RECOMMENDED ACTION:
Move to adopt Motor Vehicle Resolution prohibiting left turns from Aloha Avenue onto Highway 9
REPORT SUMMARY:
In light of the limited sight distance at Aloha and Highway 9 intersection, the City has determined
that it is in the best interest of public safety to prohibit left turns from Aloha A venue onto Highway
9. The City's Public Works Department has erected the sign prohibiting left turns onto Highway 9
from Aloha A venue on August 4, 2005. A notice was mailed to affected residents including Oak
Street School.
FISCAL IMPACTS:
Approximately $250 in labor and materials for installation of the signs.
CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION:
The MY Resolution would not be adopted and turn prohibition will not be enforceable in a court of
law.
ALTERNATIVE ACTION(S):
None.
FOLLOW UP ACTION(S):
Submit a report to City Council in September providing options for permanent improvements to the
intersection to improve sight distance.

Re: No Left Turns onto Highway 9 from Aloha Avenue
Dear Resident:
In light of a recent accident involving a VT A Bus and a passenger vehicle at the Aloha
and Highway 9 intersection and because of the limited sight distance caused by the
Highway 9 rock retaining wall the City has erected signs which prohibit left hand turns
from Aloha Avenue onto Highway 9.
The City Council will be discussing options for a permanent solution to this public safety
issue at their September 7 City Council Meeting. City Council Meetings begin at 7:00
P.M. and are held in the Civic Theater.

SUBJECT: Appeal by Starbucks Coffee Company of a Planning Commission denial of a
Conditional Use Permit to locate a coffee shop at 14410 Big Basin Way, Unit D
(Corinthian Corners)
RECOMMENDATION
1. Conduct the Public Hearing; and
2. Make all of the findings for the issuance of a Conditional Use Permit stated in Municipal
Code Section [MCS]15-55.070; and
3. Approve the appeal by Starbucks Coffee Company with conditions by adopting the attached
resolution.
BACKGROUND
At its July 27, 2005 meeting, the Planning Commission conducted a public hearing on the
application for a Conditional Use Permit by Starbucks Coffee Company to locate a coffee shop in
a 1,334 square foot tenant space within the Corinthian Corners commercial complex at the
southwest corner of Big Basin Way and Saratoga-Los Gatos Rd. Four Planning Commissioners
were present at the meeting and the outcome was a failed motion with a 2-2 evenly split vote.
Two of the Commissioners were unable to support the granting of a Conditional Use Permit
because of concerns regarding traffic and public safety. The minutes from the public hearing are
attached.
According to MCS 2-15.050, when there is an evenly split vote, the item shall be agendized for
the next Planning Commission meeting where there is a quorum unless within ten days after the
date on which the split vote was made the applicant files an appeal to the City Council. An
appeal filed within ten days of the split vote automatically converts the split vote into an official
denial of the Conditional Use Permit by the Planning Commission. Starbucks Coffee Company
filed an appeal to the City Council on July 28, 2005, one day after the aforesaid Planning
Commission hearing.
DISCUSSION
The floor area of Starbucks Coffee will be 1,334 square feet with interior seating and seasonal
outdoor seating. Starbucks will have a total of 20 employees with an average of 4 employees at
the shop during each shift. No exterior changes are proposed to the fayade or to the parking
configuration where there are six spaces. Fayade improvements to the Corinthian Corners
complex were approved as a design review application by the Planning Commission on
. September 22, 2004. The remodeling activity is currently in progress.
Economic Development Considerations
Economic considerations are applicable to Council's discussion since the General Plan Land Use
Element LU 7.1 states that "The City shall consider the economic impacts of all land use
decisions on the City." The application is consistent with the City's economic goals for the
Village. The City launched an economic development program in 2001 and has been focusing
attention on the Village in particular for some time. A business like Starbucks would create
another reason to stop in the Village and generate additional foot traffic that would likely benefit
all businesses. According to a Wall Street Journal article included in the Planning Commission's
packet, anecdotal data indicates Starbucks may even benefit the existing coffee shops.
Staff believes that the economic impacts of locating a Starbucks at this site would benefit the
Village and the City in a number of ways including generating additional sales tax, attracting
other businesses that would contribute to the Village's revitalization, bringing in visitors who
may not otherwise visit the Village or providing another stop for those who do. In addition,
Starbucks' commitment to supporting communities in which it locates is well known and the
staff of this store could be expected to contribute to the health of the Village as well.
One element of the use Council is asked to consider is parking. A parking survey conducted in
2002 (a copy is included in the Planning Commission packet) showed that even at the peak lunch
and dinner times, additional parking capacity existed in all parking lots. In the morning, which
would be Starbucks' peak, demand for parking is particularly low since few businesses are open.
Patrons who visit at other times of the day and evening would be potential shoppers, diners and
visitors who may not otherwise visit the Village. In all cases, parking spaces that would
otherwise be empty could be filled by Starbucks patrons.
The City's current requirement for parking for a restaurant use, as specified in MCS 15-
35.030(p), is 1 space for every 75 square feet of floor area plus 1 space for each 75 square feet of
outdoor dining area. Therefore, the proposed 1,334 square foot Starbucks would require 18
parking spaces, plus an additional 7 spaces for the approximately 500 square feet of seasonal
outdoor seating. This parking requirement is more stringent than in other nearby cities as shown
in attachment 4 of the Planning Commission packet. For example, the Town of Los Gatos
requires 1 parking space for every 4 seats for a restaurant use. Therefore, according to Los Gatos
parking requirements, the proposed Starbucks with approximately 24 indoor and outdoor seats
would require only 6 parking spaces. The cities of Campbell and Orinda also have parking
requirements similar to that of Los Gatos, based on the number of seats.
Moving in parallel is the process to consider changes to parking requirements in the Village as a
whole. Staff held a meeting with Village business and property owners on July 27 to collect
input on options. While there was no agreement on which option would be best, when asked for
a show of hands from those who wanted parking to remain the same, no hands were raised.
Hours of Operation
Starbucks Coffee is generally open from 5:00 a.m. to 10:00 p.m. on weekdays, and opens later on
Sundays. Staff has not placed any conditions restricting the operating hours to give the applicant
flexibility if there is more customer activity on certain days, such as Friday evenings. Staff does
not expect that the flexibility in operating hours will have impacts on adjacent property owners.
According to the applicant, most other cities do not place restrictions on Starbucks' hours of
operation. The applicant has indicated that deliveries are conducted in the middle of the night (2
_ 3:00 a.m.). To ensure this, Staff has added a condition limiting deliveries to off-peak hours or
during after hours.
Sign age
Staff is requiring that the 'Starbucks Coffee' signage be individual letters with exterior low
wattage, screened lighting. Staff is also requiring that the 36" diameter circular logo facing
Saratoga-Los Gatos Rd. be made of wood with exterior low wattage, screened illumination.
These requirements, as conditioned in the attached resolution, are consistent with the Village
Design Guidelines. Staff has also required the issuance of a building permit for the installation of
these signs.
Conditional Use Permit Findings
The proposed Starbucks Coffee shop is classified as a restaurant pursuant to the Municipal Code.
Establishing and operating a restaurant in any of Saratoga's commercial zoning districts requires
the issuance of a Conditional Use Permit from the Planning Commission (or from the City
Council upon appeal). This process acknowledges that this use may be permitted, but allows the
Planning Commission (or the City Council, in this case) to impose conditions to ensure that a
project is compatible with surrounding land uses. Staff finds that all of the required Conditional
Use Permit findings within Section 15-55.070 of the Municipal Code can be made in the
affirmative in that:
a) The proposed location of the conditional use is in accord with the objectives of the Zoning
Ordinance and the purposes of the district in which the site is located. The proposed
Starbucks will be located in the City's CH-I zoning district. The CH-1 district is designed to
implement the Saratoga Village Specific Plan and achieve the following objectives with
respect to the village:
(1) Preservation and enhancement of the small-scale, pedestrian character of the
Village to make the area more inviting to potential shoppers and diners;
(2) Preservation and enhancement of the architectural and landscape quality of the
Village;
(3) Encouragement of a town center mix of specialty shops, restaurants, convenience
shops, services and residences; and
(4) Conservation of historic structures.
It is anticipated that the establishment of Starbucks Coffee at an integral location in the
Village will attract more pedestrians to the area and make the area more inviting to visitors.
The proposed outdoor seating further contributes a dynamic and highly visible place where
people can meet. The proposed Starbucks is of a smaller scale than stores in other locations,
including its Argonaut Shopping Center location. Because the Starbucks Coffee Company is
a large business, it may not initially appear to have small-scale characteristics. However, the
purpose of item (1) is a scale of use that promotes pedestrian vitality. This vitality is what
successful downtown areas strive to maintain or achieve. The coffee shop proposed by
Starbucks is only 1,334 square feet. In staffs opinion this is a small-scale use. It is
anticipated that a popular business establishment such as Starbucks would significantly
contribute towards much needed pedestrian vitality in Saratoga's Village. Furthermore, the
configuration of the tenant space in an L-shaped building with outdoor seating and attractive
signage contribute towards a small-scale character and diminishes the perception of
Starbucks Coffee as a large-scale business establishment. Equally important is the
expectation that the establishment of Starbucks would promote a sense of confidence in
owners of new business establishments who may be currently reluctant to locate in the
village. A new Starbucks would potentially result in establishment of other new specialty
shops, consistent with the objective of item (3). Therefore, this Use Permit finding can be
made in the affirmative.
b) The proposed location of the conditional use and the conditions under which it would be
operated or maintained will not be detrimental to the public health, safety or welfare, or
materially injurious to properties or improvements in the vicinity. This finding can be made
in the affirmative in that conditions have been placed regarding the operation of Starbucks
Coffee to minimize potential impacts. These conditions address the use of parking spaces by
employees and restrict the times for deliveries.
c) The proposed conditional use will comply with each of the applicable provisions of Chapter
15 Zoning Regulations. This finding can be made in the affirmative. Pursuant to City Code
Section 15-55.030, a conditional use may be permitted by the granting of a Use Permit to
have a different off-street parking requirement than what is specified in City Code Section
15-35.030. In this case no parking spaces are proposed in connection with the proposed use.
The Municipal Code does not require any findings to be made to permit a variation from the
standard requirements. Because of its small scale and the pedestrian oriented design of the
proposed use Staff supports the proposed variation from parking standards. It has been
determined by the City's traffic consultant that the proposed Starbucks would have a less than
significant impact on parking needs.
Correspondence
As of August 3, 2005, Staff has received letters from thr.ee citizens. They are attached to this
report. Any correspondence received after this date will be copied and distributed to each
Council Member on the meeting date.
ADVERTISING, NOTICING, AND PUBLIC CONTACT
This item was properly posted and notice of the hearing was placed in the San Jose Mercury
News on July 30,2005. In addition, pursuant to MCS 15-90.070 (a), Staff mailed notices to all
property owners within 500 feet of the subject. property. As a courtesy, Staff mailed notices to
business owners, many of whom are not the actual owners of the property. A mailing list is
attached to this report. Notices were also sent to the speakers at the July 27, 2005 Planning
Commission public hearing.
FISCAL IMPACTS
There are no negative fiscal impacts noted at this time. Potential positive impacts include the
potential to attract other businesses that may generate additional sales tax.
CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION(S)
Use of the Corinthian Corners complex as a viable business location will be delayed and may
impact the ability of this commercial complex to attract other popular businesses.
FOLLOW UP ACTlON(S)
There are no follow-up actions for the City Council. However, the Planning Commission
maintains continuing jurisdiction over any approved Use Permit, and reserves the right to review
and modify the conditions of a Use Permit at a public hearing if unforeseen issues arise in the
future.

WHEREAS, the City of Saratoga City Council has received an application appealing the
Planning Commission denial of a Conditional Use Permit to allow Starbucks Coffee in a
remodeled tenant space within the Corinthian Corners commercial complex. The coffee shop
will be approximately 1,334 square feet and will have seasonal exterior seating. Approval of this
application will require a variation from the parking standards as allowed in MCS 15-55.030.
The site is located in a Commercial Zoning District; and
WHEREAS, the City Council has conducted a duly noticed Public Hearing at which time
all interested parties were giv~n a full opportunity to be heard and to present evidence; and
WHEREAS, the City Council finds the proposed project consisting of the conversion of an
existing small structure from one use to another is Categorically Exempt from the Environmental
Quality Act (CEQA) pursuant Section 15303, "New Construction or Conversion of Small
Structures", Class 3 (c) of the Public Resources Code (CEQA); and
WHEREAS, the City Council finds that all of the findings required within Section 15-
55.070 of the City Code can be made in the affirmative in that:
a) The proposed location of the conditional use is in accord with the objectives of the Zoning
Ordinance and the purposes of the district in which the site is located. The proposed
Starbucks will be located in the City's CH -I zoning district. The CH -1 district is designed to
implement the Saratoga Village Specific Plan and achieve the following objectives with
respect to the village:
(1) Preservation and enhancement of the small-scale, pedestrian character of the
Village to make the area more inviting to potential shoppers and diners;
(2) Preservation and enhancement of the architectural and landscape quality of the
Village;
(3) Encouragement of a town center mix of specialty shops, restaurants, convenience
shops, services and residences; and
(4) Conservation of historic structures.
It is anticipated that the establishment of Starbucks Coffee at an integral location in the
Village will attract more pedestrians to the area and make the area more inviting to shoppers.

