RESOLUTION NO. 25-060
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA
AMENDING THE CITY FEE SCHEDULE EFFECTIVE JANUARY 5, 2026
WHEREAS, the City of Saratoga Municipal Code authorizes the imposition of various
user fees for providing City services in all departments assembled in the City Fee Schedule; and
WHEREAS, the City Council has caused a Public Hearing Notice to be published as
required by Government Code Section 66016; and the data supporting the various user fees, fines,
penalties, rates, and assessments (attached hereto as Exhibit A) was made available for public
review at least 10 days prior to the noticed Public Meeting; and
WHEREAS, the City Council, on November 5, 2025, conducted a Public Hearing on the
proposed City Fee Schedule.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Saratoga hereby
authorizes the following:
1. Updates to City fees in all departments were indicated by proposed additions or
deletions of text in Attachment B in the Staff Report; and
2. City staff to make formatting, ordering, and corrective edits to Attachment B in the
Staff Report for the print and electronic adopted City Fee Schedule effective January
5, 2026.
BE IT FURTHER RESOLVED, the above and foregoing resolution was passed and adopted at
a regular meeting of the Saratoga City Council held on 5th day of November 2025 by the following
vote:

conjunction with the Building Valuation Data provided in the
annual publication each February, Building Valuation Data,
published by the International Code Council.
It should be noted that, when using this data, these are
"average" costs based on typical construction methods for
each occupancy group and type of construction. The average
costs include foundation work, structural and nonstructural
building components, electrical, plumbing, mechanical and
interior finish material. The data is a national average and
does not take into account any regional costs differences. As
such, the use of Regional Cost modifiers is subject to the
authority having jurisdiction.

Appendix 1. General Provisions
Appendix 1. General Provisions
Affordable Housing Fee Waivers
All planning, building, and engineering permit fees and actual costs are waived for the
following, unless otherwise limited:
a.Projects funded by the Santa Clara County Office of Suppor�ve Housing
b.Applica�on for Merger of Parcel – waive applica�on costs associated with lot mergers,
in an amount not to exceed $5,000, for projects that provide a minimum of 20% deed
restricted units affordable to low and very-low-income households.
c.Accessory Dwelling Units (ADUs) or Junior ADUs that are deed restricted so it may only
be rented to below market rate households.
d.Applica�ons under SB9 (lot split).
e.Applica�ons for conversion of exis�ng single-family in Zones R-1-20000 and R-1-40000
and outside the WUI and Very High Severity Fire areas.
1.Other Fee Waivers
a.Tree Removal Permit Fee is waived for removal of qualifying tree species in the
Wildland Urban Interface area.
b.Fallen or dead tree removals upon verifica�on.
c.Building Permit: Residen�al Reroofs- This fee is waived for proper�es in the Wildland
Urban Interface area with untreated wood shake or shingle roofs that will be replaced
with non-wood Class A roofing materials.
2.Refunds
a.Planning: If an applicant decides to cancel a project within the first 30 days, flat fees
will be reimbursed at 50% of the fee – only if a minimum amount of work was
completed prior to the request for cancellation of application. If an applicant cancels
a deposit-funded application, any remaining uncharged deposit amount will be
refunded. All Deposits are non-interest bearing.
b.Building/Public Works: Any fee erroneously paid or collected will be refunded. If an
applicant decides to cancel a project within 180 days of the Building Permit Fee or
Public Works fee payment, a refund of not more than 80% of the fee may be
authorized provided that no work has been done under the issued permit. A refund
of not more than 80% of the Plan Check Fee may be authorized provided that no plan
check review has been completed. No refund of any fee shall be authorized without
submittal of a written application by the original applicant within 180 days of fee
payment.

Appendix 1. General Provisions
4.“Actual Costs” include fully burdened personnel costs, professional and contract services,
outside agency fees, printing and publication fees, etc., directly related to the service. An
administrative overhead rate of 17.7% applies to all actual cost.
Deposits ensure that a customer pays for direct and indirect costs incurred to provide
a service. The customer who paid the deposit will receive a refund if a balance remains
a�er all Actual Costs are deducted. If the deposit is exhausted before a service is
complete, the customer must replenish the deposit in an amount determined by the
department director or work will cease. Deposits are not interest-bearing.
FACILITIES INFORMATION

2.Facility Rental Refund Policy
a.Rental Facility – includes room assigned tables and chairs

i.If addi�onal charges are incurred due to damage to the building or
contents, over�me or maintenance costs, deduc�ons will be made from
the deposit and the balance refunded.
ii.If deposit does not cover the charges, applicant will be responsible for
addi�onal fees.
iii.If clean-up is not completed, the en�re deposit shall be forfeited.
c.Rental Fees – Must be paid in full at least 30 days prior to event.
d.Cancella�ons – If event is cancelled between:
i.6 to 12 months – one-third of the deposit is forfeited; rental fee is
refunded.
ii.3 to 6 months – 100% of the deposit is forfeited, rental fee is refunded.
iii.Less than 30 days – 100% of the deposit and rental fee are forfeited.

Chapter 1, Section A. authorizes cost recovery for services hourly by the employee providing
services. Services without a specific dollar fee are billed at "Actual Costs" using the rate table
below. The rates include a 17.7% overhead rate and administrative costs. This schedule is to
change based on changes in personnel costs, including salary, benefits, and overhead costs.
