Mayor Zhao invited public comment. No one requested to speak. At 6:00 p.m., the City Council held a Joint Session with Los Gatos Saratoga Recreation in the Linda Callon Conference Room. Mayor Zhao invited public comment. No one requested to speak. Mayor Zhao called the Regular Session to order at 7:00 p.m. ROLL CALL PRESENT: Mayor Yan Zhao, Vice Mayor Belal Aftab, Council Members Kookie Fitzsimmons, Chuck Page, Tina Walia ABSENT: None ALSO PRESENT: Matt Morley, City Manager Richard Taylor, City Attorney Leslie Arroyo, Assistant City Manager John Cherbone, Public Works Director Bryan Swanson, Community Development Director Ryan Hinchman, Administrative Services Director Britt Avrit, City Clerk REPORT ON POSTING OF THE AGENDA The City Clerk reported the agenda for this meeting was properly posted on September 12, 2024. REPORT FROM JOINT SESSIONS Mayor Zhao stated the City Council held a Joint Session at 5:00 p.m. with the Saratoga Youth Commission and a Joint Session at 6:00 p.m. with Los Gatos Saratoga Recreation. Todd Badger provided a summary of the discussion during the Joint Session with Los Gatos Saratoga Recreation. CEREMONIAL ITEMS Appointment of Library & Public Art Commissioner and Parks & Recreation Commissioner Recommended Action: Adopt the Resolution re-appointing Eric Lewis to the Library & Public Art Commission and appointing Priya Shastri to the Parks & Recreation Commission and direct the City Clerk to administer the Oath of Office. RESOLUTION 24-053 WALIA/AFTAB MOVED TO ADOPT THE RESOLUTION RE-APPOINTING ERIC LEWIS TO THE LIBRARY & PUBLIC ART COMMISSION AND APPOINTING PRIYA SHASTRI TO THE PARKS & RECREATION COMMISSION. Proclamation, Suicide Awareness Month Recommended Action: Proclaim and recognize September as Suicide Awareness Month. The City Council proclaimed September as Suicide Awareness Month. SPECIAL PRESENTATION 988 Presentation Recommended Action: Receive 988 Presentation from County of Santa Clara Health System Behavioral Health Services Department The City Council received a 988 Presentation from County of Santa Clara Health System Behavioral Health Services Department. 1. The City Clerk stated she was made aware of a correction needed to the Minutes to reflect the correct names of the Committee meetings attended by Council Member Walia. RESOLUTION 24-054 WALIA/PAGE MOVED TO ADOPT THE RESOLUTION GRANTING FINAL MAP APPROVAL OF PARCEL MAP APPLICATION NO. ULS23-0011 FOR TWO LOTS LOCATED AT 12182 PARKER RANCH ROAD (APN 366-43-021). MOTION PASSED BY THE FOLLOWING VOTE: AYES: FITZSIMMONS, PAGE, WALIA, AFTAB, ZHAO. NOES: NONE. ABSTAIN: NONE. RECUSED: NONE. ABSENT: NONE. 1.4. Building Code Cleanup Ordinance Recommended Action: Waive reading and adopt an ordinance amending the City Building Code concerning building electrification (sections 16-49.020 , 16-49.030, and 16-49.040) to remove requirements that residential and commercial construction be mostly electric. ORDINANCE 404 WALIA/PAGE MOVED TO WAIVE READING AND ADOPT AN ORDINANCE AMENDING THE CITY BUILDING CODE CONCERNING BUILDING ELECTRIFICATION (SECTIONS 16-49.020 , 16-49.030, AND 16-49.040) TO REMOVE REQUIREMENTS THAT RESIDENTIAL AND COMMERCIAL CONSTRUCTION BE MOSTLY ELECTRIC. Tree Maintenance Contracts with Oscars Tree Service in the amount not-to-exceed $100,000 and with Mario Topete Tree Care and with West Coast Arborist each in the amount not-to-exceed $50,000 Recommended Action: Approve Tree Maintenance Service Contracts with Oscars Tree Service in the amount not- to-exceed $100,000 and with Mario Topete Tree Care and with West Coast Arborist each in the amount not-to-exceed $50,000 and authorize the City Manager to execute the same. RESOLUTION 24-055 PAGE/WALIA MOVED TO ADOPT THE RESOLUTION APPOINTING MIKE EADS OF CSG AS HEARING OFFICER FOR ALL MATTERS OTHER THAN THOSE IN WHICH CSG HAS BEEN INVOLVED WITH THE APPROVALS OR ENFORCEMENT PROCEEDINGS RELATED TO THE APPEAL. Update on Los Gatos-Saratoga Community Education and Recreation Partnership (LGS Recreation) Recommended Action: Receive an update on the Los Gatos-Saratoga Community Education and Recreation (LGS Recreation) partnership results for FY 2023/24. Leslie Arroyo, Assistant City Manager and Ryan Hinchman, Administrative Services Director, presented the staff report. Mayor Zhao invited public comment. No one requested to speak. Update on Saratoga Area Senior Coordinating Council (SASCC) Partnership Recommended Action: Receive an update on the Saratoga Area Senior Coordinating Council (SASCC) partnership results for FY 2023/24. Emergency Communications Recommended Action: Receive an update on the City's emergency communications practices. Joan Pliego, Public Information Officer, presented the staff report. MISC24-0006 – Extension request for the Temporary Compliance Plan for Winery Operations at House Family Vineyards at 13340 Old Oak Way Recommended Action: Adopt the resolution approving the Temporary Compliance Plan extension subject to conditions of approval. Nicole Johnson, Senior Planner, presented the staff report. Jim Cargill, representing House Family Vineyards presented remarks regarding the application. It was the consensus of the City Council to reduce public comment speaking time to two minutes. Mayor Zhao invited public comment. RESOLUTION 24-056 FITZSIMMONS/AFTAB MOVED TO ADOPT THE RESOLUTION APPROVING THE TEMPORARY COMPLIANCE PLAN EXTENSION SUBJECT TO CONDITIONS OF APPROVAL. MOTION PASSED BY THE FOLLOWING VOTE: AYES: FITZSIMMONS, PAGE, AFTAB. NOES: WALIA, ZHAO. ABSTAIN: NONE. RECUSED: NONE. ABSENT: NONE. COUNCIL ASSIGNMENTS Council Member Kookie Fitzsimmons Nothing to report. Council Member Tina Walia Silicon Valley Clean Energy Authority Board of Directors – stated the Board approved the FY budget that begins October 1st, adopted a resolution recognizing Clean Air Day, approved strategic focus areas for FY 24-25, and discussed the findings of recent work looking at long term state regulatory requirements. Cities Association of Santa Clara County Board of Directors – stated the Board received a presentation from County Executive James Williams that focused on emergency ambulance services, approved a contract with the Cities Association Executive Director, and as Chair of the Legislative Action Committee, Council Member Walia provided the Board with an update on advocacy work done. Saratoga City Council Minutes ~ September 18, 2024 ~ Page 7 of 7 Council Member Chuck Page West Valley Clean Water Program Authority Board of Directors – stated the Board approved changing the name of the Authority. West Valley Solid Waste Management Authority Board of Directors – stated the Board discussed the reports related to AB 1383 and rate changes. Valley Transportation Authority Policy Advisory Committee – stated he attended the meeting as a non- voting member and mentioned VTA has a new Legislative Director. Vice Mayor Belal Aftab Council Finance Committee - stated the Committee received a report on revenue and expenses for FY 23-24. Mayor Yan Zhao Council Finance Committee - stated she attended the meeting and has nothing more to add to Vice Mayor Aftab’s report. West Valley Sanitation District Board of Directors – stated she attended the meeting with nothing to report.
