As a follow up to the meeting we are including for your information the results of the process we went through in identifying key issues and community perceptions of teen youth in the City of Saratoga. Through our brainstorming, "think-tank" process we developed collective data to assist in planning and developing the direction of the overall Youth Commission Program. Many of you expressed an interest in being involving in the future with the Youth Commission planning process. We wholeheartedly welcome your contributions. The plan-of-action is to survey Teen youth in the community and also to conduct a Youth Teen Task Force made up of youth to participate in a similar process as you did at the meeting with a goal of comparing the results of both groups to identiify some commonality and consistency in perceptions and issues of teen youth in the community. This all should occur prior to the end of the school year. It is anticipated that by mid-July we should have a draft Youth Commission Program Plan. At this time those of you who expressed an interest will be invited to participate in a review and evaluation process. Shortly thereafter, submitting the Youth Commission Program Plan Proposal to City Council for final approval. The Youth Commission program will begin in September with interested youth applying. Once again, On behalf of the Youth Commission planning Team, we appreciate your participation and look forward to networking our community programs and developing an effective Teen program for the City of Saratoga. The basic decisions will be whether or not the skateboard ramp will remain open at its current location, whether it should it be relocated to another location or if it should be closed. If it is to remain open, other decisions concerning its use and any improvements needed to control problems caused by its operation must be addressed. RECOMMENDED ACTION It is recommended that the Commission adopt the following proposal and that they direct staff to report their findings and recommendations to the City Council at its meeting of June 20. It is also recommended that a budget appropriation of $6,000 be made to fund the immediate completion of the required work and that a $9, 000 operational budget, which is self-supporting, be established for fiscal year 1990/91. FINDINGS AND CONCLUSIONS Staff is recommmending that that the following maintenance/construction and the skateboard ramp remain open and action pertaining to use, cost be adopted. Printed on recycled paper. ~ z ~~~ 4 O a~0~ ~t, ~ PARKS & RECREATION COMMISSION CONGRESS SPRINGS SKATEBOARD RAMP PAGE 2 IJ USE 1) Hours of Operation - Sessions should be established as follows: Labor Dav to early June Sessions Manday, Tuesday, Thursday, Friday 3:00 to 5:30PM Wednesday Closed Saturday and Sunday 9:00 to 11:30AM 12:30 to 5:30PM Ear1y June to Labor Dav Session Monday, Tuesday, Thursday, 9:00 to Noon Wednesday Closed Friday, Saturday, Sunday 1:00 to 7:OOPM Wednesday Closed The first schedule provides for skating sessions of 2-1 /2 hours and the second session provides for sessions of 3 hours in duration. The afternoon hours wi11 be divided into two, two and one-half or three hour sessions. 2) Fees - Use of the ramp should be limited to those having membership photocards only. Saratoga residents wi11 pay an annual membership fee of $25 per user. A maximum of 50 non-resident memberships wi11 be available at an annual charge of $5D. In addition to the membership fees, a use fee sha11 be established at a $1 per session for resident members and $2 per session for non-resident members. It is anticipated that a combination of membership and use fees wi11 raise between $10,000 to $12,000 yearly. 3) Staffing - The City would provide a Ramp Monitor to assure compliance with the rules, check membership cards, collect fees and to assure ramp safety. Additional signs wi11 be posted as needed. IIJ MAINTENANCE/CONSTRUCTION We are recommending that the ends of the coping pipes be sealed to stop any megaphoning effect and that the substructure of the ramp be fu11y enclosed, utilizing plywood Zined with a sound absorbing material. The ramp would be resurfaced with 12 guage aluminum, coated to preven t UV deterioration and the exterior of the structure be painted. The ground surrounding the ramp would be covered with tree bark. IIIJ COST We have determined that the operating costs for the 1500 hours of operation @ $6/hour wi11 be $9,000 per year and that the membership and use fees recommended previously wi11 cover those costs. The cost to provide a painted aluminum surface and to generally complete the ramp, including basic sound attenuation improvements and to cover the surrounding ground with bark is estimated to be $5,000. Should greater sound attentuation such as acoustic foam insulation or sound wa11 construction or a higher quality of ground covering, such as astro-turf or playground surface matting be required, the cost wi11 be significantly higher. C~~~~ o~ ~ ° ° BOO C~~ 13777 FRUITVALE AVENUE SARATOGA, CALIFORNIA 95070 (408) 887-3438 MEMORANDUM TO: Mr. Dan Trinidad, Maintena:~ce Director DATES/15/90 0900 hours FROM: Michael Nottoli, Community Services Officer SUBJECT: Noise Readings at Congress Springs Park Due to the recent installation of the Congress Springs Skateboard Ramp and the. subsequent noise complaints that have followed, I was requested to conduct a noise survey of the situation. ~n 5/15/90 at 0800 hours, I took a reading to establish an ambient noise level (without the skateboarders using the ramp) near the skateboard ramp. Auer taking two separate readings within the park between 0800 hours and 0840 hours, T established an ambient of 45 decibels. On 5/14/90 at 1545 hours, I took. a 5 minute reading within the park, 25' south of the skateboard ramp while the ramp was being used by several persons. There were also approximately 10 other persons seated on the grass area nearby. With. the ramp in use, I monitored a consistent reading between 65 and 72 decibels. The sound fluctuated as the ramp users were rolling over different parts of the ramp. On 5/14/90 at 1550. hours, I took a 5 minute reading from a position against the rear fence of 19381 Via Real Drive. This location is on the far south border of the dirt field area on the south. side of the park.. My reading was consistently between 50 and 54 decibels. I also got two .peak. readings of 58 decibels. Thies location was on the west side of the creek. On 5/14/90 at 1600 hours, I took a 5 minute reading from the backyard area at 13080 Anza Drive. This piece. of property runs along the north boundary of the park. I took the reading at an open gate leading from the backyard to the field area. The reading was consistently between 45 and 53 decibels at this location. On 5/14/90 at 1620 hours, I took a reading from the backyard of 19367 Via Real Drive. This piece of property runs along the south border of the dirt field on the south side of the park. It is also located on the east side of the creek.. My reading was consistently between 45 and 52 decibels for the ramp noise. I also received two peak levels of 60 decibels caused by yelling from the ramp. City Ordinances state.; that a noise level of 70 decibels or less is allowed between the hours of 8:00 AM and 8:00 PM. The level is specified at a distance of 25 feet from the noise source. In addition, ordinances also specify that a noise level greater than 6 decibels above the local ambient level at any point outside the property plane is unlawful. CSO Spoulos will be attempting to get an ambient noise level and some additional readings during the evening hours. Health and Sanitation ~7-30.030 S4A30. Noise levels for residential zoning districts ta) No person shall cause, produce, suffer or allow to be produced by any machine, animal or device or any combination of same, in asingle-family residential zoning district, a noise level more than 6dBA above the local ambient at any point outside of the property plane. (b) No person shall cause, produce, suffer or allow to be produced by any machine, animal or device or any combination of same, in amulti-family residential zoning district, a noise level more than 6dBA above the local ambient three feet from any wall, floor or ceiling inside any dwelling unit on the same property, except within the dwelling unit in which the noise source or sources may be located. 57-30.040 Noise level for commercial and industrial zoning districts No person shall cause, produce, suffer or allow to be produced by any machine, animal or device or any combination of same, in any commercial or industrial zoning district, a noise level more than 8dBA above the local ambient at any point outside of the property plane. .