The City Council of the City Of Saratoga does hereby resolve
as follows:
~C.tion l: Pursuant to Part 3 of DiVision 9 of the Streets
and Hi2hvays Code of the State of California, and
p~rsuant to Resolution No. 146 heretofore passed and adopted
by. the City Council on the 17th day of April, 1963, hearin~
wee held on this Council's proposal to vacate and abandon the
herbtnafte~ re£erred to street, at the hour of 8:00 saclock P.tl.
of Said day at the Council Chambers at FruitVale School
order as herelaafter set forth,
Section 2: The City Council finds from the evidence submitted
that said hereinafter described street, as described
in the aforesaid resolution of intention, is unnecessary for
present or prospective street purposes and the City further finds
that at least ten (10) days prior to the aforesaid hearing said
proposed street was duly and reSularly posted with not tess than
three (3) copies of notices of said street vacation and of said
· hearing which notices mere not posted more that 300 ft. apart,
NOW, THEREFOlK, said Council makes the following order:
The City Council of the City of Saratoga hereby orders
and declares that that certain portion of the 50e street
known as Fifth Street, which portion of said street is shown and
delineated On that certain Record of Survey, recorded in Book 129
of Maps at PaSe 1, in the office of the CountF Recorder of the County
of Santa Clara, and which portion of said street runs from the
northerly line Of .Oak Street to a line parallel thereto and distan~
therefrom North ~6'31' West 106,45 ft~ be and the same is hereby
vacated and abandOned,save and except that there is retained (and
not abandoned) a 15' S~rip of said easement, limited h.owever
pedestrian and not vehicular traffic, along the centerline of said
portion of Fifth Street and being ~' ~r each side of said center-
line, which centerline is ire particularly described as fellova:
A L5 ft. strip of land the centerline of which runs
from a point of beginning on the Northeasterly line
of Oak Street distant 25 ft. on a bearing of S 42
59' W from the most southerly corner of Lot 7, Block 7,
Town of NeClXtysville to · point distant therefrom

The above and feteSsing resolution was passed and adopted by the
City Council of the City of Saratoga at a regular meeting held on the
15th day of May, 1963, by the following vote:
