ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SARATOGA
AMENDING CITY CODE PROVISIONS CONCERNING BUILDING
ELECTRIFICATION (SECTIONS 16-49.020 , 16-49.030, AND 16-49.040)
The City Council of the City of Saratoga finds that:
A. The City of Saratoga wishes to repeal the previously-adopted modifications to the
California Green Building Standards Code that added building electrification
requirements beyond those required by State law.
B. On September 4, 2024, the City Council held a duly noticed public hearing and, after
considering the supporting documents and all testimony and other evidence presented at
the public hearing, introduced this ordinance and waived the reading thereof.
C. The City Council adopted this ordinance at a duly noticed regular meeting on September
18, 2024.
Therefore, the City Council of the City of Saratoga hereby ordains as follows:
Section 1. Adoption.
The Saratoga City Code is hereby amended as set forth in Exhibit A.
Section 2. Severance Clause.
The City Council declares that each section, sub-section, paragraph, sub-paragraph, sentence,
clause, and phrase of this ordinance is severable and independent of every other section, sub-
section, sentence, clause, and phrase of this ordinance. If any section, sub-section,paragraph, sub-
paragraph, sentence, clause, or phrase is held invalid, the City Council declares that it would have
adopted the remaining provisions of this ordinance irrespective of the portion held invalid and
further declares its express intent that the remaining portions of this ordinance should remain in
effect after the invalid portion has been eliminated.
Section 3. California Environmental Quality Act.
Pursuant to the California Environmental Quality Act ("CEQA"), this action is exempt under
California Code of Regulations, Title 14, Section 15308 (the modifications are exempt because
they assure maintenance, restoration, enhancement, or protection of the environment) and Section
15061(b)(3) (the modifications are exempt because it can be seen with certainty that there is no
possibility that the activity in question may have a significant effect on the environment).

Section 4. Publication.
A summary of this ordinance shall be published in a newspaper of general circulation of the
City of Saratoga within fifteen days after its adoption.

meeting of the City Council of the City of Saratoga held on September 4, 2024, and was adopted
by the following vote on September 18, 2024

1. Amendments to Section 16-49.020
16-49.020 Amendments to Chapter 2 of Green Building Standards Code; Definitions
Chapter 2 of the 2022 California Green Building Standards Code is adopted with the
following amendments:
Section 202 Definitions
Amend Section 202 to include the following definitions to read as follows (where Section
202 includes one of the following terms, this amendment replaces that term with the term
included here):
AUTOMATIC LOAD MANAGEMENT SYSTEM (ALMS). A control system designed to
manage load across one or more electric vehicle supply equipment (EVSE), circuits, panels and
to share electrical capacity and/or automatically manage power at each connection point. ALMS
systems shall be designed to deliver no less than 3.3 kVa (208/240 volt, 16-ampere) to each EV
Capable, EV Ready or EVCS space served by the ALMS, and meet the requirements of
California Electrical Code Article 625. The connected amperage to the building site for the EV
charging infrastructure shall not be lower than the required connected amperage per California
Green Building Standards Code, Title 24 Part 11.
MOSTLY ELECTRIC- BUILDING. A building that contains no combustion equipment or-
