A RESOLUTION ACCEPTING PORTION OF WORK
SARATOGA AND COX AVENUES STORM DRAIN
AND SANITARY SEWERAGE PROJECT
RESOLVED, by the City Council of the City of Saratoga, California~ that
WHEREAS, pursuant to Resolution of Intention No. 211 adopted by this Council
on November 4, 1964, this Council awarded a contract to Leo F. Piazza for the
construction and installation of sanitary sewers described in said Resolution
of Intention;
WHEREAS, all underground installation of sanitary sewers and appurtenances
therein described has been or will be completed except for pavement replacement;
and
WHEREAS, the immediate connection of local residential structures to said
facilities is urgently necessary if the perpetuation of a serious health
condition is to be avoided;
NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND ORDERED, as follows:
1. That said work described above is hereby accepted by the City, and permits
to connect to said facilities may be issued by authorized representatives of
Sanitation District No. 4, of Santa Clara County subject to the conditions set
forth in this resolution.
2. Such partial acceptance is not to be construed by the Contractor or his
surety as a waiver of the obligation to repair any damage to underground work
which may be caused by pavement replacement or resetting of manholes.
3. Neither the Contractor nor his surety shall be held responsible for any
damage to said facilities which, in the opininn of the Director of Public Works,
are caused solely by such connection to said facilities.
4. Such partial acceptance shall in no way affect the schedule of payments
to the Contractor under the contract, and ten per cent (10%) of the amount of
labor and materials incorporated into the project shall continue to be withheld
until thirty-five (35) days after the completion and acceptance of the entire
project by the Director of Public Works and the City Council.
5. Such partial acceptance shall in no way affect the applicability of the
faithful performance bond and labor and material bond provided by the Contractor.
Said bonds will remain in effect until expressly released by the City.
6. This resolution shall become effective upon the filing with the City Council
by the Director of Public Works of his certificate that said work has been completed
to his satisfaction and upon execution of the consent and agreement to the terms
and conditions of this resolution by the Contractor and his surety below.
PASSED AND ADOPTED by the City Council of the City of Saratoga on the 5th
day of January, 1966, by the following vote:
