F~OLUTION NO. !1~
A RESOLUTION ORDERING WORK
MT. EDEN ESTATES
ASSESSMENT DISTRICT NO. 1
RESOLVED, by the City Council of the City of Saratoga,
California, that
WHEREAS, said Council did on October 18, 1961, adopt its Reso-
lution of Intention No. 108 to order certain improvements to be
made in said City under and pursuant to the Improvement Act of 1911
and to issue bonds pursuant to the Improvement Bond Act of 1915,
referenceto which Resolution of Intention is hereby made for a par-
ticular description of the improvements to be made, the boundaries
of the assessment district, and the bonds to be issued;
WHEREAS, said Resolution of Intention has been duly published
twice in the Saratoga News, a newspaper of general circulation
printed and published in said City, and notices of the passage of
said Resolution of Intention, headed "Notice of improvemen~ and of
the time and place of the hearing as fixed by said Resolution of
Intention, when and where all persons interested having any objec-
tions to the proposed improvements or against the district to be
assessed for the costs and expenses thereof~ or against the grades
at which said work shall be done, may appear before said Council an~
show cause why said proposed improvements should not be carried
in accordance with said Resolution of Intention, were duly posted
within the time and in the manner provided in said Act and as
directed by said Resolution of Intention, and notices of the adop-
tion of said Resolution were duly mailed, postage prepaid, to all
persons specified in the time, form and manner provided by law~ as
appears from the affidavits of publication, posting and mailing on
file in the office of the City Clerk;
WHEREAS, at the time and place fixed for said hearing no
protests or objections were made or presented to the proposed
improvements, or to the district to be assessed, or to the grades
at which said work was to be done, or to the bonds to be issued to
pay the costs and expenses thereof, or to the Engineer's estimate
of the costs and expenses thereof, and all persons interested desir-
ing to be heardwere given an opportunity to be heard,~and all
matters and things pertaining to said proposed improvements were
duly heard and considered by said Council.
NOW, THE~RE~ORE, said Council does hereby FIND, DETERMINE and
ORDER, as follows:
1. That the plans and specifications for said improvements
under said Resolution of Intention be, and they are hereby, finally
adopted and approved as the plans and specifications to which said
work and improvements shall be done as called for in said Resolutior
of Intention.
2. That the Engineer's estimate of the itemized and total
costs and expenses for said improvements under said Resolution of
Intention be, and it is finally adopted and approved as the
Engineer's total and detailed estimate of the costs and expenses of
said improvements.
3. That the public interest and convenience require and said
~ouncil does hereby order the improvements to be done as described
.n and in accordance with said Resolution of Intention on file in
the office of the City Clerk of said City, reference to which is
hereby made for a more particular description of said improvements
and also for further particulars, pursuant to the provisions of the
~mprovement Act of 1911, such work to be done and improvements to
De made under the direction of the Engineer of Work and subject to
the approval of the Director of Public Works of said City.
4. Said contemplated work and improvements, in the opinion of
said Council, are of more than local or ordinary public benefit, and
~aid Council does make the expense of said work and improvements
~hsrgeable upon a district, which district said Council declares to
be the district benefited by said work and improvements and to be
assessed to pay the costs and expenses thereof, which said assess-
ment district and the exterior boundaries thereof are as described
in said Resolution of Intention on file in the office of the City
Clerk.
5. Said Council further declares that all public streets and
highways and other public property within said assessment district,
in use in the performance of a public function as such, shall be
omitted from the assessment hereafter to be made tocover the costs
and expenses of said improvements.
I hereby certify that the foregoing is a full, true and correcl
copy of a resolution duly passed and adopted by the City Council of
the City of Saratoga, California, at a meeting thereof held on the
15th day of November, 1961, by the following vote of the members
thereof:

Langwill, Hartman
