RESOLUTION ORDERING VACATION AND
ABANDONMENT OF PORTION OF SEAGULL WAY
The City Council of the City of Saratoga does hereby resolve
as follows:
Section 1: Pursuant to Part 3 of Division 9 of the Streets
and Highways Code of the State of California, and
pursuant to Resolution No. 497 heretofore passed and adopted
by the City Council on the 17th day of September, 1969, hearing
was held on this Council's proposal to vacate and abandon the
hereinafter referred to street, at the hour of 8:00 o'clock
of said day at the Council Chambers at 13777 Fruitvale Avenue,
Saratoga, California, and the City Council makes the following
finding, conclusions and order as hereinafter set forth.
Section 2: The City Council finds from the evidence submitted
that said hereinafter described street, as described
in the aforesaid resolution of intention, is unnecessary for
present or prospective street purposes and the City further finds
that at least ten (10) days prior to the aforesaid hearing said
proposed street was duly and regularly posted with not less than
three (3) copies of notices of said street vacation and of s~id
hearing which notices were not posted more than 300 ft. apart,
NOW, THEREFORE, said Council makes the following order:
Section 3: The City Council of the City of Saratoga hereby orders
and declares that that certain portion of Seagull Way,
more particularly described as follows:
Beginning at the most southwesterly corner of lot 11
as shown on that certain Map entitled "Tract No. 184
Azule Homesite" recorded June 23, 1941, in Book 7 of
Maps at Page 8, Santa Clara County Records, thence
along the prolongation of the southeasterly line
South 88° 00~ 00" West 22.06 feet; thence North 3° 11' 10"
East 34.44 feet; thence along a tangent curve to the
right having a radius of 20.00 feet, a central angle
of 84° 48' 50" and a~ arc length of 29/60 feet to a
point of tangency with the southeasterly line of
Seagull Avenue; thence North 88° 00' 00" East 20.44
feet to a point of cusp; thence along a curve concave
to the southeast having a radius of 20.00 feet, a central
angle of 87D 32' O0" and an arc length of 30.55 feet;
thence continuing along the westerly line of Lot 11
South 0c 28' 00" West 33.39 feet to the point of beginning.
be and the same is hereby vacated and abandoned, save and except
that there is retained (and not abandoned) a Public Service Easement
on the above described property.
The above and foregoing resolution was passed and adopted by the
City Council of the City of Saratoga at a regular meeting held on the
~Sth day of Septemb~ ..., 1969, by the following vote:
