HomeMy WebLinkAboutCity Council Resolution 06-017RESOLUTION 06-017 A RESOLUTION OF THE CITY OF SARATOGA ORDERING AND CALLING A MUNICIPAL ELECTION TO BE HELD IN THE CITY OF SARATOGA ON JUNE 6, 2006 FOR THE SUBMISSION TO THE VOTERS A RESOLUTION RELATING TO THE SALE OF CITY OWNED PROPERTY AT 19848 PROSPECT ROAD; REQUESTING CONSOLIDATION OF ELECTIONS AND SPECIFYING CERTAIN PROCEDURES FOR THE CONSOLIDATION OF ELECTIONS; REQUESTING THE SERVICES OF THE REGISTRAR OF VOTERS; PROVIDING FOR GIVING NOTICE OF ELECTION; AND PROVIDING FOR THE SUBMISSION OF ARGUMENTS FOR AND AGAINST THE RESOLUTION, AND WITHDRAWING PRIOR AUTHORIZATION OF REBUTTAL ARGUMENTS ON CITY MEASURES. WHEREAS, California Elections Code section 1301 provides that elections for the City of Saratoga shall be held on an established statewide election date; and WHEREAS, pursuant to section 1301 and Part 3 of Division 10 of the California Elections Code, a municipal election maybe consolidated with a statewide direct primary election; and WHEREAS, a statewide direct primary election will be held on June 6, 2006; and WHEREAS, the City Council of the City of Saratoga desires to submit to the voters a proposed resolution relating to the sale of City-owned property at 19848 Prospect Road, NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Saratoga: 1. A municipal election is hereby called to be held in and for the City of Saratoga on Tuesday, June 6, 2006 for the purpose of submitting the following question: Shall the sale of City-owned property at 19848 Prospect Road, Saratoga, California YES (also known as the "North Campus") be approved as set forth in Resolution 06-016? NO 2. The text of the resolution referenced in item 1, above, is attached hereto as Exhibit A. Pursuant to Part 3 of Division 10 of the Elections Code, commencing with section 10400, the City Council hereby requests the Board of Supervisors of the County of Santa Claza to order the consolidation of the municipal election to be conducted within the boundaries of the City of Saratoga on June 6, 2006, with respect to which the Board of Supervisors of the County of Santa Clara has the power to order a consolidation. The City Council farther consents to and orders the consolidation of the municipal election hereby called with the statewide direct primary election. Upon consolidation, the consolidated election shall be held and conducted, election officers appointed, voting precincts designated, ballots printed, polls opened at 7:00 a.m. and closed at 8:00 p.m., ballots counted and returned, returns canvassed, and all other proceedings in connection with the election shall be regulated and done by the Registrar of Voters of the County of Santa Claza in accordance with the provisions of law regulating the elections so consolidated. 4. The City Clerk is hereby authorized and directed to publish a notice of municipal election within the time and in the manner specified in Elections Code section 12111. The City Clerk is further authorized and directed to do all other things required by law to hold the election above provided. 5. The City Clerk is hereby authorized and directed to certify to the adoption of this resolution and to transmit a certified copy to the Boazd of Supervisors of the County of Santa Claza and to the Registraz of Voters of the County of Santa Clara. 6. The City Clerk is hereby directed to transmit a copy of the resolution referenced in item 1 above to the City Attorney for preparation of an impartial analysis of the measure showing its effect on existing law and the operation of the measure. 7. In accordance with Elections Code section 9285(b), the City of Saratoga hereby repeals its prior authorization for rebuttal arguments to be filed on City measures. Rebuttal arguments are no longer authorized. Written arguments for and against the measure referenced above shall be filed in accordance with the schedule adopted by the Santa Clara County Registrar of Voters.
