[28 CFR 35.102-35.104 ADA title II] 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 COMMENDATION OF THE CITY COUNCIL OF THE CITY OF SARATOGA HONORING SUPERVISOR JOE SIMITIAN Whereas, Supervisor Simitian has been a strong proponent of safety in Saratoga and the surrounding mountain communities, leading efforts to enhance wildfire resiliency through partnerships with the Santa Clara FireSafe Council, expanding defensible space chipping and debris removal along public areas, and supporting the Santa Clara County Central Fire District’s Pre-Fire Management and Wildfire Resilience Programs; and Whereas, Supervisor Simitian was instrumental in establishing pop-up COVID-19 testing sites in Saratoga to keep the Saratoga community safe, and held virtual town hall meetings throughout the global pandemic to keep our community informed; and Whereas, Supervisor Simitian has played a key role in the enhancement of Sanborn Park, advocating for the County’s purchase of 103 acres of unincorporated lands, and supporting the Board's decision to commence the clean-up and remediation of the former Christensen Nursery site; and Whereas, Supervisor Simitian’s longstanding support of Hakone Gardens has been invaluable, securing resources for the preservation of the Azumaya, the Mon, and the extensive pond system, and making possible free public access to Hakone Gardens on the first Tuesday of every month through 2025; and Whereas, Supervisor Simitian has championed the expansion of Montalvo Arts Center’s community programs and increased accessibility, leading to the Board's approval of funding for these initiatives; and Whereas, Supervisor Simitian’s involvement with the Santa Clara Library District Joint Powers Association has brought numerous benefits to County libraries, including the Saratoga location, making library cards free, offering US passport services, and hosting community events such as his participation as the “celebrity storyteller” at the Saratoga library as part of the Silicon Valley Reads series and the Protect Yourself Against Sophisticated Cyber Scams event; and Whereas, Supervisor Simitian continues to be a champion for older adults, securing resources for the Saratoga Adult Day Services program and the Adult Day Services pilot program, of which SASCC is a participating location; and Whereas, Supervisor Joe Simitian has demonstrated unwavering commitment to the expansion and accessibility of open spaces and parks, fostering partnerships with County Parks and the Midpeninsula Open Space District to ensure continuous access through multiple county parks and open space preserves in the West Valley; and Whereas, Supervisor Simitian has recognized and addressed food insecurity in his district by championing the development of a “mobile food pantry,” administered by West Valley Community Services, now widely known as the Park-It Market, to deliver nutritious foods within the community; and Whereas, Supervisor Simitian stays connected to all of his West Valley communities and frequently visits the Saratoga Farmers’ Market to engage directly with residents, actively listen to their concerns, and provide valuable insights and assistance on a range of local and regional issues. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Saratoga does hereby recognize and commend Supervisor Joe Simitian for his outstanding contributions to our community, his tireless dedication to public service, and his continued efforts to enhance the quality of life for all residents of Saratoga and the West Valley. WITNESS MY HAND AND THE SEAL OF THE CITY OF SARATOGA this 4th day of September 2024. ___________________________ Yan Zhao, Mayor City of Saratoga 58 PROCLAMATION OF THE CITY COUNCIL OF THE CITY OF SARATOGA COMMENDING JACOB’S HEART CHILDREN’S CANCER SUPPORT SERVICES AND DECLARING SEPTEMBER 2024 AS CHILDHOOD CANCER AWARENESS MONTH WHEREAS, each year, thousands of children across the globe are diagnosed with cancer, a leading cause of death by disease in children past infancy in the United States; and WHEREAS, cancer remains the leading cause of death by disease among children, and approximately 1 in 285 children in the U.S. will be diagnosed with cancer before their 20th birthday; and WHEREAS, Jacob’s Heart holds the memories and honors the legacies of children from our community who have been lost to cancer, ensuring their memories will never be forgotten; and WHEREAS, the Lucile Packard Children's Hospital Stanford’s Oncology Department has worked closely with Jacob's Heart for the past 26 years as a trusted community partner addressing the emotional, practical, and financial struggles of families of children with cancer; and WHEREAS, Jacob’s Heart supports families with a child aged 21 or younger who has received a cancer diagnosis in the counties of Santa Clara, Santa Cruz, San Benito, and Monterey; and WHEREAS, recognizing Childhood Cancer Awareness Month provides an opportunity to raise awareness of the impact of pediatric cancer on children, families, and communities, and to encourage support for children battling cancer, their families, and the dedicated healthcare professionals who provide critical care; and WHEREAS, it is important for all Saratoga City residents to recognize the impact of pediatric cancer on families within our city, county, state, and country. NOW, THEREFORE, BE IT RESOLVED,that the City Council of the City of Saratoga does hereby commend Jacob’s Heart Children’s Cancer Support Services and declare September 2024 as Childhood Cancer Awareness Month in the City of Saratoga. BACKGROUND: California government code section 41004 requires that the City Treasurer submits to the City Clerk and the legislative body a written report and accounting of all receipts, disbursements, and fund balances. The Municipal Code of the City of Saratoga, Article 2-20, Section 2-20.035 designates the City Manager as the City Treasurer. This report is prepared to fulfill this requirement. The following attachments provide financial transaction data for the City of Saratoga’s Funds collectively as well as specifically for the City’s General (Operating) Fund, changes in investment pool balances, and historical investment returns. FISCAL STATEMENT: Cash and Investments Balance by Fund As of June 30, 2024, the City’s unaudited cash and investments totaled $48,227,619. The City Council’s adopted policy on the Working Capital Reserve Fund states that effective July 1, 2016: for cash flow purposes and to avoid the occurrence of dry period financing, pooled cash from all funds should not be allowed to fall below $1,000,000. The total pooled cash balance of $48.2 million exceeds the minimum amount required. Cash Summary 79 City’s Current Financial Position In accordance with California government code section 53646 (b) (3), the City is financially well positioned and able to meet its estimated expenditure requirements for the next six months. As of June 30, 2024, the City’s financial position (Assets $50.3M, Liabilities $8.7M, and Fund Equity $41.6M) remains very strong and there are no issues in meeting financial obligations now or in the foreseeable future. The following Fund Balance schedule represents actual funding available for all funds at the end of the monthly period. This amount differs from the above Cash Summary schedule as assets and liabilities are components of the fund balance. As illustrated in the summary below, Total Cash is adjusted by the addition of Total Assets less the amount of Total Liabilities to arrive at the Ending Fund Balance –which represents the actual amount of funds available. BACKGROUND: The property is a recently constructed one-story home in northern Saratoga. The project (ADR21- 0045/ARB21-0114) was approved on March 23, 2022 and passed final inspection on April 21, 2023. There were six protected trees on the property, and one redwood was approved for removal to construct the home. During construction, unpermitted grading was done in the critical root zones of pine tree #5 (14 in. DBH) and coast live oak tree #6 (12 in. DBH), this resulted in the homeowner being required to apply for an After-the-Fact tree permit, per City Code Section 15-50.050, for encroachment on protected trees. With the After the Fact tree permit, the homeowner requested the removal of both trees. Coast live oak tree #6 was denied for removal because it did not meet any qualifications for removal. and pine tree #5 was permitted for removal due to excessive root damage that increased the risk of the tree failing (City Code Section 15-50.080). The homeowner also applied for the removal of coast live oak tree #1 (34 in. DBH). The permit application stated that there was concern that the tree was dangerous, may lose limbs and would block future solar installations. The tree permit was denied because the homeowner did not meet the burden of proof that the tree met any of the qualifications for removal (City Code Section 15-50.080). The tree was found to be in excellent condition, not at an elevated risk of failure, and the tree was not impeding the solar installation on the approved plans. When the home passed final inspection from the building department in April 2023, the four remaining coast live oak trees were in good to excellent condition. In June of 2023, the homeowner removed all protected trees, coast live oak trees number 1, 3, 4, and 6, from the property without first applying and receiving the appropriate permits. 