RESOLVED, by the City Council of the City of Saratoga, Santa Clara County, California, that WHEREAS, said Council did on the 6th day of January, 1971, adopt its resolution ordering Creegan and D'Angelo, Engineer of Work, to make and file with said Council an amended assessment of all parcels of prop- erty the former assessments on which, under Resolution of Intention No. 177 adopted by said Council on February 5, 1964, are designated upon the original assessment and diagram and confirmed by said Council on June 24, 1965, and recorded in the office of the Superintendent of Streets, as Diagram and Assessment Nos. 6A and 7; WHEREAS, said Engineer of Work did, on the 6th day of January, 1971, pursuant to resolution ordering same, file with the City Clerk an amended assessment and diagram; WHEREAS, said Council fixed Wednesday, the 3rd day of February, 1971, as the time for hearing said amended assessment and caused notice of said hearing to be published twice in the Saratoga News, the first publication being fifteen (15) days before said heaping, as appears from the affidavit on file in the office of the City Clerk of said City; and WHEREAS, at the time and place fixed for said hearing, no pro- tests or objections were made or presented to the proposed amended assessment, and all matters and things pertaining to said amended assessment were duly heard and considered by said Council~ NOW, THEREFORE~ IT IS ORDERED, that said amended assessment and diagram filed with the City Clerk of said City pursuant to resolution ordering same, be, and the same is hereby, ratified, approved and confirmed. IT IS FURTHER ORDERED, that the City Clerk of said City shall deliver said amended assessment to the Superintendent of Streets, together with a certified copy of this resolution thereto attached, and said Superintendent of Streets shall thereupon record such amended assessment in his office with a certificate at the end thereof by the City Clerk of said City that it is the amended assessment approved by the said Council on February B, 1971. The Superintendent of Streets shall note opposite the several assessments in said original Diagram and Assessment that it has been displaced by said amended assessment, giving its date, and shall credit upon such amended assessments all payments theretofore made upon such original assessment. When said amended assessment has been recorded, the Superintendeat of Streets shall cause the original assessment in- volved to be cancelled. The amount origlnal ly assessed thereon and the several portions thereo~: assessed upon on the divided parts of said lots or parcels and the amounts of said partions and the interest thereon to be collected thereon as are all as more particularly hereln after set forth. Each of these parcels were assigned a share of the assessment from its parent parcel, dependent upon its frontage along either Saratoga Avenue or Cox Avenue, using the same methad of determining the assessmentt as would have been used~ had these parcels been exlstlng at the time of the original assessment spread.
