BACKGROUND:
Youth Art Month is celebrated each year in March to emphasize the value of art education and to
encourage support for excellent school art programs. Youth Art Month provides a forum for
acknowledging skills that are fostered through experience in art education programs.

PROCLAMATION OF THE CITY COUNCIL
OF THE CITY OF SARATOGA DECLARING
MARCH 2023 AS YOUTH ART MONTH
WHEREAS, Youth Art Month is an annual celebration in March supported through
the Council for Art Education and is recognized by cities, counties, and states across the
United States; and
WHEREAS, the 2022/2023 theme of Youth Art Month is “Your Art, Your Voice”;
and
WHEREAS, arts education helps students develop creative problem-solving and
critical thinking abilities, as well as provides students with a deeper understanding of
multicultural values and beliefs; and
WHEREAS, the Santa Clara County Office of Education is committed to supporting
the arts to inspire and prepare students for success in the 21
st century by using arts education
to reinforce the skills students will need to become productive, contributing members of a
strong community; and
WHEREAS, art education brings creativity and innovation to the classroom through
collaborative strategies developed by a team of administrators, teachers, parents, students,
artists, and community leaders; and
WHEREAS, arts-learning strategies and arts integration help students build critical
thinking skills, curiosity, flexibility, communication, innovation, and collaboration, which
are key traits for success in post-secondary education and the workplace; and
WHEREAS, the Saratoga City Council is dedicated to bringing art to the City of
Saratoga through its public art program and efforts of the Public Art Commission, such as
Saratoga Loves Poetry, the Online Art Challenge, and Paint the City.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Saratoga
does hereby proclaim March 2023 as Youth Art Month and encourages Saratoga residents to
support the arts in schools.

SARATOGA CITY COUNCIL REGULAR MEETING
Mayor Fitzsimmons called the Regular Session to order at 7:00 p.m.
The City Clerk explained the City Council meeting was conducted pursuant to State law as
amended by Assembly Bill 361, which allows the meeting to be conducted by teleconference. The
CityCouncilhasmetalltheapplicablenoticerequirementsandthepublicis welcometoparticipate
in person or by Zoom. Information on how the public can observe the meeting and provide public
comment was provided.

Council Member Tina Walia
Silicon Valley Clean Energy Authority Board of Directors - stated the Board allocated additional
$2M for community grants for a total of $3.5M; stated all member communities have moved
forward to reduce emissions and discussed the 2022 Community Impacts Report.
Cities Association of Santa Clara County Board of Directors - stated the Interim Executive
Director Shali Sirkay, was appointed as Executive Director; 2023 Board priorities have been
approved, and the Board received a report from Planning Collaborative related to an Accessory
Dwelling Unit program.

West Valley Sanitation District Board of Directors – stated the Board met in Closed Session for
discussion related to a lawsuit with the City of San Jose; the Board approved an item regarding
transfer of unclaimed funds.
West Valley Clean Water Program Authority Board of Directors – stated the Board discussed the
fourth amendment to the Urban Runoff Program and stated the Board will be conducting a public
opinion poll related to a State mandate to manage flow of water to storm drains.
West Valley Solid Waste Management Authority Board of Directors – stated the Board discussed
the new waste hauler contract that takes effect March 2024 with no rate increase.

Valley Transportation Authority (VTA) Policy Advisory Committee - stated the Committee
reviewed the bus stop plan and process for improvements to bus stops for Santa Clara County.
Vice Mayor Yan Zhao
Silicon Valley Regional Interoperability Authority Alternate – stated she was sworn in as the
Alternate Authority Member, Council Member Dan Furtado from the City of Campbell was sworn
in as Authority Member representing West Valley Cities; the Board is made up of 11 Board
Members; Russ Melton from Sunnyvale is Chair, Vice Chair is Karen Hardy from the City of Santa
Clara; the Executive Director provided a verbal update on several items including the Motorola
Systems upgrade, cybersecurity and regional interoperable communication success stories.
Saratoga Ministerial Association – stated the Association discussed winter activities, a potential
spring event, and discussed establishing a presence on social media platforms.

