HomeMy WebLinkAboutCity Council Resolution 06-097RESOLUTION NO. 06-097 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA DECLARING HAZARDOUS VEGETATION GROWING ON CERTAIN DESCR PROPERTY TO BE A PUBLIC NUISANCE AND SETTING A PUBLIC HEARING WHEREAS, hazardous vegetation is growing in the City of Saratoga upon certain streets, sidewalks, highway, roads and private property; and WHEREAS, said vegetation attains such growth as to become a fire menace or are otherwise noxious or dangerous; and WHEREAS, said vegetation constitutes a public nuisance. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Saratoga, as follows: 1. That hazardous vegetation does now constitute a public nuisance; 2. That said nuisance exists upon all the streets, sidewalks, highways, roads and private property, more particularly described by common name or by reference to the tract, block, lot, code area and parcel number on the report prepared by and on file in the Office of the Agricultural Commissioner County Fire Marshal; 3. That it is ordered that Wednesday, the 17th day of January. 2007, at public hearing during a regular meeting which will begin at 7:00 p.m. in the Saratoga Civic Theater, 13777 Fruitvale Avenue, is hereby fixed as the time and place where objections to the proposed destruction and removal of said vegetation shall be heard and given due consideration; 4. That the Office of the Agricultural Commissioner is hereby designated as the person to cause notice to be given in the manner and form provided in Article 15, Chapter 7 of the Saratoga Municipal Code, and as the person to hereafter cause abatement of such seasonal and recumng nuisance. The above and foregoing resolution was passed and adopted by the Saratoga City Counci] at a regular meeting held on the 20`h day of December 2006, by the following vote: AYES: Councilmembers Jill Hunter, Kathleen King, Chuck Page, Vice Mayor Ann Waltonsmith, Mayor Aileen Kao NOES: None ABSTAIN: None ~~~~ ~°-~ Aileen Kao, Mayor ABSENT: None
