Mayor Zhao invited public comment. The following individuals spoke at this time: Glen Hendriks, Bernie Mills Mayor Zhao called the Regular Session to order at 7:00 p.m. Prior to Roll Call, the City Clerk stated Vice Mayor Aftab is attending the meeting from New Mexico, as indicated on the agenda, pursuant to Government Code 54953(b). Vice Mayor Aftab confirmed for the record he has met the applicable notice requirements and confirmed the public is able to participate from his location. ROLL CALL PRESENT: Mayor Yan Zhao, Vice Mayor Belal Aftab, Council Members Kookie Fitzsimmons, Chuck Page, Tina Walia ABSENT: None ALSO PRESENT: Matt Morley, City Manager Richard Taylor, City Attorney Leslie Arroyo, Assistant City Manager John Cherbone, Public Works Director Bryan Swanson, Community Development Director Ryan Hinchman, Administrative Services Director Britt Avrit, City Clerk REPORT ON POSTING OF THE AGENDA The City Clerk reported the agenda for this meeting was properly posted on August 15, 2024. REPORT FROM JOINT SESSION Mayor Zhao stated the City Council held a Joint Session at 6:00 p.m. with Santa Clara County Sheriff’s Office and Santa Clara County Fire Department. Captain Neil Valenzuela provided a summary of the activities of the Santa Clara County Sheriff’s Office and Fire Chief Suwanna Kerdkaew provided a summary of the activities of the Santa Clara County Fire Department. ANNOUNCEMENTS Mayor Zhao shared information about Let’s Hike Saratoga, Public Safety Fair and Mayor’s Office Hours at the Farmer’s Market. Resolution Supporting Universal Childcare Recommended Action: Adopt the Resolution supporting efforts to provide Universal Childcare to all children in the State of California. RESOLUTION 24-048 AFTAB/ZHAO MOVED TO ADOPT THE RESOLUTION SUPPORTING EFFORTS TO PROVIDE UNIVERSAL CHILDCARE TO ALL CHILDREN IN THE STATE OF CALIFORNIA. Geographic Information System Consultant Contract in the amount of $37,500 Recommended Action: Authorize the City Manager to execute a contract with Lynx Technologies, Inc. for Geographic Information System (GIS) Consultant services in the amount of $37,500.00 for FY 2024-25. FOR GEOGRAPHIC INFORMATION SYSTEM (GIS) CONSULTANT SERVICES IN THE AMOUNT OF $37,500.00 FOR FY 2024-25. MOTION PASSED BY THE FOLLOWING ROLL CALL VOTE: AYES: FITZSIMMONS, PAGE, WALIA, AFTAB, ZHAO. Budget Resolution to increase Capital Improvement Program budget in the amount of $102,300 for El Quito Park Pickleball Courts for improved security and sound mitigation. Recommended Action: Adopt the Resolution appropriating $102,300 from the unallocated Park Development Fund balance into the El Quito Park Pickleball Courts CIP Fiscal Year 2024/2025 budget. RESOLUTION 24-XXX WALIA/PAGE MOVED TO ADOPT THE RESOLUTION APPROPRIATING $102,300 FROM THE UNALLOCATED PARK DEVELOPMENT FUND BALANCE INTO THE EL QUITO PARK PICKLEBALL COURTS CIP FISCAL YEAR 2024/2025 BUDGET. Contract for tree planting with Our City Forest Recommended Action: Authorize the City Manager to execute a two-year contract agreement with Our City Forest for residential tree planting. WALIA/PAGE MOVED TO AUTHORIZE THE CITY MANAGER TO EXECUTE A TWO-YEAR CONTRACT AGREEMENT WITH OUR CITY FOREST FOR RESIDENTIAL TREE PLANTING. GENERAL BUSINESS Council Member Fitzsimmons stated she will be recusing herself from this item due to the possibility the discussion could pertain to property she owns. 2.1. Economic Vitality Ad Hoc Committee Report Recommended Action: Receive report and discuss next steps for the Economic Vitality Ad Hoc Committee. Bryan Swanson, Community Development Director, and Vice Mayor Aftab and Council Member Page presented the staff report. Mayor Zhao invited public comment. Resolution Appointing Kookie Fitzsimmons and Tina Walia to the Saratoga City Council Recommended Action: 1. Adopt the Resolution cancelling the November 5, 2024 General Municipal Election and appointing Kookie Fitzsimmons and Tina Walia to the Saratoga City Council; or 2. Take no action to appoint nominees and proceed with the November 5, 2024 General Municipal Election for the election of two City Council Members. Britt Avrit, City Clerk, presented the staff report. The following individuals spoke at this time: Stan Bogosian, Jim Cargill, Mona Kaur, Bernie Mills, Jon Kwong PAGE/AFTAB MOVED TO ADOPT THE RESOLUTION CANCELLING THE NOVEMBER 5, 2024 GENERAL MUNICIPAL ELECTION AND APPOINTING KOOKIE FITZSIMMONS AND TINA WALIA TO THE SARATOGA CITY COUNCIL. MOTION PASSED BY THE FOLLOWING ROLL CALL VOTE: AYES: PAGE, AFTAB, ZHAO. NOES: NONE. ABSTAIN: FITZSIMMONS, WALIA. RECUSED: NONE. ABSENT: NONE. COUNCIL ASSIGNMENTS Council Member Kookie Fitzsimmons Nothing to report Council Member Tina Walia KSAR 15 Saratoga Community Access Cable Television Foundation Board of Directors - stated the KSAR website has been updated and launched. Cities Association of Santa Clara County Legislative Action Committee – stated the Committee took action to support two climate related Bills and, the Committee sent position letters for several other Bills. Cities Association of Santa Clara County Board of Directors – stated the Board discussed the Model Water Efficient New Development Ordinance, Regional Early Action Planning Grant 2024, and the Bay Area Finance Authority Bond. Silicon Valley Clean Energy Authority Board of Directors – stated the Board held a study session on affordability related to electricity rate increases, approved various contracts, and received an update on SVCE’s participation in the CPUC timely energization proceeding. Saratoga City Council Minutes ~ August 21, 2024 ~ Page 5 of 5 Council Member Chuck Page Saratoga Chamber of Commerce Board – stated the Board discussed the Economic Vitality Ad Hoc Committee. Santa Clara Valley Water Commission – stated the Commission discussed planned rate increases and potential water shortages related to future proposed housing. Vice Mayor Belal Aftab Saratoga Historical Foundation Board of Directors – stated he attended the meeting with nothing to report. Valley Transportation Authority Policy Advisory Committee – stated he attended the meeting with nothing to report. Mayor Yan Zhao West Valley Sanitation District Board of Directors – stated she attended the meeting with nothing to report and she attended a tour of the facilities. West Valley Mayors and City Managers Association – stated the Association received information regarding the Bay Area Finance Authority Bond. Hakone Foundation Board Executive Board – stated the Board received a report on bookings for the facility, discussed projects to update the fiberoptics and the electrical panel at the facility, and held a Closed Session with no reportable action. CITY COUNCIL ITEMS Page/Walia requested a future agenda item regarding protecting the identity of complainants.