shops, consistent with the objective of item (3) and the economic development objectives of
the General Plan. Therefore, this Use Permit finding can be made in the affirmative.
b) The proposed location of the conditional use and the conditions under which it would be
operated or maintained will not be detrimental to the public health, safety or welfare, or
materially injurious to properties or improvements in the vicinity. This finding can be made
in the affirmative in that conditions have been placed regarding the operation of Starbucks
Coffee to minimize potential impacts. These conditions address the use of parking spaces by
employees and restrict the times for deliveries.
c) The proposed conditional use will comply with each of the applicable provisions of Chapter
15 Zoning Regulations. This finding can be made in the affirmative. Pursuant to City Code
Section 15-55.030, a conditional use may be permitted by the granting of a Use Permit to
have a different off-street parking requirement than what is specified in City Code Section
15-35.030. No parking spaces are proposed in connection with the proposed use. This
variation from the standard requirements is appropriate because of the small scale and the
pedestrian oriented design of the proposed use and because the City's traffic consultant has
determined that the proposed Starbucks would have a less than significant impact on parking
needs.
Now, THEREFORE, the City Council of the City of Saratoga does hereby resolve as follows:
Section 1. After careful consideration of the Use Permit findings and other exhibits
submitted in connection with this matter, the application for a Conditional Use Permit for
Starbucks Coffee is hereby granted subject to the following conditions:
PLANNING
1. The Planning Commission shall retain continuing jurisdiction over the Conditional Use
Permit and may, at any time, modify, delete or impose any new conditions of the permit
to preserve the public health, safety, and welfare.
2. The store shall operate as represented on the plans marked Exhibit "A".
3. Any intensification of this use shall require an amended Conditional Use Permit.
4. Prior to issuance of Building Permits for any internal tenant improvements, detailed
construction plans shall be reviewed and approved by the Planning Division for Zoning
Clearance to verify consistency with the approved Exhibit "A" plans. The construction
drawings shall incorporate a copy of this Resolution as a separate plan page.
5. The construction plans shall include proposed directional signage - one near each
driveway entrance - informing customers of additional parking behind the buildings
across Big Basin Way. The directional signage shall be consistent with City Code Section
15-30.100.
6. A sign situated at a prominent location within the store shall also be shown on the plans,
informing customers of the availability of additional parking behind the buildings across
Big Basin Way.
7. Starbucks employees shall not use the on-site parking spaces.
8. All deliveries shall occur during off-peak hours or after closing.
9. A Building Permit shall be obtained for the proposed signage.
10. The 'Starbuck Coffee' signage shall be individual opaque letters with exterior low-
wattage and screened illumination, and the round logo at the side of building shall be
wooden with exterior low wattage and screened illumination. Signage shall conform to
the Saratoga Village Design Guidelines
11. If required, prior to issuance of Zoning Clearance for the proposed tenant improvements,
the ownerlapplicant shall submit to the Community Development Department verification
from the Santa Clara County Health Department showing proof of compliance of the
proposed facility with the Health Department's requirements.
12. The proposed use shall at all times operate in compliance with all regulations of the City
and/or other agencies having jurisdictional authority over the use pertaining to, but not
limited to, health, sanitation, safety, and water quality issues.
13. The applicant shall obtain a Business License from the City of Saratoga prior to
conducting business.
FIRE PROTECTION DISTRICT
14. Applicant shall comply with all Saratoga Fire Protection District requirements.
CITY ATTORNEY
15. Applicant agrees to hold City harmless from all costs and expenses, including attorney's
fees, incurred by the City or held to be the liability of City in connection with City's
defense of its actions in any proceeding brought in any State or Federal Court,
challenging the City's action with respect to the applicant's project.
Section 2. A Building Permit or Business License must be issued and construction or
business operations commenced within 24 months from the date of adoption of this Resolution or
approval will expire.
Section 3. All applicable requirements of the State, County, City and other Governmental
entities must be met.

PROJECT DESCRIPTION
The applicant, Starbucks Coffee Company, is requesting a Conditional Use Pennit to locate
a coffee shop in one of the tenant spaces located within an 11,836 square foot commercial
property known as Corinthian Corners. The site is located at the comer of Big BasinWay
and Saratoga-Los Gatos Road and was formerly occupied by a flower shop.
STAFF RECOMMENDATION
Approve the Conditional Use Pennit application with conditions by adopting the attached
Resolution.

STAFF ANALYSIS
ZONING: CH-I District: The CH-I District is designed to implement the Saratoga Village
Specific Plan and achieve the following objectives with respect to the village.
(1) Preservation and enhancement of the small-scale, pedestrian character of the Village
to make the area more inviting to potential shoppers and diners;
(2) Preservation and enhancement of the architectural and landscape quality of the
Village;
(3) Encouragement of a town center mix of specialty shops, restaurants, convenience
shops, services and residences: and
(4) Conservation of historic structures.
GENERAL PUN DESIGNATION: The General Plan designates this area as CR - Retail
Commercial. The property is located within Area J, which is the Village Area. General Plan
Land Use Policy LU 7.1 states, "The City shall consider the economic impacts of all land use
decisions on the City." Staff finds that the proposed Starbucks will provide the impetus to
attract other successful businesses, and will be an economically viable business
establishment that will be mutually beneficial to the other types of establishments in the
Village.
MEASURE G: Not applicable
P ARca SIZE: 16,180 square feet
SQUARE FOOTAGE OF TENANT SPACE: 1,334 square feet, plus seven tables for exterior
seasonal seating.
AVERAGE SITE SLOPE: Average Slope of lot is less than 10%
GRADING REQUIRED: The applicant proposes no changes to the grade.
ENVtRONMENTAL DETERMINATION: The proposed project consisting of the conversion of
an existing small structure from one use to another is Categorically Exempt from the
Environmental Quality Act (CEQA) pursuant Section 15303, "New Construction or
Conversion of Small Structures", Class 3 (c) of the Public Resources Code (CEQA).
PROPOSED ExTERIOR MATERIALS AND COLORS: Other than new signage, the applicant
does not propose any changes to the exterior of the property, which is currently being
remodeled.

PROJECT DISCUSSION
The applicant is proposing interior tenant improvements to locate a Starbucks Coffee Shop
in the Corinthian Corners commercial complex at the southwest corner of Big Basin Way
and Saratoga Los Gatos Rd. The tenant space is on the ground floor at the center of the
commercial complex, with its customer entrance facing Big Basin Way. The floor area of
Starbucks Coffee will be 1,334 square feet with interior seating and with exterior space for
seasonal seating. Starbucks will have a total of 20 employt;es with an average of 4
employees at the shop during each shift. No exterior changes are proposed to the fa<;ade or
to the parking configuration where there are six spaces. Fa~ade improvements to the
Corinthian Comers complex were approved as a design review application by the Planning
Commission on September 22, 2004. The remodeling activity is currently in progress.
Starbucks Coffee Company previously applied for a Conditional Use Pennit at this location
in 1996. At its January 22, 1997 meeting, the Planning Commission decided to continue the
application to another meeting. After the initial Planning Commission hearing, Starbucks
withdrew its application and decided to pursue another location in Saratoga.
Requirements for a Conditionally Permitted Use
The proposed Starbucks Coffee shop is classified as a restaurant pursuant to the City Code.
Establishing and operating a restaurant in any of Saratoga's commercial zoning districts
requires the issuance of a Conditional Use Pennit from the Planning Commission. This
process acknowledges that this use may be pennitted, but allows the Planning Commission
to impose conditions to ensure that a project is compatible with surrounding land uses. In
this case, Staff finds that Starbucks Coffee is an appropriate use for the central ground floor
tenant space in the Corinthian Corners commercial complex. A successful coffee shop will
attract more foot traffic to the downtown and will be beneficial to other businesses.
Correspondence
However, the increased number of visitors to the proposed Starbucks has raised some
concerns about parking, traffic and potentially decreased revenues for the existing coffee
shops in the Village. As of the writing of this report, staff has received three letters of
concern from citizens, which are attached. A more detailed discussion of traffic and
business concerns is presented below. Nevertheless, Staff has noted that while the proposal
will generate more traffic to the site, it would not substantially disrupt Village parking and
traffic circulation since the busiest times for Starbucks is 7:30 a.m. to 8:30 a.m. most
weekdays and 9:00 a.m. to 11:00 a.m. on weekends, when many Village shops have not yet
opened.

Parking and Circulation
This proposal does not meet the City's off-street parking requirements for a restaurant use
(1 space for every 75 sq. ft. of floor area, plus I parking space for each 75 square feet of
outdoor dining area pursuant to City Code Section 15-35.030(p)). The total square footage
of the Corinthian Corners complex is 11,836 square feet. The proposed 1,334 square foot
Starbucks would require 18 parking spaces, plus an additional 7 parking spaces would be
required for the approximately 500 square feet of seasonal outdoor seating. The remaining
Cotinthian Corners complex, consisting of an additional 10,502 square feet of interior
space, will require an additional 53 parking spaces, assuming the remaining tenant spaces
are all occupied by intensive retail usesl The project site has 6 off-street spaces. Pursuant to
City Code Section 15-55.030, a conditional use may be permitted by the Planning
Commission to have an off-street parking requirement different from what is listed in City
Code Section 15- 35.030(p).
When Starbucks Coffee Company applied in 1996, Staff required the applicant to provide a
parking demand study because of insufficient off-street parking. A summary of this traffic
study is attached (attachment 3). For the current application, City referred to its
transportation consultant to obtain more recent information. The City consultant's report
is included in the same attachment. The study estimates that during the a.m. peak hour
(7:30 a.m. - 8:30 p.m.), the trip generation is roughly 80 vehicles. The p.m. peak hour is
roughly 25% of the a.m. peak hour total. Therefore, the traffic and parking analyses focus on
a.m. peak hour operations.
There are four public parking districts/lots within the Saratoga Village. The subject
property is not within a parking district, and was not required to pay for district
improvements. However, the parking spaces are not just limited for use by the properties
within the districts. Because of this, the recent parking study further analyzed available
public parking near the project site. The current estimate for the parking demand is up to
20 vehicles at any given time in the morning. With an on-site supply of 6 spaces, combined
with the solid assumption that the other business establishments do not generate a large
number of 7:30 - 8:30 a.m. peak hour trips, the recent parking analysis concludes that the
parking demand can be accommodated by the existing on-street spaces or within the
parking districts. Attachment 4 includes an analysis of the use of the City's parking
districts, which shows that these parking lots were never fully occupied on any day.
In attachment 3, the City's transportation consultant also analyzed the off-site rraffic issues
and has determined the impacts to be minimal. Nevertheless, some excellent solutions to
concerns regarding circulation at the site are presented in a correspondence from Mr. Frank
Burrell 111 (attachment 6). Two of Mr. Burrell's requests have been included (with
modifications) as conditions of Use Permit approval, as described below:
1. Prohibiting on-site parking by Starbucks employees has been made a condition of
Use Permit approval in the attached resolution.
I Pursuant to City Code, an intensive retail use is a business that does not sell bulky commodities such as
furniture. The parking requirement is 1 space per 200 square feet of floor area.