Cities Association of Santa Clara County-City Selection Committee – stated Sergio Lopez from
the City of Campbell and Vicki Veenkeer from the City of Palo Alto were chosen for the Bay
Area Air Quality Management District; Local Agency Formation Commission (LAFCO)
appointees are Russ Melton from the City of Sunnyvale and alternate Mark Turner from the City
of Morgan Hill; Metropolitan Transportation Commission appointee is Margaret Abe-Koga from
the City of Mountain View.
Council Finance Committee – stated the Committee received the fee study results, directed staff
to return with additional fee analysis regarding impact of increased fees, staff presented an
overview of the RFP for Auditing Services and an overview of financial policies.

RECOMMENDED ACTION:
Review and accept the Treasurer’s Report for the month ended January 31, 2023.
BACKGROUND:
California government code section 41004 requires that the City Treasurer submits to the City
Clerk and the legislative body a written report and accounting of all receipts, disbursements, and
fund balances. The Municipal Code of the City of Saratoga, Article 2-20, Section 2-20.035
designates the City Manager as the City Treasurer. This report is prepared to fulfill this
requirement.

Cash and Investments Balance by Fund
As of January 31, 2023, the City’s unaudited cash and investments totaled $39,857,121. The
City Council’s adopted policy on the Working Capital Reserve Fund states that effective July 1,
2016: for cash flow purposes and to avoid the occurrence of dry period financing, pooled cash
from all funds should not be allowed to fall below $1,000,000. The total pooled cash balance of
$39.9 million exceeds the minimum amount required.

City’s Current Financial Position
In accordance with California government code section 53646 (b) (3), the City is financially well
positioned and able to meet its estimated expenditure requirements for the next six months. As of
January 31, 2023, the City’s financial position (Assets $40.0M, Liabilities $5.0M, and Fund
Equity $35.0M) remains very strong and there are no issues in meeting financial obligations now
or in the foreseeable future.
The following Fund Balance schedule represents actual funding available for all funds at the end
of the monthly period. This amount differs from the above Cash Summary schedule as assets and
liabilities are components of the fund balance. As illustrated in the summary below, Total Cash
is adjusted by the addition of Total Assets less the amount of Total Liabilities to arrive at the
Ending Fund Balance –which represents the actual amount of funds available.

RECOMMENDED ACTION:
Adopt the Resolution granting final map approval of parcel map application No. SUB22-0002
for two lots located at 20615 Leonard Road (APN: 503 19 073).
BACKGROUND:
Attached is a Resolution, which, if adopted, will grant final approval for a two lot Parcel Map
located at 20615 Leonard Road (APN 503 19 073). This map is for the urban lot split utilizing the
ministerial process enabled by SB9.Under the Subdivision Map Act, the Council “shall …approve
the map if it conforms to all the requirements of [the Map Act]and any local subdivision
ordinance.” The City Engineer has examined the final map and related documents submitted to the
City in accordance with the provisions of Section 14.40.020 of the Municipal Code and it was
determined that:
1.The Subdivision Map Act, the City's Subdivision Ordinance and all other applicable
provisions of law have been complied with.
2.The final map is technically correct.
Consequently, the City Engineer’s certificate has been executed on the final map and the final map
has been filed with the City Clerk pursuant to Section 14.40.040 of the Municipal Code for action
by the City Council.

SUBJECT:Santa Clara Valley Urban Runoff Pollution Prevention Program Agreement-
Fourth Amendment
RECOMMENDED ACTION:
1.Authorize the City Manager to execute a Fourth Amendment to the Santa Clara Valley Urban
Runoff Pollution Prevention Program (SCVURPPP) Agreement.
2.Appoint the West Valley Clean Water Authority Executive Director as the SCVURPPP
Representative for the City.
BACKGROUND:
The SCVURPPP is an association of 15 agencies in Santa Clara County (13 local cities and towns,
County of Santa Clara, and Santa Clara Valley Water) that share a common National Pollutant
Discharge Elimination System (NPDES) permit to discharge stormwater to the San Francisco Bay.
SCVURPPP assists its members in the implementation of pollution prevention, source control,
monitoring and outreach programs aimed at reducing pollution in stormwater runoff, protecting
water quality and beneficial uses of San Francisco Bay and Santa Clara Valley creeks and rivers.
The City of Saratoga entered into a Memorandum of Agreement (MOA) to participate in
SCVURPPP in 1999. A first amendment to the agreement was executed in 2005, a second
amendment in 2006, and a third amendment in 2016 authorizing the continuation of SCVURPPP,
each without changing the original terms.The current term of the MOA governing the SCVURPPP
is set to expire on June 30, 2023.The fourth amendment to the Agreement will extend the original
terms of the MOA to June 30, 2027.
The MOA includes a cost-sharing formula that allocates 30.2% of program costs to Valley Water,
30.1% to the City of San Jose, and the remainder to the remaining 13 other municipalities that
participate in the SCVURPPP in a manner roughly proportionate to community size and runoff
from respective jurisdictions. The City of Saratoga’s proportionate share of the program costs is
1.59%.For fiscal year 2023-2024,the SCVRPPP’s total cost is $5.66 million, of which Saratoga’s
share totals $89,970.

