A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA
CANCELLING A LANDSCAPE MAINTENANCE AGREEMENT
A. WHEREAS, the City of Saratoga and the former owner of Assessor's Pazcel
Number 397-22-012 entered a landscape maintenance agreement applicable to
said parcel which agreement is attached hereto as Exhibit A (hereinafter
referenced as "Agreement").
B. WHEREAS, the project for which the Agreement was adopted no longer exists
and has been replaced by a fire station and related facilities.
C. WHEREAS, it is no longer in the public interest to retain the Agreement.
VOW THEREFORE BE IT RESOLVED THAT:
The Agreement is hereby cancelled and shall be of no further force and effect.
The City Manager or his designee is authorized to take such action as maybe required
to implement this resolution including the execution of such additional documents as
may be required to release any and all interest of the City of Sazatoga in the
Agreement.
Thi resolution was passed and adopted at a meeting ofthe Saratoga City Council held on the 7th day
of September, 2005 by the following vote:
AYES: Councilmembers Nick Streit, Ann Waltonsmith,
Vice Mayor Norman Kline, Mayor Kathleen King
NOES: None
ABSENT: Councilmember Aileen Kao
ABSTAIN: None
