BACKGROUND: California government code section 41004 requires that the City Treasurer submits to the City Clerk and the legislative body a written report and accounting of all receipts, disbursements, and fund balances. The Municipal Code of the City of Saratoga, Article 2 -20, Section 2-20.035 designates the City Manager as the City Treasurer. This report is prepared to fulfill this requirement. The following attachments provide financial transaction data for the City of Saratoga’s Funds collectively as well as specifically for the City’s General (Operating) Fund, changes in investment pool balances, and historical investment returns. FISCAL STATEMENT: Cash and Investments Balance by Fund As of October 31, 2025, the City’s unaudited cash and investments totaled $42,664,293. The total balance of $42.7 million exceeds the minimum amount required to meet all of the City Council’s adopted reserve requirements. The reserve fund balances are shown in Table 1. As of October 31, 2025, the City’s financial position remains strong, with assets of $43.6 million, liabilities of $7.5 million, and fund equity of $36.1 million. There are no current or foreseeable issues in meeting financial obligations. The Fund Balance schedule shows actual funds available for all funds at the end of the month. It differs from the Cash Summary because fund balance reflects both assets and liabilities. RECOMMENDED ACTIONS: 1. Adopt the Resolution describing improvements and directing preparation of the Engineer’s Report. 2. Adopt the Resolution appointing the Attorneys for the District. BACKGROUND: Attached are two Resolutions to initiate the annual process of renewing the Landscaping & Lighting Assessment District LLA-1 for the upcoming fiscal year beginning on July 1, 2026, and/or annex new Zones. A summary of each Resolution is as follows: 1. Resolution describing improvements and directing preparation of the Engineer’s Report - This Resolution is required under Streets & Highways (S&H) Code Section 22622 to initiate the annual renewal process for the existing assessment district and the annexation of new Zones for the ensuing fiscal year. The Resolution references the proposed improvements to be provided by the district (Exhibit A) and directs the preparation of the Engineer’s Report required under S&H Code Section 22565. 2. Resolution appointing Attorneys - This Resolution appoints the City Attorney’s office as the attorneys for the District throughout the renewal process and limits their fees in connection with this work to $500. The provisions of SB 919 (The Proposition 218 Omnibus Implementation Act), adopted by the State legislature in 1997 (Chapter 38, Stats. 1997), and which became effective on July 1, 1997, will be implemented during the renewal process if necessary. Procedurally, this means that assessment ballots will be mailed to those property owners within the District whose proposed assessments: 1) are higher than in any previous year and who have not previously voted on their assessments, 2) are higher than what was authorized via balloting 38 conducted in a previous year, or 3) where there is annexation of new Zones. As in previous years, ballots will be separately tabulated at the close of the Protest Hearing for each Zone that may be voting. Only those ballots returned by the close of the Protest Hearing will count towards determining whether a majority protest exists. Attachment B: Resolution appointing Attorneys. 39 RESOLUTION NO. _____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA DESCRIBING IMPROVEMENTS AND DIRECTING PREPARATION OF ENGINEER'S REPORT FOR CITY OF SARATOGA LANDSCAPING AND LIGHTING ASSESSMENT DISTRICT LLA-1 - FISCAL YEAR 2026-2027 WHEREAS; The City Council did, pursuant to the provisions of the Landscaping and Lighting Act of 1972, Part 2, Division 15 of the Streets and Highways Code of the State of California, conduct proceedings for the formation of the City of Saratoga Landscaping and Lighting Assessment District LLA-1 and for the levy and collection of assessments for fiscal year 1980 - 1981, and did, on June 18, 1980, pursuant to proceedings duly had, adopt its Resolution No. 950-D, a Resolution Overruling Protests and Ordering the Formation of an Assessment District and the Improvements and Confirming the Diagram and Assessments; and WHEREAS, The public interest, convenience and necessity require, and it is the intention of said Council to undertake proceedings for the levy and collection of assessments upon the several lots or parcels of land in said District and/or several lots of parcels of land which are proposed to be annexed into said District for the construction or installation of improvements, including the maintenance or servicing, or both, thereof, for the fiscal year 2026-2027; and WHEREAS, The improvements to be constructed or installed, including the maintenance or servicing, or both, thereof, are more particularly described in Exhibit "A" hereto attached and by reference incorporated herein; and WHEREAS, The costs and expenses of said improvements, including the maintenance or servicing, or both, thereof, are to be made chargeable upon said District and/or upon the lots within the territory proposed to be annexed into said District, the exterior boundaries of which District are the composite and consolidated area as more particularly shown on a map thereof on file in the office of the Clerk of the City of Saratoga to which reference is hereby made for further particulars. Each December, the City Council conducts a reorganization to select a Mayor and Vice Mayor to serve a one-year term. To commence the reorganization, the City Clerk will declare the offices of Mayor and Vice Mayor vacant. The City Clerk will open the public comment period. Once public comment is concluded, the City Clerk will request nominations for the office of Mayor, close nominations, facilitate deliberation, then call for the vote. Following the vote, the oath of office will be administered to the Mayor. The new Mayor will then repeat this process to accept nominations for the office of Vice Mayor. Following the Oath of Office for both Mayor and Vice Mayor, the new Mayor, new Vice Mayor, and members of the Council may give remarks. Additionally, the Mayor may receive remarks from the public. In January 2010, the City Council adopted Resolution 10-002 to establish a rotation policy of the Mayor and Vice Mayor, and in July 2025, the City Council adopted City Council Policy CCP-005, Rotation of Mayor and Vice Mayor amending that policy. I write regarding item 2.1: Appointment of Mayor & Vice Mayor, in the Dec. 3, 2025, City Council agenda. First, I would like to express my full support for Tina Walia as Vice Mayor. She embodies the qualities I want in a Council member and community leader. She is, without exception, well- prepared on all issues that the Council takes up. She has consistently reached out to the community