RESOLUTION N0. 209
A RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS
PURSUANT TO SPECIAL ASSESSMENT AND ASSESSMENT BOND
ACTS FOR THE ACQUISITION AND CONSTRUCTION OF
IM3R0~S WITHOUT PROC~INGS UNDER DIVISION 4
OF THE STREETS AND HIGHWAYS CODE
SARATOGA AND COX AVENUES STORM DRAIN PROJECT
RESOLVED, by the City Council of the City of Saratoga,
California, that
WHEREAS, all of the owners of more than 60% in area of the
property subject to assessment therefor have signed and filed with
the City Clerk of this City a written petition for improvements
pursuant to special assessment and assessment bond acts, and fop
assessing the costs thereof bpon the properties benefited by said
acquisitions and improvements, and waiving proceedings under
Division 4 of the Streets and Highways Code, for the following
acquisitions and improvements:
The construction of reinforced concrete storm drain pipe~
mar~oles, catch basins and appurtenances from a point in
McFarland Avenue easterly in easements to be acquired
herein, thence northerly to a point in Cox Avenue, thence
in Cox Avenue to Quito Road, together with similar facili-
ties in Cox Avenue from the point hereinabove mentioned
westerly about 750 feet, together with the acquisition of
necessary rights of way and easements and the construction
of all work auxiliary to any of the above and necessary
to complete the mme.
WHEREAS, the City will contribute to the project all amounts
heretofore collected as storm drainage fees from properties to be
assessed, and the balance of the cost of said acquisitions and
improvements shall be assessed against the property within the
boundaries of the district benefited thereby, which boundaries are
described as the exterior boundaries of the composite and consoli-
dated area of the parcels of property set forth on the map thereof,
entitled "Preliminary Storm Drain Layout, Storm Drain for Cox
Avenue, City of Saratoga, California" on file in the office of the
City Clerk, which indicates by a boundary line the extent of the
territory included in the proposed district and which shall govern
for all details as to the extent of the assessment district;
WHEREAS, the public interest and convenience will be served by
the taking of said proceedings;
NOW, THEREFORE, IT IS HEREBY YOUND, DETERMINED and OEDERED~
that all of the owners of more than sixty per cent (60~) in area
of the property subject to assessment for said improvements who
appear to be such on the Assessor's roll on the day that said
petition was filed, or, in the case of transfers of land or parts
thereof subsequent to the date upon which the last Assessor's roll
was prepared, appear to be such on the recordsinthe County
Assessor's office which the County Assessor will use to prepare
next ensuing Assessor's roll, have signed and filed with the City
Clerk a written petition for improvements pursuant to appropriate
special assessment and assessment bond acts, without further com-
pliance with the provisions of Division 4 of the Streets and
Highways Code.
IT IS FURTHER FOUN~, DETERMINED and ORDERED, that said pro-
ceedings shall be had pursuant to the Municipal Improvement Act of
19t3, and the bonds upon the unpaid assessments thereof shall be
issued pursuant to the Improvement Bond Act of 1915o
IT iS tFdRTHER FOUND, DETERMINED and ORDERED, that the provi-
sions of Division 4 of the Streets and Highvmys Code be, and they
are hereby, dispensed with°
I hereby certify that the foregoing is a full, true and
correct copy of Resolution duly passed and adopted by the City
Council of the City of Saratoga, California, at a meeting thereof
held on the ~th day of November , 196 4_~ by the following
