A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SARATOGA ENDORSING
AB 920 AND AB 921
WHEREAS, the current demand for funding for much needed park and open space
lands is well-documented, and there is no source of monies for local government
projects beyond the already over-burdened property tax; and
WHEREAS, AB 920 would provide such funds to local government on a regular
basis, allowing for long-term planning through orderly acquisition programs by means
of a 1% real estate transfer tax which does not apply to owner-occupied residences;
and
WHEREAS, cities now have the power to condemn lands for parks, but not for
open space uses, while, at the same time, they are required to plan and zone for
open space; and
WHEREAS, AB 921 authorizes cities to condemn lands for open space uses when
such lands are designated as open space on local master plans; and
WHEREAS, both AB 920 and AB 921 would give local government the power and
wherewithal to fulfill state-mandated planning requirements,
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Saratoga
does hereby go on record as heartily endorsing AB 920 and AB 921 and urges the
Governor and the Legislature of the State of California to enact this legislation as
rapidly as possible.