~ B~enptions (a) (~ ~.a~ hours. Any noise source which does not produce a noise level exceeding 70dBA at a distance of twenty-five feet under its most noisy condition of use shall be exempt from the provisions of Sections 7-30.030 and 7-30.040 between the hours of 8:00 A. M, and 8:00 P.M. (b) Emergencies. Emergencies are exempt from the provisions of this Article. S7 30.050 Construction activities Notwithstanding any other provision of this Article, between the hours of 7:30 A. M. and 6:00 P. M., construction, alteration or repair activities which are authorized by a valid City permit shall be allowed if they meet at least one of the following noise limitations: (a) No individual piece of equipment shall produce a noise level exceeding 83 dBA at a distance of twenty-five feet from the source thereof. If the device or other source is housed within a structure on the property, the measurement shall be made outside the structure, but at a distance as close to the equipment or source as possible. (b) The noise level at any point outside of the property plane of the project shall not exceed 86dBA. Page 7-53 May 15, 1990 Honorable Mayor Martha Clevenger & City Council City of Saratoga 13777 Fruitvale Avenue Saratoga, CA 95070 Dear Mayor Clevenger & City Council: We, the undersigned, residents of Saratoga, respectfully request a closing of the skate board ramp facility located in the Congress Spring Park pending a satisfactory response to the following concerns: o Is the skate board ramp facility specifically identified f_or that use in the development of the Congress Spring Park Master Plan? o Was the facility constructed in accordance with the due process as required under the California Environmental Quality Act? o Is there an environmental clearance or a Negative Declaration for a skate board ramp facility in the Master Plan? o Is there a due process to identify such use regarding noise generation to the adjoining property owners? o Can the due process be shown where the adjoining property owners were fully notified of such construction and their concerns be heard? o Is there a noise study to determine if the noise generated exceeds the maximum level allowed within the property line? o Are there any measures to mitigate the noise nuisance generated by the skate board ramp activities? o Are there any City owned skate board ramps in California? Are they located in a residential vicinity? o What measures is the City taking to prevent school students from using this skate board ramp facility during regular school hours? o Is the use of the skate board ramp facility restricted to just Saratoga residents, or is anyone outside Saratoga permitted to use the City-funded facility? Honorable Mayor Clevenger and City Council City of Saratoga May 15, 1990 Page 2. o Do users of the skate board ramp facility, including non- Saratoga residents, sign a waiver of liability against injury to the City of Saratoga? o What measures is the City taking to prevent liability to the City against injury on City property? Since the opening of the skate board ramp, the quality of life in our neighborhood has been greatly affected by the tremendous amount of noise generated at all hours, from day break to midnight. Such noises are extremely disruptive. There are incidents where users of the skate board ramp facility trespass on private properties on route to the facility. We believe the use of the skate board ramp located in a high density residential area is totally inappropriate and irresponsible. It appears that the City has not followed the due process via environmental clearance under the CEQA and has not addressed the impact that the skate board ramp facility has on the residents and property owners in that neighborhood. We request that the City of Saratoga close down the skate board ramp facility and demonstrate the legal environmental process and re-assess the environmental impact to the adjoining property owners. We are designing,, the relocation of PG&E facilities which will be impacted by the proposed Highway 85 roadway. Someone is usually in tie office trailer at the site from 6:00 a. m. until 4:30 p. m.- Monday through Thursday. Our observation of activities at the skateboard ramp are as follows: People are usually active on the ramps by 7:00 a. m. and frequently as early as 6:00 a. m. Numbers at these early hours are from two to six individuals. Activity at the ramp is constant throughout the day, such that from. 10:00 a. m. until 4:30 p. m. Finally, we are cognizant of the "rumble" produced by the skates on the wooden ramp whenever a skater is active. Since I attended the City Council meeting May 16 I am aware of the public hearing which is scheduled for the next meeting of our commission. At the City Council meeting I heard the complaints of many of the neighbors of Congress Springs Park about the problems associated with the skateboard ramp. I am assuming that the noise problems will be well on their way to being solved by June 4. It is the problems of usage which I wish to address. Since this is the only skateboard ramp in a very large area it is acting as a magnet to draw skateboarders from all over the Valley. According to the statements I heard at the Council meeting, there is concern that the younger users are being crowded out by the older skateboarders. A proposal was made that the Saratoga residents be issued I.D. cards and certain hours be reserved for their exclusive use. I feel that since our residents use recreational facilities in many neighboring towns whenever they want this would not be a wise idea. I remember when my children were small they learned to swim through the programs offered by the Recreation Dept. As I recall, the only requirement to being allowed in the "big "pool was height. it did not matter how old you were If you did not meet the height requirement you were put in the kiddie pool. There was a bright red line prominently painted on the wall which was used to measure the children if there was any doubt. While there is not necessarily a correlation between height and age we might consider regulating the usage of the ramp based on the height of the skateboarders. There would be no I.D. cards to be issued and checked. This would be a less discriminatory method of insuring equal time for all. If groups of skateboarders could not skate together because of height disparity they may even be discouraged from coming!!! Again, I'm sorry to be unable to attend the meeting. I hope this proposal is considered. It is rather novel but then again, so is a skateboard ramp in a public park! Exhibit D DEPARTMENT OF PARK AND RECREATION CITY AND COUNTY OF HONOLULU SKATEBOARD FACILITIES AND PROGRAMS I. BACKGROUND A. In July, 1988 Mayor Frank F. Fasi directed the Department of Parks and Recreation to develop a plan of action to allow skateboarding in City parks. The City had a single skate/skateboard facility at Aala International Park and no other area where skateboarding was allowed. Initial research revealed that there were few, if any, municipal skateboard facilities across the nation. Ocean City, Maryland, however, has been operating a facility for about ten years and provided valuable information and assistance. B. The plan of action approved by Mayor Fasi in August included the following: 1. Conversion of Outdoor Courts to Skateboard Courts Eleven sites were selected where minimal improvements or construction would be required and where there would be minimal impact on current use by volleyball or basketball players. Other sites may allow shared use of the outdoor courts by posting signs indicating when skateboarding is allowed. The purpose in opening these courts is to provide skateboard areas in parks where presently there are none. 2. Skateboard Ramn Construction The Department recognized that flat, paved areas alone would not be sufficient to meet the needs of those youngsters most actively engaged in the sport. A skateboard half-pipe for beginners and advanced beginners was constructed at Kalakaua Recreation Center. Kalakaua was chosen because it had a concrete pad in place which was originally intended for skating. A second ramp will be constructed in one of three outdoor volleyball courts at Kailua Recreation Center. Kailua was chosen primarily in recognition of the efforts of skateboard advocates Patty May and the many citizens who wrote expressing their interest in such a facility. 3. The design and usage of the two new ramp facilities will be evaluated before any other new construction is planned. II. SKATEBOARD RULES AND REGULATIONS A. Exhibit A: "Rules and Regulations Relating to Skating and Skateboarding in City Parks Properties". These rules and regulations are in the process of formal adoption, pending public hearing. III. OPERATION OF SKATEBOARD FACILITI S A. Skateboarding will be allowed in specified areas in parks. Such areas are to be clearly identified by signs and enclosed with fencing to prevent errant boards from injuring others. Skateboarding at areas without ramps may be self- directed. Requests to open self-directed skateboard areas will be made in writing to the Park Maintenance and Recreation Services Administrator. No ramps, jumps or other equipment may be brought in or installed without written permission from the Director of Parks and Recreation. B. The following operating procedures will apply to skateboard facilities with ramps requiring staff supervision. 1. "Rules and Regulations Relating to Skateboarding in City Parks Properties" will be enforced. The "Skateboard Ramp Facility Rules" posted at the entrance (Exhibit E). 2. All participants must fill out and standard participant registration form (Exhibit of Liability form (Exhibit C). Both forms will at the area issuing the ID card. At the time of registration or before, each participant will be given the "Information for Skateboard Facility Users" sheet. 4. When issuing Skateboard ID cards (Exhibit D), the issuer will stamp or print the name of the area where card is issued. 