HomeMy WebLinkAboutCity Council Resolution 14-UP-103-1 · RESOLUTION NO, 14-UP-103-1 RESOLUTION ON APPEAL FROM PLANNING CCMMISSION DECISION Novo Hearing WHEREAS, the City of Saratoga Planning C0rmuission has heretofore denied the application of Manuel Lozano for a Use Permits which action has been appealed to the City Council in accord with Ordinance NS-3 of said City, and WHEREAS, the Council at the time of hearin. g on appeal determined by a majority vote of its members present that it would be more just and equit- able to have a hearing de novo on the same, a hearing de novo was thereupon ordered held thereon in accord with Section 16,8 of Ordinance NS-3, and the same was continued to the 15th day of June, 1966, at the City Council Chambers, 13777 Fruitvale Avenue, Saratoga, California, at the hour of 8:00 o'clock P, M, of said day, at which time said hearing de novo was held, and WHEREAS, the Applicant has met'the burden of proof required to support his application on said hearing de novo, NOW, THEREFORE, BE IT RESOLVED that after careful consideration of all evidence submitted in this matters the application for the Use Permit be, and the same is hereby granted subject to the following conditions: 1, Building Si~e Approval 2, Design Keview Approval, including adequate access and trafftc circulation pattern. 3, Comply with requirements of County Sanitation District No,'4 as to disposal of waste water. BE IT FURTHER RESOLVED that the report of findings attached hereto be approved and adopted as findings of this Council on appeal, and the City Clerk be and he is hereby directed to notify the parties affected by this decision. PASSED AND ADOPTED by the ClOy Council of the City of Saratoga this 6th day of July, 1966, by the following vote.' AYES.'
