PUBLIC HEARING Items placed under this section of the Agenda are those defined by law as requiring a special notice and/or a public hearing or those called by the City Council on its own volition. APCC24-0003 - Appeal of a Design Review application for a 781 square foot second story addition to an existing residence located at 13760 Manteca Way Recommended Action: Conduct a public hearing and de novo review of the application and adopt the attached resolution denying appeal APCC24-0003 thereby approving Design Review application PDR24-0002 for the construction of a 781 square foot second story accessory dwelling unit (ADU) located at 13760 Manteca Way and finding the application to be exempt from environmental review under the California Environmental Quality Act (CEQA). [28 CFR 35.102-35.104 ADA title II] -400000 -200000 0 200000 400000 600000 800000 1000000 FY2018 FY2019 FY2020 FY2021 FY2022 FY2023 FY2024 ANNUAL INCOME COMPARISON ATTENDANCE ATTENDANCE INC GIFT SHOP INC EVENTS INC DONATIONS NET INCOME 5 COMMENDATION OF THE CITY COUNCIL OF THE CITY OF SARATOGA HONORING MICHELLE WANG WHEREAS, Michelle Wang was appointed to the City of Saratoga Recreation Commission for a full term starting October 1, 2020; and WHEREAS,during Michelle’s term as a Parks & Recreation Commissioner, she and the other Parks & Recreation Commissioners helped bring residents to City parks and trails and build awareness of the City’s recreational assets through Community Outreach, Movie Nights, Historic Plaque Program for City Parks, Age-Friendly Communities, Let's Create, Let’s Hike Saratoga, and Let’s Work volunteer program; and WHEREAS, during Michelle's term she was the lead and co-lead of the Let's Work volunteer program that champions the management and eradication of invasive plant species in Quarry Park, and she and all the Commissioners were instrumental in connecting with community members during Movie Nights where Michelle encouraged community members, especially children, to share wishes and appreciations by hanging them on the Commission's "Wishing Tree;" and WHEREAS, in 2021 Michelle and the Parks & Recreation Commission worked with the Public Works Department on reviewing and making recommendations for Draft ADA Assessment Plan, the updated Parks & Recreation Commission Mission Statement, and designing a City Park Map; and WHEREAS,in 2022 Michelle and the Parks & Recreation Commission helped students from Saratoga High School to produce and edit drone videos of Wildwood Park, Kevin Moran Park and El Quito Park as part of their ongoing support of Age-Friendly Communities and also reviewed and made recommendations for the replacement of the playground equipment in Beauchamps Park; and WHEREAS, in 2023 and 2024 the Parks & Recreation Commission worked with the Public Works Department on the development of Pickleball Courts and the renovation of the Community Garden in El Quito Park; and WHEREAS,it is apparent to all who have worked with Michelle that she is a dedicated and hardworking member of the community,and her service and contributions are greatly appreciated by the City Council, Parks & Recreation Commission, and City staff. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Saratoga does hereby recognize Michelle Wang for her years of service and dedication to the City of Saratoga. Yan Zhao, Mayor City of Saratoga 6 COMMENDATION OF THE CITY COUNCIL OF THE CITY OF SARATOGA HONORING THE 40TH ANNIVERSARY OF THE SISTER CITY AFFILIATION BETWEEN MUKO-SHI, JAPAN AND SARATOGA, CALIFORNIA WHEREAS,in 1969, Mr. Kiyoshi Yasui, an eminent landscape architect from Muko-shi, Japan, visited Saratoga to develop a master plan for Hakone Gardens; and WHEREAS,seeing a similarity in the demographics of Saratoga and Muko-shi, a fruitful partnership began between the two cities; and WHEREAS, in 1984, the cities of Saratoga, California and Muko-shi, Kyoto Prefecture, Japan formalized a partnership by starting a Sister City affiliation; and WHEREAS,in 1994, Saratoga Mayor Ann Marie Burger and Sister City President Marty Clevenger, along with 70 Saratoga Sister City Committee Members, visited Muko-shi to celebrate the 10th anniversary of the cities’ affiliation, as well as the 1,200th anniversary of Kyoto’s Imperial Capital; and WHEREAS, during the 40-year history of the Saratoga-Muko affiliation, delegations from both cities visited each other multiple times to exchange and experience culture, arts, education, and history, as well as establish enduring friendships; and WHEREAS, during a visit to Muko-shi, Saratoga Sister City members learned about Taiko drumming and established a Taiko drum group in Saratoga, which performs throughout the South Bay at events such as the Saratoga Blossom Festival, Mosaic America at the McAfee Performance Center, and Yerba Buena Gardens Festival in San Francisco, among others; and NOW, THEREFORE, the City Council of the City of Saratoga does hereby recognize the long and vibrant history between Saratoga and Muko-shi on the 40 th anniversary of the Saratoga-Muko Sister City partnership and expresses its appreciation for the committed individuals who have worked diligently to maintain a thriving relationship between the two cities. BACKGROUND: California government code section 41004 requires that the City Treasurer submits to the City Clerk and the legislative body a written report and accounting of all receipts, disbursements, and fund balances. The Municipal Code of the City of Saratoga, Article 2-20, Section 2-20.035 designates the City Manager as the City Treasurer. This report is prepared to fulfill this requirement. The following attachments provide financial transaction data for the City of Saratoga’s Funds collectively as well as specifically for the City’s General (Operating) Fund, changes