AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SARATOGA TO
DESIGNATE FIRE HAZARD SEVERITY ZONES
The City Council of the City of Saratoga finds that:
1. California State Law requires the State Fire Marshal to identify areas across the state as
moderate, high, or very high fire hazard severity zones.
2. Once the State Fire Marshal provides these recommendations,the City must make the
information available to the public and adopt an ordinance designating the corresponding
fire hazard severity zones within 120 days.
3. These fire hazard severity zones can help guide fire protection planning.
4. The City of Saratoga received recommendations from the State Fire Marshall on
February 24, 2025, and posted the maps and related information on its website for public
review on February 26, 2025.
Therefore,the City Council of the City of Saratoga hereby ordains as follows:
Section 1. Adoption.
The City hereby adopts the Fire Hazard Severity Zones as recommended by the California
Department of Forestry and Fire Protection pursuant to Government Code Section 51178 as
shown in Attachment 1.
Section 2. Severance Clause.
The City Council declares that each section, sub-section, paragraph, sub-paragraph, sentence,
clause and phrase of this ordinance is severable and independent of every other section,sub-section,
paragraph,sub-paragraph,sentence,clause and phrase of this ordinance.If any section,sub-section,
paragraph, sub-paragraph, sentence, clause or phrase of this ordinance is held invalid, the City
Council declares that it would have adopted the remaining provisions of this ordinance irrespective
of the portion held invalid, and further declares its express intent that the remaining portions of
this ordinance should remain in effect after the invalid portion has been eliminated.
Section 3. CEQA Compliance.
The ordinance is Categorically Exempt from the Environmental Quality Act(CEQA)pursuant to
Section 15061(3)because it is covered by the general rule that CEQA applies only to projects which
have the potential for causing a significant effect on the environment. Here it can be seen with
certainty that there is no possibility the activity in question may have a significant effect on the
environment and therefore the activity is not subject to CEQA.

Section 4. Publication
A summary of this ordinance shall be published in a newspaper of general circulation of the City
of Saratoga within fifteen days after the ordinance's adoption.
Section 5. Effective Date.
A summary of this ordinance shall be published in a newspaper of general circulation of the City
of Saratoga within fifteen days after its adoption.
Following a duly noticed public hearing the foregoing ordinance was introduced at the regular
meeting of the City Council of the City of Saratoga held on the 4th day of June 2025, and was
adopted by the following vote on June 18, 2025.
