RESOLUTION NO. ~4~
A RESOLUTION OF AWARD OF CONTRACT
VERDE VISTA IMPROVEMENT PROJECT
RESOLVED, by the City Council of the City Of Saratoga,
California, that
WHEREAS, on the 5th day of August, 1968, the City Clerk of
the City of Saratoga publicly opened, examined and declared all
sealed proposals or bids for the work to be done and improvements
to be made as described and specified in the plans and specifica-
tions entitled, respectively, "City of Saratoga, County of Santa
Clara, California, Plans and Profiles for the Improvement of
Verde Vista Improvement Project" and "City of Saratoga, California,
Contract Documents and Specifications for Verde Vista Improvement
Project" approved by this Council on July 3, 1968, to which re-
ference is hereby made for a description of said work and improve-
ments and materials, supplies and equipment to be supplied there-
for;
WHEREAS, it has been determined that the lowest responsible
bid for said project is R. J. Zipse Paving Company, Inc., which
submitted a bid in the total amount of $48,742.52;
WHEREAS, R. J. Zipse Paving Company, Inc., has since indi-
cated to this Council, by letter dated August 6, 1968, that its
bid contained a patent error in that the bid for Ytem No. 2 for
roadway excavation and grading showed a price of fifty cents
(50~) per square foot, while the calculation shows on its face
that the intended price was five cents (5~) per square foot;
WHEREAS, R. J. Zipse Paving Company, Inc., has submitted its
work sheets in relation thereto evidencing such patent error;
WHEREAS, said contractor has requested that the Council allow
the correction of said error and that the proposal as corrected
be considered by the Council in awarding the contract; and
WHEREAS, if said correction is made, the bid of said R. J.
Zipse Paving Company, Inc. will be in the total amount of $48,742.52,
which said amount is the exact amount submitted by said R. J. Zipse
Paving Company, Inc.;
NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND ORDERED,
as follows:
1. Ro J. Zipse Paving Company, Inc., made an honest mistake
in its original bid such as any careful businessman may make and
that it was not guilty of gross or culpable negligence.
2. The City did not participate in the mistake, yet, since
the contractor has advised the City, in writing, that its bid
contained a patent error, the City has good reason to believe
that one has been made.
3. The acceptance of the corrected R. J. Zipse Paving Company,
Inc. bid will result in the performance of the work at the lowest
available price, and to readvertise for bids would not result in
competitive bidding which would result in a lower cost to the
City and would be a mere expensive formality.
4. All purposes of the requirement ~f advertising for bids,
namely, invitation of competition, the guarding against favoritism,
improvidence, fraud and corruption, in the award of municipal
contracts and securing the best work and supplies at the lowest
price practicable, have been attained, and an award based on the
corrected R. J. Zipse Paving Company, Inc., bid will be for the
benefit of property owners and taxpayers and not for the benefit
or enrichment of bidders and will be accomplished with sole re-
ference to the public interest.
5. The City Council hereby rejects all of said proposals
or bids except that hereinafter mentioned and hereby awards the
contract for doing the work and improvements and furnishing the
materials, supplies and equipment necessary therefor to the lowest
responsible bidder, to wit:
R. J. ZIPSE PAVING
COMPANY, INC.
at the unit prices named in its bid as corrected by letter from
said contractor dated August 6, 1968.
6. That the Mayor of said City is hereby authorized to make
and enter into a written contract with said successful bidder,
and to receive and approve all bonds in connection therewith,
and the City Clerk of said City is hereby directed to attest his
signature and affix thereto the official seal of said City.
I hereby certify that the foregoing is a full, true and
correct copy of Resolu$ion duly passed and adopted by the City
Council of the City of Saratoga, California, at a meeting thereof