in investment pool balances, and historical investment returns. FISCAL STATEMENT: Cash and Investments Balance by Fund As of July 31, 2024, the City’s unaudited cash and investments totaled $47,392,016. The City Council’s adopted policy on the Working Capital Reserve Fund states that effective July 1, 2016: for cash flow purposes and to avoid the occurrence of dry period financing, pooled cash from all funds should not be allowed to fall below $1,000,000. The total pooled cash balance of $47.4 million exceeds the minimum amount required. As of July 31, 2024, the City’s financial position (Assets $48.5M, Liabilities $8.9M, and Fund Equity $39.6M) remains very strong and there are no issues in meeting financial obligations now or in the foreseeable future. The following Fund Balance schedule represents actual funding available for all funds at the end of the monthly period. This amount differs from the above Cash Summary schedule as assets and liabilities are components of the fund balance. As illustrated in the summary below, Total Cash is adjusted by the addition of Total Assets less the amount of Total Liabilities to arrive at the Ending Fund Balance –which represents the actual amount of funds available. The City is currently in contract with Selway Construction for the City’s American Rescue Plan Act (ARPA)funded Park Restroom Renovations Project, awarded by City Council on July 03, 2024. The scope of this contract includes previously identified renovations and improvements to the restroom facilities at Wildwood Park. City Staff recommends that the scope and payment terms for the fire damage repairs to the Wildwood Park Restroom be added to the existing contract with Selway Construction so that the fire damage repairs and the originally planned improvements can be handled at the same time. Combing the work with the original contract will increase efficiency as the single contractor will be able to coordinate all of the work together. In addition, the combined project will allow for the restroom to be re-opened more quickly. The estimated cost of additional work for fire damage repairs is $138,876. 32 FISCAL IMPACT: The original scope of work contracted with Selway Construction for the Parks Restroom Project is funded by the ARPA fund. The additional cost of $138,876 for fire damage repairs will be funded via reimbursement from the City’s Insurance Plan. BACKGROUND: Attached is a Resolution, which, if adopted, will grant final map approval for two lots located at 14528 Chester Avenue (APN 397-03-072). This map is for an urban lot split utilizing the ministerial process enabled by SB9 and the applicant has satisfied all the applicable requirements of Ordinance No. 385. The recordation of the final map is a means to create individual lots from a larger lot for which building permits may be issued. The Subdivision Map Act provides that once the final map has been filed with the City Clerk, the City Council must approve or disapprove the final map and accept or reject any offers of dedication made to the City within the map at its next meeting.It further provides that the Council must approve the final map if it finds that the final map is in substantial compliance with a previously approved tentative map. The City Engineer has examined the final map and related documents submitted to the City in accordance with the provisions of Section 14.40.020 of the Municipal Code and it was determined that: 1.The Subdivision Map Act, the City's Subdivision Ordinance,and all other applicable provisions of law have been complied with. 2.The final map is technically correct. BACKGROUND: Housing Accountability Act The project, as a housing development proposing more than one residential unit, limits the City in its ability to “deny, reduce the density for, or render infeasible” the project under the Housing Accountability Act (HAA) (Government Code Section 65589.5) unless the project: (1) is found to be in violation of an objective general plan/zoning standard; or (2) will result in a specific adverse impact to public health and safety. While conditions and requirements may be applied to further applicable goals, policies, and strategies –any conditions and requirements not based on objective standards may not make the project infeasible or reduce the number of units. For example, the decision-making body may apply conditions related to window treatments or paint color but could not apply conditions resulting in aesthetic modifications that would render the project infeasible. Under the HAA an objective standard is one that involves “no personal or subjective judgment by a public official and [is] uniformly verifiable by reference to an external and uniform benchmark or criterion available and knowable by both the development applicant or proponent and the public official.” General Plan Housing Element The adopted Housing Element includes many programs to encourage the production of housing. One of those programs is Program 3.1-6 which requires that the Community Development Department update and annually review the City’s accessory dwelling unit (ADU) ordinance to comply with State law which requires that applications for complying ADUs be approved ministerially. The City’s current development regulations require Planning Commission Design Review approval for conversion of a single-story structure to a multi-story structure even when the second story addition is limited to the construction of an ADU. To comply with State law that applications for ADUs be approved ministerially 174 2 | P ag e and to further encourage the construction of ADUs, the Planning Commission on September 11, 2024, reviewed and recommend for approval a Municipal Code Amendment which includes revised development standards for Article 15.45 (Design Review: Single-Family Dwelling) which would allow second story additions be reviewed ministerially if the addition was limited to the construction of an ADU. This code amendment is scheduled for City Council review on October 15, 2024. If the City Council approves the code amendment, then future second story ADU additions like the subject application at 13760 Manteca Way will be approved ministerially without Planning Commission Design Review. The City of Saratoga’s 2023-2031 Housing Element requires Saratoga to plan for 1,712 housing units at all affordability levels for the 2023-2031 planning period. Very-Low Income – 454 units Low Income – 261 units Moderate Income – 278 units Above Moderate – 719 units The project will help Saratoga achieve its housing productivity goals by providing one moderate income unit. Project Description The 11,543 net square foot project site is located at the intersection of Manteca Way and Alcott Way. The site contains an existing one story 3,503 square foot single-family residence. Adjacent homes are all one story however there are nearby two-story homes located at 13698 and 13714 Manteca Way. On August 14, 2024, the Planning Commission approved Design Review application PDR24-0002 for a 781 second story to an existing one story residence for the purpose of creating an accessory dwelling unit (ADU). An interior stairway will provide second story access. The stairway will be accessible from a new rear entrance as well as from the interior of the residence. TheADU will include one bedroom, living room, office, bathroom, and kitchen. A new second story balcony on the front elevation will be accessible from the living room. The exterior colors and materials of the second story addition will be consistent with the colors and materials of the existing residence. No trees are proposed for removal. On August 29, 2024, the neighboring property owner to the rear at 13761 Fortuna Court (Appellant’s) submitted an appeal of the Commission’s approval of Design Review Application (PDR24-0002) included as Attachment A. The August 14, 2024, Commission staff report, and meeting minutes are included as Attachment’s D and E. APPEAL: The Appellant’s listed the following justifications for their appeal as to why they believe the City Council should overturn the Planning Commission’s decision and deny application PDR24-0002. 1)Design Review should not have been approved pursuant to City Code Section 15-45.080(c) because the architectural elements are not designed to avoid unreasonable impacts to privacy. The appellants believe that the many large size windows and the rear placement of them provide a direct view to Appellants master bedroom, living room, and backyard swimming pool. 175 3 | P ag e 2)Design Review should not have been approved pursuant to City Code Section 15-45.080(g) because the Single-Family Residential Design Review Handbook was not followed. The appellants believe that the design techniques contained in the Single-Family Residential Design Review Handbook, hereinafter referred to as “Handbook”, regarding the techniques to reduce a projects privacy impacts on adjacent properties were not adhered to as follows: A. Privacy - The design does not minimize windows in direct view of Appellants private indoor and outdoor areas. Larger windows are in areas that have privacy impacts. Clerestory windows or windows with higher sills are not used where privacy is a concern. Finished floor height and window placement impact on adjoining neighbors were not considered. Privacy concerns were not adequately addressed with Appellants. B. Windows – The second story rear windows are not designed with consideration of the impact they have on Appellants adjacent property to the rear and to the overall design of the structure. The Handbook’s window design techniques were not followed. The general type, shape, size, and the sheer number of windows are not architecturally appropriate as selected. Windows are not offset as to the Appellants rear adjacent structure to reduce privacy impacts. While the names of the appellants on the appeal application are limited to the rear neighbors, Yung Feng and Rony Feng, additional adjacent property owners also provided written objections to the Planning Commission’s decision to approve the project – these comments are included in the appellants appeal documentation. Proposed Landscaping In response to the appeal application and with the intent to minimize potential privacy impacts to the appellants, the applicant has prepared a Privacy Plan View Study (Attachment G) which illustrates how new proposed landscaping located along the rear property line would minimize views from the second story rear facing windows by augmenting and increasing the existing landscape privacy screening between the two properties. The applicant is proposing to plant no less than 15 Fern Pines (Podocarpus Gracilor) along their rear property line and in between their existing trees. The Privacy Plan illustrates that the Fern Pines would be maintained at a height of 13 feet. The applicant contacted the City Arborist on the selection of tree species, and it was recommended that evergreen trees offer good landscape screening – the City Arborist provided a list of potential trees, and the applicant selected the Fern Pine. Design Review Findings Because this appeal requires de novo consideration by the City Council, staff recommends that the City Council make each of the findings pursuant to City Code Section 15-45.080 required for Design Review approval as set forthbelow: a.Site development follows the natural contours of the site, minimizes grading, and is appropriate given the property’s natural constraints.This finding can be made in the affirmative in that the project only includes