116 Table 1: Summery of trees protected by City Code and removed without a permit. The homeowner was notified that the solar panels needed to be installed and the replacement tree planted before the permit could be issued for the removal of tree #1. The solar panel installation passed final inspection on January 17, 2024, after removal of the tree. The application for removal of tree #1 included a map with panels added to the north side of the building in two locations: under the tree and over the garage. The solar project manager stated that this was the only available location due to the rooftop shape, shading, and existing facilities. However, the solar permit plan submitted to the building department on September 20, 2023 moved some of the panels to the top facet. Solar outputs for this location were not submitted with the tree permit application and feasible alternatives to the removal of tree #1 were not addressed. The follow up inspection for the 2023 tree encroachment took place in April of 2024. All protected trees had been removed from the property. The homeowner was required to apply for an After-the-Fact tree permit for the removal of trees number 1, 3, 4, and 6. The permit was issued on May 21, 2024, and the homeowner appealed the conditions of approval to the Planning Commission. On June 26, 2024, the Commission conducted a public hearing to consider the tree appeal. The Commission considered the history of the property and the penalties and remedies for the application of an after-the-fact tree permit set forth in Section 15-50.17. The Planning Commission unanimously voted to deny the appeal and found that the application of code sections 15-50.170 (a) 1, (d) and (f) and the payment amount is consistent with the code section and based on the formula for calculation of value as set forth in City Code Article 15-50. A copy of the June 26, 2024, Commission staff report, and meeting minutes are included as Attachment C and AttachmentD. APPEAL: The applicant explained the basis for the appeal in a letter to the Planning Commission that is included with the appeal application in Attachment A. The appellant’s appeal is summarized below with each issue followed by staff explanation: 1)Assessment of the tree fund is incorrect, unfair, and not equitable given the facts and the circumstance. The payment assessment is equal to the value of trees unlawfully removed and based on the formula for calculation of value as set forth in City Code Article 15-50. The value of tree #1 was assessed by the project arborist hired by the applicant, Juan Davilla ISA 117 Certification WE-9595A. The values of trees #3, 4, and 6 were assessed by the City Arborist. 2)Insurance and Safety The insurance company requested that trees be pruned away from the roof. There was no documentation provided that the insurance company requested the removal of any trees. Tree #1 was at no increased risk of failure and was given a heath rating of “excellent.” There was no concern expressed over the safety of trees #3, 4, and 6. 3)Solar System The removal of the tree does not appear to be necessary for the installation and efficient operation of solar panels. The approved plan set submitted to the building department dated May 12, 2022 outlined areas for two rows of solar panels on the top facet of the home. Half of this area was utilized during the first phase of solar installation. The homeowner needed to add additional panels because the usage needs of the home increased. The locations submitted with the tree permit application submitted on May 1, 2023, placed the rows of panels on the two facets shaded by the tree and above the garage. The solar project manager stated that it was not possible to add panels to the top, west or south facets (7, 9, and 18) due to their shape, shading, and existing facilities. The solar plan submitted to building on September 20, 2023 utilized the facet directly under the tree and the top facet of the home. The location above the garage was only used for the calculations of shading used to justify the tree removal. It appears that the second phase of solar panels could have been installed on the top facet of the roof with little effort and did not need to conflict with the tree. Accordingly, staff recommends that the City Council adopt the attached resolution denying the appeal. Background and Reason for Appeal On June 16, 2022, the property owner was issued building permits for the construction of a new home. There were six protected trees on the property, and one redwood was approved for removal to construct the project. On September 19, 2022, the homeowner applied for tree permit TRP22-0333 for the removal of coast live oak tree #1 because he was concerned that the tree was dangerous, may lose limbs and would block future solar installations. On November 22, 2022, tree permit TRP22-0333 was denied. The homeowner did not meet the burden of proof that the tree met any of the qualifications for removal. The tree was found to be in excellent condition, not at any elevated risk of failure and located north-northwest of the building. On April 12, 2023, the homeowner was required to apply for an After-the-Fact tree permit (ATFTR23-0005) for unpermitted grading in the critical root zones of pine tree #5 and coast live oak tree #6. He requested the removal of both trees. Coast live oak tree #6 was denied for removal and pine tree #5 was permitted for removal due to excessive root damage that made the tree unstable. On April 21, 2023, the new home passed final inspection from the building department. On May 1, 2023, the homeowner applied for tree permit TRP23-0265 for the removal of coast live oak tree #1 to install additional solar panels to the home. A review of aerial images showed that the trees were removed without a permit between April and September 2023. On May 3, 2024, the homeowner was required to apply for an After-the-Fact tree permit (ATFTR24-0020) for the removal of trees #1, 3, 4, and 6. On May 21, 2024, ATFTR24-0020 was issued. On June 5, 2024, an application to appeal the administrative determination requiring a payment to the Tree Fund was filed with the Community Development Department. According to the appellants, the required payment is not reasonable. However, the payment amount is based on the formula for calculation of value as set forth in City Code Article 15-50. FINDINGS The penalties and remedies for unpermitted tree removal pursuant to City Code Section 15-50.170 are set forth below. I am being assessed a fee of $50,980 due to the alleged removal of trees without the required permits. The fee is comprised of fines for the removal of four trees on my home property. Three smaller trees total a fine of $7,540 and the one large oak tree fine is for $43,440 (From Tree Permit 24-0020). I concede that the fine for the three smaller trees was appropriate given the course of events and facts. However, after attending the Planning Commission Meeting on June 26, 2024, and the statements made at that hearing by the City Arborist, it is even more apparent that the situation facts support my appeal. This is an appeal of the fine of $43,440 . The Staff report contained in your packet continues to ignore the most important facts regarding the tree removal; that being the requirement by my insurer that the tree be substantially trimmed in order to allow for the issuance of my homeowners policy. I will elaborate more on this item in the balance of this letter. Background From the beginning, we designed the home around the large Oak Tree (Tree ID #1), wishing to preserve it and add to the ambiance of my new home setting. During the construction process, my insurance broker continually warned me that insurance companies were ceasing to write new policies in California. While I am confident all the council members are aware of this ongoing problem in securing home insurance in California. The fine I am appealing is a result of two factors: 1) The requirement of my insurer to remove a substantial portion of the branches of the #1 oak tree in order to be approved for home insurance, and 139 City Council September 2, 2024 Page 2 of 7 2) The timing of the actual tree removal prior to the actual installation of the solar panels, and follow-up on-site inspection by City staff. 140 City Council September 2, 2024 Page 3 of 7 INSURANCE REQUIREMENTS Sensing the requirements of my underwriter from previous discussions with them, I applied for a Tree Removal Permit (22-0333) in September 2022. I was also planning to include a solar system on my roof in the future which was somewhat blocked by the existing Oak Tree. This permit was denied. During the many conversations that occurred with City Staff Member Fusco, I mentioned the concerns of my insurance company, but these were continually ignored. As part of the insurance underwriting process, the insurer required an inspection of the home and property. This occurred in April of 2023. A snapshot of the report language provided by my insurance broker (below) indicated that all of the limbs from the large oak tree (Tree #1) required pruning as a condition of my home insurance. The language in the inspection report stated “According to our outside inspection, there are trees overhanging or touching the insured’s home. Please have the insured trim all tree branches /shrubs away from the home and submit photos once complete.” To be clear, this required pruning would have been up to and possibly exceed 40% of the tree in total that required pruning to meet the insurance requirements. This amount of pruning would have required a permit which City Staff has stated both to the Applicant at the time of discussion and in the PC hearing that this would have been denied (Planning Commission Hearing time 1:54:17). The City Arborist, Ms. Fusco stated in the PC meeting that she would not have granted such a permit. Her response to the insurance company requirements was to the effect, “... maybe we can 141 City Council September 2, 2024 Page 4 of 7 work with the Applicant to find other insurance carriers…” (Planning Commission Hearing time 1:32:38) As the construction of my home proceeded, I again sought a tree removal permit for the three smaller trees and one large oak tree. The large