5. Standard hours of operation are as shown in the approved sign for "Hours of Operation" (Exhibit F). Any increases in those hours should be accomplished with volunteer assistance. Inform the Park Maintenance and Recreation Services Administrator of any changes in hours of operation in writing. 6. Safety: Prior to opening and closing the facility, staff must inspect the ramp and area for any safety hazards. If any exist, the ramp will remain closed until repairs are completed. The ramp will be closed in the event of rain. No ramps, jumps or other equipment may be brought in or installed in the skateboard facility without written permission from the Director of Parks and Recreation. 7. Requests for the following signs may be made: "Skateboard Ramp Facility Rules" - Exhibit E "Skateboard Ramp Facility Hours of Operation" - Exhibit F 8. Staff on duty will use the "Skateboard Facility Sign-in Sheet". Staff will check the signature of the person signing and the signature on the ID card presented to confirm the identification of the participant. The sign-in sheet will also serve as a record of facility use. a:sktsop.wp r `~1e.~~ r EXHIBIT A RULES AND REGULATIONS RELATING TO SKATING AND SKATEBOARDING ACTIVITIES IN CITY PARKS PROPERTIES DEPARTMENT OF PARKS AND RECREATION CITY AND COUNTY OF HONOLULU Pursuant to and by virtue of the authority set forth in Article VI, Chapter 12, Revised Charter of the City and County of Honolulu (1973), and Chapter 91, Hawaii Revised Statutes, the Director of the Department of Parks and Recreation, subject to the approval of the Mayor of the City and County of Honolulu, hereby adopts the following rules and regulations relating to skating and skateboarding activities in public parks of the City and County of Honolulu. Part I. General Provisions A. Applicability and Scope 1. These rules and regulations shall apply to individual skating/skateboarding and group skating/skateboarding activities conducted in public parks under the control, management and operation of the Department of Parks and Recreation. 2. If any provision of these rules and regulations, or the application of such provision, is held to be invalid, the remaining portions of these regulations or the application of said portions shall not be affected. B. Objectives These rules and regulations are promulgated for the following purposes: 1. To ensure the safety of all those utilizing the City's skating facilities, either as participants or as viewers. 2. To ensure the equitable use of the City's skating facilities by the public. C. Definitions The following words or terms shall have the following meanings unless the context clearly indicates otherwise: 1. City - City and County of Honolulu. 2. Department - The Department of Parks and Recreation, City and County of Honolulu. 3. Director - The Director of the Department of Parks and Recreation, City and County of Honolulu, or his duly authorized representative. 4. Participant - An individual with a valid identification card issued by the Department of Parks and Recreation, City and County of Honolulu, engaged in skating or skateboarding activities in a City and County of Honolulu public park. 5. Skate - A pair of shoes with small wheels attached to the soles. 6. Skateboard - A f lat board of wood, plastic or any synthetic material, to the undersurface of which is attached a set of small wheels. 7. Skating facility - Any area in a public park under the control, management and operation of the Department of Parks and Recreation, City and County of Honolulu, designated by the Department of Parks and Recreation for skating and skateboarding activities. Part II. Specific Provisions A. Registration Procedure for Individual Skaters and Skateboarders 1. Any person, regardless of age, wishing to utilize City skating facilities for skating or skateboarding must register with the Department; complete a liability waiver form;. and obtain a skating or skateboarding identification card (hereinafter referred to as "I.D. Card"). All registration forms not signed in the presence of Department personnel must be notarized. Those individuals under eighteen (18) years of age must obtain the signature of a parent or legal guardian on the liability waiver form signed in the presence of Department personnel or a notarized signature of the parent or legal guardian if the parent or legal guardian is not on site. -2- 2. Any individual who loses his/her I.D card must re-register with the appropriate Department recreation center. 3. All participants must carry his/her I.D. card at all times when using the skating facility and shall present his/her I.D. card to Department personnel before entering the skating facility. I.D. cards are not transferable and anyone using another's I.D. card shall be banned from using the skating facility for a period of three (3) months. B. C. Use of Skating Facility 1. All use of skating facilities shall be at the sole risk of the participant, and the City shall not be responsible for any injuries or damages, unless such injuries or damages are proximately caused by the negligence of the Department or its employees as provided by law. 2. Skating and skateboarding shall be allowed only during the hours posted for a respective facility and only when a Department attendant is on duty. Groups and organizations may use the facility beyond posted hours upon obtaining a permit from the Department. 3. Outdoor skating facilities shall be closed on rainy days. 4. All participants must enter the skating facility through a Department-designated entrance. Anyone entering by climbing a fence or by using any other unauthorized means or who cuts in line to enter the skating facility shall be removed from the facility and shall be barred from the skating facility for the remainder of the day. Repeated unauthorized entrances or cutting in line shall be grounds for revocation of an individual's I.D. card for a period of three (3) months. Equipment and Conduct Allowed in Skating Facility 1. No skateboards with metal shields or any other device which the Department attendant, in his opinion and judgment, determines to be dangerous or hazardous to the safety of others shall be allowed in the skating facility at any time. No outside ramps, equipment, or -3- jumps are allowed in the facility unless prior approval is obtained from the Department. 2. There shall be no skating against the flow of traffic, and the flow of traffic shall be directed by the Department attendant on duty. 3. Profanity, recklessness, boisterous behavior, tandem riding, pushing, etc., are prohibited in the skating facility. 4. There shall be no intentional flying into the air of skateboards. 5. There shall be no tricks or stunts done by participants except during hours approved by the Department. 6. Only skateboards are permitted on skateboard ramps. 7. Drinking, eating, or smoking are not allowed in the skating facility. 8. Participants must wear knee pads, elbow pads, and safety helmets, for ramp activity. Knee pads, elbow pads, and safety helmets are strongly recommended in using other areas of the skating facility. 9. No slippers or barefeet are allowed in skating facility. Shoes must be worn while skateboarding. D. Revocation of I.D. Card and Appeal Process 1. Any person violating these rules and regulations for the first time shall be subject to a warning by the Department, and if such person violates these rules and regulations a second time, that person shall be subject to summary removal from the skating facility. 2. Violations of these rules and regulations shall be grounds for revocation of an individual's I.D. card and barring from use of any skating facility. However, before any such action is taken, the individual shall be given an opportunity to be heard before the Director with or without counsel and with the right to have his/her own witness(es) testify on his/her behalf and confront witnesses of the Department. Recommendation: It is recommended that the Commission review and approve these lists and authorize their being sent to the Heritage Commission after which they will be forwarded to City Council for final approval. III.A. A proposal and map of Mount Eden Estates trail for Lot 18, Tract #7761 is attached for your review. The trail has been laid out in the field and Commissioners may want to visit the site. MEMORANDUM Page 2 2/28/90 III.B. The Planning Department is asking the Commission to review and approve the improvement plans for the Equestrian Trail called for on application SD-88- 010 on Mt. Eden Road. Commissioners will recall establishing the conditions for this development last year. The Commission should review the Flans and determine if the trail width, grades, etc. are acceptable. Recommendation: Review, modify (if necessary) and approve the Improvement Plans and transmit to the Planning Department. III.C. Enclosed is a copy of the status report on the Heritage Tree Ordinance. Please review/comment/ approve. Recommendation: Approve the status report and authorize it being sent to Council for their review and approval on March 21st. V. Mayor Marty Clevenger is soliciting proposals and suggestions for Council's consideration in conjunction with the 1990 policy development process. All input will be reviewed at their conference in May. Since the deadline for submittals is March 30th, the Commission should be prepared to develop their list of programs, projects, goals, objectives, and spending priorities at this meeting or schedule a meeting later in the month for that purpose.
