At 5:00 p.m., the City Council held a Closed Session in the Linda Callon Conference Room for a
Conference with Labor Negotiators.

At 6:00 p.m., the City Council held a Joint Session with Saratoga Schools in S. Ku Hall, at the
Saratoga Senior Center.

SUBJECT: Treasurer’s Report for the Month Ended October 31, 2025
RECOMMENDED ACTION:
Review and accept the Treasurer’s Report for the month ended October 31, 2025.
BACKGROUND:
California government code section 41004 requires that the City Treasurer submits to the City
Clerk and the legislative body a written report and accounting of all receipts, disbursements, and
fund balances. The Municipal Code of the City of Saratoga, Article 2 -20, Section 2-20.035
designates the City Manager as the City Treasurer. This report is prepared to fulfill this
requirement.
The following attachments provide financial transaction data for the City of Saratoga’s Funds
collectively as well as specifically for the City’s General (Operating) Fund, changes in investment
pool balances, and historical investment returns.

Cash and Investments Balance by Fund
As of October 31, 2025, the City’s unaudited cash and investments totaled $42,664,293. The
total balance of $42.7 million exceeds the minimum amount required to meet all of the City
Council’s adopted reserve requirements. The reserve fund balances are shown in Table 1.

City’s Current Financial Position
In accordance with California Government Code section 53646(b)(3), the City is financially well
positioned to meet its estimated expenditures for the next six months. As of October 31, 2025,
the City’s financial position remains strong, with assets of $43.6 million, liabilities of $7.5
million, and fund equity of $36.1 million. There are no current or foreseeable issues in meeting
financial obligations.
The Fund Balance schedule shows actual funds available for all funds at the end of the month. It
differs from the Cash Summary because fund balance reflects both assets and liabilities. As
shown below, ending fund balance is calculated by adjusting total cash with total assets minus
total liabilities, representing the actual funds available for financial obligations.

SUBJECT: Landscaping & Lighting Assessment District LLA-1; Resolutions initiating
renewal of the District for FY 26-27.
RECOMMENDED ACTIONS:
1. Adopt the Resolution describing improvements and directing preparation of the Engineer’s
Report.
2. Adopt the Resolution appointing the Attorneys for the District.
BACKGROUND:
Attached are two Resolutions to initiate the annual process of renewing the Landscaping &
Lighting Assessment District LLA-1 for the upcoming fiscal year beginning on July 1, 2026,
and/or annex new Zones. A summary of each Resolution is as follows:
1. Resolution describing improvements and directing preparation of the Engineer’s Report
- This Resolution is required under Streets & Highways (S&H) Code Section 22622 to initiate
the annual renewal process for the existing assessment district and the annexation of new Zones
for the ensuing fiscal year. The Resolution references the proposed improvements to be
provided by the district (Exhibit A) and directs the preparation of the Engineer’s Report
required under S&H Code Section 22565.
2. Resolution appointing Attorneys - This Resolution appoints the City Attorney’s office as the
attorneys for the District throughout the renewal process and limits their fees in connection
with this work to $500.
The provisions of SB 919 (The Proposition 218 Omnibus Implementation Act), adopted by the
State legislature in 1997 (Chapter 38, Stats. 1997), and which became effective on July 1, 1997,
will be implemented during the renewal process if necessary.
Procedurally, this means that assessment ballots will be mailed to those property owners within
the District whose proposed assessments: 1) are higher than in any previous year and who have
not previously voted on their assessments, 2) are higher than what was authorized via balloting