oak was clearly blocking the solar panels and overhanging the home structure causing difficulty in my home insurance process. During construction, I was covered under a Course of Construction insurance policy but needed to convert that to ongoing home insurance as the home building was complete. This was also a requirement of my permanent lender for the home loan. I have met City staff on site discussing the necessity of the trimming permit. City staff made it clear to me that trimming permit would not be granted. Moreover, from the PC Meeting record, it was clear that no approval would be granted for the tree removal or required tree trimming of the oak tree to allow me to secure my permanent insurance and satisfy my home loan lender. Solar Panel Permit Timing The process in Saratoga for the removal of a tree related to blocking solar panels is that after the application is made to the City, written notice is then provided to the neighbors. After the neighborhood notice, the applicant is to install the solar panels and then have an inspection by the City arborist to confirm the need to remove the tree. I believe the process for applying for a tree removal permit is fraught with subjectivity, and not practical or fair given the current home insurance underwriting climate in California. It is very difficult for a homeowners to follow. It took about 6 months to design and secure the permit, install the panels and obtain the final inspection. I again made the removal application, and the required notice was given to my neighbors. There were no objections by the neighbors and in reality, letters of support for the tree removal have been received from the neighbors. (Copies enclosed) Given the timing of the solar permit process, if I had waited until after the solar panels were installed and completed the inspection, City Staff has stated on multiple occasions at the PC in response to Commissioner’s questions that “the permit would have been granted”. (Planning Commission Hearing time 1:10:38 and 1:10:56, 1:16:23) In my particular case, I did remove the tree prior to the final design and installation of the solar panels. This was necessitated by the insurance company requirements for issuance of my permanent fire insurance. While it did coincidently occur prior to the solar install process, it was not the driving decision factor in the tree removal. 142 City Council September 2, 2024 Page 5 of 7 Based upon the testimony of Ms. Fusco in the PC Hearing, it was her subjective call that since the inspection had not occurred and the tree was removed, she was denying the permit. SUMMARY The fine of $43,440 is a substantial sum of money. Given the requirements that I was faced with to obtain insurance and my permanent home loan, coupled with the mistiming of the permit inspection and actual tree removal, I feel I am being penalized unfairly. The statements by the City’s Arborist to assist in locating other insurance is out of place and not appropriate. This is not the purpose, responsibility or right of a municipal entity to select or direct which private property insurance providers should be used by its citizens . The liability for losses by insurers is real and burdensome on homeowners across the state. Unless the City is going into the business of underwriting homeowners fire insurance, it would be more beneficial for the City to offer a reasonable process for issuing permits and acknowledge the realities of the home insurance market and how its citizens must comply with their insurance requirements. I understand the importance of trees for a pleasant and harmonious environment. I also agree that trees are a big part of the ambiance and vitality of Saratoga. Therefore, I have planned 59 new trees on property. 14 of them are 36” boxes big jacaranda trees and crepe myrtle. They occupied majority of the yard spaces. At the end of the day, the decision to remove the tree for the safety of my family and property, compliance with the insurance underwriter, and protection of my home loan took precedence over the timing of the property inspection and the subjective nature of the permit approval process. I would ask for your fair treatment and overturn the fine of $43,440. BACKGROUND: As part of the 2022 Building Code update the City adopted amendments to the State of California’s Green Building Code to require that residential and commercial projects use electric appliances for space and water heating and clothes drying (gas appliances were allowed for cooking appliances and exterior appliances such as barbeques, firepits and pool heaters). The ordinance was similar to one adopted by the City of Berkeley. The Berkeley ordinance has been challenged in the courts and found to be preempted by federal law. Although Saratoga’s ordinance has a narrower scope than the Berkeley ordinance the court’s reasoning would likely apply to the Saratoga ordinance as well. Accordingly, staff