the construction of a second story addition, and no grading is proposed to construct the project. b.All protected trees shall be preserved, as provided in Article 15-50 (Tree Regulations). If constraints exist on the property, the number of protected trees, heritage trees, and native trees approved for removal shall be reduced to an absolute minimum. Removal of any smaller oak trees deemed to be in good health by the City Arborist shall be minimized using the criteria set forth in Section 15-50.080.This finding can be made in the affirmative in that the project is limited 176 4 | P ag e to the construction of a second story addition and no protected trees will be impacted for its construction. c.The height of the structure, its location on the site, and its architectural elements are designed to avoid unreasonable impacts to the privacy of adjoining properties and to community viewsheds.This finding can be made in the affirmative in that the proposed residence complies with the maximum height limitation of 26 feet allowable for residential structures; the rear facing second story windows are limited in number with one of the windows located in a stairwell; proposed landscaping screening trees located along the rear property will screen views from the second story windows into the rear neighbors windows and yard; the second story has no second story windows facing the adjacent property to the left, and the second story balcony will be located at the front of the structure to avoid views into the rear and side yards of adjacent neighbors. There are no community viewsheds in the vicinity of the site. d.The overall mass and height of the structure, and its architectural elements are in scale with the structure itself and with the neighborhood.This finding can be made in the affirmative in that the proposed residence complies with the maximum height limitation of 26 feet allowable for residential structures; the building has varying architectural forms and projections to break up the appearance of mass, the building setbacks meet or exceed those required for the R-1-10,000 zoning district. e.The landscape design minimizes hardscape in the front setback area and contains elements that are complementary to the neighborhood streetscape.This finding can be made in the affirmative in that existing landscaping within the front setback area includes lawn areas, drought resistant shrubs, trees, and groundcover. No additional landscaping is proposed. f.Development of the site does not unreasonably impair the ability of adjoining properties to utilize solar energy. This finding can be made in the affirmative in that development will not unreasonably impair the ability of adjoining properties to utilize solar energy as the project exceeds the required side and rear setbacks, and the orientation of the sun throughout the day with respect to the location of the site and position/height of the structure will not unreasonably cast shadows on adjoining properties. g.The design of the structure and the site development plan is consistent with the Residential Design Handbook, pursuant to Section 15-45.055.This finding can be made in the affirmative because the proposed project incorporates applicable design policies and techniques from the Residential Design Handbook. The overall mass and height of the structure are in scale with the neighborhood and the structure is set back in proportion to the size and shape of the lot. In addition, the proposed materials, colors, and details enhance the architecture in a well-composed, understated manner. h.On hillside lots, the location and the design of the structure avoid unreasonable impacts to ridgelines, significant hillside features, community viewsheds, and is in compliance with Section 15-13.100.This finding is not applicable to the project in that the site is not characterized as a hillside lot nor is the site located within the Hillside Residential zoning district. ENVIRONMENTAL DETERMINATION The project is Categorically Exempt from the Environmental Quality Act (CEQA) pursuant Section 177 5 | P ag e 15303, “New Construction or Conversion of Small Structures”, Class 3 (a) of the Public Resources Code (CEQA). This exemption allows for the construction of a single-family residence and small structures in a residential area. ADVERTISING, NOTICING AND PUBLIC CONTACT: All notice requirements for the appeal have been satisfied. No protected trees are proposed for removal (project). WHEREAS, on August 14, 2024, the Planning Commission held a duly noticed public hearing on the Project, and considered evidence presented by City Staff, the applicant, the property owners, and other interest parties. WHEREAS, the Planning Commission approved Design Review application PDR24- 0002. WHEREAS, on August 29, 2024, an appeal to the City Council was filed by Yung Feng & Rony Feng (“Appellants”). WHEREAS, on October 2, 2024, following a duly noticed public hearing where the City Council conducted a de novo review of the appeal, at which all interested parties were given a full opportunity to be heard and to present evidence, the City Council considered the application, site plan, architectural drawings, CEQA documentation, and other materials, exhibits, and evidence presented by City Staff, the appellant, the applicant, and other interested parties. WHEREAS, the Community Development Department recommends that the City Council determine that this Project is categorically exempt under CEQA Guidelines §15303, New Construction or Conversion of Small Structures. NOW THEREFORE, the City Council of the City of Saratoga hereby denies the appellants appeal, affirms the decision of the Planning Commission of the City of Saratoga on August 14, 2024, and approves the applicant’s Design Review application and further finds, determines,and resolves as follows: Section 1: The recitals set forth above are true and correct and incorporated herein by reference. The documents constituting the record of proceedings upon which this decision is based are located in the City of Saratoga Department of Community Development and are maintained by the Director of that Department. All conditions below which are identified as permanent or for which an alternative period for applicability is specified shall run with the land and apply to the landowner’s successors in interest for such time. No zoning clearance, or demolition, grading for this project shall be issued until proof is filed with the city that a certificate of approval documenting all applicable permanent or other term-specified conditions has been recorded by the applicant with the Santa Clara County Recorder’s office in form and content to the Community Development Director. If a condition is not “Permanent” or does not have a term specified, it shall remain in effect until the issuance by the City of Saratoga of a Certificate of Occupancy or its equivalent. 2. The Owner and Applicant will be mailed a statement after the time the Resolution granting this approval is duly executed, containing a statement of all amounts due to the City in connection with this application, including all consultant fees (collectively “processing fees”). This approval or permit shall expire sixty (60) days after the date said notice is mailed if all processing fees contained in the notice have not been paid in full. No Zoning Clearance or Demolition, Grading, or Building Permit may be issued until the City certifies that all processing fees have been paid in full (and, for deposit accounts, a surplus balance of $500 is maintained). 3. The Project shall maintain compliance with all applicable regulations of the State, County, City and/or other governmental agencies having jurisdiction including, without limitation, the requirements of the Saratoga City Code incorporated herein by this reference. 4. As a condition of this Approval, Owner and Applicant hereby agree to defend, indemnify, and hold the City and its officers, officials, boards, commissions, employees, agents, and volunteers harmless from and against: a. all claims, actions, or proceedings to attack, set aside, void or annul any action on the subject application, or any of the proceedings, acts or determinations taken, done, or made prior to said action; and b. all claims, demands, actions, expenses, or liabilities arising from or in any manner relating to the performance of such construction, installation, alteration, or grading work by the Owner and/or Applicant, their successors, or by any person acting on their behalf. In addition, prior to any Zoning Clearance, Owner and Applicant shall execute a separate agreement containing the details of this required Agreement to Indemnify, Hold Harmless and Defend, which shall be subject to prior approval as to form and content by the City Attorney. 218 Resolution No. 24-057 6 COMMUNITY DEVELOPMENT DEPARTMENT 5. The owner/applicant shall comply with all City requirements regarding drainage, including but not limited to complying with the city approved Stormwater management plan. The project shall retain and/or detain any increase in design flow from the site, that is created by the proposed construction and grading project, such that adjacent down slope properties will not be negatively impacted by any increase in flow. Design must follow the current Santa Clara County Drainage Manual method criteria, as required by the building department. Retention/detention element design must follow the Drainage Manual guidelines, as required by the building department. 6. The development shall be located and constructed to include those features, and only those features, as shown on the plans approved by the Planning Commission on August 14, 2024. All proposed changes to the approved plans must be submitted in writing with plans showing the changes, including a clouded set of plans highlighting the changes. Such changes shall be subject to approval in accordance with the City Code. 7. Prior to issuance of Building Permits, the applicant shall submit for staff approval a Lighting Plan for the home’s exterior and landscaped areas. Proposed exterior lighting shall be limited to full cut off & shielded fixtures with downward directed illumination so as not to shine on adjacent properties or public right-of-way. All proposed exterior lighting shall be designed to limit illumination to the site and avoid creating glare impacts to surrounding properties. 8. To comply with standards that minimize impacts to the neighborhood during site preparation and construction, the applicant shall comply with City Code Sections 7-30.060 and 16-75.050, with respect to noise, construction hours, maintenance of the construction site and other requirements stated in these sections. 9. Prior to issuance of Building Permits, the applicant shall prepare for review and approval by City staff a Construction Management Plan for the project which includes but is not limited to the following: a. Proposed construction worker parking area. b. Proposed construction hours that are consistent with the City Code. c. Proposed construction/delivery vehicle staging or parking areas. d. Proposed traffic control plan with traffic control measures, any street closure, hours for delivery/earth moving or hauling, etc. To the extent possible, any deliveries, earth moving or hauling activities will be scheduled to avoid peak commute hours. e. Proposed construction material staging/storage areas. f. Location of project construction sign outlining permitted construction work hours, name of project contractor and the contact information for both homeowner and contractor. 10. All fences, walls and hedges shall conform to height requirements provided in the City Code Section 15-29. 219 Resolution No. 24-057 7 11. A locking mailbox approved for use by the U.S. Postal service shall be installed and in compliance with Saratoga Municipal Code section 6-25.030. The mailbox shall be installed prior to final inspection. 12. A Building Permit must be issued, and construction commenced within 36 months from the date of adoption of this Resolution or the Design Review Approval will expire unless extended in accordance with the City Code. 13. West Valley Collection & Recycling is the exclusive roll-off and debris box provider for the City of Saratoga. FIRE DEPARTMENT 14. The owner/applicant shall comply with all applicable Fire Department requirements. ENGINEERING 15. The owner/applicant shall comply with all City requirements regarding drainage, including but not limited to complying with the city approved Stormwater management plan. The project shall retain and/or detain any increase in design flow from the site, that is created by the proposed construction and grading project, such that adjacent down slope properties will not be negatively impacted by any increase in flow. Design must follow the current Santa Clara County Drainage Manual method criteria, as required by the building department. Retention/detention element design must follow the Drainage Manual guidelines, as required by the building department. 16. Applicant / Owner shall obtain an encroachment permit for all improvements in any City right- of-way or City easement including all new utilities prior to commencement of the work to implement this Design Review. 17. Applicant / Owner shall make the following improvements in the City right-of-way: a. Obtain an encroachment permit and replace nonconforming/damaged curb and gutter in front of driveway. See City of Saratoga Standard Details for removal and new installation. New flow line shall conform to existing flow lines and grade. 18. Damages to driveway approach, curb and gutter, public streets, or other public improvements during construction shall be repaired prior to final inspection. 19. All new/upgraded utilities shall be installed underground. 20. Applicant / Owner shall maintain the streets, sidewalks and other right of way as well as adjacent properties, both public and private, in a clean, safe and usable condition. All spills of soil, rock or construction debris shall be removed immediately. 220 Resolution No. 24-057 8 21. The Owner/Applicant shall incorporate adequate source control measures to limit pollutant generation, discharge, and runoff (e.g. landscaping that minimizes irrigation and runoff, promotes surface infiltration where possible, minimizes the use of pesticides and fertilizers, and incorporates appropriate sustainable landscaping practices and programs, such as Bay- Friendly Landscaping). 22. All building and construction related activities shall adhere to New Development and Construction – Best Management Practices as adopted by the City for the purpose of preventing storm water pollution: •Owner shall implement construction site inspection and control to prevent construction site discharges of pollutants into the storm drains per approved Erosion Control Plan. •The City requires the construction sites to maintain year-round effective erosion control, run-on and run-off control, sediment control, good site management, and non-storm water management through all phases of construction (including, but not limited to, site grading, building, and finishing of lots) until the site is fully stabilized by landscaping or the installation of permanent erosion control measures. •City will conduct inspections to determine compliance and determine the effectiveness of the BMPs in preventing the discharge of construction pollutants into the storm drain. Owner shall be required to timely correct all actual and potential discharges observed. 23. Prior to foundation inspection by the City, the LLS of record shall provide a written certification that all building setbacks are per the approved plans. 24. Following is our response to the appeal. We believe that the city ran a fair process, we complied with it and now an unreasonable appeal is being made after the decision was rendered by the Planning Commission. As the commission re-runs the process, please consider the following points: 1. Before making the original application to the city, Vandana and I have made a few attempts to make our neighbors aware of the project and have been considerate to their requests. We have proof of these conversations with our neighbors at 13761 Fortuna Court, and 13745 Fortuna Court. We are attaching the text messages with these neighbors, proving that they were much aware of this process, and the Neighbor Review Forms since December of 2023 2. We are at a point where we need to also create a good living environment for us by building a house that is compliant and desirable to us, verses living in an ADU that is purely the result of neighbor’s comments. Following is the original design that the neighbors saw BEFORE we made changes to satisfy them. Please note that we had originally planned large sliding doors A2 (from fioor to ceiling). We replaced them by smaller opening service as the required egress to our bedroom. ii. B – We eliminated bathroom because we suspected that the bathroom lights at night and noise may bother 13761 Fortuna Court. Replace with flxed staircase window iii. C - Eliminated window in consideration of 13746, Manteca way iv. D and E - Eliminated window in consideration of 13746, Manteca way. We created a skylight instead. You can see these in the latest submission. v. F – Reduced the size of the balcony by 4 feet, in consideration of privacy of the front yard of 13746, Manteca Way. 4. I hope that the above compromises show the changes that we have already made in consideration of the neighbors 5. Currently we understand that the collective objections are in two categories – A. The desire not to have one more double story and B. Remaining privacy issues for 13761 Fortuna Court 6. Regarding the desire not to have one more double story - We believe that it is our family’s need to build a second story ADU (this will be the 3rd one on the street) and it is permitted by the city hence we urge that the Commission disregards any noise around creating an ADU. Especially by the neighbors who are minimally impacted by this. 7. Regarding the remaining minimal privacy concerns of 13761 Fortuna Court, we would like to highlight a few things. i. As the Planning Commission would have observed during the site visit, there are plenty of mature trees that exist between us and 13761 Fortuna Court. ii. 13761 Fortuna Court has only ONE window facing our house, most of their privacy concerns are through this window. Both families, ours and theirs have two mature adults living in each house, eliminating any risk of unwanted anti-privacy behaviors from either side. iii. In consideration for the remaining privacy, we are willing to resort to additional landscaping – speciflcally growing suitable and fast-growing privacy enabling trees on our side. This will block most of the view from mutual side and make view from both houses very natural. See sketch below for further reference. Landscaping is our proposal, and we are open to other ideas that will minimize the concerns and make the neighborhood greener. We do, however, urge strongly to the Planning Commission that we be allowed to build the ADU that we will be comfortable to live in and be worth the large sums of money that we will be spending to construct this. I proposed the meeting take place at Mr. Yung and Mrs. Rony Feng’s home. The Pawar’s requested that I meet them by myself at their home. Mrs. Feng and Mrs. Pawar have not seen or spoken much during the past year or so. Mr. Feng and Mr. Milind Pawar have never met each other, nor have they met either of the Mrs., respectively. On September 10, 2024, as requested I went by myself to the Pawar’s home. They showed me on computer a different plan/drawing than the one that was previously submitted. They said they intended to submit the revisions later. They also showed me the backyard and said they were willing to plant privacy plants along the shared rear fence. I asked the Pawar’s about their plans regarding the second-story rear facing windows. Mrs. Pawar said she preferred large windows in the master bedroom. On September 11, 2024, I contacted Mrs. Pawar via text message and asked her to provide a picture of the second-story rear side facing the Feng’s property. I also asked her to provide some details of the windows. Mrs. Pawar provided the following picture: Mrs. Pawar provided the following details: “Window A is the bedroom window. B is the staircase. And C is half obscure and way too far away from the back. It’s too early in the process for us to know the details of each. We have 229 Page 2 of 2 not thought that far ahead. We will get those details at the time of building submissions. Most probably the bedroom window will be fixed center and 2 sliders on the side.” On September 17, 2024, I spoke with Mr. Pawar via phone call. I informed him that the Feng’s were unclear of the details regarding the windows, specifically the master bedroom window(s). I asked him for more details, e.g., sill height, number, egress, and view study. Mr. Pawar did not provide any windows information and was unwilling to discuss any further. Instead, he said that if the Feng’s did not accept their offer for privacy plants now, then there is no guarantee they will plant them later. While conditions and requirements may be applied to further applicable goals, policies, and strategies – any conditions and requirements not based on objective standards may not make the project infeasible or reduce the number of units. For example, the decision-making body may apply conditions related to window treatments or paint color but could not apply conditions resulting in aesthetic modifications that would render the project infeasible. Under the HAA an objective standard is one involves “no personal or subjective judgment by a public official and [is] uniformly verifiable by reference to an external and uniform benchmark or criterion available and knowable by both the development applicant or proponent and the public official.” General Plan Housing Element The City of Saratoga’s 2023-2031 Housing Element requires Saratoga to plan for 1,712 housing units at all affordability levels for the 2023-2031 planning period. SITE CHARACTERISTICS AND PROJECT DESCRIPTION Site Description The 11,543 net square foot vacant project site is located at the intersection of Manteca Way and Alcott Way. The site contains an existing one story 3,503 square foot single-family residence. The site is level. Adjacent homes are all one story, however nearby homes are a combination of both one and two story structures. There are two-story homes located at 13698 and 13714 Manteca Way. Project Description The architectural style of the project can best be described as contemporary. The project will include the addition of a 781 second story to the existing one story residence for the purpose of creating an accessory dwelling unit (ADU). An interior stairway will provide second story access. The stairway will be accessible from a new rear entrance as well as from the interior of the residence. The ADU will include one bedroom, living room, office, bathroom, and kitchen. A new second story balcony on the front elevation will be accessible from the living room. FINDINGS The findings required for issuance of a Design Review Approval pursuant to City Code Section Article 15-45.080 are set forth below and the Applicant has met the burden of proof to support making all of those required findings: a. Site development follows the natural contours of the site, minimizes grading, and is appropriate given the property’s natural constraints. This finding can be made in the affirmative in that the project only includes the construction of a second story addition, and no grading is proposed to construct the project. b. All protected trees shall be preserved, as provided in Article 15-50 (Tree Regulations). If constraints exist on the property, the number of protected trees, heritage trees, and native trees approved for removal shall be reduced to an absolute minimum. Removal of any smaller oak trees deemed to be in good health by the City Arborist shall be minimized using the criteria set forth in Section 15-50.080. This finding can be made in the affirmative in that the project is limited to the construction of a second story addition and no protected trees will be impacted for its construction. c. The height of the structure, its location on the site, and its architectural elements are designed to avoid unreasonable impacts to the privacy of adjoining properties and to community viewsheds. This finding can be made in the affirmative in that the proposed residence complies with the maximum height limitation of 26 feet allowable for residential structures; the second story has no second story windows facing the adjacent property to the left, and the second story balcony will include half walls to mitigate side facing views and will be located at the front of the structure to avoid views into the rear and side yards of adjacent neighbors. There are no community viewsheds in the vicinity of the site. d. The overall mass and height of the structure, and its architectural elements are in scale with the structure itself and with the neighborhood. This finding can be made in the affirmative in that the proposed residence complies with the maximum height limitation of 26 feet 234 Report to the Planning Commission 13760 Manteca Way – Application #’s PDR24-0002 August 14, 2024 Page | 5 allowable for residential structures; the building has varying architectural forms and projections to break up the appearance of mass, the building setbacks meet or exceed those required for the R-1-10,000 zoning district. e. The landscape design minimizes hardscape in the front setback area and contains elements that are complementary to the neighborhood streetscape. This finding can be made in the affirmative in that existing landscaping within the front setback area includes lawn areas, drought resistant shrubs, trees, and groundcover. No additional landscaping is proposed. f. Development of the site does not unreasonably impair the ability of adjoining properties to utilize solar energy. This finding can be made in the affirmative in that development will not unreasonably impair the ability of adjoining properties to utilize solar energy as the project exceeds the required side and rear setbacks, and the orientation of the sun throughout the day with respect to the location of the site and position/height of the structure will not unreasonably cast shadows on adjoining properties. g. The design of the structure and the site development plan is consistent with the Residential Design Handbook, pursuant to Section 15-45.055. This finding can be made in the affirmative because the proposed project incorporates applicable design policies and techniques from the Residential Design Handbook. The overall mass and height of the structure are in scale with the neighborhood and the structure is set back in proportion to the size and shape of the lot. In addition, the proposed materials, colors, and details enhance the architecture in a well- composed, understated manner. h. On hillside lots, the location and the design of the structure avoid unreasonable impacts to ridgelines, significant hillside features, community viewsheds, and is in compliance with Section 15-13.100. This finding is not applicable to the project in that the site is not characterized as a hillside lot nor is the site located within the Hillside Residential zoning district. NEIGHBOR NOTIFICATION AND CORRESPONDENCE The applicant submitted five (5) notification forms from neighboring property owners and the Community Development Department received three project related emails (Attachment #3). The neighbor located at 18860 Alcott Way (located to the right of the project site) expressed concern regarding potential impacts from a rear facing balcony – the current project does not include a rear facing balcony. The neighboring property owner at 13746 Manteca Way (located to the left of the project site) has concerns that the project will not fit into the neighborhood and the front facing balcony could potentially affect their existing privacy and could block natural light. The three email comments that were received include similar concerns as those included on the notification forms. Three neighbors had no written concerns. The Community Development Department mailed public notices to property owners within 500 feet of the site. In addition, the public hearing notice and description of the project was published in the Saratoga News. ENVIRONMENTAL DETERMINATION The project is Categorically Exempt from the Environmental Quality Act (CEQA) pursuant Section 15303, “New Construction or Conversion of Small Structures”, Class 3 (a) of the Public Resources 235 Report to the Planning Commission 13760 Manteca Way – Application #’s PDR24-0002 August 14, 2024 Page | 6 Code (CEQA).