conducted in a previous year, or 3) where there is annexation of new Zones. As in previous years,
ballots will be separately tabulated at the close of the Protest Hearing for each Zone that may be
voting. Only those ballots returned by the close of the Protest Hearing will count towards
determining whether a majority protest exists.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA
DESCRIBING IMPROVEMENTS AND
DIRECTING PREPARATION OF ENGINEER'S REPORT
FOR CITY OF SARATOGA LANDSCAPING AND LIGHTING
ASSESSMENT DISTRICT LLA-1 - FISCAL YEAR 2026-2027
WHEREAS; The City Council did, pursuant to the provisions of the Landscaping and
Lighting Act of 1972, Part 2, Division 15 of the Streets and Highways Code of the State of
California, conduct proceedings for the formation of the City of Saratoga Landscaping and
Lighting Assessment District LLA-1 and for the levy and collection of assessments for fiscal year
1980 - 1981, and did, on June 18, 1980, pursuant to proceedings duly had, adopt its Resolution
No. 950-D, a Resolution Overruling Protests and Ordering the Formation of an Assessment District
and the Improvements and Confirming the Diagram and Assessments; and
WHEREAS, The public interest, convenience and necessity require, and it is the intention
of said Council to undertake proceedings for the levy and collection of assessments upon the
several lots or parcels of land in said District and/or several lots of parcels of land which are
proposed to be annexed into said District for the construction or installation of improvements,
including the maintenance or servicing, or both, thereof, for the fiscal year 2026-2027; and
WHEREAS, The improvements to be constructed or installed, including the maintenance
or servicing, or both, thereof, are more particularly described in Exhibit "A" hereto attached and
by reference incorporated herein; and
WHEREAS, The costs and expenses of said improvements, including the maintenance or
servicing, or both, thereof, are to be made chargeable upon said District and/or upon the lots within
the territory proposed to be annexed into said District, the exterior boundaries of which District
are the composite and consolidated area as more particularly shown on a map thereof on file in the
office of the Clerk of the City of Saratoga to which reference is hereby made for further particulars.
Said map indicates by a boundary line the extent of the territory included in said District and/or to
be annexed into said District and shall govern for all details as to the extent of the assessment
district, and the proposed annexation; and
WHEREAS, The Engineer of said City be, and is hereby, directed to prepare and file with
said Clerk a report, in writing, referring to the assessment district and/or proposed annexation by
its distinctive designation, specifying the fiscal year to which the report applies, and, with respect
to that year, presenting the following:
a) plans and specification of the existing improvements and for proposed new
improvements, if any, to be made within the assessment district or within
the territory to be annexed into said District;
b) an estimate of the costs of said proposed new improvements, if any, to be

made, the costs of maintenance or servicing, or both, thereof, and of any
existing improvements, together with the incidental expenses in connection
therewith;
c) a diagram showing the exterior boundaries of the assessment district and of
any zones within said district and the lines and dimensions of each lot or
parcel of land within the district as such lot or parcel of land is shown on
the County Assessor's map for the fiscal year to which the report applies,
each of which lots or parcels of land shall be identified by a distinctive
number or letter on said diagram; and
d) a proposed assessment of the total amount of the estimated costs and
expenses of the proposed new improvements, including the maintenance or
servicing, or both, thereof, and of any existing improvements upon the
several lots or parcels of land in said district in proportion to the estimated
particular and distinct benefits to be received by each of such lots or parcels
of land, respectively, from said improvements, including the maintenance
or servicing, or both, thereof, and of the expenses incidental thereto.
WHEREAS, The Office of the Public Works Director of said City be, and is hereby,
designated as the office to answer inquiries regarding any protest proceedings to be had herein,
and may be contacted during regular office hours at the City Hall, 13777 Fruitvale Avenue,
Saratoga, California 95070 or by calling (408) 868-1241.
NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Saratoga
does hereby describe improvements and direct preparation of the Engineer’s Report for the City
of Saratoga Landscaping and Lighting Assessment District LLA-1 – Fiscal Year 2026-2027.
The above and foregoing resolution was passed and adopted at a regular meeting of the Saratoga

Saratoga Municipal Code.
The recordation of the final map is a means to create individual lots from a larger lot for which
building permits may be issued. The Subdivision Map Act provides that once the final map has
been filed with the City Clerk, the City Council must approve or disapprove the final map and
accept or reject any offers of dedication made to the City within the map at its next meeting. It
further provides that the Council must approve the final map if it finds that the final map is in
substantial compliance with a previously approved tentative map.
The City Engineer has examined the final map and related documents submitted to the City in
accordance with the provisions of Section 14.40.020 of the Municipal Code and it was determined
that:

City Council assignments are made as part of a two-part process. The first part consists of the City
Council reviewing the list of assignments and providing direction on assignments that should be
added or removed.
The second part takes place at the second meeting in December and includes proposed member
assignments being presented for City Council consideration and adoption. Each Council Member
is requested to submit their assignment preferences to the City Clerk by the end of the day,
Thursday, December 4, 2025. Proposed member assignments will be reviewed and a
recommendation provided to the City Council at the December 17, 2025, meeting.

BACKGROUND:
California Government Code section 36801 states the City Council of general law cities shall
“choose one of its number” to serve as Mayor and Vice Mayor. Each December, the City Council
conducts a reorganization to select a Mayor and Vice Mayor to serve a one-year term.
To commence the reorganization, the City Clerk will declare the offices of Mayor and Vice Mayor
vacant. The City Clerk will open the public comment period. Once public comment is concluded,
the City Clerk will request nominations for the office of Mayor, close nominations, facilitate
deliberation, then call for the vote. Following the vote, the oath of office will be administered to
the Mayor. The new Mayor will then repeat this process to accept nominations for the office of
Vice Mayor. Following the Oath of Office for both Mayor and Vice Mayor, the new Mayor, new
Vice Mayor, and members of the Council may give remarks. Additionally, the Mayor may receive
remarks from the public.
In January 2010, the City Council adopted Resolution 10-002 to establish a rotation policy of the
Mayor and Vice Mayor, and in July 2025, the City Council adopted City Council Policy CCP-005,
Rotation of Mayor and Vice Mayor amending that policy. The current policy is included as
Attachment A.

ADOPTING CITY COUNCIL POLICY CCP-005, ROTATION OF MAYOR AND
VICE MAYOR
WHEREAS, California Government Code Section 36801 provides that the Mayor and Mayor
Pro Tem of a general law city is selected by a majority vote of the City Council; and
WHEREAS, said Government Code Section does not require nor provide for any particular
procedure for selecting the Mayor; and
WHEREAS; the Saratoga Municipal Code does not provide a procedure for selecting the Mayor
and the Mayor Pro Tem; and
WHEREAS, on December 16, 2009, the Saratoga City Council voted to implement a Mayor
rotation policy that would place the council candidates with the two highest votes in any one election into
a queue to rotate into the position of Mayor and Vice Mayor; and
WHEREAS, on January 20, 2010, the City Council adopted a Resolution establishing a mayoral
rotation policy.
NOW, THEREFORE,the City Council of the City of Saratoga hereby adopts City Council Policy CCP-

I.PURPOSE
This policy establishes the rotation for the Mayor and Vice Mayor.
II.BACKGROUND
Section 36801 of the California Government Code provides that the Mayor and Mayor
Pro Tem (Vice Mayor) of a general law city is selected by a majority vote of the City
Council.
In December 2009, the City Council voted to implement a rotation policy that placed the
City Council candidates with the two highest votes in any one election into the queue to
rotate into the position of Mayor and Vice Mayor. In January 2010, the City Council
adopted a Resolution establishing the Mayoral rotation policy.
In June 2025, the City Council voted to amend the rotation policy, and in July 2025
adopted a Resolution amending the Mayoral rotation policy originally adopted in 2010.
III.POLICY
Saratoga shall elect a Mayor and Vice Mayor annually in December. The meeting shall
occur prior to the second regular meeting in December to enable the newly elected
Mayor the opportunity to recommend appointment of Council Members to various
boards and committees at the second regular meeting in December. Under normal
circumstances, the top two vote getters in each election are considered to be in the
queue for Mayor and Vice Mayor. Notwithstanding the foregoing, no Council Member
shall have a right to serve as Mayor or Vice Mayor.

Greetings City Council Members.
I write regarding item 2.1: Appointment of Mayor & Vice Mayor, in the Dec. 3, 2025, City
Council agenda.
First, I would like to express my full support for Tina Walia as Vice Mayor. She embodies the
qualities I want in a Council member and community leader. She is, without exception, well-
prepared on all issues that the Council takes up. She has consistently reached out to the
community on issues heard by the Council, and she especially seeks to understand the point of
view of all residents when considering her positions.
There is a reason so many residents spoke on her behalf at the last reorganization meeting in
December 2024. These residents cited Tina’s outreach, appreciated that she did her
homework, that she listened to both sides, and went above and beyond. To me, these are the
hallmarks of an excellent Council member. (According to my notes, twelve residents
expressed support for Council member Walia either verbally or in written comments, one
person congratulated Council member Aftab on his anticipated election as mayor, and no one
expressed support for any other Council member.)
Second, the mayoral rotation policy, which this Council modified in June and formally
adopted in July, states, “Under normal circumstances, the top two vote getters in each election
are considered to be in the queue for Mayor and Vice Mayor.” With the anticipated election of
Vice Mayor Page as Mayor, all three Council members elected in 2022 will have rotated in as
Mayor in the order of their election results. Therefore, it is time to rotate in the Council
members who were elected in 2024.
Unfortunately, one of the stated reasons for reviewing the mayoral rotation policy—that is,
what happens when an election is canceled because the incumbents run unopposed—was not
addressed by the new rotation policy. Therefore, given that the rotation queue remains a part
of the policy, the only reasonable thing is to go back to the last time Council members Walia
and Fitzsimmons received votes, which was in 2020 when Walia received 7,181 votes and
Fitzsimmons 5,694 votes. By your own policy, Council member Walia should be elected Vice
Mayor this year.
Now, I understand that, per State law, the Council members elect the Mayor and Vice-Mayor
and are not beholden to any policy. However, you all created the policy earlier this year, and
presumably you created it for a reason. And let me just say it again: your policy states, “Under
normal circumstances, the top two vote getters in each election are considered to be in the
queue for Mayor and Vice Mayor.” Deviating from this would raise the question of why
today’s circumstances are not “normal,” and suggest that politics are at play. If you do deviate,
I hope you have a good explanation for the residents of Saratoga.

There is a third consideration I want to address. During public comment at the June 18, 2025,
Council meeting regarding the mayoral rotation policy, a resident spoke to the Council about
the perception among Saratoga’s of South Asian ethnicity that the passing over of Rishi
Kumar for mayor, and the subsequent passing over of Tina Walia for Vice Mayor in 2024, was
racial motivated. Let me quote her: “Many in my community of South Asian ethnicity viewed
that as not just a political slight, but as a shameful and racially motivated decision that
continues to cast a shadow over our city’s commitment to fairness and inclusion.”
In response, Council member Page dismissed her concern as “a crock,” adding, “Nobody ever
that sat on this Council, that I know of, ever had a racist bone in their body.” Let’s just
stipulate that no Council member ever had a racist bone in their body. It is also missing the
point. The point is that the perception exists. Regardless of the Council’s true motivations, the
fact is that since the rotation policy was first adopted in 2010, the only Council members who
have been passed over were both of South Asian ethnicity.
Asians make up over half of our city. If the perception exists that members of their community
are getting passed over, as was expressed to you by a member of that community, then that’s a
problem. And it’s one the Council needs to take seriously instead of dismissing out of hand.
For all these reasons, Council member Walia should be elected as Vice Mayor by this Council.
She is exceptionally qualified, she clearly has the support of residents, and it is the right thing
to do by your own policy.
That said, it does not require a crystal ball to know how Council members Page and
Fitzsimmons will vote. So, I am appealing directly to you, Mayor Aftab, to do the right thing.
There is no credible reason for bypassing Council member Walia again. I know you tend to
vote in lockstep with Council members Page and Fitzimmons, but I urge you to do the right
thing this time and nominate Council member Walia as Vice Mayor and subsequently vote for
her.

P.S. During the June 18 Council meeting regarding the Mayoral Rotation Policy, Council
member Page implied that Council member Walia took part in the Council bypassing Rishi
Kumar for Mayor. This is disingenuous. You must remember that Council member Walia took
the oath of office for the first time just minutes earlier. But more to the point, she voted in
support of Kumar’s nomination as Mayor. It’s in the minutes.
P.S.S. Also during the June 18 Council meeting, Council member Fitzsimmons stated, “Using
election data provided by staff, going back over thirty years, the data tells me that if there had
been an election in 2024, the probability is that I would get the most votes, I would be number
one with the most votes.” The only relevant data is the one time residents had the opportunity
to vote for Fitzsimmons, and she came in second. Everything else is speculation.

