HomeMy WebLinkAboutCity Council Resolution 360 WJ~L:A:s 7/3/67 A RESOLUTION AMENDING RESOLUTION N0. 329 ENTITLED "A RESOLUTION OF INTENTION TO ACQUIRE AND CONSTRUCT IMPROVEMENTS" VILLAGE PARKING DISTRICT N0.1 RESOLVED, by the City Council of the. City of Saratoga, California, that Resolution No. 329 entitled "A Resolution of Intention to Acquire and Construct Improvements" adopted by this Council on May 4, 1966, be, and the same is hereby, amended in the following particulars: 1. That Section 7 of said Resolution'be amended to read aS followS: "(a) The acquisition of the following described parcels of property and the improvement thereof by clearing, grubbing, grading, removal of existing trees, shrubs and structures, and the construction therein of~ base, pavement, headerboards, curbs, gutters, striping, sidewalks, sur- face and subsurface storm drainage facilities where required, including mains, catch basins, inlets, manholes with manhole frames and covers, and Junction boxes, railings and stairways, where required, retaining walls, electrollers, electric services, where required, landscaping, irrigation system~ sanitary sewer mains, manholes with manhole frames and covers and cleanouts~ where required, together with all appurtenances to any of the above and necessary to complete same as off-street automobile parking facilities: All that certain real property, situate in the City of Saratoga, County of Santa Clara, State of California, and being portions of Blocks 3, 8 and 9 as shown on a certain ma~ entitled "Town of McCartyville" corded in Book "A" of Maps at page 3, Santa Clara County Records, more particularly described as follows: PARCEL 1 Beginning at a point in the Northeasterly line of Lot 1 in Block 8~ said point of beginning being North 47° 00' 00" West 190,16 feet distant from the most Easterly corner of said Lot 1, as said Lot is shown on the aforementioned map~ thence from the said point of beginning South 43° 00, 00" West 154o49 feet~ thence North 47° 00' 00" West 12.30 feet; thence South 43° O0~ O0" West 45.51 feet; thence South 47~ 00' 00" East 7o12 feet; thence North 76~ 16' 10" East 6~,76 feet to the Westerly line of Lot 1 in Block 9, as shown on the aforesaid map; thence along the last said Westerly line North 13~ 43~ 50" West 98.70 feet to the most Northerly corner of said Lot 1 in Block 9, said point also being on the Southwesterly line of Lot 4 in said Block 8; thence along the Said Southwesterly line of Lot 4 North 47° 00' 00" west 96.61 feet to the Westerly corner of said Lot 4; thence along the Northwesterly line of said Lot 4 North 4B~ 00~ 00" East 7.50 feet to a point on the Southwesterly line of that certain parcel of land described in the Deed to Andrew P. (c) The acquisition of sanitary sewer mains, manholes with manhole frames and covers and wyes in Fourth Street from Saratoga Creek southerly 140 feet, more or less, thence southwesterly 180 feet, more or lesso (d) The acquisition of capacity rights and right of service and use in sanitary sewerage collection, transmission, treatment, outfall and disposal facilities of County Sanitation District Noo'4 of Santa Clara County. (e) The acquisition of all lands and easements and the performing of all work auxiliary to any of the above and necessary to complete the Same° 2~ That Section 10 of said Eesolutlon be amended to read as follows~ 2 "10. Said contemplated acquisitions and improvements, in the opinion of said Council, are of more than local or obdinary public benefit, and the costs and expenses thereof are made chargeable upon an assessment dis- trict, the exterior boundaries of which district are the composite and consolidated area as more particularly shown on a map thereof entitled "City of Saratoga, Village Parking District Number 1, Assessment Diagram", on file in the office of the City 01erk, to which reference is hereby made for further particulars° Said map indicates by a boundary line the extent of the territory included in the proposed district and shall govern for all details as to the extent of the assessment district." 3. That Section 18 be added to said Resolution reading as follows: "18. A parking improvement and maintenance district will be formed for the purpose of paying the costs and expenses of acquiring, constructing, reconstructing, installing, extending, enlarging, repairing, improving, maintaining and operating off-street automobile parking facilities and landscaping, including the cost of necessary repairs, replacement, water, electrical current, care, supervision and any and all other items neces- sary for the proper maintenance and operation thereof, the exterior bound- aries of which shall be coterminous with the exterior boundaries of the assessment district above described, to be known as 'City of Saratoga Village Parking District Number 1 Maintenance District', pursuant to Sec- tion 10108 of the Streets and Highways Code, more particularly described as follows: All that certain real property, situate in the City of Saratoga, County of Santa Clara, State of California, and being portions of Blocks 3, 8 and 9 as shown on a certain map entitled '~Town of McOartysville' recorded in Book ,A, of Maps at Page ~3, Santa Clara County Records and portion of Quito Rancho,.more particularly described as follows: PARCEL 1 All of Block 8 and Lot 1 in Block 9 as shown on the above said map excepting therefrom the following described parcelt That portion of Lots 1, 2, 3 and 4 in Block 8 lying within the bound- aries of the lands conveyed to Andrew P. Hill, Jr., as described in the Deed recorded September 28, 1910 in Book 364 of Deeds at Page 68, Santa Clara County Records. PARCEL 2 All of Lots B through 6, inclusive, in Block 3 as shown on the afore- said map and portion of the Quito Ranch as described in the Deed of Trust recorded January 6, 1966 in Book 7238 of Official Records at Page Santa Clara County Records. 4. That Section 19 be added to said Resolution reading as followS: "19~+~ That the City Council of said City proposes te enter into an agreement with County Sanitation District No. ~ of Santa Clara County, which agreement will provide for the ownership by said Sanitation District of the sewer system to be installed by the City of Saratoga, and for the providing of service to the properties in said area by said Sanitation District in accordance with its rates, rules and regulations, and that said agreement shall become effective after proceedings have been taken for the levy.of the assessments and sale of bonds and ~unds are available to carry out its terms."