on issues heard by the Council, and she especially seeks to understand the point of view of all residents when considering her positions. There is a reason so many residents spoke on her behalf at the last reorganization meeting in December 2024. These residents cited Tina’s outreach, appreciated that she did her homework, that she listened to both sides, and went above and beyond. To me, these are the hallmarks of an excellent Council member. (According to my notes, twelve residents expressed support for Council member Walia either verbally or in written comments, one person congratulated Council member Aftab on his anticipated election as mayor, and no one expressed support for any other Council member.) Second, the mayoral rotation policy, which this Council modified in June and formally adopted in July, states, “Under normal circumstances, the top two vote getters in each election are considered to be in the queue for Mayor and Vice Mayor.” With the anticipated election of Vice Mayor Page as Mayor, all three Council members elected in 2022 will have rotated in as Mayor in the order of their election results. Therefore, it is time to rotate in the Council members who were elected in 2024. Unfortunately, one of the stated reasons for reviewing the mayoral rotation policy—that is, what happens when an election is canceled because the incumbents run unopposed—was not addressed by the new rotation policy. Therefore, given that the rotation queue remains a part of the policy, the only reasonable thing is to go back to the last time Council members Walia and Fitzsimmons received votes, which was in 2020 when Walia received 7,181 votes and Fitzsimmons 5,694 votes. By your own policy, Council member Walia should be elected Vice Mayor this year. Now, I understand that, per State law, the Council members elect the Mayor and Vice-Mayor and are not beholden to any policy. However, you all created the policy earlier this year, and presumably you created it for a reason. And let me just say it again: your policy states, “Under normal circumstances, the top two vote getters in each election are considered to be in the queue for Mayor and Vice Mayor.” Deviating from this would raise the question of why today’s circumstances are not “normal,” and suggest that politics are at play. If you do deviate, I hope you have a good explanation for the residents of Saratoga. 74 There is a third consideration I want to address. During public comment at the June 18, 2025, Council meeting regarding the mayoral rotation policy, a resident spoke to the Council about the perception among Saratoga’s of South Asian ethnicity that the passing over of Rishi Kumar for mayor, and the subsequent passing over of Tina Walia for Vice Mayor in 2024, was racial motivated. Let me quote her: “Many in my community of South Asian ethnicity viewed that as not just a political slight, but as a shameful and racially motivated decision that continues to cast a shadow over our city’s commitment to fairness and inclusion.” In response, Council member Page dismissed her concern as “a crock,” adding, “Nobody ever that sat on this Council, that I know of, ever had a racist bone in their body.” Let’s just stipulate that no Council member ever had a racist bone in their body. It is also missing the point. The point is that the perception exists. Regardless of the Council’s true motivations, the fact is that since the rotation policy was first adopted in 2010, the only Council members who have been passed over were both of South Asian ethnicity. Asians make up over half of our city. If the perception exists that members of their community are getting passed over, as was expressed to you by a member of that community, then that’s a problem. And it’s one the Council needs to take seriously instead of dismissing out of hand. For all these reasons, Council member Walia should be elected as Vice Mayor by this Council. She is exceptionally qualified, she clearly has the support of residents, and it is the right thing to do by your own policy. That said, it does not require a crystal ball to know how Council members Page and Fitzsimmons will vote. So, I am appealing directly to you, Mayor Aftab, to do the right thing. There is no credible reason for bypassing Council member Walia again. I know you tend to vote in lockstep with Council members Page and Fitzimmons, but I urge you to do the right thing this time and nominate Council member Walia as Vice Mayor and subsequently vote for her. During the June 18 Council meeting regarding the Mayoral Rotation Policy, Council member Page implied that Council member Walia took part in the Council bypassing Rishi Kumar for Mayor. This is disingenuous. You must remember that Council member Walia took the oath of office for the first time just minutes earlier. But more to the point, she voted in support of Kumar’s nomination as Mayor. It’s in the minutes. P.S.S. Also during the June 18 Council meeting, Council member Fitzsimmons stated, “Using election data provided by staff, going back over thirty years, the data tells me that if there had been an election in 2024, the probability is that I would get the most votes, I would be number one with the most votes.” The only relevant data is the one time residents had the opportunity to vote for Fitzsimmons, and she came in second. That was the moment when the prior rotation system effectively broke. In 2020, after a lot of confusion and no initial nominations, Councilmember Kumar proposed that all five members be considered in alphabetical order, with the first receiving three votes becoming Mayor. The Council proceeded in the agreed sequence, ultimately selecting Yan Zhao as Mayor and Tina Walia as Vice Mayor. This improvised approach, while procedurally valid, marked a departure from both the spirit and structure of the existing policy-and signaled to the public that norms could be set aside without notice or explanation with personal politics in play. While council discretion is protected by law, the lack of a clearly communicated rationale in that moment introduced long-term confusion. Residents were left unclear about whether the rotation still existed, when and how it could be suspended, and on what basis leadership decisions were being made. The recent update to the policy unfortunately compounds this confusion. Rather than providing a clearer process, it implies a rotation in theory while removing all structure in practice. This not only fails to restore trust- it undermines it further. This issue transcends any one individual or election cycle. It is about the integrity of our process, and the expectation that the Council’s internal decisions should be understandable, consistent, and rooted in shared standards, not left to shifting interpretations or personal alliances. I urge the Council to consider revisiting the rotation policy in a way that prioritizes public 78 confidence and democratic fairness.