While the MOA amendment does not propose to change the cost distribution methodology, total
program costs have increased. Saratoga’s Fiscal Year 2023-3034 costs are approximately 8%
higher than the previous year amount of $82,568. The increase is mostly due to the increase in
MRP requirements. Attachment B shows SCVURPPP totals per agency for the past three years.
SCVURPPP fees are paid through the West Valley Clean Water Authority, a Joint Powers
Authority (JPA), rather than directly by the City of Saratoga. The JPA serves as the Stormwater
Pollution Prevention Authority for the cities of Campbell, Monte Sereno, Saratoga and Town of
Los Gatos. In this capacity, the Authority develops an annual work plan to fulfill requirements of
the NPDES permit. The Executive Director serves as the SCVURPPP representative for the
Authority members and has participated in the SCVURPPP Management Committee since the JPA
was established in 2018 but has not been formally appointed to serve as the City’s representative.
Consequently, staff recommends that the City Council formally appoint the Clean Water Program
Authority Executive Director as the SCVURPPP Representative for the City in addition to
authorizing the City Manager to execute the Fourth Amendment to the SCVURPPP Agreement.

POLLUTION PREVENTION PROGRAM
THIS FOURTH AMENDMENT TO AGREEMENT PROVIDING FOR
IMPLEMENTATION OF THE SANTA CLARA VALLEY URBAN RUNOFF
POLLUTION PREVENTION PROGRAM (the “Amendment”) is entered into by and
between the SANTA CLARA VALLEY WATER DISTRICT, a local public agency of
the State of California (“District”); CITY OF CAMPBELL, a municipal corporation of
the State of California; CITY OF CUPERTINO, a municipal corporation of the State of
California; CITY OF LOS ALTOS, a municipal corporation of the State of California;
TOWN OF LOS ALTOS HILLS, a municipal corporation of the State of California;
TOWN OF LOS GATOS, a municipal corporation of the State of California; CITY OF
MILPITAS, a municipal corporation of the State of California; CITY OF MONTE
SERENO, a municipal corporation of the State of California; CITY OF MOUNTAIN
VIEW, a municipal corporation of the State of California; CITY OF PALO ALTO, a
municipal corporation of the State of California; CITY OF SAN JOSE, a municipal
corporation of the State of California; CITY OF SANTA CLARA, a municipal
corporation of the State of California; CITY OF SARATOGA, a municipal corporation
of the State of California; CITY OF SUNNYVALE, a municipal corporation of the State
of California; and COUNTY OF SANTA CLARA, a political subdivision of the State of

All of the above-mentioned entities are hereinafter collectively referred to as
“Parties” or individually as “Party.”
RECITALS
A.The Parties previously entered into that certain Agreement Providing For
Implementation of the Santa Clara Valley Urban Runoff Pollution Prevention Program
(the “Agreement” or “MOA”) pursuant to which the Parties established certain terms and
conditions relating to the implementation and oversight of the Santa Clara Valley Urban
Runoff Pollution Prevention Program (the “Program”), including a cost sharing
allocation, which was appended thereto as Exhibit A. Unless otherwise set forth herein,
all terms shall have the meaning set forth in the Agreement as amended. A copy of the
Agreement inclusive of Exhibit A is attached hereto as Appendix 1. A copy of the
Agreement inclusive of all of its previous amendments is available via the internet at

content/uploads/2019/10/MOA_2016_complete_package_DEC_2016.pdf);
B.The Agreement originally provided for a five-year term, which, based on
its execution, was set to conclude on or about March 10, 2005. However, on or about
February 20, 2005, the Parties unanimously entered into a First Amendment to the
Agreement, which extended the term of the Agreement by one additional year;

C.The Parties thereafter unanimously entered into a Second Amendment to
the Agreement, which extended the term of the amended Agreement by “one fiscal year
beyond the termination date of the (then) next NPDES Permit issued to the Parties,
including any administrative extension of the (then) next NPDES Permit’s term which
occurred pursuant to the NPDES regulations.” The next NPDES permit applicable to the
Parties (and others) was subsequently adopted by the California Regional Water Quality
Control Board, San Francisco Bay Region (“RWQCB SFBR”) on October 14, 2009 and
was known as the Municipal Regional Permit (“MRP”) because it covered numerous
public agencies in the San Francisco Bay Region in addition to the Parties. The MRP
was then administratively extended until a new NPDES Permit applicable to the Parties
(and the other public entities in the San Francisco Bay Region) was adopted by the
California Regional Water Quality Control Board, San Francisco Bay Region, on
November 19, 2015 (“MRP 2.0”). MRP 2.0 became effective on January 1, 2016 and
was originally scheduled to terminate on December 31, 2020;
D.The Parties thereafter unanimously entered into a Third Amendment to the
Agreement, which once again extended the term of the amended Agreement by “one
fiscal year beyond the termination date of the next NPDES Permit issued to the Parties,
including any administrative extension of the next NPDES Permit’s term which occurred
pursuant to the NPDES regulations.” MRP 2.0 was then administratively extended,
largely due to the COVID-19 pandemic, until a new NPDES Permit applicable to the
Parties (and the other public entities in the San Francisco Bay Region) was adopted by
the California Regional Water Quality Control Board, San Francisco Bay Region, on
May 11, 2022 (“MRP 3.0”). MRP 3.0 became effective on July 1, 2022 and is currently
scheduled to terminate on June 30, 2027 unless administratively extended;
E.The Parties expect to utilize the Program to continue to represent their
interests relative to MRP 3.0 (including with respect to an administrative appeal of its
adoption that the State Water Resources Control Board is considering to pursue on its
own motion), to help them effectuate certain aspects of compliance with MRP 3.0, and,
beyond that, in negotiating the terms of a further renewed NPDES Permit when MRP 3.0
nears the end of its anticipated five-year term and any administrative extension provided
thereto;
F.The Parties also expect to continue to utilize the Program’s preferred
approach of achieving consensus to resolve issues and reach decisions, and to rely on the
Majority Vote mechanism set forth in Section 2.08 of the Agreement at the Management
Committee level only when consensus-based resolutions appear or become elusive;
G.The Parties now desire to update the Agreement as previously amended
and further extend the term of the MOA as set forth below;
H.Section 7.02 of the MOA provides that it may be amended by the
unanimous written agreement of the Parties and that all Parties agree to bring any
proposed amendments to their Council or Board, as applicable, within three (3) months
following acceptance by the Management Committee; and

I.The Program’s Management Committee accepted this Amendment for
referral to the Parties’ Councils and/or Boards at its meeting on January 19, 2023.
NOW, THEREFORE, THE PARTIES HERETO FURTHER AGREE AS
FOLLOWS:
1. Recognition of Current Permit. Recital F of the Agreement, as previously
amended, is hereby further amended by the addition of the following subsections:
6. Order No. R2-2009-0074 (the Municipal Regional Permit, NPDES
Permit CAS612008); adopted October 14, 2009 and amended by the
RWQCB SFBR on November 28, 2011;
7. Order No. R2-2015-0049 (MRP 2.0, NPDES Permit CAS612008);
adopted by the RWQCB SFBR on November 19, 2015;
8. Order No. R2-2022-0018 (MRP 3.0, NPDES Permit CAS612008);
adopted by the RWQCB SFBR on May 11, 2022.
2. Extension of Term of Agreement. Sections 6.02 and 6.02.01 of the
Agreement, as previously amended, are hereby replaced as follows:
This Agreement shall have a term extending one fiscal year
beyond the date of termination of MRP 3.0; such termination
date shall, however, be deemed to include any administrative
extension of MRP 3.0 which occurs or arises pursuant to the
NPDES regulations or any modification of the MRP 3.0
termination date that arises from an NPDES permitting action
undertaken by the RWQCB SFBR or California State Water
Resources Control Board.
3. Superseding Effect. This Fourth Amendment of the Agreement shall
supplement all prior amendments of the Agreement and supersede any conflicting
provisions of the prior amendments of the Agreement.