2. The placement of rwo directional signs (one near each driveway entry to the site)
indicating the availability of additional parking at the 2-hour parking zones behind
the businesses on the northwest side of the street has been included as a condition
of approval. In addition, Starbucks will also be required to place an interior sign
informing customers of the additional parking spaces.
City Council Meeting of April2005
At its April 20, 2005 public hearing, the City Council directed the Planning Commission to
review alternatives to reduce the current parking requirements in the Village. It was
discussed at this meeting that suspending or relaxing the parking requirements could be a
low cost way to stimulate activity in the Village. The impetus of Council's direction is a
result of the current situation of the Village which continues to struggle to retain
businesses and attract customers.
The Corinthian Corners site is an integral property in the Saratoga Village. The purpose of
the current remodeling activity is to make this site attractive to commercial tenants. Many
structures in the Village have difficulty attracting viable commercial tenants due to aging
infrastructure, which does not meet current commercial standards. Staff understands the
concerns of nearby coffee shop owners, as described in one of the letters (attachment 6)
received by Staff. The Starbucks Coffee Company has indicated to Staff that smaller coffee
shops in the vicinity of Starbucks in other locations actually do quite well and has provided
a newspaper article on this issue for reference (attachment 5).
Hours of Operation
Starbucks Coffee is generally open from 5:00 a.m. to 10:00 p.m. on weekdays, and generally
opens later on Sundays. Staff has not placed any conditions restricting the operating hours
to give the applicant flexibility. According to the applicant, most other cities do not place
restrictions on Starbucks hours of operation.
The applicant has indicated that deliveries are conducted in the middle of the night (2 -
3:00 a.m.). The traffic report prepared in 1996 indicates that delivery truck will not impact
other vehicles. To ensure this, Staff has added a condition limiting deliveries to off-peak
hours or during after hours.
Signage
Staff is requiring that the 'Starbucks Coffee' signage is halo illuminated. Staff is also
requiring thar the 36" diameter circular logo facing Saratoga Los Gatos Rd. be made of
wood with exterior low wattage and screened illumination. These requirements, as
conditioned in the attached resolution, are consistent with the Village Design Guidelines.
Staff has also required the issuance of a building pennit for the installation of the signs.

Design Review
Design Review approval is not required for this application. No exterior changes to the
facade are proposed in this application. Landscaping will be provided as part of the
September 22, 2004 Design Review approval for the remodeling of the site.
Condusion
All of the required Conditional Use Permit findings within Section 15-55.070 of the City
Code can be made in the affirmative in that:
. The proposed Starbucks Coffee shop meets the objectives of the Zoning Ordinance
and the purposes of the zoning district in which the site is located, in that the
proposed establishment is appropriately located to provide a popular beverage and
lively gathering place for the residents of Saratoga and will promote a stable,
attractive environment for the downtown Village; and
. The proposed coffee shop will not be detrimental to the public health, safety or
welfare, nor materially injurious to properties or improvements in the vicinity in
that conditions have been placed regarding the operation of Starbucks Coffee to
minimize potential impacts; and
. The proposed establishment will comply with all applicable provisions of the
Saratoga Municipal Code.
STAFF RECOMMENDATION
Approve the Conditional Use Permit application with conditions by adopting the attached
Resolution. It should be noted that the Planning Commission maintains continuing
jurisdiction over any approved Use Permit, and reserves the right to review and modify the
conditions of a Use Permit at a public hearing if unforeseen issues arise in the future.

WHEREAS, the City of Saratoga Planning Commission has received an application
for a Conditional Use Permit to allow Starbucks Coffee in a remodeled tenant space within
the Corinthian Comers commercial complex. The coffee shop will be 1,334 square feet and
will have seasonal exterior seating. The site is located in a Commercial Zoning District; and
WHEREAS, the Planning Commission has conducted a duly noticed Public Hearing
at which time all interested parties were given a full opportunity to be heard and to present
evidence; and
WHEREAS, the Planning Commission finds the proposed project consisring of the
conversion of an existing small structure from one use to another is Categorically Exempt
from the Environmental Quality Act (CEQA) pursuant Section 15303, "New Construction
or Conversion of Small Structures", Class 3 (c) of the Public Resources Code (CEQA); and
WHEREAS, the Planning Commission finds that all of the findings required within

