At 6:00 p.m., the City Council held a Joint Session with Assemblymember Berman in the Linda
Callon Conference Room.
Mayor Zhao invited public comment.

1. Following the public hearing, introduce and waive the first reading of an ordinance
amending Chapter 15 (Zoning Regulations) of the Saratoga City Code to implement
programs of the 2023-2031 Housing Element.
2. Direct staff to place the ordinance on the consent calendar for adoption at the next regular
meeting.

the Board appointed Stephen Guruwaiya and Tanuj Siripurapu to the Board.
Silicon Valley Clean Energy Authority Board of Directors – stated the Board approved funding
allocation for a project, approved a local long term solar and storage project, and approved
allocation for the expanded education fund.

Saratoga Chamber of Commerce Board – stated the Board discussed the upcoming Economic
Vitality meeting.

Cities Association of Santa Clara County – stated she attended this meeting for Council Member

Review and accept the Treasurer’s Report for the month ended September 30, 2024.
BACKGROUND:
California government code section 41004 requires that the City Treasurer submits to the City
Clerk and the legislative body a written report and accounting of all receipts, disbursements, and
fund balances. The Municipal Code of the City of Saratoga, Article 2-20, Section 2-20.035
designates the City Manager as the City Treasurer. This report is prepared to fulfill this
requirement.
The following attachments provide financial transaction data for the City of Saratoga’s Funds
collectively as well as specifically for the City’s General (Operating) Fund, changes in investment
pool balances, and historical investment returns.
FISCAL STATEMENT:
Cash and Investments Balance by Fund
As of September 30, 2024, the City’s unaudited cash and investments totaled $41,724,101. The
City Council’s adopted policy on the Working Capital Reserve Fund states that effective July 1,
2016: for cash flow purposes and to avoid the occurrence of dry period financing, pooled cash
from all funds should not be allowed to fall below $1,000,000. The total pooled cash balance of
$41.7 million exceeds the minimum amount required.

City’s Current Financial Position
In accordance with California government code section 53646 (b) (3), the City is financially well
positioned and able to meet its estimated expenditure requirements for the next six months. As of
September 30, 2024, the City’s financial position (Assets $42.8M, Liabilities $6.9M, and Fund
Equity $35.9M) remains very strong and there are no issues in meeting financial obligations now
or in the foreseeable future.
The following Fund Balance schedule represents actual funding available for all funds at the end
of the monthly period. This amount differs from the above Cash Summary schedule as assets and
liabilities are components of the fund balance. As illustrated in the summary below, Total Cash
is adjusted by the addition of Total Assets less the amount of Total Liabilities to arrive at the
Ending Fund Balance –which represents the actual amount of funds available.

SUBJECT:Ordinance Amending Articles 15-18,15-19, 15-35, 15-45, 15-56, 15-57, and
15-58 of the Saratoga City Code to Implement Programs of the 2023-2031
Housing Element.
RECOMMENDED ACTION:
Waive reading and adopt the ordinance amending Chapter 15 (Zoning Regulations) of the Saratoga
City Code to implement programs of the 2023-2031 Housing Element.
BACKGROUND:
At its meeting of October 15, 2024, the City Council conducted a public hearing to consider
amendments to Chapter 15 (Zoning Regulations) of the Saratoga City Code to;1) update the City’s
ADU ordinance to comply with State Law, and 2) adopt amendments to Mixed-Use development
standards to remove constraints to achieve the maximum density allowed. Following the hearing,
the Council introduced the ordinance and directed staff to place the matter on the consent calendar
for the next regular meeting of the City Council.
The ordinance introduced by the City Council is included in Attachment A. If adopted by Council,
it will take effect in 30 days.

ORDINANCE NO. XXX
AN ORDINANCE AMENDING ARTICLES 15-18,15-19, 15-35, 15-45, 15-56, 15-57 AND
15-58 OF THE SARATOGA CITY CODE TO IMPLEMENT POLICIES OF THE 2023-
2031 HOUSING ELEMENT
The City Council of the City of Saratoga finds that:
1.On March 20, 2024, the City Council adopted the 2023-2031 Housing Element for the City
of Saratoga and certified the associated Final Environmental Impact Report and adopted
all findings required by law. In connection with that approval, the City Council adopted
Ordinance No. 399 amending the City Code and rezoning properties as required to make
sites available with appropriate zoning and development standards to accommodate the
portion of the City’s regional housing need for each income level that could not be
accommodated on sites available under existing City zoning.
2.The Housing Element Policy Program includes adopted programs to be implemented which
include modifying the city regulations to facilitate the construction of Accessory Dwelling
Units and recommended amendments to zoning districts that allow mixed-use development
to remove constraints that could limit maximum residential densities.
3.On September 11, 2024, the Planning Commission held a duly noticed public hearing
consistent with Section 15-85.050 of the Saratoga Municipal Code and considered the
amendments proposed in this Ordinance, supporting documents, and all testimony and
other evidence presented at the public hearing; and recommended that the City Council
adopt the amendments.
4.On October 15, 2024, the City Council held a duly noticed public hearing consistent with
Section 15-85.080 of the Saratoga Municipal Code and, after considering the supporting
documents and all testimony and other evidence presented at the public hearing, introduced
this Ordinance and waived the reading thereof.
5.The City Council adopted this Ordinance at a duly noticed regular meeting on November
6, 2024.
Therefore, the City Council of the City of Saratoga hereby ordains as follows:
Section 1. Adoption.
Chapter 15 (Zoning) of the Saratoga City Code is amended as set forth in Attachment 1. Text to be
added is indicated in bold double-underlined font (e.g., bold double-underlined) and text to be
deleted is indicated in strikeout font (e.g., strikeout). Text in standard font is readopted by this
ordinance. Text in italics (e.g., italics) is descriptive only and is not part of the amendments to the
City Code.

Section 2. Severance Clause.
The City Council declares that each section, sub-section, paragraph, sub-paragraph, sentence,
clause and phrase of this ordinance is severable and independent of every other section, sub-
section, paragraph, sub-paragraph, sentence, clause and phrase of this ordinance. If any section,
sub-section, paragraph, sub-paragraph, sentence, clause or phrase of this ordinance is held invalid,
the City Council declares that it would have adopted the remaining provisions of this ordinance
irrespective of the portion held invalid, and further declares its express intent that the remaining
portions of this ordinance should remain in effect after the invalid portion has been eliminated.
Section 3. California Environmental Quality Act
This ordinance is part of the project described in the Environmental Impact Report described in
the Findings above. On March 20, 2024, the City Council certified the Final Environmental Impact
for the Project and adopted CEQA Findings and a Statement of Overriding Considerations for
impacts that were found to be significant and unavoidable, adopted and incorporated into the
project all of the mitigation measures for the project, and adopted a Mitigation Monitoring and
Reporting Program. None of the amendments adopted by this ordinance require subsequent or
supplemental environmental analysis under CEQA, as described in Public Resources CodeSection
21166 and CEQA Guidelines Section 15162 because there has not been a substantial change to the
project; a substantial change to the circumstances under which the project is being undertaken, or
new information, which was not known and could not have been known at the time the
environmental analysis was completed, has become available.
Section 4. Publication.
A summary of this ordinance shall be published in a newspaper of general circulation of the City
of Saratoga within fifteen days after its adoption.
Following a duly noticed public hearing the foregoing ordinance was introduced at the regular
meeting of the City Council of the City of Saratoga held on the 15th day of October 2024 and was
adopted by the following vote on November 6, 2024.

PROPOSED AMENDMENTS TO CHAPTER 15 OF THE SARATOGA MUNICIPAL
CODE TO IMPLEMENT THE PROGRAMS OF THE 2023-2031 HOUSING ELEMENT
The Saratoga Municipal Code is amended as set forth below. Text to be added is indicated in bold
double-underlined font (example) and text to be deleted is indicated in strikeout font (example).
Text in standard font is readopted by this ordinance. Text in italics (example) is explanatory and
not a part of the Code or amendments.
1. Site Coverage and Required Setbacks in the P-A zoning district
15-18.060 Site coverage
The maximum net site area covered by structures on any lot in a P-A district shall be thirty forty
percent.
15-18.080 Front, side, and rear setback areas.
(a)For any nonconforming site in the P-A district, as defined in this Chapter, the requirements
provided in Section 15-65.040(b) apply to the site. For any conforming site in the P-A
district, the minimum setback area requirements in the P-A zoning district, are as follows:
(1)Front setback area.The minimum front setback area of any lot in a P-A district shall be
twenty-five feet from the front lot line.
(2)Side setback area.The minimum side setback area of any lot in a P-A district shall be ten
percent of the average width of the site; provided, that a side setback area of more than
twenty-five feet from the applicable side lot line shall not be required and a side setback area
of less than ten feet from the applicable side setback area shall not be permitted, subject to
the following exceptions:
(i)The exterior side setback area of a corner lot shall be not less than fifteen feet from the
exterior side lot line.
(ii)For at least fifty percent of the building façade length,Oone foot shall be added to an
interior side setback area for each two feet of height or fraction thereof by which a portion
of a structure within thirty feet of the side lot line for such setback area exceeds fourteen feet
in height; provided, that an interior side setback area of more than thirty feet from the interior
side lot line shall not be required.
(3)Rear setback area.The minimum rear setback area of any lot in a P-A district shall be
twenty-five feet from the rear lot line, subject to the following exceptions:
(i)One foot shall be added to the minimum rear setback area for each two feet of height by
which a structure exceeds fourteen feet in height.
(ii)Where a rear setback area is abutting property within an A, R-1, or HR, or R-M district, the
minimum rear setback area shall be thirty-five feet from the rear lot line.