development in Very High Fire Hazard Severity Zones
RECOMMENDED ACTION:
Adopt the Resolution establishing a process for review of development applications subject to
Public Resources Code section 4290 concerning development in Very High Fire Hazard Severity
Zones.
BACKGROUND:
Public Resources Code section 4290 directs the California Board of Forestry and Fire Protection
(“Cal Fire”) to adopt regulations establishing wildfire protection standards for development in
Very High Fire Hazard Severity Zones (VHFHSZ). (These are known as the “FireSafe
Regulations.”) For decades, the FireSafe Regulations only applied in limited areas throughout the
State, but in 2018 the Legislature expanded their scope and beginning on July 1, 2021 they apply
to a significant portion of the City. (The regulations are set forth at 14 Cal. Code Regs. §§ 1274.00-
1276.04. They do not apply to accessory dwelling units or to parcels created before 1991 subject
to conditions relating to the perimeters and access to the buildings.) The VHFHSZ in Saratoga is
shown in Attachment B.
For a wide range of projects in the VHFHSZ the FireSafe Regulations require review by CalFire
or its designee (in this case the Santa Clara County Fire Department)of the project’s compliance
with the FireSafe Regulations. The most critical standard requires all roads in areas subject to the
Regulations to ensure two-way traffic flow with at least two, 10-foot wide lanes. (These roads
must be paved, with the ability to support at least 75,000 pounds, and the grade generally cannot
exceed 16%. The regulations also contain access requirements relating to turnouts and
turnarounds, dead-end roads, bridges, and gate entrances.)
Because much of the VHFHSZ area is in the City’s hillsides, most, if not all, of the roads subject
to the FireSafe Regulations in Saratoga do not meet this standard. In such cases,the reviewing
authority typically rejects the application, requiring resubmittal with plans showing compliance
with the technical specifications of the FireSafe Regulations. It is infeasible for most projects to
comply not only due to cost, but also environmental impacts and the need for land acquisition for
sufficient rights-of-way.Although the FireSafe Regulations contain a process allowing exceptions

for applicants showing that their projects are designed to provide the “same practical effect” as the
standards that are not feasible due to due to health, safety, environmental conditions, physical site
limitations or other limiting conditions, state regulators have not provided guidance on what such
measures would include.
Santa Clara County faces a similar situation and has adopted a process whereby it conducts project
specific evaluations on a case-by-case basis for single-family residential development on existing
lots along existing roads once the reviewing authority has identified that the project does not fully
comply with the road access standards listed in the FireSafe Regulations. The evaluation considers
an engineering cost estimate for the improvements necessary to comply and determines whether
the County can waive compliance with some or all of the FireSafe Regulations on the basis that
applying them would violate the State or Federal Law.
The attached resolution would implement a similar process in Saratoga. Development applications
would continue to be submitted to the applicable reviewing authority. If it is determined that the
project does not fully comply with the road access standards listed in the Fire Safe Regulations the
applicant would have the option of revising the plans or providing the City with information
concerning the infeasibility of compliance and a request that the City determine that applying the
standards would violate State or Federal law. This determination would be made by the City
Attorney’s office in consultation with the Community Development Department and Department
of Public Works based on factors such as the cost and feasibility of necessary improvements and
rights of way.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA
AUTHORIZING ADOPTING PROCEDURES FOR REVIEW OF DEVELOPMENT
CONDITIONS SUBJECT TO PUBLIC RESOURCES CODE 4290
WHEREAS, in accordance with Public Resources Code 4290 the State Board of Forestry has
adopted regulations establishing wildfire protection standards for development in Very High Fire Hazard
Severity Zones (VHFHSZ); and
WHEREAS, these regulations are set forth at are set forth at 14 Cal. Code Regs. §§ 1274.00
et seq. and are known as the “Fire Safe Regulations;”
WHEREAS, the Fire Safe Regulations establish various roadway standards that, due to the
topography in the City of Saratoga, are not met by many current roads and improving these roads to meet
the roadway standards would pose significant engineering, environmental, and economic challenges; and
WHEREAS, in certain cases conditioning approval of residential development on completion
of off-site roadway improvements pursuant to the Fire Safe Regulations may be in violation of state and/or
federal law.
NOW, THEREFORE,the City Council of the City of Saratoga hereby determines that
applications for residential development on existing lots in the Very High Fire Hazard Severity Zone
subject to the Fire Safe Regulations shall be processed as follows:
1.Applications shall be forwarded to the reviewing authority specified in the regulations;
2.Following this review, if the reviewing authority determines that project changes or conditions
concerning offsite roadway improvements are required, the applicant may request that the City review
those changes or conditions to determine if they may violate state or federal law by submitting a
written request together with documentation of the facts and circumstances that the applicant believes
create a conflict with state or federal law;
3.The City Attorney, in conjunction with Department of Public Works and the Community
Development Department, shall review the application; and
4.If the City Attorney determines that the offsite roadway improvement conditions are likely to
violate state or federal law then the Community Development Department shall not impose the
conditions so identified as part of the permit(s) issued for the project.

