RESOLUTION OF THE CITY COUNCIL OF TIlE CITY OF SARATOGA CALLING
A PUBLIC HEARING TO DETEDIINE gttETHER PUBLIC NECESSITY, HEALTH,
SAFETY, OR WELFARE REQUIRES THE FOEHATION OF AN UNDERGROUND UTILITY
DISTRICT ON ALLENDALE AVENUE BETWEEN FRUITVALE AVENUE AND PORTOS
DRIVE AND ON TIlE EAST SIDE OF FRUITVALE AVENUE BET~4EEN SARATOGA

BE IT RESOLVED by the Council of th~ City of Saratoga, as follows:
~4EREAS, Ordinance No. 38.20 establishes a procedure for the creation of
underground utility districts and requires as th~ initial step in such procedure
the holding of a public hearin8 to ascertain whether public necessitys health~
safety, or welfare requires the removal of poless overhead wires and associated
overhead structures and The underground installation of wires and facilities
for supplying electrice connunicatton, or similar or associated service in any
such districtJ and
~]tEREASs it has been reconnended that such underground utility dtstrfctj
hereinafter called Districts be formed on Allendale Avenue between Fruitvale
Avenue and Portos Drive and on The East side of Fruitvale Avenue between Saratoga
Avenue and San Marcos Road.
NOW, THEREFORE, BE it Resolved as follows:
1. NOTICE IS HEREBY GIVEN that a public hearing will be held by the
Council of the City of Saratoga on ~ay 1, 1968, at the hour of 8:00 o'clock,
P. H. in the Council Chambers of =he City Hall, 13777 Fruitvale Avenues Saratoga~
Californias to ascertain whether the public necessitys health, safety or welfare
requires the removal of poles, overhead wires and associated overhead structures
and the underground installation of wires and facilities for supplytn~ electric,
communications or similar assoicated service in the District hereinabove
described,
2. At such hearing all persons interested shall be given an opportunity to
be heard. Said hearing way be continued from time to time as may be deterrained
by the City Council.
3. The City Clerk shall notify all affected property owners as shown on the
last equalized assessment roll and utilities concerned at least ten (10) days
prior to the date ~hereof,
4. The area proposed to be included in the District is shown upon that
certain map entitled Saratoga Underground Utility District ~1, dated April 3,
1968, which is on file in the office of the City Clerk of the City of Saratoga.
Adopted by the Council of the City of Saratoga on the 3rd day of April,
1968, by the following vote:
AYES: Councilmen Glennons Tyler, Hartsnan, Burry, Robbins
