RESOLUTION ABANDONING PORTION OF
PUBLIC UTILITY EASEMENT
WHEREAS, it appearing that the hereinafter described portion of a
public utility easement is no longer necessary for the purpose intended
and has not been in use for the past twelve (12) months, and the City
Council being so advised and good cause appearing,
NOW, THEREFORE, BE IT RESOLVED that the hereinafter described portion
of easement be and the same is hereby abandoned, save and except the City
retains a wire clearance easement under said four-foot section abandoned,
the within abandonment shall not include wire clearance purposes. Said
portion so abandoned as above referred to is described as follows:
The southerely four (4) feet of that certain ten (10)
foot wide public utility easement on Lot 11 as aaid
easement and lot are shown on that certain map entitled
'Tract 1404, Rio Villa Terrance", which map was filed for
record in Book 57 of Maps, at Page 17, Santa Clara County
Official Records.
The above and foregoing resolution was regularly introduced and there-
after passed and adopted on the 18th day of July, 1973, by the following
vote at a regular Council Meeting:
AYES: Councilmen Kraus, Dwyer, Diridon and Bridges
NOES: None
ABSENT: Councilman Smith ~
