A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SARATOGA DECLARING WEEDS A PUBLIC NUISANCE AND
SCHEDULING A PUBLIC HEARING
WHEREAS, the growth of weeds and brush accumulate annually upon private property,
including that on property adjacent to structures or located in the public right-of-way, streets,
alleys, and sidewalks in the City of Saratoga; and
WHEREAS, weeds and brush may attain such large growth as to become, when dry, a fire
hazard to adjacent improved properties.
NOW, THEREFORE, BE IT RESOLVED THAT:
1. The City Council of the City of Saratoga, California, hereby declares that all weeds
growing upon any private property or in any right-of-way, street or alley, as defined in
article 7-15 of the Saratoga Municipal Code, constitutes a public nuisance, which
nuisance must be abated by the destruction or removal thereof.
2. The Santa Clara County Consumer and Environmental Protection Agency’s Weed
Abatement Program is hereby ordered to give notice of the passage of this resolution
stating that, unless such nuisance is abated without delay by the destruction or removal
of such weeds, the work of abating such nuisance will be done by the County
authorities; and the expense thereof assessed upon the lots and lands form which, and/or
in the front of which, such weeds and brush shall have been destroyed or removed.
3. All property owners having objections to the proposed destruction or removal of such
weeds and brush are hereby notified to attend a meeting of the City Council to be held
on the Council Chambers of City Hall, 13777 Fruitvale Avenue, Saratoga, California,
on April 15, 2026, at 7:00 P.M. when and where their objections will be heard and
given due consideration.
The above and foregoing resolution was passed and adopted at a regular meeting of the Saratoga
City Council held on the 4th day of March 2026 by the following vote:
