RESOLLw~ION CREATING SPECIAL ASSESSMENT DISTRICT
PURSUANT TO STI~;~]T LIGHTING ACT CF 1919
WHEREAS, the City of Saratoga incorporated on October
1956, and by reason thereof that certain highway lighting
district known as "THE SARATOGA LIGHTING DISTP:ICT" was com-
pletely included within the exterior boundaries of the City
of Saratoga and thus said highway lighting district as such
was, pursuant to Streets and Highways Code Section 19270 to
1927~, inclusive, ipso facto dissolved, and
WItEREAS, the City Council of the City of Saratoga has
deemed and does hereby deem it to be in the public interest
and convenience that the existing street lighting system of
said former distri~.t be continued to be maintained and supplied
with electric current and to do so pursuant to the Street Lighting
~Act of 1919~ and
WHEREAS, pursuant thereto the City Council has heretofore
ordered the Clerk of said City to prepare a report in writing
in accord with Streets and Highways Code Section 18041, which
report was thereafter prepared and presented to said City
Council and considered by it, a copy of which report is attached
to this Resolution, and
WHEREAS, thereafter on the 7th day of June, 1957, said
City Council passed .and adopted Resolution Nos. 24 and
which Resolutions respectively were and are Resolution of intention
to order the proposed improvement of continuation of furnishing
of electric current for the street lighting system and maintain-
ing the street lighting system within a special assessment district,
whose boundaries coincide with the 'boundaries of the aforesaid

Saratoga highway lighting district and a Resolution fixing a
time and place of hearing in accord with the laws applicable
thereto, and
WEEAS, the 28th day of June, 1957 at the hour of 6:00
o~clock P.M. of said day, at the Council ChamPbets of the City
of Saratoga at Firemen's Hall, Oak Street, Saratoga, California,
was set as the time and place for hearing protests in accord with
said Street Lighting .Act of 1919, and that prior thereto a
Notice in accord with Streets and Highways Code Section 18071
was conspicuously posted along all streets in the district not
more than 300 feet apart and more than four of said notices were
posted for at least four days in four public places in said City
and proposed district, which posting was completed at least ten
days prior to June 28, 1957 and
WHEREAS, a notice similar in substance was published by
two successive insertions in the Los Gatos Times-Observer, which
publication was completed at least ten days prior to said June
28, 1957, and
WHEREAS, a'~ 'Me aforesaid time and place, namely, at the
hour of 6:00 orelock P.M. on June 28, 1957, the Council heard,
considered and passed on all protests to the creation of said pro-
posed assessment and assessment district, and said Council finding
that no protests have been made or filed
and good cause appearing therefor,
NOW, THEREFOP. E, :the City Council of the City of Saratoga
hereby resolves as follow.el
1. All the statements in the preamble to this Resolution
are hereby referred to and incorporated into this section
by reference and are hereby declared to be findings of this City
Council.
2. The area of lands in the City of Saratoga as shown on
Exhibit "A" attached hereto and incorporated heroin by
reference is hereby established as a special assessment district
pursuant to the Street Lighting Act of 1919, said area hereby
being found to be benefited by the improvement of the::~'~f.~r~l~l~g
of electric current for and the maintenance of the street lighting
system presently exsiting therein and as shown on said Exhibit
and said proposed improvement is hereby ordered to be made and
after compli.anee with Streets and Highways Code Section 18155,
thereafter the City Clerk is hereby directed to imediately open
said p~:~posed improvement to bid in accord with Streets and Highways
Code Sections 18170, et seq.
3. Said assessment district is hereby given the name of
"SCL DISTRICT ONE", and all the lands within said district
are hereby assessed in the total sum of $3,581.53 for the fiscal
year 1957-1958, each parcel is hereby ~eclared to be benefited".:"by such
improvement in the proportion that its assessed valuation bears to
the total assessed valuation of the entire district, and said
assessment shall be and is hereby prorated over all of said parcels
im direct proportion. to each's assessed valuation.
~. Pursuant to Streets and Highways Code Section 18155, the
City Gterk is hereby directed to forthwith deliver to the Santa
Clara County Auditor a certified copy of this Resolution which
includes the diagram an.d assessment for said district, the same
to be done no later than .August lO, 1957.
