HomeMy WebLinkAboutCity Council Resolution 479 RESOLUTION NO. 479 ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 3 BE IT RESOLVED by the Council of the City of Saratoga as foillows: I~EREAS, by Resolution No. 399-4, a public hearing was called for Wednesday, April 16, 1969, at the hour of 8:00 P. M, in the Council Chambers, at 13777 Fruitvale Avenue, Saratoga, California, to ascertain whether the public necessity, health, safety, or welfare requires the removal of poles, overhead wires and facilities for supplying electric, communication, or similar or associated service on the Civic Center property on Fruitvale Avenue, between ~ildcat Creek, Fruitvale Avenue, and the Redwood School property, as shown on the }~aD of Saratoga Underground Utility District No. 3 dated April 2, 1969; and WHEREAS, Notice of such hearing has been given to all affected property owners as sho~n on the last equalized assessment roll and utilities concerned in the manner and for the time required by law; and WttEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard, NOW, ~IEREFORE, be it resolved that the Council of the City of Saratoga hereby finds and determines that the public necessity, health, safety and welfare require the removal of poles, overhead wires and 'associated structures, and the under8round installation of wires and facilities for supplying electric, communi- cation, or similar or associated service, on the Civic Center property on Fruitvale Avenue, between Wildcat Creek, Fruitvale Avenue, and the Redwood School property as shown on the ~p of Saratoga Underground Utility District Moo B, dated April 2, 1969; and further, but without limiting the foregoing; that such undergrounding is in the public interest because it x~ill eliminate overhead wires and appurtenances in an area of unusual scenic interest to the general public; and pursuant to Chapter 15 of the Saratoga City Code, such described area is hereby established as Saratoga Underground Utility District No. 3. RESOLVED, FUR~!ER, that the follo~ing shall not be exceptions in said I~der- ground Utility District No. 3: Those facilities ~ore particularly described in subsection~ (d), and (f), of Section 15-6, Chapter 15 of the Saratoga City Code. Subsections as follows: (d) Poles, overhead wires and associated overhead structures used for the transmission of electric energy at nominal voltages in excess of 34,500 volts. (f) Antennae, associated equipment and supporting structures, used by a utility for furnishing communication services. RESOLVED, 'FURT~IER, that all poles, overhead wires and associated overhead structures shall be removed and underground installations made in said underground utility district within the following ti-es: a. Underground installation by utility companies and proDerty owners and recommeetions not later than Movember 1, 1969; b. Removal of poles, overhead wires and other associated overhea~ structures not later than November 30, 1969, except those from the first pole beyond the pole immediately behind the city office which may remain attached until perminent location of the city corporation yard. RESOLVED, FURTHER, that the City Clerk, within ten (10) days after the adoption of this resolution, shall mail a copy hereof and a coDy of Ordinance 38.20 to affected property owners as such a~e sho~al on the last e~ualized roll and to the affected utilities, Adopted this 16th day of April ~-_- ~ -_ ..... , 1969, by the City Council of the City of Saratoga by the following vote: AYES: Councilmen Tyler, Dwyer, Robbins, Smith, Sanders NOES: None AB SENT: None ' "" ~YOR ATTEST: /' · CITY CLEPF. -2-
