A RESOLUTION DETSRrnNII;a TO mmERTAKE PROCEEDINGS PURSUANT
TO SPECIAL ASSESS:',ŒI;'l' A1:D ASSESSNENT BOND ACTS FOR THE
ACQUISITION AND CONSTRUCTION OF IMPROVEMENTS WITHOUT
PROCEEDINGS UNDER DIVISION ~ OF THE STREETS AND HIGHWAYS CODE
VILLAGE PARKING DISTRICT NO.2
RESOLVED, by the City Council of the City of Saratogat
California. that
WHEREAS, all of the owners of more than 60% in area of the prop-
erty subject to assessment therefor have signed and filed with the
City Clerk of this City a written petition for undertaking pro-
ceedings pursuant to special assessment and assessment bond acts,
and to assess the costs thereof upon the properties benefited by
said acquisitions and improvements, and waiving proceedings under
Division q of the Streets and Highways Code, for following acqui-
sition and construction of improvements:
(a) The acquisition of the property more particularly described
in Exhibit "A" her-eto attached and by reference incorporated herein
and the improvement thereof by clearing, grubbing, grading, re-
moval of existing trees, shrubs and structures, where required,
and theçonstruct1021 therein of base, pavement, wearinK-_~-.YJ'façe1
curbs. ~utters. surface and subsurface storm drainage facili-
ties, where required, lighting facilities, striping, driveway
approaches and landscaping, including irrigation facilities to-
gether with all work auxiliary to any of the above and necessary to
complete the same as off-street automobile parking facilities.
(b) The improvement of the southerly side of Big Basin WaYt
Fourth Street and Fifth Street within the limits of the proposed
assessment district by the construction and/or reconstruction, as
required to meet the standards of the City of Saratoga, of curb
cuts, driveways, sidewalks, curbs, gutters, pavement, surface a~d
subsurface storm drainage facilities and underground electrical
transmission and distribution facilit~es and communication faci'i-
ties together with appurtenances to any of the above.
(c) The acquisition of all lands and easements and the per-
forming of all work auxiliary to any of the above and necessary to
complete the same.
WHEREAS, the costs and expenses of said contemplated acquisi-
tions and improvements are to be chargeable upon an assessment
distriatt the exterior boundaries of which are the coterminous

exterior boundaries of the composite and consolidated area shown ,
on the map thereof and on file in the office of the City Clerk to
which reference is hereby made for further particulars;
WHEREAS, the public interest and convenience will be served by
the taking of said proceedings;
NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED and ORDERED
that all of the owners of more than 60% in area of the property
subject to assessment for said proposed acquisitions and improve-
ments'have filed with the City Clerk of this City a written pe-
tition for the acquisition and construction of improvements pursuant
to appropriate special assessment and assessment bond acts, with-
out further compliance with the provisions of Division 4 of the
Streets and Highways Code.
IT IS FURTHER FOUND, DETERXINED and ORDERED that said proceedings
for the acquisition and construction of said improvements shall be
had pursuant to the Municipal Improvement Act of 1913 and the bonQs
upon the unpaid assessments thereof shall be issued pursuant to
the Improvement Bond Act of 1915.
IT IS FURTHER FOUND, DETERMINED and ORDERED that the provisions
of Division q of the Streets and Highways Code be, and they are
hereby, dispensed with.
