A RE8OLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA DESIGNATING THE
CUPERTINO SANITARY DISTRICT AND COUNTY SANITATION DISTRICT Nf% 4 AS AUTHOR-
IZED AGENCIES IN THE MATTER OF PROVIDING SANITARY SEWERAGE COLLECTION AND
DISPOSAL FACILITIES WITHIN THE CORPORATE LIMITS OF THE CITY OF SARATOGA.
WHEREAS, the Cupertino Sanitary District is a duly constituted public agency
created under the Sanitary District Act of 1923 for the purpose of
providing sanitary sewers, and
WHERE~iS, County Sanitation District No. 4 is a duly constituted public agency
created under the County Sanitation District Act for the purpose of
providing sanitary sewers, and
WHEREAS, a Joint Report was prepared by the two Districts on October 31, 1958,
entitled, "Joint Report on determination of a Mutual Boundary between County Sanit-
ation District No. 4 and Cupertino Sanitary District within the City of Saratoga,"
which report was submitted to the ~lty oK Saratoga, and
WHEREAS, each of the two Districts have entered into separate agreements
with the Cities of San Jose and Santa Clara for sewage disposal and treatment for
their respective "Service Areas", which "Service Areas", have a cormnon boundary
basically the same as the"Mutual Boundary" referred to above, all as shown on
Exhibit "A", attached hereto, and
WHEREAS, the City of Saratoga lies entirely within the above two "Service
Areas", and
WHEREAS, the City of Saratoga Planning Commission refers all Tentative Maps
and various Site Approvals to the Cupertino Sanitary District in por~tions of the
City North-west of the above "Mutual Boundary", and to County Sanitation No. 4
in portions of the City Southeast of said boundary for peports on solutions to
all sewering problems, and
WHEREAS, the Santa Clara County Local Agency Formation Commissinn uses the
above two "Service Areas" as guides in permitting orderly District Annexations
of the respective Districts, and
WHEREAS, the City of Saratoga by an Agreement dated January 12, 1961 did
transfer all its right, title and interest in and to the sewerage system owned
by it and situated either within the boundaries of the former Saratoga Sanitary
or without the boundaries of the former Saratoga Sanitary District and within
the boundaries of City to County Sanitation District No. 4, and
WHEREAS, the City of Saratoga by an Agreement Dated June 14, 1962, authorized
County Sanitation District No. 4 to issue sewer permits and to inspect the install-
ation of laterals in portions of said District that lie within the corporate limits
of the City of Saratoga, and
WHEREAS, the City of Saratoga by an Agreement dated June 8, 1962, authorized
the Cupertino Sanitary District to issue sewer permits and to inspect the install-
ation of laterals in portions of said district that lie within the corporate limits
of the City of Saratoga, and
WHEREAS, each District has acknowledged and accepted the above authoriz-
ations and have been issuing permits and inspecting laterals as agents for the
City for many years, and
WHEREAS, each District has cooperated with the City in helping solve all
sewering problems within the City, for many years, and
WHEREAS, the City believes it to be to the best interests of its citizens
to supply sanitary sewer service through the Cupertino Sanitary District and
County Sanitation District No. 4 sewer systems whrough the respective "Service
Areas" shown on said Exhibit "A". , and
WHEREAS, all parties referred to herein are public agencies and are authorized
to contract with each other for the general welfare pursuant to the Joint Powers
Act, Government Code §6500 et. seq.,
NOW, THEREFORE BE IT RESOLVED that the City hereby appoints the Cupertino
Sanitary District and County Sanitation District No. 4 as its official agencies
for the purpose of providing sanitary sewers and service appurtenant thereto to
all the areas presently within or to be within the corporate City Limits, in
accordance with "Service Areas" shown on Exhibit "A", or as they may be subsequently
modified by mutual agreement of said Districts.
BE IT FURTHER RESOLVED that acceptance of this appointment constitutes agree-
ment by Cupertino Sanitary District and County Sanitary District No. 4 to comply
with and bound by the provisions of Section 13-19.1 of the Saratoga City Code
as to all existing and future installations within the corporate limits of City.
BE IT FURTHER RESOLVED that acceptance of this appointment constitutes agree-
ment by Cupertino Sanitary District and County Sanitation District No. 4 to make
every effort to preserve trees in excess of 6" diameter 2' above ground level
adjacent to sanitary sewer installations on private property and/or public
right of way and to confer with the city staff prior to removal of such trees.
BE IT FURTHER RESOVLED that a certified copy of this Resolution be mailed
forthwith to the Cupertino Sanitary District and County Sanitation District No. 4.