Now, THEREFORE, the Planning Commission of the City of Saratoga does hereby
resolve as follows:
Section 1. After careful consideration of the floor plan and other exhibits submitted
in connection with this matter, the application for a Conditional Use Permit approval for
Starbucks Coffee is hereby granted subject to the following conditions:
PLANNING
!. The Planning Commission shall retain continuing jurisdiction over the Conditional
Use Permit and may, at any time, modify, delete or impose any new conditions of
the permit to preserve the public health, safety, and welfare.
2. The store shall operate as represented on the plans marked Exhibit "An.
3. Any intensification of this use shall require an amended Conditional Use Permit.
4. Prior to issuance of Building Permits for any internal tenant improvements, detailed
construction plans shall be reviewed and approved by the Planning Division for
Zoning Clearance to verify consistency with the approved Exhibit "An plans. The
construction drawings shall incorporate a copy of this Resolution as a separate plan
page.
5. The construction plans shall include proposed directional signage - one near each
driveway entrance - informing customers of additional parking behind the
buildings across Big Basin Way. The directional sighage shall be consistent with
City Code Section 15-30.100.
6. A sign situated at a prominent location within the store shall also be shown on the
plans, informing customers of the availability of additional parking behind the
buildings across Big Basin Way.
7. Starbucks employees shall not use the on-site parking spaces.
8. A Building Permit shall be obtained for the proposed signage.
9. The 'Starbuck Coffee' signage shall be halo illuminated, and the round logo at the
side of building shall be wooden with exterior low wattage and screened
illumination. Signage shall conform to the Saratoga Village Design Guidelines
10. If required, prior to issuance of Zoning Clearance for the proposed tenant
improvements, the ownerlapplicant shall submit to the Community Development
Deparnnent verification from the Santa Clara County Health Deparnnent showing
proof of compliance of the proposed facility with the Health Deparonent's
requirements.

n. The proposed use shall at all times operate in compliance with all regulations of the
City and/or other agencies having jurisdictional authority over the use penaining to,

12. The applicant shall obtain a Business License from the City of Saratoga prior to
conducting business.
FIRE PROTECTION DISTRICT
13. Applicant shall comply with all Saratoga Fire district requirements.
CITY ATTORNEY
14. Applicant agrees to hold City harmless from all costs and expenses, including
attorney's fees, incurred by the City or held to be the liability of City in connection
with City's defense of its actions in any proceeding brought in any State or Federal
Court, challenging the City's action with respect to the applicant's project.
Section 2. A Building Permit or Business License must be issued and construction
or business operations commenced within 24 months from the date of adoption of this
Resolution or approval will expire.
Section 3. All applicable requirements of the State, County, City and other
Govermnental entities must be met.
Section 4. Unless appealed pursuant to the requirements of Article 15-55.080 and
15-90 of the Saratoga City Code, this Resolution shall become effective ten (10) days from
the date of adoption.

We reviewed the previous staff report, parking study, and traffic study completed for the proposed
Starbucks store to be located on the south side of Big Basin Way just west of Saratoga-Los Gatos
Road. The studies were completed by Meyer, Mohaddes Associates (MMA) and examined the
operations of the Saratoga Avenue (Big Basin Way) and Saratoga-Los Gatos Road (Saratoga-
Sunnyvale Road) intersection and addressed site access and on-site circulation.
The MMA traffic and parking studies estimated that 40 vehicles would enter and exit the site during
the peak one-hour period in the morning. Fehr & Peers survey data from a Starbucks in Orinda and
from one on Hillsdale Avenue in San Jose showed that the peak-hour trip generation was
approximately 80 vehicles or double that included in the study. During the PM peak hour, the
number of vehicles entering the site was approximately 25 or about 30 percent of the AM peak hour
total. Thus, all of the traffic and parking analyses focus on AM peak hour operations.
Off.site Traffic Issues
Starbucks stores do not generate a substantial amount of new traffic in the area they serve.
Typically, drivers already on the adjacent roadways stop at Starbucks on their way to another
primary destination. These trips are referred to as pass-by or diverted trips. The Fehr & Peers San
Jose store survey showed that Starbucks was the primary destination for only 22 percent of
customers. The remaining 78 percent were traveling on the adjacent street or diverted from another
nearby street to visit the store.
Based on this data, the proposed project would generate approximately 18 new peak hour trips at
the Big Basin Way/Saratoga-Los Gatos Road intersection during the AM peak hour. This volume is
considered negligible. The remaining 62 trips would already be traveling on Saratoga Avenue, Big
Basin Way, Saratoga-Los Gatos Road, or Saratoga-Sunnyvale Road and would turn into the site.
Based on an average of about one vehicle per minute, the change to the operation of the adjacent
signalized intersection is also expected to be negligible. Even if ten vehicles changed travel patterns
within a one or two-minute timeframe, the change in delay would not be noticeable to other drivers.
Parking Issues
Based on a peak hour demand of 40 vehicles, the MMA parking study estimated a demand of 10
parking spaces assuming a wait time of 15 minutes. With our estimate of 80 vehicles during the peak
hour, we estimate a parking demand of up to 20 vehicles at anyone time in the morning. With an on-
site supply of 8 spaces, up to 12 vehicles will use parking on Big Basin Way. Since most of the other
commercial establishments do not generate a substantial number of AM peak hour trips, this

demand could be accommodated by the existing on-street supply or nearby public lots. The only
parking-related issue is the possibility of patrons parking on the north side of Big Basin Way and
crossing the street mid-block instead of using the crosswalk at the Saratoga-Los Gatos Road spur.
This is an issue for any establishment in the village commercial district and is typically addressed
through enforcement. Additional signage could be installed if this issue becomes a consistent
problem.
Site AccessiOn-Site Circulation
The previous staff report included two recommendations: 1) widening the Big Basin Way driveway
from 16 to 20 feet to improve turning movements into and out of the driveway, and 2) restriping the
driveway on the Saratoga-Los Gatos Road spur to allow both inbound and outbound movements
instead of outbound only. We concur with these recommendations.