Dear Mayor, Council Members, and City Manager,
I hope you are all doing well. I am writing today out of respect for the work you do and out of
deep concern for how leadership transitions are being handled in our city.
I speak not just for myself, but as part of a larger community that has been paying close
attention to the way the positions of Mayor and Vice Mayor are determined. Residents rely on
our elected leaders to work collaboratively, make thoughtful decisions, and uphold processes
that are clear, fair, and publicly understood. These processes form the foundation of trust
between the community and its government.
Under normal circumstances, the top two vote-getters in each election are considered to be in
the queue for Mayor and Vice Mayor. While this tradition does not grant any Council Member
a guaranteed right to serve in those roles, it does provide residents with a predictable,
transparent framework for how leadership rotates. This clarity matters.
When the method for selecting our Mayor and Vice Mayor becomes unclear — when it
changes without meaningful community discussion, or appears influenced by behind-the-
scenes negotiations — it undermines that trust. It discourages civic participation. Many
residents are left wondering: Why stay engaged if we feel our votes do not meaningfully guide
who represents us in leadership roles?
For these reasons, I respectfully urge the Council to restore a transparent and consistent
rotation method. This is not about who holds the title in any particular year, but about ensuring
that leadership decisions reflect fairness, continuity, and a process the public can rely on.
A clear and predictable system strengthens public confidence and reinforces the principle that
our local government operates with integrity and accountability. It keeps residents connected
to their city and invested in its future.
Thank you for your time, your service, and your consideration of this important matter. I
sincerely hope the Council will take steps that reaffirm transparency and uphold the values our

I am writing to express concern about the ambiguity that now surrounds the City Council’s
process for selecting the Mayor and Vice Mayor, particularly following the 2025 revision to
Policy CCP-005.
The updated policy states that “under normal circumstances, the top two vote-getters in each
election are considered to be in the queue for Mayor and Vice Mayor,” but it also emphasizes
that “no Council Member shall have a right to serve.” This language creates the impression of
an orderly rotation, but removes any public expectation that it will be followed and
introducing uncertainty rather than transparency.
The original rotation policy was adopted in 2010 to reduce personal politics and provide a fair,
predictable structure rooted in voter support. That framework worked smoothly for nearly a
decade, serving both Council and community well. Now, by contrast, residents are left with an
ambiguous process that undermines consistency and invites public skepticism.
n 2019, Councilmember Rishi Kumar was next in line under the long-standing rotation norm,
yet he was bypassed. That was the moment when the prior rotation system effectively broke.
In 2020, after a lot of confusion and no initial nominations, Councilmember Kumar proposed
that all five members be considered in alphabetical order, with the first receiving three votes
becoming Mayor. The Council proceeded in the agreed sequence, ultimately selecting Yan
Zhao as Mayor and Tina Walia as Vice Mayor.
This improvised approach, while procedurally valid, marked a departure from both the spirit

without notice or explanation with personal politics in play.
While council discretion is protected by law, the lack of a clearly communicated rationale in
that moment introduced long-term confusion. Residents were left unclear about whether the
rotation still existed, when and how it could be suspended, and on what basis leadership
decisions were being made.
The recent update to the policy unfortunately compounds this confusion. Rather than
providing a clearer process, it implies a rotation in theory while removing all structure in
practice. This not only fails to restore trust- it undermines it further.
This issue transcends any one individual or election cycle. It is about the integrity of our
process, and the expectation that the Council’s internal decisions should be understandable,
consistent, and rooted in shared standards, not left to shifting interpretations or personal
alliances.
I urge the Council to consider revisiting the rotation policy in a way that prioritizes public

confidence and democratic fairness. It is not about limiting Council discretion, but about
providing clarity to the public you serve.
