A RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS
PURSUA~ T0 .SPECIAL ASSESSMENT AND ASSESSMENT
BOND ACTS FOR ~ ACQUISITION. AND CONSTRUCTION
OF IMPRO~TS WITHOUT PROCEEDINGS UNDER
DIVISiON "~ 0F, THE,STRUTS ~ HIGHWAYS CODE
COX AVENUE SANITARY SEWERAGE PROJECT
RESOLVED, by the City Council of the City of Saratoga,
California, that
WHEREAS, all of the owners of more than 60% in area of
the property subject to assessment therefor have signed and filed
with the City Clerk of this City a written petition for improve-
ments pursuant to special assessment and assessment bond acts,
and for assessing the costs thereof upon the properties benefited
by said acquisitions and improvements, and waiving proceedings
under Division 4 of the Streets and Highways Code, for the follow-
ing acquisitions and. improvements:
The construction of sanitary sewer mains, wye branches,
laterals, manholes and appurtenances in Cox Avenue from Quito
Road westerly approximately 2040 feet to provide sanitary sewerage
service, together with all work auxiliary to any of the above
and necessary to complete the same.
WHEREAS, County Sanitation District No. 4 of Santa Clara
County will contribute to the project that portion of the cost
thereof, including expenses incidental thereto, from Paseo Presada
easterly to Quito Road, and the balance of the cost of said ac-
quisitions and improvements shall be assessed against the propertie
of the parties petitioning therefor and benefited thereby, the
boundaries of which properties are described as the exterior
boundaries of the composite and consolidated area of the parcels
of property set forth on the map thereof, on file in the office
of the City Clerk, which indicates by a boundary line the extent
of the territory included in the proposed district and which shall
govern for all details as to the extent of the assessment district~
WHEREAS~ the public interest and convenience will be served
by the taking of said proceedings;
NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED and ORDERED,
that all of the owners of more than sixty per cent (60%) in area
of the property subject to assessment for said improvements who
appear to be such on the Assessor's roll on the day that said
petition was filed, or, in the case of transfers of land or parts
thereof subsequent to the date upon which the last Assessor's roll
was prepared, appear to be such on the records in the County
Assessor's office which the County Assessor will use to prepare
the next ensuing Assessor's roll, have signed and filed with the
City Clerk a written petition for improvements pursuant to
appropriate special assessment and assessment bond acts, without
further compliance with the provisions of Division 4 of the Streets
and Highways Code.
IT IS FURTHER FOUND, DETERMINED and 0RDERED~ that said pro-
ceedings shall be had pursuant to the Municipal Improvement Act of
1913, and the bonds upon the unpaid assessments thereof shall be
issued pursuant to the Improvement Bond Act of 1915, and that said
proceedings shall be incorporated into and made a part of the
Saratoga and Cox Avenue Storm Drain Project.
IT IS FURTHER FOUND, DETERMINED and ORDERED, that the
provisions of Division 4 of the Streets and Highways Code be~ and
they are hereby, dispensed with.

I hereby certify that the foregoing is a full, true and
correct copy of Resolution duly passed and adopted by the City
Council of the City of Saratoga, California, at a meeting thereof
