myself until I became involved in city governance in late 2021, my knowledge of these events
was limited to the car show and the Forth of July Celebration and that was because I went to
Kevin Moran park on the fourth one year.

Assembly Bill 2449
RECOMMENDED ACTION:
Receive report on teleconferenced public meetings pursuant to Assembly Bill 2449 and direct staff
to return to “normal” pre-pandemic Brown Act rules for teleconferencing beginning March 1,
2023.
BACKGROUND:
On February 1, 2023 the City Council adopted Resolution 23-009 which authorized
teleconferenced meetings pursuant to Assembly Bill 361 through February 2023. Assembly Bill
2449 (AB 2449)became effective January 1, 2023,and provides a new option for teleconference
meetings of the City Council and Saratoga’s Brown Act bodies (Commissions and Committees).
A detailed description of AB 2449 has been prepared by the City Attorney and is provided as
Attachment A of this report.The two options available, beginning March 1, 2023, are:
1.Resume “normal” pre-pandemic Brown Act requirements for posting agendas at locations
where City Council Members and Commissioners attend meetings remotely and allow
public access to the location(s).
2.Allow the options for “Just Cause” and “Personal Emergency” under AB 2449 as described
in this report in addition to the “normal” pre-pandemic process.
In summary, AB 2449 gives local governments the option of allowing members of legislative
bodies to participate remotely a limited number of times each year if there is “Just Cause”or a
“Personal Emergency.” These terms mean:
Just Cause:A City Council Member/Commissioner “may rely on this provision based on
a need related to: (a) caregiving for certain family members, (b) a contagious illness, (c) a
physical or mental disability, and (d) travelling while on official business for a public
agency.” The City Council Member/Commissioner “is required to provide a general
description of the circumstances relating to their need to appear remotely for just cause.”
Personal Emergency:The City Council/Commission is required “to approve remote
participation and applies only to medical emergencies for the City Council

Member/Commissioner or their family. The City Council Member/Commissioner must
request approval of remote participation and provide a general description of the
circumstances. This description generally need not exceed 20 words and does not require
the member to disclose any medical diagnosis or disability, or any personal medical
information that is already exempt under existing law. There must be a separate request
for each meeting at which the member wishes to participate remotely. The Council may
add such requests to the agenda as an urgency item. The law does not provide any guidance
on standards to be used by the Council in considering requests for remote participation.”
It is recommended that the City Council choose option one returning to “normal” pre-pandemic
Brown Act rules for teleconferencing. These include:
The agenda must list the location of all teleconference locations and the agenda must be
posted at all teleconference locations 72 hours before the meeting.
Teleconference locations must be accessible to the public. Members of the public at each
location must be given the opportunity to address the legislative body.
Votes must be taken by roll call when using teleconferencing during a meeting.
A quorum of the legislative body must be located within the boundaries of the jurisdiction
(either at City Hall or at remote locations within the City).
If the Council chooses the option to allow teleconferencing under AB 2449, the requirements are:
City Responsibilities:
A quorum must be present at a “singular physical location clearly identified on the agenda.”
o If there is less than a quorum at the location listed on the agenda, then no Council
Member (or Commissioner for Commission meetings) may participate using either
the ‘Just Cause’ or ‘Personal Emergency’ provisions.
o If one or more Council Members (or Commissioners) attending in person leaves
the meeting which results in less than a quorum at that location, then any Council
Member or Commissioner using the Just Cause or Personal Emergency provisions
may no longer participate in the meeting.
o The meeting can only continue as long as a quorum participates in person OR with
members using the “usual” option of posting the agenda, etc. at the remote location
with a quorum present in Saratoga either at City Hall or at City Hall in combination
with remote locations in the City.
The City must provide, (1) for public observation of the meeting via either a two-way
audiovisual platform, or a two-way telephonic service accompanied by live webcasting;
(2) opportunities for the public to comment via a call-in option, an internet-based option,
and an in-person location; and (3) information on how to observe and comment in all
notices of the meeting. In accordance with the City’s Remote Public Participation Policy,
the City currently provides the public with the option to observe and participate in City
Council, Council Committee, and Commission meetings held in the Civic Theater and
Linda Callon Conference Room in person, by telephone, or internet-based meeting option.
Information about public participation options is provided on agendas for meetings held in
both locations.
The City must provide procedural protections to ensure that the Council takes no action
during a disruption that prevents the public from observing or commenting on the meeting.
This meansameeting would need to stop if there were any disruptions to call-in or internet-
based meeting observation and participation options and may not continue until service is
resumed. Note that this differs from the “normal” pre-pandemic rules that would allow the
meeting to continue.

City Council Member/Commissioner Responsibilities:
Must participate via both audio and visual technology. If the Council Member’s audio or
visual connection is lost during the meeting, the Council Member may not participate until
the connection is restored.
Must disclose at the meeting before action is taken whether there are any adults in the room
and disclose general nature of the relationship.
Must not have exceeded the limits on use of the Just Cause and Personal Emergency
provisions during the calendar year.
o AB 2449 provides that “No member may participate remotely using those
provisions more than three consecutive months or 20 percent of the regular
meetings…” and no member “may rely on one or both of the Just Cause and
Personal Emergency provisions no more than a total of four times per year.” For
perspective, the Council typically holds 23 regular meetings per year; 20 percent of
23 is 4.6 meetings. Regular Commission Meetings generally vary from 6 to 12
meetings per year. For Commissioners who have 12 regular meetings per year, they
may rely on one or both provisions listed no more than a total of two times per year.
Commissioners that have 6 regular meetings per year, may rely on one or both
provisions listed no more than once per year.
o City staff would work to develop procedures and systems to track use of the
exceptions by each Council Member and Commissioner.
If the Council directs staff to allow teleconferencing under AB 2449, staff will return with
proposed amendments to the Council Norms and Rules of Procedure integrating the various
requirements of AB 2449. Attachment B is a sample procedure and checklist for AB 2449
implementation prepared by another city.

RE:AB-2449 and Teleconferencing
The legislature has approved and the Governor has signed Assembly Bill 2449 (“AB 2449”)
adding a new limited teleconferencing option to remain in effect until December 31, 2025. This
adds a new way for Council members and Commissioners to teleconference for Council and
Commission meetings if the Council authorizes its use.
Prior to AB 2449 there were two teleconferencing options:
1. “The Usual” option: This option is generally the teleconferencing option that has
historically been available; it requires the Council member/Commissioner to post
a hard copy of the agenda at their remote location and allow the public to
physically attend the meeting at the location where the official is located (e.g.,
home, office, or hotel room). This option does not have a sunset; it is planned to
still be available after 2025. (See Government Code section 54953(b).)
2. “The Covid Emergency” option: This option is essentially the same as the
teleconferencing option the legislature adopted in September 2021 in response to
Covid (commonly referred to as AB 361); as before, it requires the Council to
monthly make certain findings regarding the state of emergency and its impact on
the ability to safely meet, and/or the continued imposition or recommendation of
measures to promote social distancing. This option sunsets at the end of 2023 and
will become unavailable if the Governor rescinds the COVID emergency as
expected on February 28, 2023.
AB 2449 adds a third option: The “Just Cause or Personal Emergency” option. It provides two
distinct grounds for a Council member or Commissioner to attend remotely: (i) for Just Cause, or

(ii) for a personal Emergency. The legislation provides somewhat complicated criteria that must
be satisfied, procedures that must be implemented, and strict recordkeeping requirements and
limitations on the number of times an official can rely on these bases to attend remotely. This
option is scheduled to sunset at the end of 2025. (See Government Code section 54953(f)
1.)
We describe the new Just Cause or Personal Emergency option below and present a table
summarizing and comparing each of the three options.
The Just Cause and Personal Emergency Option
Note that the discussion below assumes that the COVID Emergency option is no longer
available. To be a bit less wordy, this memo uses the terms “Council member” and “City
Council” even though all the provisions would also apply to Commissioners and Commissions if
the Council decides that the City should allow use of this option.
For a Council member to rely on either the Just Cause or Personal Emergency provisions the
following requirements must be met:
1.At least a quorum of the Council must be present at a singular physical location clearly
identified on the agenda. If there is less than a quorum at the specified location, then no
Council member may participate using either the just cause or personal emergency
provisions. If one or more Council members attending at the specified physical location
leave the meeting such that there is less than a quorum at that location then any Council
members using the Just Cause or Personal Emergency provisions may no longer
participate in the meeting. The meeting may continue as long as there is a quorum of
Council members participating in person or from remote locations using “The Usual”
option.
2.The City must notice the meeting and meet certain minimum technological requirements.
Specifically, the City must provide (1) for public observation of the meeting via either a
two-way audiovisual platform, or a two-way telephonic service accompanied by live
webcasting; (2) opportunities for the public to comment via a call-in option, an internet-
based option, and an in-person location; (3) information on how to observe and comment
in all notices of the meeting; and (4) procedural protections to ensure that the Council
takes no action during a disruption that prevents the public from observing or
commenting on the meeting.
3.The Council member must participate via both audio and visual technology. If the
Council member’s audio or visual connection is lost during the meeting, the Council
member may not participate until the problem is resolved (these circumstances should be

noted in the minutes. Note that this requirement differs from “the Usual” option which
allows participation by audio only).
4.The Council member must disclose at the meeting before action is taken whether there
are any adults in the room with the Council member and must disclose the general nature
of the member’s relationship with any such individuals.
5.The Council member must not have exceeded the limits on use of the Just Cause and
Personal Emergency provisions during the calendar year. No member may participate
remotely using those provisions more than three consecutive months or 20 percent of the
regular meetings Council within a calendar year. The Council meets 23 times per year;
20 percent of 23 is 4.6. This means that Council members may rely on one or both of the
Just Cause and Personal Emergency provisions no more than a total of four times per
year. (The number for Commissioners will depend on the number of regular meetings
each year for the Commission on which they serve.)
6.The Council member must inform the Council of their need to participate remotely for
Just Cause or a Personal Emergency “at the earliest opportunity possible.” The
legislation acknowledges that this may be as late as the start of the Council meeting in
question.
If the requirements above are satisfied, then a Council member may rely on either the Just Cause
or Personal Emergency if the following additional requirements are satisfied:
Just Cause – A Council member may rely on this provision based on a need related to:
(a) caregiving for certain family members, (b) a contagious illness, (c) a physical or
mental disability, and (d) travelling while on official business for a public agency. The
Council member is required to provide a general description of the circumstances relating
to their need to appear remotely for just cause.
Personal Emergency – This provision requires the Council to approve remote
participation and applies only to medical emergencies for the Council member or their
family. The Council member must request approval of remote participation and provide
a general description of the circumstances. This description generally need not exceed 20
words and does not require the member to disclose any medical diagnosis or disability, or
any personal medical information that is already exempt under existing law. There must
be a separate request for each meeting at which the member wishes to participate
remotely. The Council may add such requests to the agenda as an urgency item. The law
does not provide any guidance on standards to be used by the Council in considering
requests for remote participation.
If the City elects to allow Council members to participate using the Just Cause and Personal
Emergency provisions we recommend that it add a standing agenda item to receive Just Cause
reports and Personal Emergency Requests. In the event of such a report the City Clerk can verify

that the baseline procedural requirements above have been satisfied. In addition, we recommend
that staff make clear to Council members that there is no assurance that a Council member will
be able to participate using the Just Cause/Personal Emergency exception. If a quorum of the
Council is not attending from a single physical location neither option will be available and the
Personal Emergency option is available only at the discretion of the full Council.

AB 2449 ATTENDANCE BY A MEMBER VIRTUALLY - PROCEDURE
Member prior to the meeting must do the following:
1. Notify the legislative body at the earliest opportunity possible, including at the start of a regular
meeting, of their need to participate remotely for “just cause” including a general description of
the circumstances relating to their need to appear remotely at the given meeting;

a. a childcare or caregiving need of a child, parent, grandparent, grandchild, sibling, spouse,
or domestic partner that requires a member to participate remotely

publicly disclose whether any individual over the age of 18 is present at the remote location with
the member and the general nature of the member’s relationship with the individual.
