EESOLUTION ONAPPEALFROM PLANNING COI~4ISSION DECISION
WHEREAS, the City of Saratoga Planning Commission has heretofore denied
the application of Tidewater Oil Company, for an architectural and site
control permit, which action has been appealed to the City Council in accord
with Ordinance No. 3A-11 of said city, and
WHEP3AS, the Council at the time of hearing on appeal determined by a
majority vote Of its members present that it would be more just and equitable
to have a hearing de novo on the same, a hearing de novo was thereupon ordered
held thereon in accord with Section 2.2 of Ordinance No. 3A-11, and the same
was continued to the 16th day of August, 1961, at Fruitvale School Auditorium,
Saratoga, California, at the hour of 8100 o'clock ?. M. of said day, at which
time said hearing de novo was held, and
WItEREAS the applicant has met the burden of proof required to support his
said application on said hearing de novo,
NOW, THEREFORE, BE IT RESOLVED that after careful consideration of all
evidence su~nitted in this matter, the application for the architectural and
site control permit be, a~d the same is hereby granted. .
BE IT FUSTHEa RESOLVED that the report of findings attached hereto be approved
and adopted as findings of this Council on appeal, and the City Clerk be and he
is hereby directed to notify the parties affected by this decision.
PASSED ANDADOPTED by the City Council of the City of Saratoga this
16th day of August, 1961, by the following vote:
AYES: Glennon, ])rake, LanEwill, Hartman
NOES: None

REPORT OF FINDINGS
The application for an Architectural and Site Control Permit
on behalf of Tidewater Oil C~any shows:
That the improvement and/or the use of the site ~
(will not be) unsightly, undesirable or obnoxious in
appearance to the extent that it will hinder the orderly
and harmonious development of the City; impair the desi-
rability of residence, investment or occupation; limit the
opportunity to obtain the optimum use and value of land
and improvements; impair the desirability of living con-
ditions in the area or adjoining areas and/or other wise
adversely affect the general prosperity and welfare.
