A RESOLUTION GRANTING CONSENT OF THE CITY COUNCIL OF THE
CITY 0F SARATOGA TO SANITATION DISTRICT N0.4 0F SANTA
CLARA COUNTY TO UNDERTAKE PROCEEDINGS TO ACQUIRE AND
CONSTRUCT A SANITARY SEWERAGE PROJECT AND TO PROVIDE
THAT THE 00ST SHALL BE ASSESSED ON THE DISTRICT
BENEFITEDUNDER APPROPRIATE SPECIAL ASSESSMENT AND
ASSESSMENT BOND PROCEEDINGS
SANITARY SEWERAGE PROJECT N0. 1958-2
RESOLVED, by the City Council of the City of Saratoga,
California, that
WHEREAS, the Board of Directors of County Sanitation District
No. 4 of Santa Clara County has filed with this Council a certified
copy of its Resolution Requesting Consent of this Council to under-
take appropriate special assessment and assessment bond proceedings
for the acquisition and construction of a sanitary sewerage system
and to assess the cost thereof on the lands described in said
Resolution;
WHEREAS, a portion of the property proposed to be assessed is
within the City Limits of the City of Saratoga over which this
Council has Jurisdiction; and
WHEREAS, the public interest and general welfare will be
served by undertaking and completing said project;
NOW, THEREFORE, IT IS ORDERED, as follows:
1. That consent be, and the same is hereby, granted to said
County Sanitation Distric$ No. 4 of Santa Clara County to acquire
and construct said sanitary sewerage system, as described in said
Resolution, to form said assessment district and to make such
changes and modifications therein as may be proper or advisable in
the manner provided by law.
2. That consent be, and the same is hereby, granted to said
District to open all such public streets as are required for the
installation of said sanitary sewerage system. All work pertaining
to said project shall be done under the direction of the District
Engineer and to the satisfaction of the City Engineer of said City,
and in conformity with good engineering practice. Said District
Engineer shall require of the contractor that all of the provisions
of the specifications are complied with by the contractor, to the
end that no greater amount of ditches are open at any time than is
necessary, ~hat they shall be adequately lighted and barricaded, ant
that they shall be promptly backfilled, and tha~ the pavement shall
be restored with materials of like quality and character as those
existing therein at the time of such work and to its former condi-
tion and state of usefulness as nearly as may be. In this regard,
District shall first receive the written approval of the City
~Engineer that all backfill and paving complies with City require-
~men~s prior to final payment to contractor, to which District agree~
by acceptance of the within consent, this resolution being condi-
tional upon such agreement by District.
3. That the City Engineer of said City be, and he is hereby,
authorized and directed ~o carry out the provisions of this Resolu-
tion.
4. That the City Clerk be, and he is hereby, directed to
file with the Secretary of said District a certified copy of this
~esolution.

I hereby certify that the foregoing resolution was duly and
?egularly passed and adopted by the City Council of the City of
Saratoga, California, at a meeting thereof held on the 17th day of
September, 1958, by the following vote of the members thereof:
