RESOLUTION ANNEXING CERTAIN AREAS TO AZULE
LIGHTING DISTRICT PURSUANT TO STREET
LIGI~TING ACT ~)F 1919
ldHEREAS, in the inion of the City Council of the
City of Saratoga, the public interest and convenience requires
the furnishing of electric current for the illumination of
,a, street lighting system for the area described in Exhibit
A
' "hereof, and
WHEREAS, pursuant to this city's resolutions, Series
59, the city has heretofore created and there is presently
existing a It ;hting district created under and ,by virtue of
the Street Li~ting Act of 1919, and known as "Azule Lighting
District"', and
WHEREAS, the City Council of this City is of the opinion
that the ~z
prope~t described in Exhibit: "A' hereof should be
annexed to said ule Lighting District in order to furnish
said electric current, and
WHEREAS, the City Council has heretofore ordered the

with Streets & Highways Code ections
at the same time made a determination that the alternate procedure
for levyin~ and collectin~ assessments on an ad valorem basis
as set forth in Sections 18160 through 18169 of said Streets &
Highways Code be followed, and
WHEREAS, the aforesaid report has been repared and
presented to said City Council and considered gy it, and this
Council has heretofore passed and adopted Resolutions No. 164 and
164-A, reference to which resolutions is hereby specifically
made, and
WHEREAS, pursuant to said res?lutions, the 16th day of
October, 1963, at the hour of 8:00 o clock P.M. of said day, at
the Council Chambers of the City of Saratoga located at
Saratoga High School, Herriman Avenue and Highway #9, Saratoga,
California, was set as a time and place for hearing protests
in accord with said Street Lighting Act of 1919, and that prior
thereto a notice in accord with Streets & Highways Code Section
18071 was cons icuously posted along all streets in the Azule
Lighting Dist~ct and in the area to be annexed thereto, not

more than 300 feet apart and more than three in number eing
so posted, which posting was completed at least ten days prior
to October 16, 1963, and

~HEREAS at the aforesaid time and place, namely, at
the hour of 8:60 o'clock P.M., October 16, 1963, at the afore-
said Council Chambers, the Council heard, considered, and
passed on all protests to the creation of said proposed annexa-
tion to said Azule District, and to the improvements
proposed, and the that no written protests having
been filed,
and good cause appearing therefor,

Saratoga hereby resolves as follows:

Section 2: It is hereby ordered that the real pro erty

Lighting District, including the area of Azule Lighting
District Annexation No. 1, and all costs shall be paid
out of and charged against the '~zule Lighting District"~fund.

the Azule Lighting District Annexation No.
l, constitutes one single zone, and is not divided into
separate zones. It is hereby ordered that all c~the
costs and expenses o£ said improvement shall be paid by
special assessment taxes levied upon all of the lands,
exclusive of within the entire Azule
Lighting Distri Azule Lighting District
Annexation No. 1 'a~' shall be prorated over all of the
parcels of saidianain direct proportion to each' s
assessed valuation,. and none of any part of the estimated

be borne by said district.
A certified of this resolution and of
the of Azule Lighting District
Annexation No. 1 I filed with the Tax Assessor
of the County of Santa Clara and shall also be filed
with the State Board of Equalization ursuant to
Chapter 8, Part 1, Division 2 Title ~ of the Government
Code of the State of California. The Assessor of the
County of Santa Clara shall, in making up the citt's
assessment roll, desi~rmte the entire area of the

district, including the annexed area, under t e! sir~ e
district designation of Azule Lighting District.
The above and foregoing resolution was duly and regularly
introduced and passed and adopted by the Cttl Council of the
City of Saratoga at a reEular meeting held on the 16th day of
October, 1963, by the following vote:
