RESOLUTION FINDING NO MA3ORITY PROTEST AND CALLING AND GIVING
NOTICE OF A SPECIAL ELECTION TO BE HELD IN CERTAIN INHABITED
TERRITORY DESIGNATED AS "WESTBROOK 1972-2" AND AT WHICH ELECTION
THE PROPOSITION OF ANNEXING SAID TERRITORY TO THE CITY OF SARATOGA
WILL BE SUBMITTED TO THE ELECTORS RESIDING WITHIN SAID TERRITORY
The City Council of the City of Saratoga hereby resolves as follows:
WHEREAS, the City of Saratoga has heretofore received a petition signed
by not less than one-fourth of the qualified electors residing within the terri-
tory hereinafter described, as shown by the County registration of voters, and
which said petition contains a description of the territory proposed to be annexed
and asks that said territory be annexed to the City of Saratoga, and
WHEREAS, thereafter the City Council passed its Resolution of Intention
pursuant to Section 35116 of the Government Code of the State of California, and
therein, the 18th day of October, 1972, at the hour of 8:00 o'clock P.M. was
fixed as a time and place where written protests and objections might be made and
heard to said annexation, no protests were made to said annexation, and said Council
further finding that all jurisdictional and procedural steps required to be made
or done from the commencement of said annexation proceedings up to the present
time have been duly and regularly taken and done,
NOW, THEREFORE, this Council hereby finds and orders as follows:
(1) Pursuant to Government Code Section 35121.1 of the State
of California, this Council hereby finds and declares that a majority protest has
not been made to the within annexation proceedings;
(2) It is hereby ordered that a special election in said territory
is hereby called to be held on December 12, 1972, in the territory proposed to be
annexed, which territory shall be and is hereby designated as "WESTBROOK
ANNEXATION 1972-2", the boundaries of which territory and the proposition to be
submitted to the electors residing therein being set forth hereafter in the "Notice
of Election".
The City Clerk is hereby ordered to publish in the Los Gates Times Observer,
a newspaper of general circulation printed and published outside of the City of
Saratoga but within the County of Santa Clara, at least once a week for four weeks
prior to said election, the following notice of election, to-wit:
NOTICE OF ELECTION
NOTICE IS HEREBY GIVEN that on December 12, 1972, an election will be
held in the hereinafter described territory at which election the proposition to
be submitted to the electors shall be as follows:
"Shall Westbrook Annexation 1972-2 be annexed to and incor-
porated within the City of Saratoga, the property therein to
be subject to taxation after such annexation e.qually with all
YES
other property within said City of Saratoga?"
NO
That opposite the aforesaid words there shall be printed on the ballot
the words "YES" and "NO" with a voting square to the right of each. That if an
Elector stamps a cross in the voting square after the words "YES", his vote shall
be counted for the annexation, and if he stamps a cross in the voting square after
the work "NO", his vote shall be counted against the annexation.
The territory so proposed to be annexed to the City of Saratoga is located
in the County of Santa Clara, State of California, and is more particularly
described as follows:

All that certain real property situate in the County of
Santa Clara, State of Califon~ia, more particularly described
as follows:
BEGINNING at a point in the southerly boundary of Prospect
Road, said southerly boundary being the city limit line of the
City of Saratoga, a municipal corpom tion, and the prolognation
of the centerline of Johnson Road, as said roads are shown on
the map of Tract 1222 and recorded in Book 46 of Maps, Page 6
and 7, Santa Clara County Records; THENCE from said Point of
Beginning, leaving City of Saratoga city limit line, north 5°
09' 39" east 20.00 feet to a brass plug in the centerline of
Prospect Road; THENCE north 5° 09' 39" east 1123.31 feet along
the centerline'of the above mentioned Johnson Road to a RR
spike; THENCE south 86°,57' 50" east 1140.54 .feet to a granite
monument at the northeasterly corner of the aforementioned Tract
1222, said point also being the most northerly corner of Tract
1179, Recorded in Book 44 of Maps, Page 28 and 29, Santa Clara
County Records; THENCE along the northerly boundary of Tract 1179
south 61° 20' 22" east 587.42 feet to a point on the centerlin~
of Saratoga Creek as shown on the map of the aforementioned Tract
1179, said point being south 61° 20' 22" east 27.04 feet from an
iron pipe; THENCE along the Centerline of said Saratoga Creek the
following bearings and distances:
SOUTH 35° 33' 23" west 156.53 feet;
THENCE south 53° 16' 08" west 188.10 feet;
THENCE south 31° 16' 08" west 175.56 feet;
THENCE south 0° 28' 52" east 264.00 feet;
THENCE south 41° 01' 08" west 287.10 feet to a point in the center-
line of Prospect Road, said point also being on the City of Saratoga
city limit lines; thence along said city limit line south 8° 26'
west 20 feet to the southerly boundary of Prospect Road as sho~ on
said Tracts No's 1222 and 1179; thence along last mentioned south-
erly line being in the city limits line of Saratoga, north 81° 34'
west 80.52' and north 85° 41' west 1172.34' to the point of begin-
ning.
There shall be one voting precinct hereby designated as Precinct No. 1,
which Precinct shall comprise all of the aforesaid territory known and contained in
said "Westbrook Annexation 1972-2", and the place at which polls will be open in
said Precinct is as follows: Richardson Residence, 18940 Sunnybrook Av.,
Saratoga, California
and the officers for said election therein are as follows:
Judges: Barbara N. Thurner, 18941 Sunnybrook Ave., Saratoga
Charlotte M. Roemisch, 12051 Brookglan Drive, Saratoga
Betty Wilson, 18921 Sunnybrook Ave., Saratoga
Inspector: Jean M. Richardson, 18940 Sunnybrook Ave., Saratoga
That on said day of election, the polls will be open from 7:00 o'clock A.M.
to 7:00 o'clock P.M. of said day at which time the polls will be closed.
That the foregoing Notice of Election shall be published by the
City Clerk according to law and he shall conduct said election in said territory
in the manner provided by law.
PASSED AND ADOPTED by the City Council of the City of Saratoga this
18th day of October , 19 72 , by the following vote:
AYES: Councilmen Dwyer, Diridon and Smith
NOES: None
ABSENT: Councilmen Kraus and Bridges