This letter summarizes the results of the traffic analysis for the proposed Starbucks to be located in the City
of Saratoga. The project site is localed on the southwest comer of Big Basin Way and Saratoga-Los Gatos
Road. Meyer. Mohaddes Associates, Inc. has recently completed a parJcing demand study for the proposed
project. Additional analysis of the traffic impacts. both peak hour and daily, and site access evaluation was
requested at the recent Planning Commission study session.
For this study. the traffic impacts to the signalized intersection of Big Basin Way and Saratoga-Los Gatos
Road were evaluated during the AM and PM peak hours for both existing and project conditions. The
concept of Level of Service (LOS) was used to dmnnine performance al the stUdy intersection. This
analysis used the 1985 Highway Capaciry MQ1IUQ] (HeM) levels of service definition and calculation
procedures. LOS was defmed with the plII]lose of describing traffic congestion using simple parametets
with traffic operations rated on an A to F scale. LOS A representS Cltcellent or free flow conditions while
a LOS F represents failure or heavily congested conditions. Intersection perfonnance is measured in tems
of stopped delay per vehicle (in seconds).
LOS was evaluated using the CAPSSI software. CAPSSI uses the 1985 HCM methodology for optimizing
cycle lengths and splits to calculate the resulting intersection performance. Default values adopted by the
Santa Clara County Transportation Agency, the County.s Congestion Management Agency (CMA), wete
used for the required CAPSSJ inpUlS. Typical traffic signal cycle lengths were measured in the field.
Existing Conditions
Existing peak hour turning movement counts observed in November of 1996 were supplied by the City.
During the AM and PM peak hOUlS, the interseclion of Big Basin Way and Saraloga-Los Gatos Rolld
operates at LOS C with average veh;cle delays of 20 to 22 seconds. Based on daily traffic volumes
provided by the City from the fall of 19,'5, Big Basin Way carries an average of 12,850 vehicles per cl:.y
and SaratOga-1.Qs Gales Road carries aJ) average of 14,425 vehicles per day.

RECOMMENDED ACTION(S):
Direct Planning Commission to review existing parking requirements for Village businesses and
make recommendation to City Council regarding changes.
Direct staff to meet with affected businesses and/or property owners in the Village to discuss the
implications of any changes.
REPORT SUMMARY:
The Village continues to struggle to retain businesses and attract customers. The City of Saratoga
has taken a number of steps to help: installed new benches and trash receptacles, new parking signs,
and lighting in the trees to improve the evening ambience. The City has co-sponsored events such as
the annual treeclighting ceremony, Art in the Park, etc., to bring people into the Village. However,
future Village support will be far less than in the recent past as a result of budget reductions for
2005-06. Council has directed staff to cut funding for Economic Development in the next fiscal
year.
Parking Standards Reviewed
The Village Ad Hoc Committee, comprised of Mayor Kathleen King and Vice Mayor Norman Kline,
has been searching for no or low cost activities that would help support the Village. One constraint
on business expansion and attracting new businesses is the stringent parking standards that apply to
businesses outside of the four prescribed Parking Districts. Saratoga's parking standards are shown
in the following table:

A quick survey of small cities with similar central business districts shows that Saratoga requires .
more parking for those business not included in a Saratoga, parking district than other communities.

ViJlage Parking Options
Several options exist to modify parking requirements and enable existing businesses to expand
and/or property owners to attract new business including the following:
. Standardize parking requirements for an Village businesses
. Set the standards for the non-Parking District properties at the lowest level required in a
parking district
. Suspend parking requirements for a fixed amount of time, for example 1-5 years
AIJy of these options could potentially improve the economic vitality of the Village by permitting a
wider range of businesses as well as an increase in total business square footage.
ViJlage Parking Capacity
A Village parking study was conducted in July 2002 (included as Attachment C) that showed
parking demand highest during lunch and dinner hours and that Parking lots 1,2 and 4 were most
used. However, during all times, additional parking capacity existed in the Village. Modifying
parking standards might create business activity that would fill the vacant spaces.

The Village Ad Hoc Committee believes suspending or relaxing parking requirements could be a
low cost way to stimulate activity in the Village. If Council agrees, staff would collect further
information. The Planning Commission would then evaluate the information and develop a
recommendation to the City Council.
In addition, staff anticipates that business and/or property owners may have differing opinions about
the attractiveness of changing the parking standards. Many have bought into established parking
districts to meet the requirements at the time they came to Saratoga. Staff expects meetings with the
Village business community and the Chamber of Commerce to be needed to explain any possible.
changes and gather feedback.
FISCAL IMPACTS:
The process to gather information, work with the Planning Commission and hold meetings would
require staff time; irnplementation would require City Attorney time in order to make the necessary
changes to our Municipal Code.
CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION(S):
No changes to the parking standards would occur at this time.