recommends that the Building Code be amended to remove the described requirements. Many jurisdictions in Santa Clara County have adopted similar amendments or otherwise suspended enforcement of these requirements. There are alternative approaches to achieve the benefits sought by the 2022 amendments. Staff plans to investigate these options and make a recommendation to the Council as part of the next regular Building Code update in the fall of 2025. The General Assembly is an important opportunity where city officials can directly participate in the development of Cal Cities policy. Taking place on Oct. 18, the General Assembly is comprised of voting delegates appointed by each member city; every city has one voting delegate. Your appointed voting delegate plays an important role during the General Assembly by representing your city and voting on resolutions. To cast a vote during the General Assembly, your city must designate a voting delegate and up to two alternate voting delegates, one of whom may vote if the designated voting delegate is unable to serve in that capacity. Voting delegates may either be an elected or appointed official. Action by Council Required. Consistent with Cal Cities bylaws, a city’s voting delegate and up to two alternates must be designated by the city council. Please note that designating the voting delegate and alternates must be done by city council action and cannot be accomplished by individual action of the mayor or city manager alone. Following council action, please submit your city’s delegates through the online submission portal by Wed., Sept. 25. When completing the Voting Delegate submission form, you will be asked to attest that council action was taken. You will need to be signed in to your My Cal Cities account when submitting the form. Submitting your voting delegate form by the deadline will allow us time to establish voting delegate/alternate records prior to the conference and provide pre-conference communications with voting delegates. Conference Registration Required. The voting delegate and alternates must be registered to attend the conference. They need not register for the entire conference; they may register for Friday only. Conference registration is open on the Cal Cities website. The voting delegate card may be transferred freely between the voting delegate and alternates, but only between the voting delegate and alternates. If the voting delegate and alternates find themselves unable to attend the General Assembly, they may not transfer the voting card to another city official. Seating Protocol during General Assembly. At the General Assembly, individuals with a voting card will sit in a designated area. One City One Vote. Each member city has a right to cast one vote on matters pertaining to Cal Cities policy. 2. Designating a City Voting Representative. Prior to the Cal Cities Annual Conference and Expo, each city council may designate a voting delegate and up to two alternates; these individuals are identified on the voting delegate form provided to the Cal Cities Credentials Committee. 3. Registering with the Credentials Committee. The voting delegate, or alternates, may pick up the city's voting card at the voting delegate desk in the conference registration area. Voting delegates and alternates must sign in at the voting delegate desk. Here they will receive a special sticker on their name badge and thus be admitted to the voting area at the General Assembly. 4. Signing Initiated Resolution Petitions. Only those individuals who are voting delegates (or alternates), and who have picked up their city’s voting card by providing a signature to the credentials committee at the voting delegate desk, may sign petitions to initiate a resolution. 5. Voting. To cast the city's vote, a city official must have in their possession the city's voting card and voting tool; and be registered with the credentials committee. The resolution must have the concurrence of at least five additional member cities or individual members. If a resolution is approved at the General Assembly, it becomes official Cal Cities policy. Here’s how resolutions and the General Assembly work. The petitioned resolution is an alternate method to introduce policy proposals during the annual conference. The petition must be signed by voting delegates from 10% of member cities, and submitted to the Cal Cities President at least 24 hours before the beginning of the General Assembly. Petitioned Resolutions The Cal Cities President assigns general resolutions to policy committees where members review, debate, and recommend positions for each policy proposal. Recommendations are forwarded to the Resolutions Committee. Who’s who The Resolutions Committee includes representatives from each Cal Cities diversity caucus, regional division, municipal department, and policy committee, as well as individuals appointed by the Cal Cities president.