2. Side and Rear Setbacks in the C-N zoning district
15-19.030 C-N district regulations.

(f)Front, side, and rear setback areas.For any nonconforming site in the C-N district, as
defined in this Chapter, the requirements provided in Section 15-65.040(b) apply to the site.
For any conforming site in the C-N district, the minimum setback area requirements in the
C-N district, are as follows:
(1)Front setback area.The minimum front setback area of any lot in a C-N district shall be ten
feet; except that on a site abutting and fronting on the same street as, or directly across the
street from, an A, R-1, HR, R-M or P-A district, the minimum front setback area shall be
fifteen feet.
(2)Side and rear setback areas.No side or rear setback areas shall be required for any lot in a
C-N district, subject to the following exceptions:
(i)On a reversed corner lot abutting a lot in an A, R-1, or HR district, the minimum exterior
side setback area shall be not less than one-half of the required front setback area of the
abutting lot.
(ii)Except as otherwise provided in subsection (f)(2)(i) of this Section, oOn a lot abutting an A,
R-1, or HR district, the minimum side setback area or rear setback area abutting such other
district shall be thirty twenty feet.
(iii) On a lot directly across a street or alley from an A, R-1, or HR district, the minimum side
setback area or rear setback area abutting to such street or alley shall be ten feet.
Where a side or rear setback area is required under any of the foregoing provisions, one foot shall
be added to the required setback area for each one foot of height or fraction thereof by which a
structure within thirty feet of the lot line for such setback area exceeds fourteen feet in height.

3. Required Parking Spaces
15-35.030 Schedule of off-street parking spaces.
Except as otherwise provided in this Code regarding specific project types, off-street parking
spaces shall be provided in accordance with the following schedule:
Use Spaces Required
(a) Single-family dwelling, excluding accessory
dwelling units
Two covered spaces within a garage.
(b) Accessory dwelling unit One covered space within a garage, except as
otherwise provided in Article 15-56.See
Municipal Code Section 15.56.025.

parking. No spaces beyond the number noted
per unit are required.
In Mixed Use zoning districts:
• MU-MD: One and one-half spaces per
unit.
• MU-HD: One space per unit.
• MU-VHD: One and one-half spaces per
unit.
In C-V, C-N, CH-1, and CH-2 zoning
districts:
•One and one-half spaces per unit (one
space per unit covered)
In all other zoning districts except Mixed
Use:
• One space per bedroom up to a
maximum requirement of two spaces per unit.
There is no parking requirement for any new
multi-family residential or mixed use
development that is within one-half mile
walking distance of a major transit stop,
which is the intersection of two or more major
bus routes with a frequency of service interval
of 15 minutes or less during the morning and
afternoon peak commute periods, or a major
transit stop that is included in the applicable
regional transportation plan.
(d) Hotels and motels One space for each guestroom or for each two
beds, whichever is greater.
(e) Bed and breakfast establishments One space for each bedroom to be rented, in
addition to the spaces required for the single-
family dwelling.
(f) Schools and day care facilities One space for each employee, including
teachers and administrators, plus such
additional spaces as determined by the
Planning Commission to be adequate for
student and visitor parking.
(g) Community facilities and institutional
facilities not otherwise described in this Section
One space for each employee and such
additional number of spaces as may be
prescribed by the Planning Commission.
(h) Places of public assembly, including religious
institutions, theatres, lodge halls, auditoriums and
mortuaries
One space for each four seats or one space for
each forty square feet of floor area usable for

seating if seats are not fixed, plus one space
for each two employees.
(i) Clubs, including country clubs, recreation
clubs, swimming clubs and tennis clubs
One space for each membership, one space
for each employee, and such additional spaces
as may be prescribed by the Planning
Commission.
(j) Health/fitness centers One space for each 150 square feet of gross
floor area
(k) Nursing homes One space for each three beds, one space for
each two doctors providing medical services
on a regular basis, and one space for each two
employees.
(l) Professional and administrative offices One space for each two three hundred square
feet of floor area.
(m) Medical offices and clinics One space for each two three hundred square
feet of floor area.
(n) Retail establishments One space for each two three hundred square
feet of floor area.
(o) Bulky commodity sales establishments
such as household furniture, mattresses,
appliances, carpeting and floor coverings
One space for each five hundred square feet
of floor area.
(p) Service establishments and financial
institutions
One space for each two three hundred square
feet of floor area.
(q) Restaurants One space for each seventy-five square feet of
floor area. In addition, if the restaurant has
outdoor dining, one space for each seventy-
five square feet of outdoor dining area shall
also be provided.
(r) Warehouses, storage buildings and storage
facilities combined with commercial uses
One space for each one thousand square feet
of floor area.
(s) Commercial uses conducted primarily
outside of buildings, public buildings and
grounds other than offices, and public utility
structures and facilities
One space for each employee, and such
additional spaces as may be prescribed by the
Planning Commission.
(t) Single-room occupancy building One space for each unit plus one space for the
on-site manager when required and one space
for each additional employee.

4. Article 15.45 – Design Review: Single-Family Dwelling
15-45.060 - Planning Commission design review; public hearing.
(a) Pursuant to this Article, the following projects shall receive design review approval by the
Planning Commission prior to issuance of a building permit in any A, R-1, HR, or R-OS
district to the extent not precluded by another section of this Chapter or State Law:
(1)Any new multi-story main structure or multi-story accessory structure.
(2)Any conversion of a single-story structure to a multi-story structure, with the exception of
an application for an attached accessory dwelling unit in compliance with Section 15-
56.025, which shall be reviewed ministerially.
(3)Any new structure over eighteen feet in height or any existing structure that would exceed
eighteen feet in height as a result of the proposed construction, except in those instances
where the existing structure would exceed eighteen feet in height due to an application
for an attached accessory dwelling unit in compliance with Section 15-56.025, which
shall be reviewed ministerially.
(4)Any project that requires design review under the terms or conditions of any tentative or final
subdivision map, use permit, variance or conditional rezoning.
(5)Any new dwelling on a lot having a net site area of less than five thousand square feet.
(6)Any project that increases the cumulative floor area of all structures on a site to more than
six thousand square feet.
(7)Any project that, in the opinion of the Community Development Director, may be
significantly inconsistent with the design review findings required in Section 15-45.080 of
this Article, or may cause excessive damage to the natural environment, or may result in
excessive intensification of the use or development of the site.
(8)Any addition to a structure over eighteen feet in height that would expand the existing floor
area by more than fifty percent or modify the existing footprint by more than fifty percent.
(b)A public hearing on the application for design review approval under this Article shall be
required. Notice of the public hearing shall be given not less than ten days nor more than
thirty days prior to the date of the hearing by mailing, postage prepaid, a notice of the time
and place of the hearing to the applicant and to all persons whose names appear on the latest
available assessment roll of the County as owning property within five hundred feet of the
boundaries of the site which is the subject of the application. Notice of the public hearing
shall also be published once in a newspaper having general circulation in the City not later
than ten days prior to the date of the hearing.

5. Article 15-56 - Accessory Dwelling Units
15-56.035 Owner occupancy restrictions.
(a)With respect to a lot containing a junior standard accessory dwelling unit, for applications
received after January 1, 2025,the owner must reside in either the remaining portion of
the structure or the newly created junior accessory dwelling unit. one of the dwellings
on the lots must be the bona fide principal residence of at least one legal owner of the lot
containing the dwelling, as evidenced at the time of building permit approval by appropriated
documents of title and residency. Prior to the issuance of a building permit, the applicant
shall provide evidence that a deed restriction has been recorded on the title of the affected
property stating that one of the dwelling units on the lot shall remain owner occupied. Owner
occupancy shall not be required if the owner is another governmental agency, land
trust, or housing organization.
15-56.040 – Permitting
Notwithstanding any other provision of this Chapter, Wwithin sixty days of receipt of a
complete application, the Community Development Department shall ministerially approve or
deny any application for a junior accessory dwelling unit or an accessory dwelling unit that is in
compliance with the requirements of this Article or otherwise qualifies for ministerial approval
pursuant to State law.
6. Article 15-57 – Ministerial Consideration of Qualifying Projects
15-57.050 Urban Lot Splits.
A parcel map for an Urban Lot Split shall be allowed subject to ministerial review if the parcel
map for the lot split meets all of the requirements in this section.
(a)Parcel Map.A parcel map for an Urban Lot Split shall be allowed with ministerial approval
if the parcel map for the lot split meets all of the following requirements:
(1)The parcel is located within a Single-Family Residential Zoning District.
(2)The parcel map subdivides an existing parcel to create no more than two new parcels of
approximately equal lot area provided that one parcel shall not be smaller than forty percent
of the lot area of the original parcel proposed for subdivision.
(3)Both newly created lots are no smaller than one thousand two hundred square feet.
(4)Each lot resulting from the Urban Lot Split adjoins the public right-of-way via a twenty foot
street frontage or have access to the public right-of-way via a recorded twenty foot wide
access easement benefiting the lot; if necessary to allow one lot resulting from an Urban Lot
Split to meet this requirement, the other lot shall provide such an access agreement.
(5)Urban Lot Splits dividing a parcel with an existing street frontage of less than eighty feet
provides only a single driveway curb cut providing access to both lots created by an Urban
Lot Split, via a twenty foot wide access easement as needed.

(6)The Urban Lot Split does not result in a new lot with a width that is less than fifty percent of
the width of the original parcel. For purposes of this Article "width" means "site width" as
defined in City Code Section 15-06.620(d).
(7)The parcel has not been established through prior exercise of an Urban Lot Split as provided
for in this Article and Government Code section 66411.7.
(8)The parcel is not located within a historic district or property included on the State Historic
Resources Inventory, as defined in Public Resources Code Section 5020.1, or within a site
that is designated or listed as a city or county landmark or historic property or districts
pursuant to a city or county ordinance.
(9)Neither the owner of the parcel being subdivided nor any person acting in concert with the
owner has previously subdivided an adjacent parcel using an Urban Lot Split.
(10) The Urban Lot Split conforms to all applicable objective requirements of the Subdivision
Map Act [Division 2 (commencing with Government Code Section 664100)] and the City
Code, except as otherwise expressly provided for in this section.
(11) The landowner provides all easements required for the provision of public services and
facilities to the resulting lots.
(b)Number of Units.Section 15-57.040(b) notwithstanding, no more than four dwelling units
shall be allowed on any parcel created by the use of an Urban Lot Split or any parcel that is
the site of a Three-Unit Residential Conversion. For purposes of this provision, "unit" means
any dwelling unit, including, but not limited to, a unit or units created pursuant to
Government Code Section 65852.21, a primary dwelling, an accessory dwelling unit as
defined in Government Code Section 65852.2, or a junior accessory dwelling unit as defined
in Government Code Section 65852.22.
(c)Development Standards.Residential uses are the only allowed uses of a lot created by an
Urban Lot Split. Development standards for residential development on each new lot
resulting from an Urban Lot Split shall conform to section 15-57.040 of this Article
Development standards shall be applied to each new building individually. If application of
the development standards of the City Code, including this Article, to an Urban Lot Split
would have the effect of physically precluding the construction of two units on either of the
resulting lots or that would result in a unit size of less than eight hundred square feet, the lots
shall conform as closely as possible to those standards while allowing the construction of
two dwelling units of eight hundred square feet floor area on each lot. Sections 15-
57.050(a)(2) and (3) are not subject to this exception.
(d)Accessory Dwelling Units.Notwithstanding Government Code Section 65852.2 or
65852.22, Accessory Dwelling Units and Junior Accessory Dwelling Units shall not be
permitted on any lot resulting from an Urban Lot Split on which a Two-Unit Residential
Development has been approved under this Article.
(ed)Nonconforming Zoning Conditions.Correction of nonconforming zoning conditions shall
not be required as a condition for ministerial approval of a parcel map application for the
creation of an Urban Lot Split.
(fe) Residency Requirement. An applicant for an Urban Lot Split shall sign an affidavit stating
that the applicant intends to occupy one of the housing units on the resulting lots as their

principal residence for a minimum of three years from the date of the approval of the Urban
Lot Split. In the event that the applicant cannot sign such affidavit because the land to be
subject to the Urban Lot Split is vacant or they occupy a unit on the land but intend to
demolish that unit within three years, the applicant will qualify for ministerial approval as
set out in this article by signing an alternative affidavit. The alternative affidavit shall state
the reason for using this alternative affidavit and that the applicant (i) intends to initiate
approval of at least one housing unit on the property within three years from the date of
approval of the Urban Lot Split and (ii) intends to occupy one of the units so constructed as
their principal residence for a minimum of three years from the issuance of the last Certificate
of Occupancy for the residence to be occupied and any dwelling units for which the applicant
simultaneously applies. No affidavit requirement shall apply to an applicant that is a
"community land trust," as defined in Revenue and Taxation Code Section
402.1(a)(11)(C)(ii) or is a "qualified nonprofit corporation" as described in Revenue and
Taxation Code Section 214.15.
7.Mixed-use and multi-family design standards
15-58.030 Design Standards, building placement and articulation.

(3)M-U, P-A, C-V, and C-N districts.A minimum 70 percent of ground-floor building
frontage must be built within 10 feet of the front setback line, as illustrated in Figure 15-

Dear City Council Members
Representing my own views, I write regarding the trajectory of the Ordinance Amendments we are making to Chapter 15 - Zoning Regulations of the Saratoga
City Code in order to implement the programs of the 2023-2031 Housing Element I fear that in an effort to get the housing element certified and remain
certified by the California Department of Housing, we may have swung too far in ameliorating the state's intent to not hinder development In doing so, the
changes we have made and continue to implement have effectively removed public review from the planning process and weakened the public noticing process
Many of the ordinance amendments we have made since we began the implementation of the code changes in March 2024 has been to slowly transition the
planning review process from discretionary design review approval by the Planning Commission to mandatory objective design review approval (effectively
removing the public hearing portion of the planning review process) The table below illustrates the changes that we've implemented ( / plan on implementing)
based on the type of building planned to be developed
I understand that our policy reasoning for making these changes was to get certified as soon as possible and to meet the state's expectation that we remove
impediments from housing developments to get plan approval Moreover, I also understand that some of these ordinance amendments have already gone into
effect and these comments may feel too little too late, but I would feel remiss not to bring our attention to these issues and not to try and course correct at this
juncture Consequently, the biggest change in this new framework is that so long as a development meets the objective standards set in Article 15-58, then the
Planning Commission shall grant design review approval It's not clear to me whether this means these types of developments are still required to go through a
public hearing process Our code changes have also left a gap in the public notice requirements
I'm fearful that with these changes, the first time the public might become aware of a development (especially since there are no more story pole requirements)
is when shovels begin moving dirt, which is far too late in the development planning process As such, I have two suggested remedies / mitigations that still
allow us to meet the policy objectives of removing impediments, while inserting the public hearing / comment back into the planning review process
First, we need better noticing requirements When we had the story pole requirement, the public could easily see the planned development Since the removal
of the story pole requirement, however, the larger Saratoga public is not aware of project developments because Saratoga does not have a requirement to place a
development planning notice poster board at the site of development There are no renderings of what the planned development will look like posted at the site
of development Other cities have poster board requirements that allow the public to learn about development plans
Second, we can still remove the veto power of the planning commission, but still require developers to hold a site visit to allow the public to provide comment
on the planning development The developer may choose to listen or ignore the public comment, but at least in this way if we have an amenable developer, the
city has helped facilitate a dialogue between the public and developer and potentially resolve any otherwise unresolved issues I think the city has a
responsibility to help maintain the look and feel of our community At minimum, I think the public's voice should at least be given a chance to be directly heard
by the developer/applicant
Please consider these two suggestions and direct staff / the Planning Commission accordingly

SUBJECT:Landscaping &Lighting Assessment District LLA-1; Resolutions initiating
renewal of the District for FY 25-26.
RECOMMENDED ACTIONS:
1. Adopt the Resolution describing improvements and directing preparation of the Engineer’s
Report.
2. Adopt the Resolution appointing the Attorney’s for the District.
BACKGROUND:
Attached are two Resolutions which, upon adoption, would initiate the annual process of renewing
the Landscaping &Lighting Assessment District LLA-1 for the upcoming fiscal year beginning
on July 1 and/or annex new Zones. A summary of each Resolution is as follows:
1.Resolution describing improvements and directing preparation of the Engineer’s Report
-This is the Resolution required under Streets & Highways Code Section 22622 to initiate the
annual renewal process for the existing assessment district and the annexation of new Zones
for the ensuing fiscal year. The Resolution references the proposed improvements to be
provided by the district (Exhibit A) and directs the preparation of the Engineer’s Report
required under Streets and Highways Code Section 22565.
2.Resolution appointing Attorneys -This Resolution appoints the City Attorney’s office as the
attorneys for the District throughout the renewal process and limits their fees in connection
with this work to $500.
The provisions of SB 919 (The Proposition 218 Omnibus Implementation Act) adopted by the
State legislature in 1997, (Chapter 38, Stats. 1997), and which became effective on July 1, 1997,
will be implemented during the renewal process if necessary.

Procedurally this means that assessment ballots will be mailed to those property owners within the
District whose initial proposed assessments are either 1) higher than in any previous year and
who have not previously voted on their assessments, 2) higher than what was authorized via
balloting conducted in a previous year, or 3) annexation of new Zones. As in previous years,
ballots will be separately tabulated at the close of the Protest Hearing for each Zone that may be
voting. Only those ballots returned by the close of the Protest Hearing will count towards
determining whether a majority protest exists.

DIRECTING PREPARATION OF AN ENGINEER'S REPORT
FOR THE CITY OF SARATOGA LANDSCAPING AND LIGHTING
ASSESSMENT DISTRICT LLA-1 - FISCAL YEAR 2025-2026
WHEREAS, the City Council did, pursuant to the provisions of the Landscaping and
Lighting Act of 1972, Part 2, Division 15 of the Streets and Highways Code of the State of
California, conduct proceedings for the formation of the City of Saratoga Landscaping and
Lighting Assessment District LLA-1 and for the levy and collection of assessments for fiscal
year 1980 - 1981, and did, on June 18, 1980, pursuant to proceedings duly had, adopt its
Resolution No. 950-D, a Resolution Overruling Protests and Ordering the Formation of an
Assessment District and the Improvements and Confirming the Diagram and Assessments; and
WHEREAS, the public interest, convenience and necessity require, and it is the intention
of said Council to undertake proceedings for the levy and collection of assessments upon the
several lots or parcels of land in said District and/or several lots of parcels of land which are
proposed to be annexed into said District for the construction or installation of improvements,
including the maintenance or servicing, or both, thereof, for the fiscal year 2025-2026; and
WHEREAS, the improvements to be constructed or installed, including the maintenance
or servicing, or both, thereof, are more particularly described in Exhibit "A" hereto attached and
by reference incorporated herein; and
WHEREAS, the costs and expenses of said improvements, including the maintenance or
servicing, or both, thereof, are to be made chargeable upon said District and/or upon the lots
within the territory proposed to be annexed into said District, the exterior boundaries of which
District are the composite and consolidated area as more particularly shown on a map thereof on
file in the office of the Clerk of the City of Saratoga to which reference is hereby made for
further particulars. Said map indicates by a boundary line the extent of the territory included in
said District and/or to be annexed into said District and shall govern for all details as to the
extent of the assessment district, and the proposed annexation; and
WHEREAS, the Engineer of said City be, and is hereby, directed to prepare and file with
said Clerk a report, in writing, referring to the assessment district and/or proposed annexation by
its distinctive designation, specifying the fiscal year to which the report applies, and, with respect

RECOMMENDED ACTION:
Review recommendations of the Economic Vitality Ad Hoc Committee and provide direction to
staff on next steps.
BACKGROUND:
At the regular City Council Meeting on Wednesday, May 1, 2024, the City Council held an
interactive discussion about economic vitality throughout Saratoga, in addition to hearing
comments from the public. At the conclusion of the discussion, the Council established an ad-hoc
committee with Vice Mayor Belal Aftab and Council Member Chuck Page leading the committee.
The intent of the Economic Vitality Ad Hoc Committee is to bring together various stakeholders,
including business owners, community members, and property owners, to collaborate and develop
innovative solutions towards increasing economic activity.
The Committee met on June 11 and again on October 23. In the interim, outreach to businesses
and property owners occurred, including an online survey and individual outreach conversations.
Through the outreach efforts, the Committee grouped input into six categories:
Community Engagement and Events
Infrastructure and Public Facilities
Business Delivery and Attraction
Marketing and Promotion
Economic Support and Development
Regulatory and Administrative Measures
Attachment A reflects each category with individual ideas or themes.
The discussion at the October 23 outreach meeting allowed the Committee to further refine the list
and to focus on the items that resonate the most with the community.Of particular note, the City
already has efforts planned or underway that allow for or address a number of requests as they

were expressed by stakeholders. Although expectations are high with some respect, it is important
to acknowledge the priority that Economic Vitality already carries.
Community Engagement and Events The stakeholders identified a lack of knowledge in how to
volunteer to support or produce events. Information was provided on how this can occur and the
advantage that community groups have over the City in delivering events. The city’s existing
Community Grant program was identified as a resource to support this category.
The committee recommends that the Chamber and other community organizers engage through,
for example:
Hosting regular events
Providing community focused concerts
Incorporating a farmers’ market in the Saratoga Village
Infrastructure and Public Facilities Stakeholders discussed areas of deficiency in the Village,
including lighting at crosswalks and on side streets. Discussion on the efficacy of signage leading
to parking identified need for a new look at wayfinding. This category also carried the bulk of the
conversation on expanded sidewalks focused on areas in front of restaurants.
Hero Ranch has confirmed their interest in funding a pilot project for a wider sidewalk. The project
would likely include approximately 115 feet of curbline. The location aligns with a planned
sidewalk safety project planned by Public Works at the location. The wider sidewalks would result
in the loss of three parking spaces. The project could prove beneficial in providing enhanced site
distance at the crosswalk.
The discussion at the Council meeting on August 21 including contemplating conceptual design
drawings prior to making a decision. The cost for this work is estimated at $7,000. As noted, Hero
Ranch is interested in funding the project, however they would like assurance that the pilot would
proceed to construction prior to investing in the effort.
The Committee recommends directing staff to proceed with a pilot project at the identified
location. Alternatively, the Council could provide direction for the City to fund the conceptual
design work to limit the financial risk to the business and allow for further City Council review
once the conceptual design is complete.
The City has lighting and signage upgrades included in the current Parking District Improvement
Project. The committee recommends monitoring effectiveness of signage and lighting upgrades
for additional future modifications.
Business Diversity and Attraction and Marketing and Promotion Stakeholders acknowledged the
difficulty of attracting specific businesses where market forces drive private decisions. This topic
evolved into a need for a business development effort, with comments on ensuring a look at the
potential return on investment occurs (i.e. the potential sales tax return with respect to
expenditures). The Chamber of Commerce was seen as a potential service provider in this area.
The Committee recommends directing staff to identify a scope of services and cost, in partnership
with the Chamber of Commerce, for Business Diversity and Attraction with a citywide focus,

insuring the scope measures efforts outside of Chamber membership. The resulting cost and scope
would be considered through the City’s annual budget process.
Economic Support and Development Although overlapping with the previous topic, the input here
revolves around efforts that might improve the business environment, including façade grants,
shop local programs.
No additional recommendations occurred from this topic.
Regulatory and Administrative Measures Discussion including the potential for modifications to
Conditional Use Permit regulations to more actively manage active uses, potentially including a
grandfather clause for existing businesses. The discussion included a look at prioritization and the
risk of creating regulations that lead to empty storefronts, which would be a step down from
inactive storefronts.
In addition, the Housing Element includes a commitment to revisit the Village Design Standards.
That work will begin this December.
The Committee recommends that City staff explore partnering with the Chamber to develop a
database of contacts, including business and property owners to help enhance communications.
The Committee also recommends that City staff analyze and report back on an increased website
presence that could include a modern look at why visitors should choose Saratoga, including a
comprehensive directory of local businesses.