3. All exceptions should include a public review and comment
period so that local residents understand the potential impact of a
proposed exception and can provide input. Someone making a
decision in an office by looking at a map and discussing the
options with the applicant does not have the insight that local
residents can provide. And in our hillsides, notification of a
proposed exception should be sent to all residents within a five
(5) mile radius as a minimum in order to notify “all” impacted
residents. (NOTE: Only notifying residents who live within 500
feet of the applicant meets the letter of CEQA regulations but
does not meet the spirit of the regulation to notify ALL impacted
residents.)
I love our hillsides. I hope that you will do everything you can to
protect this beautiful place and the residents who live here. None
of us are safe from wildfires. It is not reasonable to think “this will
never happen here” or the “requirement to meet the Firesafe
Regulations is not proportionate to the impacts of a project.”
Saving one life or keeping one person out of harm’s way in an
emergency is worth everything.
Please make Resolution No. 23 very specific – 1/ only apply to
single-family residences, 2/ specify the City approves any
alternate conditions, and 3/ require a public review and comment
period for the exception.

Comments Dear City Council Members,
Making any exceptions to Firesafe Regulations should be done
with extreme caution and care. The number one priority should
be safety of residents and ease of evacuation. The Santa Clara
Fire Department and Cal Fire have been extremely cognizant of
these risks to residents in prioritizing their safety. With this in
mind, Resolution No. 23 is far too broad and should be very
specific.
1. Exceptions should only be considered for single-family
residences, not generic “residential development.”
2. The exception process should NOT be applied to multi-family
developments - regardless of whether they are multi-family
dwellings or a group of closely clustered single-family homes.
This will generate a lot of traffic in a small area and put residents
and people at risk way during an emergency evacuation.
3. The exception process should NEVER be applied to any
commercial operations that generate lots of traffic on our
winding, rural roads.
Any exceptions being considered should include a public review
and comment period, so that local residents can understand the
potential impact of a proposed exception and provide input. This
is not a decision to be made in an office by looking at a map and
discussing the options with the applicant, without the insight and
input that local residents can provide.
And in our highly vulnerable residential hillsides where most
parcels are over an acre, notification of a proposed exception
should be sent to all residents within a five (5) mile radius as a

minimum in order to notify “all” impacted residents. (NOTE:

In an emergency evacuation such as a wildfire (which has
literally been in our backyards on several occasions in the recent
past) access to the hillsides by CalFire and other emergency
personnel, along with a safe exit for residents from our hillsides
are absolutely necessary to protect life. Our weather patterns
and conditions dictate that we need to continue to be cautious to
ensure safety of our residents and neighborhoods.

We read the House Winery Developmental Review comments from the Saratoga Fire
Department.
Upon reading the Saratoga Fire Department comments, a few notes alarmed me.
1. The Winery is located in a Very High Fire Hazard Severity Zone (VHFHSZ). The winery's
commercial operation with a kitchen substantially increases the fire risk in this VHFHSZ. The
homes affected by operating the winery is far beyond the 500 feet limit and could potentially
be a hazard to all the hillside homes in the vicinity.
2. The fire safety of the Saratoga residents is of paramount importance to the city's leadership
with top priority to save lives in the event of a fire. Making exceptions and using loopholes to
grant permits to The House Family Winery may in the long run cause evacuation delays
during an emergency and jeopardize the safety of the residents. The alternate routes noted in
the report - a) jeopardizes The House winery evacuations through longer, less familiar roads to
safety and b) poses great danger to local residents, preventing smooth and quick evacuation,
due to the increased winery traffic on these single lane mountain roads. We residents already
experience extremely slow traffic and road delays when there are concerts in nearby wineries.
During an emergency, there is bound to be more traffic congestion and fewer exit options.
Adding one more commercial operation in this residential neighborhood, with additional
traffic generated by winery staff and guests may lead to disastrous results.
We urge the council to apply the rules in the spirit of providing Saratoga residents safety from

fire. Making an exception to Saratoga's Firesafe Regulations should not result in loss of lives
or property damage, or even cast a doubt in the minds of the hillside residents about the City's
consideration about the residents' safety. Thank you.