place so the community can be engaged and we can make

Recommendations. Our downtown and merchants are suffering
and under the burden of too many restriction. It's obvious given
the number of empty store fronts.
I support:
- More outdoor dining options will bring in more people
- Rejecting demands from local downtown neighbors that
unreasonably limit the viability of business with restrictions that
act solely to thier benefit and to the detrement of the all other
residents.
- Letting people know that lower portion of the downtown has
ample parking
- The City working toward bringing business into downtown that
generate foot traffic supporting other business as well and limited
non active store front use

Our downtown businesses are dying and we desperately need a
plan for economic revitalization. We must foster an environment
that not only supports our current business community but also
actively attracts/recruits new enterprises and investments.
Saratoga’s unique charm deserves preservation, yet we must
embrace progress and change to ensure our city’s sustainability.
Without a focused initiative on economic development, our
businesses are at risk. I urge you to consider the following
actions:
Strengthen Existing Businesses: Develop policies and programs
that help our local businesses thrive, including easing regulations
that may hinder their growth. This includes adding parklets for
outdoor dining, widening sidewalks, meeting with business
owners to gauge what else would help them stay in business.
Attract New Enterprises: Actively market Saratoga as a
destination for diverse businesses by offering incentives or
creating a streamlined process for new establishments to join our
community.
Revise Outdated Regulations: Review and update ordinances to
reflect current business needs and modern economic trends,
ensuring that Saratoga is competitive with neighboring cities.
Engage with Local Stakeholders: Hold regular town halls or
roundtables with local business owners and residents to hear
their challenges and brainstorm solutions.

Comments City Council members,
I have attended several of the Village Vitality meetings and
appreciate the work that this team has done to help make our
Village more active and “alive.”
There are several proposals on the table, including a return of
parklet dining (I understand that this is up to us and not a state
highway issue), measures to attract businesses to our vacant
storefronts, and measures to better clarify the uses for village
storefronts.
I understand that the Council is not inclined to act on these
measures without feedback from the community. As a member of
the community, I want to add my voice in support of these
measures.
Please work with this team to bring more life to our lackluster
Village scene.

Hello all,
As a resident of Saratoga, I am eager and energized by the conversations we are having in our
community in recent months. I am thankful for all the Council members, staff, and community
members driving this initiative to uplift the vitality of our beloved city.
I understand that the city is preparing to agendize the Economic Vitality topics and direction
based on a report submitted by the Committee, to be voted on this Wednesday Nov 6. I fear
that this is not proper notice for community involvement. Take the delay of my email to
express my concern as an indication of the time needed to engage the community - and this is
merely to express my concern with the scheduling, not even to look over the agenda items.
Particularly as these topics impact so much of the community, a 2 weeks notice at minimum
would be appreciated, with the report with proposed items shared in advance. The community
has been active on these topics and so it would be appreciated if Committee operations
reciprocated those efforts by making adequate space and notice for community feedback.
For the sake of transparency, and out of respect for the vibrant community involvement, it
would ask that the drafted report/proposals for an overall plan to be shared well in advance
with the community. And then discussed in a community meeting, before submitted for City
Council vote. Remote access would also be requested.
And in the name of efficiency, for the items that require immediate action such as the outdoor
dining pilot, they should be among the first to be brought up.
I thank the City Council and Committee members for taking the time to consider my message.
I look forward to cultivating a more involved and transparent dynamic between our city
leaders and community members.

Comments As Saratoga residents since 1999, it saddens my wife and I to
see the vitality of the Village suffer so badly over the last several
decades. I highly endorse the SVN Recommendations to
revitalize our village. We need more "fun" in downtown Saratoga,
including restaurants, bars, and anything that will generate
sufficient foot traffic to have a viable and "living" Village. We
should increase outdoor dining options, reject objections from
neighbors (don't live near a downtown if you don't want to be
near a thriving village), and allow businesses other than design
studios and real estate offices and five star restaurants that few
can afford. It's time to make Saratoga Village a fun, thriving place
that we can all be proud of.

Comments My family and I moved to Saratoga in 2012. Since then, my
impression is that downtown is shrinking and is not competitive. I
would love to see more business catering to different interests
(not just hair salons and nail salons, we already have more than
enough). I'd love to see more places where people spend time
and money. Variety will draw people to downtown and for them to
spend their money at a number of different stores.

Comments I am writing to express my support for the proposals and
recommendations of SVN Saratoga Vitality Neighbors.
I feel our Saratoga Downtown needs to have a greater number
and diversity of restaurants, services and activities. It would be
great to have activities like ceramic painting, pottery making,
painting workshops etc. It would also be great to have more
restaurants offering different types of cuisines, more pastry and
ice cream stores, coffee shops and bakeries.
We also really need more retail options in our downtown area.