Mayor and Council Members,
1) I don't recall any recent council discussion resulting in directing the City Attorney to
develop this waiver process. Did I miss it? Or is this a proposal by staff?
2) I question the granting of a waiver to a requirement established by a higher
authority based on the opinion of the City Attorney that "improvement conditions are
likely to violate state or federal law". Such a process is very likely to result in
litigation. Just imagine if your request is rejected while others are granted.
3) Should the council decide to adopt the procedure in the proposed resolution, I
request the following modifications:
1. A decision by the City Attorney to grant a waiver goes to the Planning
Commission for approval and the decision may be appealed to the Council.
2. The resolution as written contains the following phrase "applications for
residential development". This is too vague. Any such waiver should be
restricted to single family residence development.

General Fund
The following summarizes the recommended mid-year amendments listed above under the
General Fund section.
Property taxes.Saratoga's largest revenue source is property taxes, with an adopted 2022-
23 budget of $17.5 million or 67% of budgeted revenue. The property taxes category
includes taxes paid by Saratoga property owners, supplemental tax revenue from increased
assessed values, the real property transfer tax, Excess Education Revenue Augmentation
Fund (ERAF), and property tax in lieu of motor vehicle license fees. The Santa Clara
County Assessor's Office's most recent reports reflect higher than budgeted property tax in
lieu of vehicle license fees, $100,000, and higher than anticipated Excess ERAF, $200,000.
Building plan check fee revenue and expenditures.The City received a one-time plan
check fee revenue in 2022-23 resulting from the Quito Village project,with seventy percent
(70%) of the fee earmarked to offset contract plan check services. Both the revenue and
expenditure amendments are one-time and not expected to recur in future years. The
recommended action authorizes an increase in budgeted revenue of $200,000 and contract
services expenditures of $145,000.
General Plan Update Fee revenue.The City applies a General Plan Update fee at the
time of building permit issuance to support the General Plan & Advanced Planning Updates
CIP project. Since July 1, 2020, the City has received $448,302, and only $200,000 has
been transferred to the General Plan & Advanced Planning Update project. A correcting
interfund transfer of $250,000 from the General Fund to the Administrative and
Technology CIP is necessary to ensure the surcharge supports its intended purpose. The
Administrative and Technology CIP Fund reflects a corresponding revenue and
expenditure adjustment. The underlying cause of the miscoded revenue requiring a budget
amendment has been resolved.
Investment income.City investments in the Local Agency Investment Fund (LAIF) have
experienced slow and steady increases in investment returns over the past nine months. At
the mid-year review, City staff anticipates that the rates experienced in the first half of the
fiscal year will remain steady through the end of the fiscal year. The recommended action
increases the investment income budget by $375,000.
Other Funds
The City tracks several services provided organization-wide through special Funds that allocate
costs to City programs based on usage.
Office Support Fund. The City Clerk's Office requested funds for an electronic document
management system improvement project in the 2022-23 General Fund budget process.
City budget staff intended to include the request in the Office Support Fund. However, it
was omitted entirely from the adopted document. Staff recommends including $45,000 in
the budget amendment to move the project forward this year and likely continue into the
next fiscal year. The project is consistent with the Office Support Fund's purpose, and a
sufficient fund balance is available for the budget amendment.

Risk Management Fund. The adopted budget included preliminary cost increases for
liability and property insurance premiums based on the best information available. After
adoption, the premiums for 2022-23 were $96,307 higher than originally estimated. A
sufficient fund balance is available for the budget amendment.
Streets Capital Fund. The recommended Streets Capital Fund amendments provide two
updates. First, the recommendation transfers budget appropriations from the Annual
Retaining Wall Maintenance and Repairs CIP project (9153-003) to the Pierce Road
Retaining Wall CIP project to meet project expenditure needs in the later project. Second,
the recommendation reappropriates $30,000 to the Traffic Signal Battery Backup project,
which was closed prematurely in the City’s financial database.
Administrative and Technology Capital Fund. The recommended amendment
appropriates the $250,000 correcting transfer from the General Fund for the General Plan
Update Project.
